Dear Mr Goldberg
The quesaon has been asked of the Spokane County Plannulg Department as to whether the
property which is zoned UR-22 (FiIe No ZE-50-78) has "received final adoption" of the
zone change The specif'ic condition is as follows
That, if after one year from the date of the P1annulg Comnussion's acnon, the
applicant has not received final adoption of the zone change, the applicauon is void
This condition was placed on the property at the time the Spokane County Planning
condition recommended approval of the proposal to the Board of County Commissioners
This condition means that if the Board of County Comnussioners did not formally act upon
4 the zone change vvithui a year, the proposal would be void. The Board of County
Comrrussioners did take formal action (Resolution 79-0476 see attached) on Apn19, 1979,
thereby executmg or glvuig "final adoption" of the zone change The answer to yowr
quesaon is yes, and the Plannulg Deparnnent has changed its zonuig map (see attached) to
reflect this acaon of the Board of County Commissioners
Pernuts can be issued for a one hundred twelve (112)-unit apartmant project once
compliance with conditions of approval (per attached Resoluuon) and the standards of the
Spokane County Zoning Code for the I7R-22 zone and other condsaons as may be requued
by reviewing agencies at the time of building permits have been met

The above-entitled matter coming on regularly for hearing before the Board of
County Commissioners of Spokane County, Washington, on this day, and it
appearing to the Board that the Spokane County Planning Commission has qiven
due notice of the hearing on the matter in the manner and for the time provided by
law; that said Planning Commisslon has held a public hearing as required; and
that the said Planning Commission concurs in the plan to zone the following
described pcoperty as•
MULTIPLE FAMILY SUBURBAN:
A portion of the SW 1/4 of the NE 1/4 of Section 9, Township 25 N., Range 44,
E.W.M., more particularly described as follows: Beqinning at intersection of
East line of County Road 1404 and South line of SW 1/4; thencs North along said
East line and East line extended north to north line of Spokane Valley Irriqation
Canal R/V1T; thence NWly along Canal R/W to ATorth line; thence West to NW corner;
thence South to SW comer; thencs East to POB, except platted portion. All in
Spokane County, Wa shington .
NOW e THEREFORE, BE IT RESOLVED, That the above-descrlbed property be, and the
same is zoned under the classification of MULTIPLE FAMILY SUBURBAN as defined
in the Zoning Ordinance of Spokane County, adopted Augus t 2 5, 1953 , as amended.
AND FURTHER BE IT RESOLVED That any development on the above-desccibed property
shall be subiect to the following conditions.
1) The County Engineer's Office has requested the followinq:
Note: All required improvements shall be built to meet or exceed minimum
County cons truction s tandard s.
a) Applicant shall construct curbs and 5' cement concrete sidewalks and
pave rights of way to me et existing pavement.
b) Applicant shall obtain approval for on and off~ite drainage plans and
access permits before issuance of building permits.
2) The applicant shall comply with cules and regulations of the Health District
in providing for adequate sewage disposal. Atl necessacy Health Distcict
permits shall be obtained prior to building permit issuance.
3) Mains and hydrants to be installed, in accordance with the Spokane County
Fire Marshal's requirements.
43 That a Final Declaration of Non-Significance be signed by the Board of County
Commi s s ioners .
5) Improvements shall be in substantiat conformance with the plot pl an on file.
6) A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by Che County Zoning Administrator prior to building
permit issuance.

7) That the provisions of SEPA's Notice of Action pursuant to 43.21c.080 R.C.W.
and the Board of County Commissioners' Resolution #77-1392 be accorripanied
by the applicant within thicty (30) days of formal action by the Board, as
instructed by the Planning Department staff.
Sy Interior driveways and parking areas shall be paved.
9) That, if after one year from the date of the Planning Commission's action, the
applicant has not received final adoption of the zone change, the application
is void.
11) The County Engineer's Office requires paving on Bowdish to 30' wide, curbing
and sidewalks; and also curbing and paving required to meet the existing
paving on Jackson.

Unpaved roadways have been determined to be the major reason
for not attaining air qual ity standards. We, therefore, request
that the special permit be denied until it can be demonstrated that
dust from Bowdish Road from Jackson north to Buckeye will be con-
trolled thro ugh pa rticipation in an LID or in a dust palliative
program Air pollution regulations require that dust control

Meeting and would comment on the following items.
ZE-141-77 & ZE-71-78
This office would not oppose the rezoning of these parcels but would advise the
applicants that future controls on Sign Route 27 (Pines xoa.d) could restxict access
to right turn only movements along Sign Route 27. This office would also adviee
applicants to consider all access onto Pines via euisting county road system
inasmuch as the multitude of present accesses have cauaed traffic operation
problems. If unable to comply with this restriction, all access onto Pines must
be applied for through the Department of Transportation.

off and disposal problems, solid waste collection, traffic flow patterns,

III. CONDITIONS
If the Planning Commission approves this request, the following conditions
should be considered: a) Compliance with al1 requests stated under Specific Information above.
b) Improvements shall be in substantial conformance with the plot plan on file.
c) A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.
d) That the provisions of SEPA's Notice of Action pursuant to 43.21c.080
R.C.W. and the Board of County Comnissioners Resolution #77-1392 be
accompanied by the applicant within thirty (30) days of formal action .
by the Board, as instructed by the Planning Department Staff.
e) Interior driveways and parking areas shall be paved.
f) That, if after one year from the date of the Planning Commission's
action, the applicant has not received final adoption of the zone
change, the application is void.
