Re: Response to May 7, 2004 Letter for Requirement for Change of Conditions for
Modifications to Site Plan of Record for ZE-113-78
On May 10, 2004, I received a letter from you dated May 7, 2004 regarding proposed
modifications to the site plan of record for ZE-113-78. Specifically, you asked for
clarification as to whether the City would require a change of conditions hearing before the
City's Hearing Examiner to approve these proposed modifications. I have reviewed your
letter together with the file contents for ZE-113-78. It is my determination that the proposed
modifications are not substantive in nature and therefore would not require a change of
conditions hearing before the City's Hearing Examiner. My determination is based on the
following:
• Resolution No. 79-0999 of the Spokane County Commissioners specifies in Condition
No. 5 that the applicant shall develop the subject property generally in accordance with
~ the concept presented to the Planning Commission. This condition further states that
minor variations when approved by the Zoning Administrator will be permitted, including,
but not limited to the following changes: building location, building materials, landscape
plans, and general allowable uses of the permitted zone. The condition specifies that all
variations must conform to the regulations set forth in the Spokane County Zoning
Ordinance, and that the original intent of the development plans must be maintained.
This condition therefore allows for variations in the development concept provided that
the overall intent of the previous approval continues to be met.
• The original site plan record specified the development of a multi-family dwelling
complex comprising a total of thirty-one*(31) dwelling units. The subject property is
zoned Urban Residential-22 (UR-22) and is 1.48 acres in size. Based on the UR-22
density requirement of twenty-two (22) units per acre, a maximum of thirty-two (32) on-
site dwelling units is permitted. Your proposed modification would reduce the total
number of units to thirty (30) units. This modification represents a reduction in the total
number of units and is not a substantive change.
• The original site plan of record specified a total of forty-eight (48) on-site parking spaces.
Your proposed modification proposes a total of sixty (60) on-site parking spaces.
Chapter 14.802 (Off-Street Parking and Loading) specifies an on-site parking
requirement of 1.5 spaces per dwelling unit for multi-family dwellings. Based on a

proposed total number of thirty (30) units, the minimum on-site parking requirement is
forty-five (45) spaces (30 units x 1.5 spaces per unit). Your proposed modification would
increase the total number of on-site parking spaces by twelve (12) spaces. Section
11.10.070.4 of the Spokane Valley Interim Environmental Ordinance specifies that up to
forty (40) parking spaces are categorically exempt from environmental review pursuant
to this ordinance. The proposed twelve (12) space increase is therefore non-
substantive.
• The current site plan proposes on-site reconfigurations of buildings and parking spaces
to reflect the presence of public sewer and the need to provide an on-site stormwater
facility to accommodate site generated stormwater runoff. These reconfigurations do not
substantially change the original nature or intent of the zone change site plan of record,
and are therefore non-substantive.
Please note that the determination that the proposed modifications are not substantive to
warrant a change of conditions of hearing before the Hearing Examiner in no way alleviates
the developer of complying with applicable conditions of approval from ZE-113-78,
Resolution No. 79-0999, applicable City of Spokane Valley regulations and standards and
other agency's regulations and standards.

When we met in November of last year in a pre-development meeting on this
project, we discussed the Diamond Rock proposed 30 unit apartment project.
During that meeting you indicated that you were concerned that language in the
original approval by the Board of County Commissioners in July of 1979, noted
under section 5, "The applicant shall develop subject property generally in
accordance within the concept presented to the Planning Commission." During
our meeting we reviewed the previous plans prepared by Roy L. Wyatt,
Architects and Associates as well as the new plan prepared by Mr. Wyatt. It is
our contention that the new development meets or exceeds the requirements set
forth in 1979 in everyway and in fact this proposed development is in full
compliance with the original rezone approval, thereby negating the need to bring
this matter back before the Hearing Examiner for a ruling.
To that end, we have prepared the following for your consideration. The
following are excerpts directly from the Resolution approving the rezone in 1979.
Original text is in italics with comments following in normal text.
1) The County Engineer's Office has requested the following:
NOTE: All required improvements shall be built to meet or exceed
minimum County construction standar+ds.
a) Applicant shall construct cement concrete curb, five foot wide
sidewalk and pave right of way to existing pavement.
b) Applicanf shall obtain approval for on and off-sife drainage and
access plans before issuance of building permits

