FINDINGS AND ORDER
A. INTRODUCTION
This matter having come before the Examiner Committee on December 15, 1978,
and the members of the Committee present being Eldon Thomas, Chairman, Jane
Myer4s, and John Culler and there being the following persons present who wish
to request approval of a Zone Change/conditions on a previoulsy approved app-
lication; Bob Bethards and Roy Wyatt for a change in condition number 5 which
requires developing the site in substantial conformance with the approved site
plan for the purpose of amending the condition to allow the further development
of this parcel to include two more office buildings and several multiple family
suburban dwelling units.
B. FINDINGS OF FACT
1. That the existing land use in the area is generaliy residential, Inland
Empi re Zoological Society and Vacant Land.
2. That the Comprehensive Plan designates this area as appropritate for
residential development.
3. That the existing zoning of the property described in the application is
Agricultural.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper legal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion or i ntent of adopted pol icies .

7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.
8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed neither approval nor
disapproval of the proposed use.
. 10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfarp.
C. ORDER
The Hearing Examiner Committee, pursuant to the aforementioned, finds that the
application of Ronald McCloskey for a reconsideration of a condition on a
previously approved application as described in the application should be
approved.
Special conditions or contingencies applied to motion:
a. Compliance with all requests stated under Reviewing Agency Comments
above.
b. The applicant shall develop subject property generally in accordance within
the concept presented to the Hearing Examiner Committee. Minor variations
when approved by the Zoning Administrator will be permitted, including,
but not limited to the following changes: Building location, building
materials, landscape plans, and general allowable uses of the permitted
zone. All variations must conform to regulations set forth in the Spokane
County Zoning Ordinance. The original intent of the development plans

c. A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.
d. That the provisions of SEPA's PVotice of Action pursuant to 43.21c.080 RCW
and the Board of County Commissioner's Resolution #77-1392 be accomplished
by the appticant within thirty (30) days of formal action by the Hearing
Examiner Committee as instructed by the Planning Department staff.
e. I nterior driveways and parking areas shall be paved.
f. Direct light from any exterior area lighting fixture shall not extend over
the property boundary.
g. That, if after one year from the date of the Hearing Examiner Committee's
action, the applicant has not received final adoption of the zone change,
the application is void.
h. Sponsor shall be in conformance at all times with all regulatory agehcies.

II. REVIEWING AGENCY COMMENTS:

The County Engineer's Office has requested the following be considered if
the rezone is approved:
NOTE: All required improvements shall be built to meet or exceed
minimum County construction standards.

1. An appropriate on-site drainage disposal system shall be approved by
the Spokane County Engineer's Office prior to the release of
building permits for the project.
b. ~pokane County Health District:
The applicant shall comply with rules and regulations of the Health
District in providing for adequate sewage disposal. All necessary Health
District permits shall be obtained prior to building permit issuance.
Approval of sewage disposal facilities by the Spokane County Health
District.
c. County Fire Marshal's Office: Fire District #1
Installation of fire hydrants to be in accordance with the requirements
of the Spokane County Fire Marshall. ,
Access and circulation plans for emergency vehicles to be approved prior
to building permit issuance.
d. Water Purveyor: IRVIN WATER DISTRICT
We are able to supply this proposal with adequate water.
III. CONDITIONS
If the Planning Commission approves this request, the following conditions
should be considered:

Dear Steve:
Thank you for the meeting last week. It helped me to determine
the development options for our North Pines Road property.
In summary, I understand your tentative authorization to proceed
with our plans for a multi-family project with these tentative
verbal parameters:
1) Build to 2-1/2 stories
2) Build up to 24 units during the change of condition
request process.
The original conditions for approval of ZE 78-78 limited us with
24 units and two office buildings. In the near future we will
apply for a change of conditions to allow a higher density of
units and a deletion of the two office buildings.
We will engage an architect to prepare necessary site plans and
proceed to submit the required documents to the Spokane County
Planning Department.

