6 PROPOSAL
The sponsor, Equitable Investors, Inc , 1s requesting approaal of a change
of conditions, File No ZE-64A-78, Multiple Family Suburban Zone, for the
purpose of reviewing a revzsed specific site plan to lnclude a"Kinder-Care"
(pay Care) Facility
C FINDINGS OF FACT
1 That the existing land use zn the area is residential, commercial and
rai1 road (sewer i nterceptor)
2 That the Comprehensive Plan designates this area as appropriate for
Suburban deve7opment.
3 _ That the existing zoning vf the property descrlbed in the application
is Multiple Family Suburban
4 That the provisions of RCW 43 21C (The State Envzronmental Po11cy Act)
have been cvmplied with, and the Committee concurs with the Declara-
tion of Nan-Szgnzficance

stormwater runoff and provide necessary landscaping for runoff
8 That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43 21C 080 RCW and the Board of Spokane County Com-
missioners Resolution #77-1392 be initiated by the project
applicant within thirty (30) days of final disposition of
this application, and prior to any on-site improvements, or
file appropriate documents to the effect that the NOTICE OF
ACTION is waived in accordance with Spokane County Commissioners'
Resolution #82-0458 dated May 4, 1982
9. Pursuant to the provisions of Chapter 43 21C RCW, the SEPA
Guidelines (14AC 197-101 and the Spokane County Environmental
Ordinance C,SCEO a proposed decl aration of non-s igni fi cance
has been issued at least fifteen (15) days prior to this date,
the officia] file, written comments and/or public testimony
contain information regarding assessment of the proposal's
adverse impacts to the physical environment, a finding is
here6y made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of
the project, and a final declaration of non-significance is
hereby to be lssued
10. That a 6-foot sight-obscuring fence be provided along the
north and east property lines
11. Any division of land for the purpose of sale, lease or
transfer shall comply with RCW 58-17 and the Spokane County
Platting Ordinances prior to issuance of 6uilding permits
b) COUNTY ENGINEERING DEPARTMENT
1 Access permits for approaches to the Spokane County Road
System shall be obtained from the Spokane County Engineer
2 a) Applicant shall improve Sullivan Road in a manner
consistent with Spokane County Major Arterial Roadway
Section for Sullivan Road.

(b) Sidewalks are required along Sullivan Road.
3 Applicant shall submit for approval by the Spokane County
Engineer road, drainage, and access plans prior to the
issuance of a building permit on the property
4 The applicant shall submit for approval by the Spokane
County Engineer and the Spokane County Health District
a detailed combined on-site sewage system plan and
surface water disposal plan for the entire project prior
to the issuance of any building permit on the property.
5 A parking plan and traffic circulation plan shall be
submitted and approved by the Spokane County Engineer
prior to the issuance of a building permit on the
property. The design, location, and arrangement of
parking stalls sha]1 be in accordance with standard
traffic engineering practices. Paving or surfacing as
approved by the County Engineer, will be required for
any portion of the project which is to be occupied or
travelled by vehicles.
fi. The word "applicant" shall include the owner or owners
of the property, his heirs, assigns, and successors.
7 To construct the road improvements stated herein, the
applicant may, with the approval of the County Engineer,
join in and be willing participant in any petition or
resolution which purpose is the formation of a Road
Improvement District (RID) for said improvement pursuant
to RCW 36.88, as amended Spokane County will not
participate in the cost of these improvements.
8 As an alternative method of constructing the road improve-
ment stated herein, the applicant may, with the approval
of the County Engineer, accomplish the road improvements
stated herein by joining and participating in a County
Road Project (CRP) to the extent of the required road
improvement Spokane County will not participate in the
cost of these improvements.
9. The construction of the road improvements stated here1n
shall be accomplished as approved by the Spokane County
Engi neer.
10. All required improvements shall conform to the current
State of Washington Standard Specifications for Road and
Bridge Construction, and other applicable county standards
and or adopted resolutions pertaini,ng to Road Standards
and Stormwater Management in effect at the date of con-
struction, unless otherwise approved by the County
Engineer

Commissioners Resolution No, 80-1592 as amended.
c) COUNTY UTILITIES DEPARTMENT
1 Pursuant to the Board of County Commissioners Resolution
No 8000418, the use of on-site sewer disposal systems
is hereby authorized This authorization is conditioned
on compliance with all rules and regulations of the
Spokane County Health District and is further conditioned
and subject to specific application approval and issuance
of permits by the Health District.
2 The Owner(s) or Successor(s) in interest agree to authorize
the County to place their name(s) on a petition for the
formation of a ULID by petition method pursuant to RCW
36 94 which the petition includes the Owner(s) property
and further not to object by the signing of a protest
petition against the formation of a ULTD by resolution
method pursuant to RCW Chapter 36.94 which includes the
Owner(s) property. PROVIDED, this condition shall not
prohibit the Owner(s) or Successor(s) from objection to
any assessment(s) on the property as a result of improve-
ments called for in conjunction with the formation of a
ULID by either petition or resolution method under RCW
Chapter 36.94,
3 Any water service for this project shall be provided in
accordance wlth the Coordinated Water System Pl$n for
Spokane County, as amended,
4. Each dwelling unit shall be double plun6ed for connection
to future area-wide collection systems, Plans and Specifi-
cations for the double plumbing are to be reviewed and
approved by the Utilities Department,
d) COUNTY HEALTH DISTRICT
1 A combined surface water and sewage disposal detailed plan
shall be approved by the County Engineer and the Spokane
County Health District prior to the Tssuance of any building
permit for this projectt
2 Sewage disposal method shall be as authorized by the
Director of Utilities, Spokane County.
3, Subject to specific application approval and issuance of
permits by the Health Offlcer, the use of an individual
on-site sewage system may be authorized.

