The proposal is generaliy located east of and adJacent to Plnes Road, approximately 150 feet north of Velley Way In Section 15-25•44. Tax parcel numbers: 15543•1704, 1705 and a portion of 1726. Leyal descriptlon: The N 90' of the W 130.72' of the S 1/2 of Blxk 117, Opportunity; the W 130.72' of the S 1/2, except the N 90' and except the S 133' of 81ock 117; and also the E 115.72' of the W 246.44', except the S 133' of the S 1/2 of 81odc 117. 2. The proposal consists of a zone reclassification to Local Business on an approximate .99-acre site for the purpose of developlng offices. 3. The previous Spokane County Comprehensive Plan Map, which was In efiect In 1978, designeted this area as appropriate for residentlal development. 4. The provislona of RCW Chapter 43.21 C(State Environmental Policy Act) have been oomplied with end, In fact, a previous chalrman of the Board of Gounty Commissioners signed a Final Deciaration of Nonslgnlficance on July 18, 1978. 5. The Spokane County Planning Commission he{d a publlc hearinq on June 16, 1978, concerning the proposel, subsequent to which, by Findings dated June 16, 1978, they recommended that the Board of County Commissbnera approve the rezone to Local Buslness subjeCt to speciflc conditions of approval. 6. The Board of County Commisstoners tormaliy accepted the Planning Commisslons reoommendation on July 6, 1978, and ooncurred In the recommendation to approve the Local Buslness rezone. However, as was then customery, the Board took no ection on ffnailzlnq the rezone until ell conditions of approval were met, pr(marily the dedicatlon ot roed rlght-of-wey. Subsequent prxedure by 1he Board allowed zone ChangeS to be finali2ed and reoorded fmmediateiy by Resoiution. Conditions of approval (lnciudinq right-of•wey dedication) were left to be Complied with at the time a building permit was requested. These same procedures are currently being used In reione matters. ' 7. It appears that the condition of approval delaying the finalization of the zone was an engineer's condition requirlng the dedlcation of additional ripht-of-way along the north boundary of the site. In recent oontacts with the County Engineer, it was felt that the dedication of additlonal right-of-way oould be obtalned at the time a buildtng permft was requested. The zone should be tinalized with conditions of approval suggested by the Planning Commission In 1978. 8. The current Board finds that the failure to finalize this zone was through no fault of the appiicant but slmply a change In County procedure (streamilninp the method • , . ~ • ! Inasmuch es the ectbn of the Bogrd of County Commissioners herein ls 8n administrative action, no formal legal advertislng was required; however, the appllcant was advised of the action. From the foregoing Flndlngs, review ot the Planning Commission's reoommendatlon dated June 16, 1978, review of the Board's Resolution #78-890 dated July 6, 1978, and a review of Flle No. ZE-68-78, the Board hereby APPROYES the rezone subJect to the followlnq conditions of approval. CONDITiONS 1. fmprovements shall be In substantial conformance with the plot plan on file with thfs application. 2. The appllcant shall oompiy with rules and regutations of the Heaith District in providing for edequate sewage disposal. All necessary permits shall be obtained from the Heaith District prior to buifding permit Issuance. 3. Mains and hydrants to be Installed, if needed, !n ac;cordance with the Spokane Counly Fire Marshal. 4. All required Improvements shail be bu11t to meet or exceed minimum County construction standards. 5. Appilcant shali dedicate the North 14' of the advertised property for ripht of way. 6. Applicant shall construct curbs end pave riqht of wey to meet existing pavement. 7. Applicant sha11 obtain approval for on and off-slte drainage plan and access permlts before Issuance of bulldin9 permits. 8.
