request to rezone an approximate 43,274 square foot site from
Agricultural to I-2 for the purpose of Light Assembly, Office, and
Warehouse Use.
A request for a Change of Condition in an existing Restricted
Industrial Zone for the purpose of amending an original condition of
approval to allow partial removal of fencing and landscaping for site
expansion of an existing development.
Location:
The site is generally located east of and adjacent to University Road
and west of and adjacent to YanMarter Road, approximately 300 feet

While both the rezone and change of condition sites are within the Urban
category, they are adjoined on the west by an Industrial category.
Transitional pol icies for sites such as this, together with guidel ines for
light industrial uses in an Urban category, suggest various techniques to
accommodate transition of use and insure compatibility between different
land uses. Buffering techniques generally include landscaping, fencing,
spatial separation, and change in land use intensity.

Industrial zoning has been approved within the area since the
mid-1970s. The Restricted Industrial Zone immediately south of the
proposal, which is also within the Urban category, is the most recent
. rezoning and the only action in the area which has occurred since
adoption of the Comprehensive Plan. That approval calls for
development and landscaping comparable with that in the industrial
park immediately to the east (Montgomery Business Park).
Zones in the area are scheduled to crossover to the new Zoning Code

Proposed Buffering Techniques: Site plan proposes: 1) 35' of
landscaping, consisting of 5 of Type III and 30 of lawn, adjacent
to the west property line (University Road); 2) 20' of Type I and
1208' area adjacent ta the north property line; and 3) 5' of Type IY
adjacent to the south property line. Some landscaping is proposed in
the parking area.
Other Site Plan Considerations: The proposed rezone site is planned
to be a physical extension of the existing industrial development to
the east. A proposed driveway will connect the two facilities and
parking areas. To accomplish this, an existing sight-obscuring fence
along the east property line of the rezone site, as well as enough
landscaping to accommodate a 25-foot wide driveway, is proposed to be
eliminated. Since both the fence and landscaping were conditions of
the Restricted Industrial Zone, where the existing facility exists, a
change in that condition is proposed.

- The site plan submitted for review by the Zonzng Nearing
Examiner Cammittee is general in nature. Detailed review to
determine cvnpliance with all Ord7nanee regulations and

III. SITE DEVELOPMENT RECOMENDATIONS
Des n,: Apprava 1 of the ChaRge of Candi t ion, to remove the fence and some
landscaping, is approprtate with approval of the rezone. The resadential
use intended to be buffered by that conditlon will be eliminated with
redevelaprnent under the new rezone.
8uffering: The propased buffering along the west and nvrth property lines
meets the required landscape standards of the I-2 Zone.
Landscapinq: Some addittonal amount of landscaping may have to be
provided in the parking area of the rezone to rreet standards of
landscaping in parking lots.
~Si na e• The I-2 Zone contains specific sign standards which should be
aeque for this area.
Circulation/Access: The CQUnty Engineer requires additianal dedicatian
along University Road to create a right of way width of 39-feet easterly
of the centerline.

I1(. 5EPA ENVTRONMENTAL REVIEW
An Endironmentai Checklist was submitted by the spansor and was
reviewed by the County Planning Department. The review considered
the specifics of the ptoposat, other available information, County
ordinanc+es, other regulations and laws, possible standard Cvnditions
of Approval, the Generalized Corrprehensive Plan, and other County
policies and guidelines. The Zoning Administrator has determined
that "Nv geing robable significant adverse impacts" wauld result from the
proposal developed and has issued a Determinaation of
Non-Significance ("DNS").