4 Water service shall be by an existing public water supply
when approved by the Regional Engineer (Spokane), State
Department of Social and Health Services
5 Use of private wells and water systems is prohibited
6. Disposal of sewage effluent beneath paved surfaces is
currently prohibited.
e) COUNTY BUILDING AND SAFETY DEPARTMENT
1 Mains and hydrants to be installed, in accordance with
the Spokane County Department of Building and Safety.
2 Approved numbers or addresses shall be placed on all new
and existing buildings in such a position as to be plainly
visible and legible from the street or road fronting the
property Said numbers shall contrast with their back-
ground.
f) COUPJTY AIR POLLUTION CONTROL AUTHORTTY
1. Spokane County Air Pollution Control Authority regulations
require that dust be controlled during all phases of the
project. We further require that all travelled surfaces
be paved and kept clean.

The Hearing Examiner Committee, pursuant to the aforementioned, finds that
the application of Equitable Investors, Inc. for a change of conditions as

EXISTING ZONING MULTIPLE FAMILY SUBURBAN (est in 1978)
PROPOSED USE. 90-unlt complex and a 4,800 S F Kinder-
Care facility,
PROJECT LOCATION This site is generally located in the
Spokane Valley, more specifically at the southeast corner of
Sullivan and the abandoned railroad.

CHANGE OF CONDITIONS. This site was.approved for Multiple Family
Suburban zoning in October, 1978,by the Board Qf County Commissioners.
In so approving, the Board i,eviewed a development plan showing 95
units involving the entire site and required Condition #5, stating
"Improvements shall be in substantial conformance with the plot
plan on file". The applicant is reques'ting a change to that p7an,
which generdlly adds a kinder-care fac3,lity which reduces the site
-size by 1096 and reduces the number of units by 5%
The site (Parcel A at 24,000 S,F.) is to be used as a Kinder-
care facility, Parcel B is to be used'for 90 apartment units
The revised site plan changes the site from approximately 5 acre
parcel to 4 4 acres
95 units to 90 units
2,293 S.F,/unit to 2,153 S.F. / unit
19 units/acre to 20 units/acre and adds
a Kinder care facility with approxzmately 100 children
planned for.
Tlie site plan submitted w7th this change of consideration request
is somewhat general and appears to generally comply with the zoning
ordinance. A detailed review is required at huilding permit stage

III BACKGROUND/ANALYSIS
a) CUMPkEHENSIVE PLAN - This zone change was approved prior to
the adoptlon of the Spokane Cuunty Generalized Comprehensive
Plan. However, the site 11es withiii the Suburl,an category of
the Future Land Use Plan and is bounded to the north by
cornmercial and to the west by the Urban category. The density
proposed by this redesign exceeds the density guidelines of
the Suburban and Urban categories of the Future Land Use Plan,

b} STTE CONSIDERATTONS: The site is bordered to the east and
south by existing Multiple Family Suburban zoning. Staff
recommends sight obscuring fencing be provided adjacent to
the parking lot to screen headlights and naise from crossing
over adjacent land uses, also, that landscaping be provided
as indlcated on the submitted revised site plan,
c) HISTORY QF OTHER LAND USE ACTIONS: A preliminary Short Plat
approval has been given for this site (SP-83-241), which
recognizes the proposed divisions into Parcels A& B as
earl3er indicated,
d) CONCLUSION. The applicant's redesign complies with the
Spokane County Zoning Ordinance 1n relation to development
standards and density, However, the project does exceed
recommended denslty for the category 7t lies in,and also
the Urban category which is the counties most highly populated
category. Staff would, therefore, recommend that the project
not be allowed to increase the number of units per acre but
that it maintaln the ratio as app6r9ved in 1978,
IV. AGENCIES RECOMMENDED CONDITIONS, IF APPROVED
a) COUNTY PLANNING DEPARTMENT
l. That prior to develapment of this site the pending Short
Plat shall be finalized and al~l,conditions as stated
therein must be complled with.,w

2, Approval by the Zoning Administrator of a specific
lighting and signing plan for.the described property
prlor to the release of any building permits,
3. A speclfic landscape plan, planting schedule and pro-
visions for maintenance acceptable to the Spokane County
Zoning Administrator shall be submitted with a performance
bond for the project prlor to release of building permits,
4. The applicant shall develop subject property generally
in accordance within the concept presented to the Hearing
Examiner Committee. Varlations when appi^oved by the
Zoning Administrator wi11 be permitted, including, but
not limited to the following changes; Building 1ocation,
landscape plans, and general allowable uses of the
permitted zone, All variations must conform to regula-
tions set forth 7n the Spokane County Zoning Ordinance
The original intent of the development plans shall be
maintained.

5. The speclfic development plan will be submitted for
the Zoning Administrator's reView and approval prior to
issuance of building permits,
6. A11 current standards of the-Multiple Family Suburban
Zone, as amended, shall be complied with in the develop-
ment of this site
7. Applicant shall comply with '208' recoirniiendations
concerning stormwater runoff and provide necessary
landscaping for runoff.
8. That the provisions of SEPA's NOTICE OF ACTION pursuant
to Chapter 43 21C 080 RCW and the Board of Spokane County
Commissioners Resolution #77-1392 be initiated by the
project applicant within thirty (30) days of final
disposition of this application, and prior to any on-site
improvements, or file appropriate documents to the effect
that the NOTICE OF ACTION is waived in accordance with
Spokane County Commissioners' Resolution #82-0458 dated
May 4, 1982.
9. Pursuant to the provisions of Ehapter 43 21C RCW, the
SEPA Guidelines (IdAC 197-10) qnd the Spokane County
Environmental Ordinance (SCEO); a proposed declaration
of non-si gni ficance has been issued at 1 east fi fteen (15)
days prior to this date, the official file, written
comments and/or public testimony contain informatlon
regarding assessment of the praposal's adverse impacts
to the physical environment, a"findi►iy is hereby made
that no potentially significaritNadverse impacts upon
the physical environment are ariticipated as a result of
the project, and a final declaration of non-significance
is hereby to be issued.

11. Any division of land for the purpose of sale, lease or
transfer shall comply with RCW 58-17 and the Spokane
County Platting Ordinances prior to issuance of building

b) COUNTY ENGINEERING DEPARTMENT
1. The applicant shall dedicate 6 feet on Sullivan Road for
right-of-way prior to any use of the pronerty.

shall be obtained from the Spokane County Engineer.

a detailed combined on-site sewage system plan and
surface water dispbsal plan for the entire project prior
to the issuance of any building permit on the property

on compliance with all rules and regulations of the
Spokane County Hea1th District and is further conditioned
and subject to specific application approval and issuance
of permits by the Nealth District.
2. The Owner(s) or Successor(s) in interest agree to authorize
the County to place their name(s) on a pet7tion for the
format7on of a ULID by petition method pursuant to RCw
36 94 which the petition inclUdes the Owner(s) property

PLANNING

written request forty-five (45) days prior to the above expiration date

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW, requires all state and local
governmental agencies to consider environmentaT values both for their own actions and when licensing private
proposals. The Act also requires that an Environmental Impact Statement be prepared for all major actions
significantly (and "adversely", as per WAC 197-10) affecting the quality of the physical environment. The
purpose of this checklist is to help the agencies involved determine whether or not a proposal is such a

In reviewing your request of a revised site plan for project #ZE-64-78, it appears
to be generally in conformance with the oyiginal development plan and the conditions
added by the Board of County Commissioners in Resolution #78-1313 dated October 2,1978.
Detailed plans including landscaping, setbacks, parking, fencing, etc , must be
provided prior to release of any building permits
The revision to a kinder-care facility consumes approximately 10% of the site size,
and, therefore, we request the number of units to be iikewise reduced
The Multiple Family Suburban Zone, Section 4 07.080, lists certain uses whlch appear
similar to a"Kinder-Care" concept. This section requires a minimum of 15,000 square
feet with 125 feet of continuous frontage on a publ ic street Certain criteria for
a Variance must be evident or inherent with the property to justify an approval

And, finally, the implied division for lease or sale to accommodate the "Kinder-Care"
facility must comply wlth Short Plat Ordinance requirements.

Dear Steve:
Enclosed is a revised plan for the use of the property that was the
subject of the above referenced zoning matter. You have a slide of
the original plan. You will note that it'(and the zoning approved) allows
for 95 multifamily units with parking on the perimeter of the property and
buildings lining an interior landscaped area. The revised plan is for
5 fewer units (a total of 90) and, like the approved plan, has parking on the
perimeter and buildings 1ining an interior courtyard. The revised plan also
includes a 23,980 square foot parcel at the Northwest corner of the property
for a Ki nder-Care Learni ng Center.

In reviewing your proposal for day care centers, i.e., the zoning that
would be appropriate for the day care centers that we discussed and the
parking requirenents, I would make these observations.
The Commercial zone does not list day care centers as specific permitted
uses, and I wouldn't feel that that zone was intended to handle that type of
use where children may be out of doors or exposed to high volumes of traffzc,
noisQ,etc. I would recommend that you consider the Residential Office zone
or.other zones for this use that miaht be more aRAropr,atp and cnncistent
with the residenttal areaa
In regard to parkinq stagdatdS. I feel that the school standards listed
in 4.17.061 of the Spokane County Zoning Ordinance, subparagraph E,would be
applicable to tfiis use. Those re4uirements are that three sQaces for each
teachin4 station be available. For this type of u-u I thig a teachin9 station
should consist of 35 children.
