P ~ ~ t- • NO. 78 13~` BQARD CaF COUNTY COMMISSIONERS OF SPOKANE COUNTY WASHINGTON FIND 1NGS AND ORDER REGARDING ZONING MAP PROPOSAL, 2E-105--78 , AGRICULTURAL SUBURBAN TO MULTIPLE FAMILY SUBURBAN AND RESTRICTED INDUSTRIAL: HAASE CONSTRUCTION, INC, WHEREAS, The Spokane County Planning Commfssion did, after public hearing on August 18, 1978, forward to the Board of County Commissioners a recommendation that the Zoning Map not be changed from the existing Agricultural Suburban classification (by a vote two to two, as the motion for approval lacked a quorum vote of the Commission) on property described as fol lows: The North 1/2 of Lots 12 and 13, Fnlitland Addition, except the North 135 feet of the West 213 feet of Lot 13 in Section 8, Township 25 N., Range 44, E. W, M,, Spokane County, Washington, a nd , WHEREAS, The applicant before the Planning Commission, Haase Construction, Inc. , did subsequently request a hearing before the Board of County Commissioners to present evidence and testimony in favor of this application, and, WHEREAS, The Board did hold a public hearing on September 18, 1978, to consider the recommendatfon of the Planning Commission and testimony and evidence of the applicant and other interested parties, and, WHEREAS, AC said hearing opportunity was afforded those favoring and those opposing the above-described zone reclassificatfon, and the Board of County Commissioners fully considered the testimony given, the records, and mfnutes of the Planning Commission and all evidence presented, and having individually acquainted themselves with the site and vicinity in question, does hereby find: 1) The Board has concluded that the entire property be zoned Restricted Industrial, including that portion for which the Multiple Family Suburban Zone was requested. 2) That the Board of County Commissioners upholds the conditions of the Spokane County Planning Commission contained in the Staff's findings as well as the conditions contained in the Planning Commission's minutes of August 18, 1978, to be sufficient and controlling. To help you recall tYie matter this was a zone change application which originally requested part ot the subject property be rezoned restricted industrial and part multi-family. After the original zone change application was made, the staff prepared condifiions for aPproval which included sidewalks around the multi-family portion of the application. It is this particular condition I arn addressing. Upon final approval of tYie zone change at the appeal stage, the County Commissioners rezoned the entire parceJ. restricted industra.al without the existence of a new site plan. ConsEquently, the conditions for road i.mprovement were izever changed to ~ account for the change in use that occurred. I am preparing to hire an eng,ineer to draft the road engineering plan at this time. I am requesting that your ofiice give written approval to develop the roads per the conditions stated in the C:irnmissioners Resolution (attached) with the exception of the condition requiring sidewalks around that portion of the site which was 'originally proposed for multi-family use in view of the fact that the use was changed to restricted industrial. During a conversation you and I had on January 24, 1980, you indicated the siciewalk requirements would be waived on Buclceye but you were unsure at the time about the necessity for sidecaalk on University. I agree that in the future a sidewalk may be desirable on University. HowEVer, I don't feEl that an island of sidewalk today leading nowhere would lzave any value. Is there a way I can eliminate that require- ment for the prese:it but agree to install the sidewa]_k when more activity develops in the neighborhood and the sidewalk can then be tied into that development. Zone Reclassification, ZE-137-76 - Aqriculturai 5uburbsn to Restricted Industrial: Johnston, was recommended for apprmval by the Spokane County Planninq Commis sion on July 22. 1977, This proposai is located approximately 242 feet west of Universfty and runs north from Montgomery to the property involved in ZE-I05-78. The site size is 27, 000 square feet, has ninety feet of frontage on Montgomecy and was praposed to contain warehouses and afffces. Therefore, tVTr.