It is the intent of this project, as shown on the site plans to provid frontage
improvements along 8th Avenue that will be constructed in accordance with
City/County standards and that cement concrete curb and gutter, a planting
strip/swale area and a 5-foot concrete sidewalk will be provided. Additionally, gtn
will be widened to the north to meet the proposed curb to current City standards.
It is also the intent of this project to prepare engineering plans for street and
drainage plans to accommodate both on and off site drainage and access
demands. These plans will accompany the site plan engineering and site
development drawings at time of building permit submittal.
2) The applicant shall comp/y with ru/es and negu/ations of the Hea/th
District in providing for adequafe sewage disposal. AIl necessary
Health District permits shall be obtained pnor to building permit
issuance.
When the rezone of this property was originally prepared, presented and
approved, the intent of the overall project was to meet; the then current standard
for sewage disposal which was via septic tanks and drain field discharge. Since
that time, many things have changed, most notably, the fact that sewer is now
adjacent or nearly adjacent to this property. Because of this it is assumed that
Spokane County Health will require this property to hook the proposed 30-unit
apartment complex to sewer. To which this applicant will agree.
The advantage that the ability to hook to sewer has is two-fold, the most obvious
is the absence of septic tanks and drainfields. The second benefit is the ability to
use the property originally set aside for septic tanks and drainfields to reconfigure
the site for the same 30 units and make this a more desirable place to live by
. providing larger living units than was originally proposed as well as providing
realistic parking ratios. In the before, the site only provided 48 parking spaces
while in the after it will provide 60 spaces which better coincides with the
necessary 1.50 per unit on average as well as leaving space for visitors, which
the before scenario didn't do. Again, this is available because of the lack of room
set aside for septic and drainfield. The result of the additional parking spaces is
that generally, little to no parking on 8th Avenue will be required to accommodate
both tenants and visitors to this apartment complex, which probably could not
have been said about the original proposal.
3) Mains and hydrants to be installed in accordance with the Spokane
County Fire Marshal's requirements.
As discussed at the meeting, it is the intent of this project to follow the guildelines
and requirements of Spokane Fire District No. 1 as well as all requirements as

outlined in the Uniform Building Code, which was the point of much discussion during our first meeting.
4) The Planning Commission recommended that a Final Declaration of
Non-Significance (DNS) be issued and that an Environmental lmpact
Statement is not necessary for this proposal.
It is our understanding that after reviewing the potential impacts on the specific
elements of the environment from the development of 31 multi-family units, under
the then new SEPA laws, that the Planning Commission issued a DNS. Since,
1979 the SEPA guidelines for the State of Washington have changed little. This
would then indicate that a review of a newly submitted checklist for a 30-unit
apartment building would have no new impacts associated with this
development. Based on this, one would have to say that this project has no
additional impacts to either the natural or built environment. In fact, because of
the presence of sewer, this project will impact the environment less now, by
hooking up to sewer, than the earlier project would have had by using septic.
Therefore, we believe, if the SEPA Checklist is one of the most critical
determining factors in review, this new proposed project has the same or less
impacts than the previously proposed project.
The litmus test as to layout and site plan conformity, could be made with the
evaluation of SEPA. SEPA in and of itself does not speak to site plan
configuration; it speaks to the demands placed on both the natural and built
environment. Therefore, if 31-units did not place unacceptable demands then
you could surmise that impacts from a 30-unit proposal would then be diminished
proportionately. While this proportion would be imminently small and not truly
measurable the logical step would be to say the impacts are the same and they
were found to be IVon-Significant (DNS).
5) The applicant shall develop subject property generally in accordance
within the concept presented to the Planning Commission. Minor
variations when approved by the Zoning Administrator will be
permitted, including, but not limited to the following changes: building
locations, building materials, /andscape plans and general allowable
uses of the permitted zone. All variations must conform to regulations
set forth in the Spokane County Zoning Ordinance. The original infent
of the development plans shall be maintained.
As discussed in our meeting it is our contention that this plan meets the intent of
the original plans. The architect of record, Roy L. Wyatt, has stated such at our
meeting as he was the architect for the original project in 1979 and the proposed
project now. As the architect, he is responsible for developing the site plan in
conformance with the zoning code as well as any additional stipulated conditions
imposed by the governing body. It is his opinion that had there been sewer in the

before condition, that the site plan would have been layed out much the same as
is currently proposed. Having been involved in land development for 20-years I
would also agree to his assertion. For this proposal, the biggest change is the
removal of the septic field. This has allowed the site plan to be used more
efficiently and provide units that more closely meet the demands of today's
apartment dwellers than those of 20 years ago.
Between the two alternatives the following comparisons apply:

