Map: Greenacres, U.S.G.S., 1973, and Spokane N.E., U.S.G.S., 1973. 2. Findings: a. This project lies over the Spokane-Rathdrum Aquifer. b. The project is within Critical Water Supply Service Area #3 and within the service area of Irwin Water District A. Water supply will be a public system. c. The project is inside the Spokane County Comprehensive Wastewater Management Area, inside the General Sewer Service Area, and inside the Priority Sewer Service Area recommended in the '201' Study. The method of sewage disposal is subject to approval of the Director of Utilities, Spokane County, pursuant to County Resolution 80.0418 adopted March 24, 1980. The topography and soils in the area are generally suitable for use of individual on-site sewage disposal systems. The lot is not of the proper dimensions to permit the use of both an individual well and sewage system. d. The project lies in a relatively steep sloping area east of Pines Road and north of Mansfield Avenue. Surface soils are classed by the U.S. Soil Conservation Service as Spokane very rocky cornplex and Garrison very stony loam with 0% to 30% slopes. They have a septic tank filter field limitation of slight to severe with the majority classed as moderate. There is also possible contamination of groundwater. This soil would be classified as a Type IV. f. Geologically, the soils are glaciofluvial deposits. These geological structures generally yield moderate to very large amounts of water. Data f rom wel 1 s i n the area referenced i n secti on 1 g shows they are from 59' to 170' deep and have static water levels varying from 40' to 140' below the surface. The Irwin Water District #6 has indicated that it can supply domestic use water for the project upon completion of agreements with the proponent. 3. Required (mandatory) Conditions If Approved: . Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. ~ Water service shall be coordinated through the Director of Utilities, Spokane County. c~ Water service shall be by an existing public water supply when ~ approved by the Regional Engineer (Spokane), State Department of ~ Nealth. ~ A public sewer system will be made available for the project and o~ individual service will be provided prior to sale. I. GENERAL INFORMATION Applicant: Ron McCloskey W. 321 Spofford Avenue Spokane, WA 99205 (509) 328-2832 Contact Planner: Steve Davenport Location: Generally located east of and adjacent to Pines Road, approximately 250 feet north of Cherry Street in the NW 1/4 of Section 10, Township 25 North, Range 44 EWM, Spokane County, Washington. Proposal: Change of Conditions to an existing Urban Residential-22 (UR-22) zone to allow 48 multi-family dwellings. The previous zone approval allowed 24 multi-family dwellings and two office buildings. II. SITE INFORMATION A. Site Size: Approximately 2 acres B. Comprehensive Plan: The property is located within the Urban category of the Comprehensive Plan and within the Priority Sewer Service Area (PSSA). The Urban category is intended to provide the opportunity for development of a "city-like" environment which includes various land uses and intensive residential development. Urban areas will have public water systems, sanitary sewer systems, storm sewer systems and other public services available. This category promotes "fill-in" within established development areas where utilities, arterials, schools and community facilities are existing. C. Site Characteristics: The site is undeveloped with narive trees and grasses and has moderate to steep slopes. D. Neighborhood Characteristics: The neighborhood contains a variety of housing types ranging from single family residences to apardments. The neighborhood boundaries can be generally defined as Trent Avenue to the north, Bowdish Road to the west, Montgomery Drive to the south, and the Pines Road corridor to the east Trent school is 1/2 mile north of the proposal. 8/93 HEC Staff Report for ZE-78A-78 Page 20 E. Zoning Analysis: ' Proposal: Urban Residential-22 (UR-22) (ZE-78-78C), established in 1991, previously classified as Residential Office (RO) (ZE-78-78C) . North Urban Residentia122 (UR-22) (ZE-96-84-C) established in 1991, previously classified as Multi-family Suburban (WS) (ZE-96- 84C). South: Urban Residential-22 (ZE-32-69) established in 1991, previously classified as Residential Office (RO) (ZE-32-69). East: Urban Residentia122 (UR-22) (ZE-96-84-C) established in 1991, previously classified as Multi-family Suburban (MFS) (ZE-96- 84C). West: Urban Residential-22 (LJR-22) (ZE-23-68) established in 1991, previously classified as Mulri-Family Suburban (MFS) (ZE-23- 68). The site was originally conditioned to allow 24 multi-family dwelling units and two office buildings (ZE-78-78C). The Change of Cond.irions proposes to eliminate the two office buildings and to increase the number of multi-family dwelling units from 24 to 48. Urban Residential-22 (UR-22) zoning is the predominate zone category along the Pines corridor Be*ween Mansfield Avenue and Euclid Avenue. With approval of this Change of Conditions, there will be 494 undeveloped nlulti-faxnily dwelling units that have been conditionally approved along the east side of this section of Pines Road. Summarv: The Change of Conditions to allow increased residential density is consistent with the purpose