cause to be paid, in full the claims of all persons performing labor upon or furnishing materials
to be used in such work, then this obligation sha11 be void; otherwise to remain in full force
and effect, sub,ject, however, to the following conditions:
FIRST: This bond sha11 inure to the benef it of any person performing labor upon or
furnishing materials to be used in such work to the extent, and only to the extent, that any such
person has perfected a valid lien therefore, in accordance with the terms and provisions of the
laws of the State of ftshington , PROVIDED HOWEVER, that no suit, action or proceeding to re-
cover on this bond by any such person who has perfected such a valid lien shall be sust ained un-
less the same be commenced within six months from the date on which such lien was filed.
SECOND: That if the Principal shall default in the performance of said contract, the
surety shall be given immed,iate notice thereof in writing by the Owner, and the Surety sha11 have
and be accorded by the Owner the right, at the Surety's option, to proceed or procure others to
proceed with the performance of such contract, and a11 reserves, deferred payments and other
maaeys provided by said contract to be paid to the Principal sha11 be paid to the Surety at the
$eme times and under the same conditions as by the terms of said contract such moneys would have
been paid to the Principal had the contract been performed by the Principal, and the Surety sha11
be entitled thereto in preference to any assignee of the Principal or any adverse claimant; but
iY the Owner shall complete or re-let said contract, all reserves, deferred payments or other
maneys remaining after payment for such completion sha11 be paid to the Surety or applied as it
may direct to the settlement of any obligations incurred hereunder.
THIRD: That the Surety sha11 not be liable for any guarantees of the efficiency or
vearing qusllties of any work done or materials furnished under said contract, or the maintenance
thereof, or for any repairs thereto or reconstruction thereof after completion, nor shall this
bond obligate the Surety to furnish any bond, policy or obligation other ths¢i this instrument.
FOURTH: That no suit, action or proceeding by the Owner to recover on this bond shall
' be sustained unless the same be comnenced within twelve months from completion of said structure
or vork of improvement.
FIFTH: The total amount of the Surety's liability under this bond to the Owner and to
laborers and materialmen shall in no event exceed the pena.lty hereof.

faithfully perform the work contracted to be performed under said contract, and shall pay or
cause to be paid, in full the claims of a11 persons performing labor upon or furnishing materials
to be used in such work, then this obligation sha11 be void; otherwise to remain in full force
and effect, subject, however, to the following conditions:
FIRST : This bond sha11 inure to the benef it of any person performing labor upon or
furnishing materials to be used in such work to the ex.tent, and only to the extent, that any such
person has perfected a valid lien therefore, in accordance with the terms and provisions of the
laws of the State of Washington , PROVIDED HOWEVER, that no suit, action or proceeding to re-
cover on this bond by any such person who has perfected such a valid lien shall be sustained un-
less the same be commenced within six months from the date on which such lien was filed.
SECOND: That if the Principal shall default in the performance of said contract, the
surety shall be given irmnediate notice thereof in writing by the Owner, and the Surety sha11 have
and be accorded by the Owner the right, at the Surety's option, to proceed or procure others to
proceed with the performance of such contract, and all reserves, deferred payments and other
moneya provided by said contract to be paid to the Principal sha11 be paid to the Surety at the
$sme times and under the same conditions as by the terms of said contract such moneys would have
been paid to the Principal had the contract been performed by the Principal, and the Surety sha11
be entitled thereto in preference to any assignee of the Principal or any adverse claimant; but
1f the Owner shall complete or re-let said contract, all reserves, deferred payments or other
maneye remaining after payment for such completion shall be paid to the Surety or applied as it
mey direct to the settlement of any obligations incurred hereunder.
THIRD: That the Surety sha11 not be liable for any guaxantees of the efficiency or
wearing qualities of any work done or materi als furnished under said contract, or the maintenance
thereof, or for any repairs thereto or reconstruction thereof after completion, nor shall this
bond obligate the Surety to furnish any bond, policy or obligation other theari this instrument.
FOURTH: That no suit, action or prnceeding by the Owner to recover on this bond shall
be sustained unless the same be commenced within twelve months from completion of said structure
or vork of improvement.
FIFTH: The total amount of the Surety's liability under this bond to the Owner and to
laborers and materialmen shall in no event exceed the penalty hereof.