IV. SEPA ENYIRONMENTAL REVIEW (continued)
The "DNS" was circulated to eight other agencies of jurisdiction and
other agencies/departments affected by the future development for
review and connnent. The "ONS" comnment perfod ends January 7, 1987,
and was advertised 15 caiendar days before said date in the
newspaper, by letter to adjacent property owners within 400 feet of
the proposal, and by notice on a sign posted on the proposal site.
The Hearing Examiner Conmittee may consider additional environmental
related testimony and the "DNS" at the publlc hearing.
V. PLANNING SUMMARY
The proposed rezone to I-2 is appropriate and should be approved for
the following reasons:
1. The Comprehensive Plan's Urban category supports light
industrial uses along arterials where impacts to adjacent
residential uses can be mitigated.
2. The parcel is a transition development occurring between
existing industrial uses or zones to the south, east, and west.
3. The site plan proposes aesthetics comparable to those existing
in the industrial park to the east and those required on the
site to the south.
4. The purpose and intent of the required fencing and landscaping
as a buf fer wi11 be no 1 onger va 1id wi th redeve 1 opment of the
rezone site from residential to light industrial use.
5. Modification of the condition will allow a logical physical
expansion of the existing facility onto the rezone site.
VI. CONDITIONS OF APPROVAL
(A11 Conditions imposed by the Zoning Heartng Examiner Committee shall be
binding on the "Applicant", which term shall include the owner or owners
of the property, heirs, assigns, and successors.)
a) COUNTY PLANNING DEPARTMENT
REGARDING THE REZONE (ZE-29-86):
1. All current standards of the Light Industrial (I-2) Zone, as
amended, shall be complied with in the development of this
site.

2. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County
Conanissioners Resolution #77-1392 be initiated hy the project
applicant within thirty (30) days of final disposition of this
application, and prior to any on-site improvements, or file
appropriate documents to the effect that the NOTICE OF ACTION is
waived in accordance with Spokane County Cortanissioners'
Resolution #82-0458 dated May 4, 1982.
REGARDING THE CHANGE OF CONDITIONS (ZE-41A-78)
1 That Condition #9 of the Board of County Cortmissioners'
Resolution #78-1038 (File ZE-41-78), as it relates to
applicant's Condition #7, dated May 31, 1978, be amended as
follows:
That fencing along the property line comon to the rezone site
described in File ZE-29-86 and Lot 4, Block 1 of Montgomery
Commercenter be eliminated. That a portion of landscaping,
along that same described line, be eliminated so as to
accommodate a driveway generally as shown on the site plan for
ZE-29-86 and ZE-41A-78.
REGARDING BOTH REQUESTS (ZE-29-86 AND ZE-41A-78)
. 1. The applicant shall develop subject property generally in
accordance within the concept presented to the Hearing Examiner
Cortanittee. Variations when approved by the Zoning Administrator
will be permitted, including, but not limited to the following
changes: 6uilding tocation, landscape plans, and general
allowable uses of the permitted zone. All variations must
conform to regulations set forth in the SPOKANE COUNTY ZONING
ORDINANCE. The original intent of the development plans shall
be maintained.
2. That the project is subject to Section 7.06, the Aquifer
Sensitive Area Overlay Zone of the ZONING CODE FOR SPOKANE
COUNTY, which sets forth various measures for Aquifer
protection; specifically, measures dealing with wastewater
disposal, spill protection measures, and stormwater runoff.
3. Any division of land for the purpose of sale, lease or transfer,
shall comply with RCW 58-17 and the Spokane County Platting
Ordinances prior to issuance of building permits.

