At the requirement of Steve Norobiowski, Spokane County Zoning
Administrator, we are requesting written permission to locate required
landscaping and 208 drainage improvements in public rights-of-way for the
above mentioned project. The project is located at the northwest corner
of Sprague Avenue and Adams Road.
We propose to utilize the 8 Foot strip of right-of-way along Sprague
Avenue, between the back of the sidewalk and the property line, for both
1 and sc~7pi ng ancl 208 drai nage swal es . Al so, we propose to ut-i 1 i ze the 4
foot strip of right-of-way along Adams Road, between the back of sidewalk
and the property line, for the same purposes as identified for Sprague.
Enclosed, please find a pre1iminary site plan showing the areas and
development 1ayout.
Mr. Horobiowski req_uests a letter signed bv yourself indicating the
following:
1. Giving approval to place the above described improvements in
public rights-of-way.
2. Providing information as to future improvements to Sprague and
Adams and if above described rights-of-way will, be utilized for

This office has received a report regarding your noncompliance ~"v-ith the nditions of
app~val for Zone Change ZE-77-78 on your property located~t~t Ada.ms Road,
Spokane County Parcel No. 14544-2034. Recent visual inspe~s~onindicate that this
report is accurate.
. ' This property is zoned Commercial. Section 4.22.040 of the Spokane County Zoning
Ord.inance states that "any person, fum or corporation who violates, disobeys, omits,
neglects or refuses to comply with. zone change conditions of approval imposed by the
Board of County Commissioners shall be guilty of a misdemeanor." The cunent used
car lot business which is run out of the existing dwelling unit does not conform to the plot
plan on file. Conditional of Approval No. 5 for ZE-77-78 (Board of County
Commissioners Resolution No. 78-1071) requires that i.urprovements shall be in substanrial
conform,ance with the plot plan. The plot plan on file shows a 6,120-square-foot retail
store and a 30-space parldng lot
It is the intent of this letter to advise you of an apparent zoning violation and to request
complia.nce. Accordingly, we are of the opinion that, since you have now been informed
_ _ of the requirements of the Spokane County Zoning Ordinance, a period of ten (10) days, ,
beginning with the date of this lettcr, should be sufficient time in which to bring your
property into compliance by applying for a change of conditions for ZE-77-78 with the

Dear Mr. I,ogsdon: " As requested in your letter of May 19, 1981, and discussed in our meeLing
of May 21, we have reviewed the possibility of allowing portions of County road
right-of-way, along Sprague Avenue and Adams Road, to be used for landscaping
and "208" drainage in conjunction with the private development on property at
the northwest,corner of Sprague Avenue and Adams Road. -
There are no plans to widen or change Sprague Avenue or Adams Road that
would necessitate the use of the public right-of-way behind the sidewalk area,
now or in the foreseeable future. Consequently, the County Engineer's office
would be willing to grant a permit for landscaping and "208" drainage within
. . these rights-of-way, as proposed in your plan. .
The other matter discussed at our meeting was the proposed vacation of
' portions of Riverside Avenue. We will support the proposed vacation, as
discussed, that is, 20 feet along the south side of Riverside Avenue, retaining
the 70-foot diameter cul-de-sac and a radius or cutoff at.Adams Road, condi- .
tioned upon the construction of concrete curb along the frontage of your
client.'s property and necessary utility relocations.

3. Applicant shall obtain approval for on and off- site drainage
plans and access permits before issuanae of building permits.

The applicant shall comply with rules and regulations of the Health
Dlstrict in providing for adequate sewage disposal. All necessary
Health District permits shall be obtained prior to building permft

Hydrants to be installed in accordance with the Spokane County
Fire Marshal's requirements.
d) Environmental Review:
The Staff recommends that a final Declaration of Non-Significance
be signed by the Board of County Commissioners.
III. CONDITIONS: -
If the Planning Commissfon approves this request, the following conditions
should be considered:

a) Compliance with all requests stated under Specffic Informatfon above.
b) Improvements shall be in substantial conformance with the plot plan
on file.
c) A landscape plan showing specific detail and accompanied by a
performance bond shall be approved by the County Zoning Administrator
prfor to building permit issuance.
d) That the provisions of SEPA's Notice of Action- pursuant to 43.21c.080
R.C.W . and the Board of County Commissioners Resolution #77-1392
be accomplished by the applicant within thirty (30)days of formal
action by the Board, as instructed by the Planning Department Staff.
e) That, if after one year from the date of the Planning Commission's
action, the applicant has not received final adoption of the zone
change, fihe applfcatfon is void.

This office would not oppose the rezoniiig of these parcels but would advise the
applicants that future controls on Sign Route 27 (Pines Road) could restrict access
to right turn only movements along Sign Route 27. This off ice would also advise
applicants to consider all access onto Pines via existing county road system
inasmuch as the multitude of present accesses have caused traffic operation
problems. If unable to comply with this restriction, all access onto Pines must
be applied for through Che Department of Transportation.
