INTRODUCTION This matter having come before the Examiner Committee on November 15, 1979, and the members of the Committee present being Eldon Thomas, Chairman, Jane Myers, and Ted McCoury and there being the following persons present who wish to request approval of a Zone Change; Robert Dellwo, representing applicants' Theron Hitchcock and James Leinweber, owners of property in the proposal for a Zone Reclassification, Agricultural/Transient Living to Commercial for the purpose of (no proposal at this time). B. FINDINGS OF FACT 1. That the existing land use in the area is residential, school, commercial, and undeveloped. 2. That the Comprehensive Plan designates this area as appropriate for commercial and residential development. 3. That the existing zoning of the property described in the application is Agricultural and Transient Living. 4. That the provisions of RCW 43.21C (The State Environmental Policy Act) have been complied with. 5. That the proper legal requirements for advertisement of the Agenda Item have been fulfilled. 6. That this proposal is not in conflict with the provisions of adopted regula- tion. 7. That the land in this area is suitable for the proposed use, or uses within the proposed Zone Classification. 1 'tile No. ZE-163-79 8. That the proposed use is compatible with existing uses in the area. 9. That the owners of adjacent lands expressed both approval and disapproval of the proposed use. 10. The Hearing Examiner Committee finds the proposed use to be in harmony with the general purpose and will not be otherwise detrimental to the public 1 health, safety, and welfare. C. ORDER The Hearing Examiner Committee, pursuant to the aforementioned, finds that the application of Theron Hitchcock, et al for a Zone Reclassification as described in the application should be approved. Special conditions or contingencies applied to motion: 1. All uses allowed in the Commercial zone will be permitted except massage parlors, beer parlors, and cocktail lounges as cited in Chapter 4.10, Section 4.10.030 (10) & (11) of the Spokane County Zoning Ordinance. 2. That the present residential uses on the properties or any other uses not allowable in the Commercial zone be discontinued at such time as a devel- opment plan is submitted and approved for any portion of the advertised property. a) COUNTY FIRE MARSHAL 1. The site is located in Fire District #1. 2. Mains and hydrants need to be installed in the above areas. Access plans for firefighting equipment around the byilding shall be approved prior to building permit issuance. 2 . • ":ile No. ZE-163-79 3. Adequate water for fire protection and distribution of water is required for the following zone changes. A water plan is required to be submitted prior to any development or use of subject lands. b) COUNTY ENGINEER 1. Applicant shall dedicate 15 feet on Sprague Avenue for right-of-way. 2. Applicant shall dedicate 10 feet on Tschirley Road for right-of-way. 3. Applicant shall dedicate a 20 foot radius on Tschirley Road and Sprague Avenue. 4. Applicant shall dedicate a 20 foot radius on Tschirley Road and Main Avenue. 5. Applicant shall dedicate a 20 foot radius on Flora and Sprague Avenue. 6. Applicant shall dedicate a 20 foot radius on Flora and Main Avenue. 7. Access permits shall be obtained from the Spokane County Engineer's Office prior to issuance of building permits. 8. Applicant shall construct cement concrete curb, sidewalk and pave to existing pavement on Flora Road, Main Avenue and Tschirley Road. 9. Appropriate on and off-site drainage and access plans shall be approved by the Spokane County Engineer's Office prior to the issuance of building permits for the project. 10. The design, location and arrangement of parking stalls shall be in 0 accordance with standard traffic engineering practices. That the provisions of SEPA's Notice of Action pursuant to 43.21C.080 RCW be initiated by the applicant within thirty (30) days of final action of the Responsible Administrative Body and be completed before any site improvements are made. 2. The zone reclassification has been found to be environmentally non- significant. Therefore, a final declaration of non-significance shall be signed by the Chairman of the Hearing Examiner Committee. 3. The specific development plan for this zone reclassification shall be subject to all of the provisions of SEPA, Chapter 43.21C RCW when submitted to the Hearing Examiner Committee. f) ZONING 1. The specific development plan will be submitted for Hearing Examiner Committee review and approval prior to issuance of building permits. g) That the Hearing Examiner Committee after hearing all testimony and a review of the staff analysis adopts the proposed declaration of non-signifi- cance and directs the chairman of the committee to sign the final declaration of non-significance.