b) COUNTY ENGINEERING DEPARTMENT
Prior To The Issuance Of A Bui lding Permit
1. Access permits for appraaches to the County Road System shall be
obtained from the Spokane County Engineer.
2. Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans.
.
3. The applicant shall submit for approval by the Spokane County
Engineer and the Spokane County Health District a detailed
combined on-site sewage system plan and surface water disposal
plan for the entire project or portion thereof, if development
is to be phased.
4. A parking plan and traffic circulation plan shall be submitted
and approved by the Spokane County Engineer. The design,
1 ocat ion, and arrangement of park i ng sta 11 s sha11 be in
accordance with standard traffic engineering practices. Paving
or surfacing as approved by the County Engineer, will be
required for any portion of the project which Ts to be occupied
or traveled by vehicles.
5. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
6. The construction of the road improvements stated herein shall be
accompltshed as approved by the Spokane County Engineer.
. 7. The County Engineer has designated Typical Roadway Section
Number One, Secondary Arterial standard for the improvement of
University Road which is ad3acent to the proposed development.
This wi11 require the addition of approximately 12 feet to
14 feet of asphalt, curb and sidewalk along the frontage of tho
development.
8. Roadway standards, typical roadway sections and drainage plan
requirements are found in Spokane 6oard of County Comnissioners'
Resolution No. 80-1592 as amended and are applicable to this
proposal.
9. The applicant should be advised that individual driveway access
permits are required prior to the issuance of a building permit.
10. No construction work is to be performed within the existing or
proposed public right of way until a permit has been issued by
the County Engineer. All work within the public road right of
way is subject to inspection and approva] by the County Engineer.

b) COUNTY ENGINEERING DEPARTMENT (continued)
11. All required construction within the existing or proposed public
right of way is to be completed prior to the release of a
building permit. A bond in the amount estima►ted by the County
Engineer to cover the cost of construction of lmprovements shall
be filed with the County Engineer.
12. Applicant shall convey to Spokane County a sufficient amount of
road right of way so as to provide 39-feet east of the
centerline of University Road.
c) COUNTY UTILITIES DEPARTMENT
1. Pursuant to 6oard of County Comissioners Resolution No.
80-0418, the use of on-site sewer disposal systems is hereby
authorized. This authorization is conditioned on compliance
with all rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific
application approval and issuance of permits by the Health
District.
2. The owner(s) or Successor(s) in interest agree to authorize the
County to place their name(s) on a petition for the formation of
a ULID by petition method pursuant to RCW 36.94 which the
petition includes the Owner(s) property and further not to
object by the signing of a protest petition against the
formation of a ULID by resolution method pursuant to RCW Chapter
36.94 which includes the Owner(s) property. PROYIDED, this
~ condition shall not prohibit the Owner(s) or Successor(s) from
objection to any assessment(s) on the property as a result of
improvements called for in con3unction with the formation of a
ULID by either petition or resolution method under RCW Chapter
36.94.
3. Any water service for this project shall be provided in
accordance with the Coordinated Water System P1an for Spokane
County, as amended.
4. Each new unit shall be double-plumbed for connection to future
areawide collection systems.
d) COUNTY HEALTH DISTRICT
1. A combined surface water and sewage disposal detailed plan shall
be approved by the Spokane County Engineer prior to the issuance
of any on-s i te sewage d i sposa 1 permit or bu i 1 ding permi t for
this project.
2. Sewage disposal method shall be as authorized by the Director of
Ut i 1 i t i es, Spoka ne County.

d) COUNTY HEALTN DISTRICT (cantinued)
3. Subject to specif7c application approval and issuance of permits
by the Health Officer, the use of individual on-site sewage
disposal systems nay be authorized.
4. Water service shall be courdinated through the Director of
Utilities, Spvkane County.
5. Water service shalY be ay an existing public water supply when
approved by the Regional Engineer {Spokane}, State Department of
Social and Health Serv3ces.
6. Use of private wells and water systems is prohiblted.
7. Disposal of sewage effluent beneath paved surfaces is currently
prohibited.
8. The project sha11 not produce more than 3,600 gallons of
generated wastes per day for vn-site sewage disposal.
e) COUNTY BUILDTNG AND SAFETY DEPARTMENT
1. The site 1s located in Fire District # 1.
2. This praject may involve the storage and handling of critical
materials. It is recommended that the applicant contact the
Department of Building and Safety for materials identif ieatlon
and containment requirements prior ta the issuanGe of any
. building permit.
3. The required fire flow for any building or praperty development
is determined by bullding size, type of construction, and
proximity of exposures. Required fire flows shall be based on
an evaluation of each bailding at the time of building pennit
applicatian. The specific location of hydrants shall be
determined by the fire district.
4. Any proposed conditions reiating to building locatian, design,
and occupancy sha11 be reviewed by Building and Safety for
compl iance with t'he uniforrn Bui lding and Fire Codes prior ta
finalization of action.
5. Fire hydrants shall be lacated so as to be accessibie to fire
apparatus and not be obstructed by any structure or vegetativn
ar have the visability impaired for a dlstance of fifty feet in
the direetion of vehicular approach ta the hydrant.
6. Trash enclasures shall not be located adjacent to combustible
constructfon or underneath windows or nonprvtected eaves.

