Purpose:

I. FINDINGS OF FACT
a) Land Use:

The Plan Map has designated this area as appropriate for residence
development.
II. SPECIFIC INFORMATION:
a) County Engi neer' s Offi ce
The County Engineer's Office has requested the following be considered,
if the rezone is approved:
N o t e: All required improvements shbll be built to meet or exceed
minimum County construction standards.
1. Applicant shall dedicate the West 10' of the advertised property
for right of way and slope easements as necessary.
2. Applicant shall construct 5' cement concrete sidewalk curbs and
pave right of ways to meet existing pavement.
3. Applicant shall obtain approval for on and off-site drainage
plans and access permits before issuance of building permits.
b) Spokane County Health District:
The applicant shall comply with rules and regulations of the Health
District in providing for adequate sewage disposal. All necessary
Health District permits shall be obtained prior to building permit
issuance.
c) Spokane County Fire Protection:
Mains and hydrants to be installed in accordance with the Spokane
County Fire Marshal's requirements.

d) Environmental Review:
The staff recomends that a Fi na] flecl arati on of Non-Si gni fi cance
be signed by the Board of County Corrunissioners.
III. CONDITIONS:
If the Planning Commission approves this request, the following conditions
should be considered:
a) Compliance with a]1 requests stated under Specific Information above.
b) Improvements shall be in substantial conformance witM the plot plan
on file.
c) A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.
d) That the provisions of SEPA's Notice of Action pursuant to 43.21c.080
R.C.W. and the Board of County Commissioners resolution #77-1392 be
accomplished by the applicant within thirty (30) days of formal action
by the Board, as instructed by the Planning Department Staff.
- e) Interior driveways and parking areas shall be paved.
f) That, if after one year from the date of the Planning Commission's
action, the applicant has not received final adoption of the zone
change, the application is void.

ZONE RECLASSIFICATION PR4CEDURE

STEP 1. PRE-APPLICATION CONFERENCE
Obtain an appointment with the Zoning Admuiistrator or his designee to
discuss the proposed zone reclasslfication. You will be advised of the
zone classification appropriate to the use of the property contemplated
and of the Planning Commission's past actions which might affect action
on your proposal. If after this discussion you desire to proceed with the
application, you will need to follow the additional steps listed below.
STEP 2. PRE-APPLICATION AND STAFF PREPARATION OF REQUIRED FORMS

Fill out a Zone Change Pre App].ication Form, which requires an accurate
lectal description of the property proposed for rezoning along with the name,
address, and telephone number of the person responsible for the request to
the Spokane County Planning Commission office. In addition, the applicant
shall submit one (I) up-to-date print of the Engineer's section maps and
Assessor's section maps coveruig the area within the application and all
property within 400 feet of the boundaries of it. Draw the subiect property
boundary in red and give current parcel numbers of each ownership. The
pr(bperty outlined in red must coincide with the legal description.
The necessary application forms will be prepared by the staff within ten
days utilizing the information requested. A$10.00 fee will be charged for
preparation of the forms. These forms are as follows:
a) Zone Change Application
b) Environmental Checklist -
c) Petition Form s
d) Title Company Forms
e) Title Company Location Map
f) Title Company Memo
g) Zoning Worksheet
STEP 3. TITLE COMPANY OWNER SEARCH
Take the title company forms (d), title company location map (e) and
title company memo (f) to any Iocal title company you may select for a
title search of pr operty owners and taxpayers within four hundred (400)
feet of the periphery of the proposed zone change parcel, and as well as
Iegal owner or owners of the site.
STEP 4. PETITION FOR REQUIRED SIGNATURES
After the TitlLm Company returns the ownership forms and map, transfer the
t2tle information to the petition forms and secure signatures of either the
owner or purchaser of the property. In cases where the owner lives out
of town, a signed Ietter in support of the petition is acceptable. In other
cases where property has been purchased through an unrecorded contract,
then a copy of th e contract (or bill of sale) or a statement by the owner of
record must be submitted along with the property purchaser's name on the
petition.