and intent of the Urban Residential-22 (UR-22) zone category which defines the characterisrics of the Urban Residential-22 (tJR-22) zone to include "...paved roads, public sewer and water, accessibility to schools and libraries, and a full line of public services including manned fire protection and public transit accessibiliry." F . Land Use Analysis: Site: Vacant and undeveloped. North: Vacant and undeveloped. South: Small office building and vacant property. East: Vacant and undevelopeti. West: Apartment complex. ' 8/93 HEC Staff Report for ZE-78A-78 Page 21 ~ , ~Umm r~. . , The area north of Interstate 90 near Pines Road has experienced recent growth of high density residential development as well as a mix of business and industrial development near the freeway. Mulri-family developments exist to the west of Pines Road and a large developed mobile home park is approlcimately 1/4 southwest of the site. The lack of adequate soil for drainfields has limited development on the east side of Pines Road, however, recent proposals for sewer extension makes development of this area more viable. G. Circulation: Aceess to the proposal is provided by Pines Road which is a Sta.te Highway with four lanes and sidewalks. Pines Road connects to Interstate 90 approximately 1/2 mile south of the site and to Trent Road approximately 1/2 mile to the north. Internal circulation for the development will be provided by private driveways. H . Design: Proposed Site Plan: Use: 48 unit apartment complex. Proposed Buildings: Four apartment buildings containing 12 dwelling units each. Building Coverage: 20% Maximum Structure Height: 38' proposed, 50' maximum Building Setbacks: Pronosed Reauired Front yard: Pines Road 90' 55725' Side Yard 10' to 75'(varies) 5' per story Rear Yard 15' 15' Parking 96 72 Proposed Buffering/Landscaping Techniques: The proposed landscaping meets the requirements of the Zoning Code with a 20 foot wide strip of Type III landscaping adjacent to Pines Road and a 5 foot wide strip of Type III adjacent to all side property lines. Additional planting areas are provided in the parking area to meet the landscape requirements for parking. Other Site Plan Considerations: The site plan submitted for review by the Hearing Examiner Comnuttee is general in nature. Detailed review to determine compliance with all Zoning Code regulations and conditions of approval is recommended to be administrative and to occur at the Building Permit stage. Summarv: The site pian submitted for review by the Hearing Examiner Committee generally conforms to the development standards of the Urban Residentia.t-22 (UR-22) zone. 8/93 HEC Staff Report for ZE-78A-78 Page 22 I. Density: The proposal requests a density of 23.4 units per acre. The Urban Residential-22 (UR-22) zone allows 22 units per acre which may be increased through bonus densities as allowed under Chapter 14.820 of the Zoning Code. Under these provisions, the applicant has requested bonus densities for connecrion to public sewer (3.5 units/acre), availability of transit (0.5 units/acre), and access to an arterial (0.5 acres/unit), for a maximum density allowable density of 26.5 units per acre. Summan~i The site is presently approved for a density of 12.5 units per acre. The Change of Conditions proposes to increase this density to 23.4 units per acre which is somewhat less than the maximum allowable density for the site of 26.5 units per acre. J. Power Transmission Lines/Other Known Easements: None identified. K. Water Supply: The proposal is within the Irvin Water District #6 service area. Appropriate provisions for connection to a public water system will be required prior to the issuance of building permits. L. Sewage Disposal: Connecrion to a public sewer system is required. M. School: The proposal is in the East Valley School District. N. Fire Protection: The proposal is within Fire District No. 1. The Fire District and the Division of Buildings Department (Fire Marshall) are required to approve fire protection provisions prior to issuance of bullding permits. Q. Cultural Resources: None identified. R: Transit: The proposal is located within the Public Transit Benefit Area (PTBA) and public transit is available on Pines Road. A park and ride faciliry is located at the intersection of Pines Road and Interstate 90. S: Parks: The Spokane County Parks and Recreation Plan identifies Mission Park as the nearest park facility. Mission Park is designated as a community park and is located approxunately one mile from the site. The park offers a developed playground and a swimming pool. III. ENVIRONMENTAL REVIEW: An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regularions and laws, possible standard Cond.irions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Planning Departrnent has determined that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Determinahon of Nonsignificance ("DNS 8/93 HEC Staff Report for ZE-78A-78 Page 23 t " ♦ . The "DNS" was circulated to 14 other agencies of jurisd.iction and other agencies/departments affected by the future development for review and comment. The "DNS" comment period ends August 17, 1993 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional environmental related tesrimony at the public hearing. IV. