property at 15915 E. Sprague. I have been informeci this will
not be placed on the May agenda, which I can live with. We
are, however, fearful it might not make the June agenda, in
which case it could cause considerable loss to me due to an
agreement made ta develop the praperty which exptfes at the
end of June. I would like to ask that you do anythiny you
can to help me get this matter acted on in June.
I might add that in my c ontacts with the adjoining property
owners, the comment was made, almost without exception, that
it is asinine to have to take each piece of property on Sprague
avenee separately to the zone commission. Almost everyone
feels that it should be automatic to zone Sprague Avenue at
least C ommercial.

NOW, THEREFORE) THE CONDITION OF THIS OBLIGATION IS SUCH, That if the Principal shall
fsithfully perform the wark contracted to be performed under said contract, and shall pay or
cause to be paid, in full the claims of all persons performing labor upon or furnishing materials
to be used in such work, then this obligation shall be void; otherwise to remain in full force
and effect) sub,ject, however, to the following conditions• ~
I FIRST: This bond shall inure to the benefit of any person performi.ng labor upon or
furnishing materials to be used in such work to the extent, and only to the extent, that any such
~ person has perfected a valid lien therefore, in accordance with the terms and provisions of the
laws of the State of VJashington , PROVII7ED HOWEVER, that no suit, action or proceeding to re-
eover on this bond by any such person who has perfected such a valid lien shall be sustained un-
leea the 8ame be com¢nenced within six months from the date on which such lien was filed.
SECOND. That if the Principal shall default in the performance of said contract, the
eurety shall be given immediate notice thereof in writing by the Owner, and the Surety shall have
-aud be e,ecorded by the Owner the right, at the Surety's option, to proceed or procure others to
px*ceed with the performance of such contract, and all reserves, deferred payments and other
ameye provided by said contract to be paid to the Principal shall be paid to the Surety at the
+am timee and under the same conditions as by the terms of said contract such moneys would have
beia paid to the Principal had the contract been performed by the Principal, and the Surety shall
be entitled thereto in preference to any assignee of the Principal or any adverse claimant, but
it the Owner shall complete or re-let said contract, all reserves, deferred payments or other
aoneys remaining after payment for such completion shall be paid to the Surety or applied as it
aW direct to the settlement of any obligations incurred hereunder.
THIRD: That the Surety shall not be liable for any guarantees of the efficiency or
wearing qualities of any work done or materials furnished under said contract, or the maintenance
thereof, or for any repairs thereto or reconstruction thereof after completion, nor shall this
bond obligate the Surety to furnish any bond, policy or obligation other than this instrument.
FOURTH: That no suit, action or proceeding by the Owner to recover on this bond shall
be eustained unless the same be commenced within twelve months from completion of said structure
or vork of improvement.
FIF'TH: The total amount of the Surety's liability under this bond to the Owner and to
laborers e,nd ma,terielmen shall in no event exceed the penalty hereof.

Subject Intent of Zoning Resolution Authorizing Change in Zoning Map.
The legal description used in Zoning Resolutidn #78-913, signed by the
Board of County Commissioners on July 6, 1978, was inadvertently typed
in part as being Tract 131, Vera, whereas the correct location was
Tract 31, Vera. This then places all property in the same location -
north side of Sprague Avenue, approximately 700 feet east of Sullivan Road.
Therefore, we believe the intent of the zoning proposal is for the above
location, and the map should reflect same. (Tract 31, Uera)