3. Luncheon Meetinu
Eldon Thomas, Chairman of the Policy Committee, set the date of july 25th
at 2:00 P.M. in the Planning Office, North 811 Jefferson, to discuss the
zone change proposed amendments. Other items discussqd were: 1) seating
order of the Planning Commfssion; 2) Additional microphones; and 3) County
Park system.

That the zone reclassffication request (File Number ZE-31-78) be continued to
a special hearing scheduled for August 16, 1978. Because a final Environ-
mental Impact Statement has not yet been submitted, the Commission could not
take action on the zone change proposals; however, they elected to hear the
applicant's presentation.
Mr. Thomas moved, Mrs. Byrne seconded, to adopt the Resolution proposed
by Mr. Kennedy as follows: "WHEREAS, The testimony indicated little public
opposition, and, WHEREAS, the applicant has indicated willingness to work
with interested public agencfes and future testimony m3y justify reconsi.dera-
tion; BE IT RESOLVED THfkT The Planning Commfssion indicated its favorable
interest in these zone changes and the concept of a larger development".
Motion carried unanimously.
M:-. Litt explained that the next heari.ng would present testimony on trafffc
by the County Engineer's and an air pollution report.

Mr. Angove explained that there w4re two areas of main concern:
the Lower Little Spokane River area and improving the demand
curve on community parks for maintenance costs.
Mr. McCoury stated he would like to pl ace more emphasis on
neighborhood parks. Mr. Angove replied that the Snool Districts
have developed extensive playgrounds, and this is used instead
of neighborhood parks.
Ms. Quigley moved, Mr. Kennedy seconded, that the Commission
approve the SixYear Action Program for County Parks as submitted
by the Spokane County Parks and Recreation Department. Motion
carried unanimously.

M.. Hesseltine, representing the Pine River Park Com:nittee,
appeared before the Commfssion regarding ZN-109-77, the S& F
proposal to rezone to the Mj'nfng Zone, to request a postponement
of the pendfng hearing. The Commissfon felt that the applicant
should be present for setting a date of the hearing, and requested
Mr. Hesseltine to return on july 28th when both interested parties
could be present.
2. PrQposed AmsndM,.znts to the Snokane County Zoning 0-dinanae-
Jerry Litt presented the proposed amsndments to the Spokane County Zoning
Ordinance regarding the requirements for changing of the Zoning 1VIap.
M:. Kennedy stated that the hearing would be consideration of the amend-
ments as they were advertised, and then the Commission would review the
recommended changes as listed by the staff.

M:. Litt explained that the basic change w3s the deletion of the 61a/o petition
requirement and also the methods of notification.
M: s. Byrne stated that the water and sewar facilities should be shown on the
plan and this is not being done. This was a procedure set up by the
Policy Committee.
Detailed discussion w3s held by the Commission members on whether or not
a site development plan was necessary with the submittal for a request for
a zone change,
Mrs. Byrne moved, Mi•. Quigley seconded, that the staff develop language,
in cooperation with Mr. Emacio, and that the matter be continued for one week
to allow for preparation to present the inform.3tion to the Com-nission, in
providing additional detail to determine whether or not a developmm-nt plan
could be submitted at a later date after the original submission (Section
4 . 21.040-(c)-(5) .
M: . Jack Finney, Engineer' s Office representati ve , explazned that he did
not believe it would be necessary to have all of the inform3tion on a
proposal submitted by the applicanr before he would be able to make
recommendations as he scheduled mpetings wlith the people prior to the hearing.

This office would not oppose the rezoning of these parcels but would advise the
applicants that future controls on Sign Route 27 (Pines Road) could restrict access
to right turn only movements along Sign Route 27. This office would also advise
applicants to consider all access onto Pines via existing county road system
inasmuch as the multitude of present accesses have caused traffic operation
problems. If unable to comply with this restriction, all access onto Pines must
be applied for Chrough the Department of Transportation.
