FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on October 22, 1979, and
the members of the Committee present being Ted McCoury, Acting Chairman,
Jane Myers, and Paul Sceva, Jr. and there being the following persons present
who wish to request approval of a Zone Change; Robert J. Bethards, Agent for
Applicant for a Zone Reclassification, Agricultural to Commercial for the purpose
of retail shops and services.
B. FINDINGS OF FACT
1. That the existing land use in the area is residential, mobile home park,
commercial and undeveloped.
2. That the Comprehensive Plan designates this area as appropriate for major
commercial development.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Jtem
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion.
7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.

9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Robert L. Picken for a Zone Reclassification as described in the
appl ication should be approved.
Special conditions or contingencies applied to motion:
a) COUNTY FIRE MARSHAL
1. The site is located in Fire District #1.
2. That mains and hydrants need to be installed. Access plans for fire
fighting equipment around the building shall be approved prior to
building permit issuance.
b) COUNTY ENGINEER
1. Access permits shall be obtained from the Spokane County Engineer's
Office prior to issuance of building permits.
2. Applicant shall construct cement concrete sidewalk on Sprague Avenue
3. An appropriate on-site drainage disposal system shall be approved by
the Spokane County Engineer's Office prior to the issuance of building
permits for the project.
c) WATER PURVEYOR
1. Purveyor is VERA WATER AND POWER and are able to supply the site
with adequate water for domestic fire and irrigation uses.
d) COUNTY HEALTH DISTRICT
1. No comments received.

That the provisions of SEPA's Notice of Action pursuant to 43. 21 C.080 RCW
be initiated by the appticant within thirty (30) days of final action of the
Responsible Administrative Body and be completed before any site improve-
ments are made.
The request has proven to be environmentally non-significant. Therefore,
a final declaration of non-significance shall be signed by the Chairman of
the Hearing Examiner Committee.
f) ZONING
1. A specific landscape plan, planting schedule and provisions for
maintenance acceptable to the Spokane County Zoning Administrator
shall be submitted with a performance bond for the project prior to
release of building permits.
2. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee.
Minor variations when approved by the Zoning Administrator will be
permitted, including, but not limited to the following changes:
Building location, landscape plans, and general allowable uses of the
permitted zone. All variations must conform to regulations set forth in
the Spokane County Zoning Ordinance. The original intent of the
development plans shall be maintained.
3. Direct light from any exterior area lighting fixture shall not extend
over the property boundary.
4. That the applicant meet the parking requirements of the Zoning
Ordinance and resubmit a site plan incorporating the proper parking
provision.

review of the staff analysis adopts the proposed declaration of non-signifi-
cance and directs the chairman of the committee to sign the final declaration

. The laws and regulations in our society are, at times, difficult to under-
stand and fully comprehend. This is tNe of ioning ordinances, which are
laws intended to protect and govern the many different uses of land in
Spokane County. It is my responsibility, as the Zoning Investigator, when
the situation arises, to help resolve conflicts involving the Spokane
County Zoning Ordinance.
It has come to the attention of this office that used cars and tools are
currently being sold on your property, located at East 14,920 Sprague Avenue,
Spokane County, parcel number 23541-0431. While this property is zoned
Commercial, the conditions of the rezone were specifically for construction
of a single story retail and service building. Ms. Marcia Raines, Zoning
Administrator,-has informed me that if anything besides construction of
this s:ngle story retowi' ard service bwilding ?s to take rlacA on ynur
property, then-you will have to apply'for a change of conditions through
the Spokane County Planning Department. A recent check with the Spokane
County Planning Department indicates that there has been no applications
made for a change of conditions. We are of the opinion that a period of 30 days, beginning with your receipt
of this letter, should be sufficient time for you to either contact Ms. Raines,
at 456-2274, concerning this change of conditions and to make application for
the same, or to bring your property into compliance with the conditions of
the rezone by removing the vehicles for sale. Do not hesitate to act upon
