FINDINGS AND ORDER REGARDING ZONING MAP PROPOSAL, ZE-117-78,
AGRICULTURAL TO MANUFACTURING: ACM=~ CONCRETE COMPANY
WHEREAS, The Spokane County Zoning Hearing Examiner Committee
did, after public hearing an October 20, 1978, forward to the Board of County
Commissioners a recommendation that the Zoning Map be changed from the
existing Agricultural classification to the M,anufacturing classification on property
described as follows:
The South 115 feet of Lots 1, 2, 3, 4, S, and 6 of Block 8, Dundee
Addition; All of Lots 7, 8, 9, 10, 11, and 12 of Block 8, Dundee
Addition, and the North 30 feet of Alki Street which borders Lots 7
through 12 of Block 8, Dundee Addition. All in Section 13,
Township 2 5 N,, Range 43, E, W, M., Spokane County, Washington.
and,
WHEREAS, The Board having conducted its own public hearing on
November 29, 1978, at the request of Mi , and Mrs, james D. Crull, North 630 Park
Road, Spokane, WA 99206, to present evidence and testimony in favor and
opposition to the application, and
WI-IEREAS,At said hearing opportunity was afforded those favoring
and those opposing the above-described Zoning Mcip proposal, and the Board of
County Commissfoners of Spokane County having fully considered the testimony
given, the records, and minutes of the Zoning Hearing Examiner Committee and all
other evidence presented and having personally acquainted themselves with the
site and vicinity in question, does hereby find:
1) That the Board of County Commissioners upholds the recom-
mendation of the Spokane County Zoning Hearing Examiner
Committee for approval, subject to the findings and conditions
set forth in the Zoniny Hearing Examiner Cornmittee minutes of
October 20, 1978.
2) That an additional condition be required in that sight-obscuring
slats be placed in the fence opposite residences at North 630
and 708 Park Raad.
3) ThE Board of County Commissioners also concurred in the
Planning staff's recommendation that a Final Declaration of
Non-Significance be issued.

This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request ot
Acme Concrete Company, East 5204 Broadway Avenue, Spokane, Washington
for the above captioned zone reclassification; and
The Spokane County Zoning Hearing Examiner Committee havina heard the
above application on October 20, 1978, did approve said zone reclassifi-
cation, subject to certain conditions; and
The Board having conducted its own public hearing on Pdovember 29, 1978
at the request of Mr. and P1rs. James D. Crull, North 630 Park Road,
Spokane, 4lashington 99206 and after visiting the site and reviewing the
testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the action of the Spokane County Zoning Hearing
Examiner Committee approving said application, subject to certain con-
ditions, and subject to an additional condition that sight obscuring slats
be placed in the fence opposite residences at North 630 and 708 Park Road.
The Board also concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of Non-Significance
be issued.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

haul roads will increase particulate emissions. We ask that the propo-

PLANNING DEPART 1. Reference your proposed Declaration of Nonsignificance of October 3, 19W?T
for subject pro3ect and its attached environmental checklist.
2. We have comments on the following checklist items:
a. Section II. 3. (e) and (h): Response should be "yes" since "wash
water" high in suspended solids is discharged into "surface" water
(exposed Spokane Valley Aquifer); the exposure of the groundwater
subjects it to elevations of both temperature and dissolved oxygen;
and the removal of protective soil cover has attendant greater potential
for pollution/contamination from a variety of sources.
b. Section II. S. (a) and 9(b): In addition to the responses indicated,
the removal of the land is in itself a depletion of a natural resource.
This should be mitigated by positive planning for use of the area upon
the completion of the mining. In a memorandum of July 18, 1978, from
Raq Card and Larry Esvelt, 208 Study Managers to the Citizen Represen-
tatives Corps (208 Study), the 208 Study Technical Advisory Committee
recommended the following priorities:
1. For existing penetrations:
(a) Backfill the excavation with "inert" material;
(b) Recreational or other planned and controlled
public use of reclaimed sites;
(c) Close control of access by a public agency to pre-
clude entry into the sites; and
(d) Leave the control essentially as is.
2. For plan preparation for future gravel extraction:
(a) No new operations over the aquifer including no reactiv-
ation of inactive sites or expansion of currently planned
excavations;
(b) Controlled excavations to a"safe" vertical clearaace
above the water table plus planned renovation of the
site for public use.
(c) Allow penetration to below the water surface with planned
renovation and re-use of the excavation site.

c. Section II. 17: Response should be "maybe" since enlargement
of the pit exposes more of the aquifer to potential pollution
and produces a greater perimeter of steep slopes into deep water
with resultant increase in accidental drowning hazard.

above, the site could be reclaimed as a recreational site.

this proposal warranted? The adjacent properties are nq lqnger us.ed fpr agri-
culture. P7ost has been zoned local business or manufacturing. The area in ques-
tion has been vacant for a number of years. It has not been used for agriculture
and it is doubtful if it ever will be. The property to the west and south are part
of a c7ravel pit, to the north a vacant area still zaned aCriculture. To thP,ea!Lt
is a trailer park entry.
2. What effect will the proposed zone reclassification have on the adjacent properties ?
Effect on the south and west is to expand existing gravel pit permitting straightening
or Lne pit doundar7es. Un the north there is a vacant parcel, still zoned agricul-
tura1 will remain. Across Park Road to the east 1ies an entry to a mobile home
park and other property owned by Acme Concrete Co., presently vacant.
3. Can a reasonable return from a reasonable use of the property ln question be
secured under the existing zone clas sification ?(It no, why Due to
the small area (only 280' X 300') it is doubtful that it will ever be used for -
agri cul tural purposes. It wi 11 probabl y have to be rezoned for any profi tabl e ,