e) COUNTY BUILOING AND SAFETY DEPARTMENT (continued)
7. Depending on the extent of existing water mains and hydrant
locations, fire hydrants which meet the minimum fire flow
requirements as enumerated in Chapter 6, Title 3 of the Spokane
County Code, may be required to be installed prior to any
construction.
8. Approved numbers or addresses shall be placed on a11 new and
existing buildings in such a position as to be plainly visible
and legible from the street or road fronting the property. Said
numbers shall contrast wtth their background.

County Code and that prior to the relocation or demolition, a
permit from the Department of Building and Safety is required.
f) WATER PURVEYOR
1. Water Purveyor is Irvin Water District, and they are able to
supply the site with adequate water for domestic, fire and
irrigation uses.
g) COUNTY AIR POLLUTION CONTROL AUTHORITY
A11 air pollution regulations must be met. This includes but is not
1 imited to the fol lowing:

1. Air pollution regulations require that dust emissions during
demolition, excavation and construction projects be controlled.
This may require use of water sprays, tarps, sprlnklers, or
suspension of activity during certain weather conditions. Haul
roads should be treated and emissions from the transfer of
earthen material must be controlled as well as emissions from
all other construction related activities.
2. Measures must be taken to avoid the deposition of dlrt and mud
from unpaved surfaces onto paved surfaces. If tracking or
spills occur on paved surfaces, measures must be taken
imrtediately to clean these surfaces.
3. All travelled surfaces (ingress, egress, parking areas, access
roads) must be paved and kept clean.
4. Some objectionable odors will iikely result during the
construction phase of the project and from motor vehicles using
the site following completion of the project and from occupants
of the proposed pro3ect.

This office would not oppose the rezoning of these parcels but would advise the
applicants that future controls on Sign Route 27 (Pinea Aoad) could restrict access
to right turn only movements along Sign Route 27. This off ice would also advise
applicants to consider all access onto Pines via existing county road sgstem
inasmuch as the multitude of present accesses have caused traffic operation
problems. If unable to comply with this restriction, all access Qato Pinee must
be applied for through the Department of Transportation.

An on site observation of the site on 6/11/78 revealed that the relatively
level topograpY~y in combination with the Garrison gravelly loam soils are suitable
conditions for the installation of sub-surface disposal Wastewater systEms. (Ref.
Bonucellis Business Park plot map - undated and received by S.C.H.D. on 5/30/78.)
According to the field investigation no known private wells are within
150 feet of subject development.
Prior to release of any waste water system permit it will be necessary for
the following items to be addressed:
1. Provide a statement from Public Water Purveyor on its ability to
provide domestic and Pire flow water volumes and that subject development is within
a recognized public water service area.
2. Applicant must specifically identify and design wastewater disposal
systems for the specific uses intended for the buildings. If more than one wastewater
system is needed for separate buildings and/or segregated properties, a separate
application and permit will be needed for each additional system.
3. Pursuant to current operating policy, any wastewater systems exceeding
1500 gallons daily flow for commercial or industrial developments shall first receive
the approval of Washington State Department of Social and Health Services and State
Department of Ecology.

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RC JV,
requires all state and local governmental agencies to consider environmental values
both for their own actions and when licensing private proposals. The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affecting the quality of the environment. The
purpose of this checklist is to help the agencies involved deterrhine whether or not a
proposal is such a ma jor action.

presently available to you. Please answer questions as "yes" or "maybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the dearee of impact, asking you for more informa-