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION The Change of Conditions is consistent with the development standards of the Urban Residential-22 (UR-22) zone and the goals, objectives, and decision guidelines of the Urban category of the Comprehensive Plan. Land uses in the vicinity are compatible with the proposal, and the proximity to Pines Road and Interstate 90 support the deveiopment of multi-family prajects. Public services and utilities are available to the site, inciuding water, sewer, and public transit. The Planning Departrnent recommends approval as conditioned. V . CONDITZONS OF APPROVAL i. All conditions imposed by the Hearing Examiner Committee shall be binding on the "Applicant", which terms shall include the owner or owners of the property, heirs, assigns and successors. ii. The zone reclassification applies to the following real property: The South 290 feet of the West 450 feet of the South 30 rods of the North 43-1/3 rods of the Southwest Quarter of the Northwest Quarter of Section 10, Township ZS North, Range 44 E.W.M., situate in the Spokane County, Washington, EXCEPT the West 230 feet of the South 194 feet thereof; AND EXCEPT Pines road and EXCEPT any portion thereof lying within the South 36-2/3 rods of the West 60 rods of said Southwest Quarter of the Northwest Quarter reserving however to the grantors, their heirs and assigns the right to ingress and egress over and across the property described herein for the purpose of getting access to adjoining property. The proposal shall comply with the Urban Residential-22 (tTR-22) zone and the Aquifer Sensitive Area (ASA) Overlay zone as amended. 2. The applicant shall develop subject property generally in accordance within the concept presented to the Hearing Body. Variarions, when approved by the Planning Director/designee, may be permitted, includ.ing, but not limited to building location, landscape plans and general allowable uses of the permitted zone. All variations must conform to regularions set forth in the Spokane County Zoning Code, and the original intent of the development plans shall be maintained. 3._ Approval is required by the Planning Director/designee of a specific lighting and signing plan for the described property prior to the release of any building permits. 4. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 5. The Planning Department shall prepare and record with the Spokane County Auditor a Title Notice noti.ng that the property in question is subject to a variety of special conditions imposed as a result of approval of a land use action. This Title Notice shall serve as public notice of the conditions of approval affecting the property in question. The Title Notice should be recorded within the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Planning Deparanent. Access permits and irnprovements to Pines Road must be approved by the Washington State Department of Transportation (WSDO'1). 2. T'he applicant shall submit for approval by the Spokane County Engineer road, drainage and access plans. 3. The applicant shall submit for approval by the Spokane County Engineer and the Spokane County Health District a detai.led combined on-site sewage system plan and surface water disposal plan for the entire project, or portion thereof, if the development is to be phased. 4. A parking plan and traffic circulation plan shall be submitted and approved by the Spokane County Engineer. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Applicant shall construct a paved and delineated approach to meet the existing pavement on Pines Road. 7. Roadway standards, typical roadway secrions and drainage plan requirements aze found in Spokane Board of County Commissioners Resolution No. 80-1592 as amended and are applicable to this proposal. SPOKANE COUNTY UTILITIES DEPARTMENT 1. [The dedication shall state: ] "The owner(s) or successor(s) in interest agree to authorize the County to place theu name(s) on a petition for the formation of UL1D by petition method pursuant to RCW 36.94, which petition includes the owner(s)' property; and further not to object by the signing of a protest peririon against the formation of a ULID by resolution method pursuant to RCW Chapter 36.94 which includes the owner(s)' property. PROVIDED, this condition shall not prohibit the owner(s) or successor(s) from objecring to any assessment(s) on the property as a result of improvements called for in conjunction with the formation of a ULID by either petition or resolution method under RCW Chapter 36.94." 2. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 3. Applicant shall make connection to public sewer system. Sewer connection pernut is required. Plans and specifications are to be reviewed and approved by the Utilities Department. SPOKANE COUNTY HEALTH DISTRICT 1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. 2. Water service shall be coordinated through the Director of Utilities, Spokane County. 3. Review of vehicle access and water supply prior to construction. WA STATE DEPARTMENT OF TRANSPORTATION 1. Access to Pines Road (SR-27) requires that the applicant obtain the needed WSDOT commercial road approach pernut(s) for the intended property use. The applicant should also be aware that current standards call for road approaches in this area to be separated by at least 125 feet from any adjacent road approaches.