While this is a small table, it should be noted that water use will be less due to
low flow plumbing facilities now required by all water districts, traffic generation will be less, even though it is incremental, 31 units generate less traffic than 30
units. Therefore, it is our assertion that the layout proposed for the Diamond
Rock 30-unit apartments meets the intent of the original rezone and approval by
the Planning Commission.
6) A landscape plan showing specific detail and accompanied by a
performance bond shall be approved by the County Zoning
Administrator prior to building permit issuance.
A landscape plan will be submitted with the building permit application package.
7) Interior driveways and parking areas shall be paved.
The applicant agrees that all interior driveways and parking areas shall be paved.
8) That, if after one year from the date of the planning commission's
actions the applicant has not received final adoption of the zone
change, the applications is void.
The zone change application was adopted by the Board of County
Commissioners by County Resolution No. 79-0999. Thereby meeting the
condition imposed.
Lastly, we believe by RCW 36.70B.030, Project Review - Required Elements -
Limitations, that the reviewers ability to determine if one site plan or another is in
conformance lies with the technical aspects of the proposal as specifically

identified by code and not with the interpretation of site plan layout. For instance,
are 30-units less than 31-units, if so that is the criteria, not whether they may be
reconfigured, etc... a copy of the applicable RCW is attached for your review.
Therefore, in accordance with the recommendations outlined in RCW 36.70B.030
we believe that this proposal is in conformance with the requirements set forth by
the Planning Commission and agreed to by the Board of County Commissioners
in 1979 and ask that you accept this proposal as being in general conformance
and not require a resubmission to the Hearing Examiner for consideration and
approval.

regulations shall serve as the foundation for project review. The review of a proposed project's
' consistency with applicable development regulations, or in the absence of applicable regulations the adopted comprehensive plan, under RCW 36.70B.040 shall incorporate the determinations under this ~

(2) During project review, a local government or any subsequent reviewing body shall determine
whether the items listed in this subsection are defined in the development regulations applicable to the Iproposed project or, in the absence of applicable regulations the adopted comprehensive plan. At a
~ minimum, such applicable regulations or plans shall be determinative of the:

(a) Type of land use permitted at the site, including uses that may be allowed under certain
circumstances, such as planned unit developments and conditional and special uses, if the criteria for
their approval have been satisfied;
(b) Density of residential development in urban growth areas; and ; (c) Availability and adequacy of public facilities identified in the comprehensive plan, if the plan or

development regulations provide for funding of these facilities as required by chapter 36.70A RCW.
(3) During project review, the local government or any subsequent reviewing body shall not ;
reexamine alternatives to or hear appeals on the items identified in subsection (2) of this section, except
for issues of code interpretation. As part of its project review process, a local government shall provide a ,
procedure for obtaining a code interpretation as provided in RCW 36.70B.110.
(4) Pursuant to RCW 43.21 C.240, a local government may determine that the requirements for
environmental analysis and mitigation measures in development regulations and other applicable laws

provide adequate mitigation for some or all of the project's specific adverse environmental impacts to
which the requirements apply.

(5) Nothing in this section limits the authority of a permitting agency to approve, condition, or deny a
project as provided in its development regulations adopted under chapter 36.70A RCW and in its '
policies adopted under RCW 43.21C.060. Project review shall be used to identify specific project design
and conditions relating to the character of development, such as the details of site plans, curb cuts,
drainage swales, transportation demand management, the payment of impact fees, or other measures to
mitigate a proposal's probable adverse environmental impacts, if applicable. ;

RCW 36.70B.040
Determination of consistency.
(1) A proposed project's consistency with a local government's development regulations adopted under
chapter 36.70A RCW, or, in the absence of applicable development regulations, the appropriate
elements of the comprehensive plan adopted under chapter 36.70A RCW shall be decided by the local
~
government during proj ect review by consideration of:
(a) The type of land use;
(b) The level of development, such as units per acre or other measures of density;
(c) Infrastructure, including public facilities and services needed to serve the development; and
(d) The characteristics of the development, such as development standards.
(2) In deciding whether a project is consistent, the determinations made pursuant to RCW
36.70B.030(2) shall be controlling.
(3) For purposes of this section, the term "consistency" shall include all terms used in this chapter
and chapter 36.70A RCW to refer to performance in accordance with this chapter and chapter 36.74A
RCW, including but not limited to compliance, conformity, and consistency.
(4) Nothing in this section requires documentation, dictates an agency's procedures for considering
consistency, or limits a city or county from asking more specific or related questions with respect to any
of the four main categories listed in subsection (1)(a) through (d) of tliis section.

(5) The department of community, trade, and economic development is authorized to develop and
adopt by rule criteria to assist local governments planning under RCW 36.70A.040 to analyze the
consistency of project actions. These criteria shail be jointly developed with the department of ecology.

re-zones and development along and adjacent to SR2 in this area will increase
congestion and accident potential due to random access onto SR 2. It is
the position of this Department that access from these developments should
more properly be provided by the development of a frontage road system
with access to SR 2 at selected County road locations.

The increasing number of multiple family dwellings developing in
close proximity to SR 27 (Pines Road) will accelerate the need to provide
further control and restrictions on traffic movement entering and leaving

well as make all concerned aware of the possible restriction of traffic
movements.

The development of this as a regional shopping center will cert-
ainly have a significant impact on the Sullivan Road Interchange and I-90.
Spokane County should be prepared to participate with the Department of
Transportation in the costs of any revisions to the interchange as a re-
sult of the increased traffic. In addition, in order for the Department
of Transportation to respond to these impacts it is necessary that we be
provided with the traffic projections anticipated by this development.
Even though there has been an E. I. S. filed, the recent developments in

the Liberty Lake area of a proposed regional shopping center under the
combined efforts of the Homestead and Highlands developments, coupled with
the rumor of other proposals for a regional shopping center lying North of
I-90 would indicate to us that the traff ic figures provided in that E.I.S.
may no longer be valid.

Very close attention should be given to the access from this parcel
onto SR 291 (Francis Ave.) to minimize the all ready high accident potential
and congestion.

WHEREAS, The Spokane County Planning Commission did, after public
hearing on September 22, 1978, forward to the Board of County Commi s sioners a
recommendation that the Zoning Map be changed from the existing Agricultural Suburban classification to the Multiple Family Suburban classification o'n property

This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
Wolfland, Inc., South 717 Pines Road, Spokane, 4JA 99206 for the above
captioned zone reclassification; and
The Board having received the recommendation of the Spokane County
Planning Commission to approve the zone reclassification, subject to
~ findings and conditions as contained in the Commission's minutes dated

The Board instructed the Planning Staff to prepare Findings and Order,

Pollution of the aquifer is our main concern. After the units
are built and the water is polluted - it's to late to do sornething
about it. The nitrate tolerance level for children is much lower
than for adults. The nitrate levelis at 3% now and obviously it
must get higher with more densitSq of people. Some areas are being

Mrs, Byrne inquired about the two requests which had been received
regarding time for special hearings Mr. Main requested a special
date for the Homestead application and Mr. Slade of the Senske engineer-
ing firm had asked for a hearing on Mt, Baldy, Mr. Kennedy remarked
_ that previously the Commission had voted on not granting special requests
and that all items would be heard in a routine manner. He stated that
the policy had been established not to set up special hearings for
special cases.
Mr. Thomas noted that the Hearing Examiner Committees' function would
preclude meeting of the full Plannfng Commis sion to make determinations
on special requests and requested that Mr. Emacio reference the Hearing
Examiner Ordinance which had recently been adopted and give the
Commission a legal interpretation on holding hearings for special
reque s ts .

That the zone reclassification request (File Number ZE-109-78) be approved for
only the property of the people in favor of the zone change which is the area
to the northeast of the advertised property which is to be included in the legal
description, deleting that portion of the property to the north which is owned
by Mr. Peterson, owner of the nursery; and in so approving, adopts the Staff's
findings as the Planning Commiss-ion's Findings of Fact as well as the
conditions stated in the Staff's findings, EXCEPT DELETE Conditions "b" ,"c
and "d" as listed in the Staff's Findings; and the additional condition that when
any additional residential permits are applied for, that a standard avigation
easement in favor of Felts Field Airport is requested as the area lies within
the control zone of Felts Field, If trailers are desired, a Conditional Use
permit would also be required. It was recommended that a Final Declaration
of Non-Significance be signed by the Board of County Commissioners.
