and Boa.rdw►ay. The P3annfng Commissfoa recommended denlal; however,
the Board of County Commissianers reversed the decisian and gave their
approval to the zoning request on May 23rd,
ZN-150-77, proposed by Harlan Dougl.ass,, at the northwest corner of
Francis and Washinqtond This proposal was recommended for approval
by the Planning Commission, and the appeal hearf.ng upheld thf.s decisfon
and gave thefx approval ta the zoning request on May 23rd.
ZE-192-77, proposal on North Pines from Local Bus Lness to Cvmmerctal,
by Mc C Prapertfes. xhis zane change propasal was recommended for
denial by the Planning CbmmissLon, and a decision has not as yet heen
given by the Beard of County Commfssioners after their appeai hearing.

Mr. Sweltzer reported that the Staff requested a one month cantinuance
on showtng ResLdentfal affiee Zones whtch had been approved on Nar#h
Pines for information and eva.luation by the Cam,mfssian.

There had nat been a recent meeting of the Poltcy Committee .
1VIrs. Byrne suggested a discussion be held an the Policy Cammtttee
being ad hoc or a temporary commLttee and the determination made
whether it fs necessaty to have as a permanent corrlmittee an3 also define
the responsibili.ties of the committee.
Mro Kennedy asked that the Policy Commf,ttee be continued. i3e stated
that it shauld be checked whether or not the member of the Commfssion
has the capabiZity of vottng on an issue and rnrho 3etermines whether a
person has a conflict of Interest. He saf.d this should be decided by
Commlssion members.
Mro Thoinas moved, Mr. Kennedy seconded that it be pmposed that the
Folicy Committee be a permanent committee but not meet on a regular
ha s is but oniy at the dlrection of the C omrnl s s i.on .
Mro Emac14, Iegai couns8l, advfse3 that it would be necessaxy to
amend the By-Laws, advertise the amendment praposed, and take action
at the next regular hearing vf the Gommissi on. Mrv McCoury
suggested that this matter be postponed until the first meeting in May

ZW-26-78, Citiaen Request ot Change Zoning Map,
Mr o Terry M a ThoYnp son reque sted that the C ommis s ion p lac e h i s
proposed zone chanqe from Aqricultural to Restricted Industrial on
the agenda in May for property located in the area of Russell Road
lntersecting with Highway No e 2. The Site contains appraximately
50 acres aad it is planned to have an offlce - industrial park, Mr.
Thompson stated th+at 30 % of the required property owners' siqnatures
had been obtatned on the petitlon which had been circulation. Mr.
Sweitzer informaed the Coanmission that the West Suburban Compre-
hensive Plan desiqnates the area on the edqe of the subject property
as Restrfated Industrial zaninq a
Mr. Quigley moved, Mre Matn seconded, that Mr. Thompson's
request be placed on the Commisston's next agenda. Messrs.
McCoucy, Kennedy Qulgley, Thomas and Main voted "Aye" o Mrs a
Rawlings voted "No". Mrs, Byrne abstatned from votinq. Motion
carried.
Mrs. Byrne mov+ed, Mro Kennedy seconded, that a study or referral be
made by the appropriate committee or soine action be taken regarding
some of the requirements to see if they should not be changed - to
be studied and re-evaluated to see lf they are still filling the purpose that was

e) Ordinance Ameridments:
Vital Records Center as a Conditional gse in the Aqricultural Zone.
In order that the language be consistent, 40040170 (ii) and 4,24a550,
should be "Vital Records Center" instead of "Vital Statistics Center"
in the proposed amendments.

Mr. Quigley maved to approve the proposed amendrnent a1J.owing a
Vftal Records Center as a Conditional Use in the Agrfcultural Zone.
Mr. Thomas moved, Mrs. Byrne moved to amend the motion to
amend Paragraph 3-B to read a fifty foot (50) front yacd setback instead
of the 25 feet listed in the standards. Motion carried unanlmously.
Mrs o BYrne moved, Mr e Quigley seconded, to amend the Zoning
Ordlnance to allow a Vital Records Center as a Conditional Use Permit
in the Agricultural Zone, including the Declaratfon of Non-Significance
for the environiaental assessment by the Staff, with the change of
fifty (50) feet. Motion carried unanimously.
Proposed Deletion of Section 4.06 . 040 from the Zonina Ordinance
Reqardinct Uses Prohibited - BeautX Parlors in the Two-Familv Zona.
Mr. Sweitzer stated that the Staff has recefved three letters requestinq
deletion of this use as a home occupation. It is necessary to 3etermine
whether the beauty parlor is a prfmary use or a home occupationa
Mr. Quigley moved that the proposed amendment be denfed.
Mrs. Mary Mttchell, East 12819 Semro, spoke in opposftion to the
proposed amendment. She cfted the work done in 1963 through 1965
to obtain the status the way It exists. Mro and Mrs. Munyan have
made the request for the deletion.
Mike Senske reported that duplexes are being used for residentfal pur-
poses only and not for commercial uses. He stated that the State of
Washington is planning to drop all licensing features for beauty parlors
in the near future.
Mr. Quigley moved, Mr. Mal n seconded that the proposat to drop
the beauty parlor provls ion be denied.
Mcs o Rawlings moved, Mrs a Byrne seconded, that the motfon be
arnended that tha other residential zoned be reviewed for appropriateness
of horrle occupations. Motfon carried unanimously as amended,
Proposed Conditional Use withfn Residenttal Office Zone - Residential,
OffLce Accessorv Uses
Mr. Sweitzer explained that the primary use is office, and the proposed
amendment would consider allowing pharmacies, coffee shops,
cafeterias, and answering services as an accessary use through the
Condittonal Use Permit procedure within the Resfdential Office Zoneo
It would be anticipated that the accessory use would occupy no more
than 10 96 of f1oDr area in the Residential Office Zone a

Mr. Main asked questions regardfng the space devoted to thls use
and also the provision for signing. Mr. Quigley asked that this
proposed amendment be considered at a iater time and have the Staff
prepare altematives for review by the Commission. Mrs. Byrne
sugqested that a definition of accessory uses amendment be returned to
the Staff for futher clarlffcation and placed on a future agenda. Motion
carrted unanfinously.
3. ZE-5-78, TRANSIENT LIVING TO COMM£RC?AL: PEARSON, BOYD & LTTTLER
That the zone reclassiffcation request (File Number ZE-5-78) be approved,
and in so approvfnq, adopts the Staff's findinqs as the Planninq Commission's
Findings of Fact as well as the conditions stated in the Staff's Findlnqs, and
wLth the added coadition that the zone chanqe be developed in substantial
conformance wfth Plot Plan "D" dated April 13, 1978 and that the applfcation
fs to conform to the regulreraents of the Dlstrict Fire Chief, aad that a

PLANNING COPIMISSION
I. BACKGROUND•
Thirty-one property owners within the Kokomo Townsite Subdivision, signed a
~ petition that was submitted to the Planning Commission by a Mr. Terry E. Friis
on February 24, 1978, requesting that the south half of Block 41 and all of
Block 48 of Kokomo Townsite be considered for a single family residential zone
reclassification.
The Planning Commission in an unanimous vote, placed ZE-38-78 on the first
available hearing agenda, consistent with Section 4.21.030 of the Spokane
County Zoning Ordinance.
The Plat of Kokomo Townsite was approved for 56 Blocks, 24 Lots in each Block,
on April 10, 1908, with an average lot having fifty (50) feet of frontage
with 6,500 square feet of area.
II. SUWARY
This reauest is fc+r a zone reclassification to a more restrictive zone
classification for the primary purpose of restrictina all future land uses to
single family homes and to prohibit the construction of additional two-family
residential uses (duplexes).
III. GENERAL INFORMATION
A. Existing Land Use - Site
The South 1/2 of Block 41 and all of Block 48 have 36 lots total At
present, the County land use records indicate four (4) single family
residences and two (2) duplexes, located on the 36 lots in question,
with twenty-five (25) lots undeveloped.
to the north a mix of single family residences and two family resi-
dential uses (duplexes)
to the south primarily single family uses; scattered two-family
residential uses (duplexes) along 32nd Avenue
to the east single fmaily residential uses within Skyview Addition
to the west primarily single family residential uses
A majority of the residential uses within Kokomo Townsite Subdivision are
single family, but in recent years a number of two-family residences (duplexes)
have been constructed, creating a mixing of residential land uses within
certain areas of Kokomo.

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCJV,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals. The Act also requires

The construction of the aforementioned four duplexes involves the develop-
nent of the following described real property:

Said property is located in the East 11,000 block of 29tn Avenue, bounded

I~ is the concensus of we, the undersigred proD?rty cwners, that t•Ir. Thzron
W. Hitchcock is demonstrating serious disregard for the va1ue of our personal
property, by constructing-specuTative, 1ow quality duplexes on the prooerty
described hereinbefore. As individual property owners we have made.substantial
personal investments, of both time and money in our her:ies, and it is our colIec-
tive opinion that the construction of the four specu7ative duplexes will szrve
to reduce the market resal e-val ue. of our ir►zproved personal property; i t wi 11
increase the amount of traffic on 29th Avenue, wnich is presently not a through
street to Bowdish; it wili increase the subsequent noise levels within the
neighborhood, w-ith the advent of increased traffic concAntrations along 29th
Avenu2; it will increase the potential danger to our chiidren, who must use
t.-he streets to go to and from school eacn day, as the infIux of traffic wiIl
create a much higher risk, without the benefit of a tnrou5h street to Bowdish;
it wiil provide temporary housing for transrent tenants, who wiZ1 be encouraged
to move in-to the neighborhood, because it is a v2ry nice area, and these tenan~s
wi11 have no vested interest in our neign5orhood, other than to pay rent and
occupy marketed two-family housing.
The development of the four dupTexes rzpresents a sp°culative, low quality
. project, which is inconsistent with the protective covenants that were a
bound part of ali other construction developments alcng 29th avenue. Mr. Hitcn-
coclc specifically required each purchaser of property along 29th Avenue, fram
Universzty to Skipworth, to abide by specific protec'uive covenants, which were
an instrurl.-_,nt o-ic each purchase agreement. These prozective covenants perm►tted
constructi on of onl y s i ng1 e-fami 1y resi dences , wi th a mi n i Tus?~ sal es val u? of
$37,500.00, on a 1ot with minimum frontaga.
By inspection, the homes that have been constructed along 29tn Av?nue, betwzen
University and Bowdish, are of good quaiity, they have been well landscaped and
imp*oved, tney have been equally well maintained, and emulate tne pride that
the undersigned, have in our individual homes and oar neighborhood. This c-
cern for our nei ghborhood - i s wel ] founded, in as much as we have worked ve.-
hard to develop our individual homes and, in so doing, have insUred the
future:marke t-.resale va]ue of-our per.sonal property and built a good neighoor-

•1r: Hitchcock's four duplexes, conversely, are of speculative qua7ity, and represent a potential threat to our individual investments, as well as to the
yuality of our neighborhood. Nis intentTOns are to rent thesz duplexes, main- tain ower.ship and possibiy sell them in the future. They are representative
of low budget speculative construction, have no aesthetic integrity and will
be minimally improved and maintained, as they must be competive with the
rental'market existing in the Spokane Valley.
THUS, it the collective opinion of we, tne undersigned property owners, tnat
iir. Hitchcock be:required to build only single-family residences, of good
quality, on the proper-ty hereinbnfore described. It is our intent to reyister
our formal compl ai nt and oppos i ti on to Mr. Theron W. Hi tchcock' s dupl ex deve7 op-
ment, and to make this a matter of public record. We believe that if Mr. Hitcn-
cock were to construct custom single-family residences on the remaining prop2rty
at the east end of 29th Avenue, between S;cipworth and Bowdish, our personai
investments would not be jeopardized and the integrity of our nei5hborhood
would be naintained.
WE are herzby requesting that the Spokane Ceunty Commissioners be made cog-
nizant of this matter, and we ask that your appropriate response be submitted
to each of the undersigned property owners.
