CItizens and Property owners of Section 23, Township 25 N., Range 43,
E.W.M. against approval of zone reclassification No. ZE-127-78 Residential
Mobile Home to Residential Office for the purpose of establishing a
real estate office.
We the undersigned citizens and property owners of Section 23, Township 25
N., Ran ge 43, E.W.M. do hereby petition the members of the Spokane County
Planning Commission to recommend to the Board of County Commissioners of
Spokane County, that zone reclassification No. ZE-127-78 Residential Mobile
Home to Residential Office for the purpose of establishing a real estate
office to be help in a public meeting by the Spokane County Planning
Commission on Friday, October 20, 1978 at 1:30 p.m., not to be approved
for the following reasons as identified by the citizens and property
owners of Section 23, Township 25 N., Range 43 E.W.M.
1) The fact th at the neighborhood in which the zone reclass-
ification is requested is currently a family neighborhood
and the intrusion of a business enterprise would drastically
change the complext.ion of this setting.
2) T,Thereas the current traffic flow on 4th Avenue is currently
quite heavy, the addition of the patrons automobiles
traveling to and from the proposed real estate office
would not to anything to alleviate the traffic problem.
3) Whereas the surrounding and adjacent property to the
proposed real estate office could possibly suffer a decrease
in value or experience difficulty in reselling the property
due to the fact that a business enterprise is located so near.
Once again we the undersigned citizens and property owmers of Section 23,
ToN,rriship 25 N., Range 43, E.W.M. petition and appeal to the members of
the Spokane County Planning Commission that they not rega.rd approval of :zone
reclassification No. ZE-127-78 Residential Mobile Home to Residential
Office for the purpose of establishing a real estate office b ased on the

WHEREAS, The Spokane County Zoning Hearing Examiner Committee
did, after public hearing on October 20, 1978, forward to the Board of County
Commissioners a recommendation that the Zoning Map be changed from the
existing Residential Mobile Home classification to the Residential Office
classification on property described as follows:
The North 100 feet of Lot 2, Block 2 of Caroline Addition in
Section 23, Township 25 N., Range 43, E.W. M., Spokane
County, Washington.

WH EREAS , The Board having conducted its own public hearing on
December 4, 1978, at the request of Larry Dusek, West 1025 Indiana Avenue,
Spokane, WA, et al, to present evidence and testimony in favor and opposition
to the application, and
WHEREAS, At said hearing opportunity was afforded those favoring
and those opposing the above-described Zoning Map proposal, and the Board of
County Commfssioners of Spokane County having fully considered the testimony
given, the records, and minutes of the Zoning Hearing Examiner Committee and all
other evidence presented and having personally acquainted themselves with the
site and vicinity in question, does hereby find:
1) That we concur with the Zoning Hearing Examiner Committee's
recommendations as contained in their minutes of
October 20, 1978, and that we find the reasons expressed by
the Zoning Hearing Examiner Committee to be sufficient and
controlling.
2) That the Board of County Commissioners upholds the recommen-
dation of the Spokane County Zoning Hearing Examiner Committee
for approval, subject to the findings and conditions set forth in
the Zoning Hearing Examiner Committee minutes of October 20,
1978.
3) The Board of County Commissioners also concurred in the
Planning staff's recommendation that a Final Declaration of
Non-Significance be i ssued ,

This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
Charles R. Spencer, East 5219 Fourth Avenue, Spokane, Washington 99206
for the above captioned zone reclassification; and
The Spokane County Zoning fiearing Examiner Committee having heard the
above application on October 20, 1978, did approve said zone reclassi-
fication, subject to certain conditions; and
The Board having conducted its own public hearing on December 4, 1978,
at the request of Larry Dusek, West 1025 Indiana Avenue, Spokane, IAIA,
etal, and after visiting the site and reviewing the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the action of the Spokane County Zoning Hearing
Examiner Committee which approved the zone reclassification application.
The Board also concurred in the Planning Staff's recommendation that no
significant adverse impacts will result and a Declaration of Non-Significance
be issued.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.

II. SPECIFIC INFORMATION •
a) Countv EnQineer's Office:
The County Engineer's Office has requested the following be considered if the
rezone is approved:
NOTE: All required improvements shall be built to meet or exceed minimum
County construction standards.
1. Applicant shall construct cement concrete curb, five foot wide sidewalk
and pave right of way to existing pavement.
2. Applicant shall obtain approval for on and off-site drainage & acces s
plans before issuance of building permits.
b) Spokane County Health District:
The applicant shall comply with rules and regulations of the Health District
in providing for adequate sewage disposal.. All necessary Health District
permits shall be obtained prior to building permit issuance.

c) Fire Protection
Mains and hydrants to be installed, in accordance with the Spokane County
Fire Marshal's requirements.
d) Environmental Review
The Staff recommends that a Final Declaration of Non-Significance be signed
by the Board of County Commissioners.
III. CONDITIONS:
If the Planning Commission approves this request, the following conditions should
be considered:
a) Compliance with all requests stated under Specific Information above.
b) The applicant shall develop subject property generally in accordance within
the concept presented to the Planning Commission. Minor variations when
approved by the Zoning Administrator will be permitted , including, but not
limited to the following changes: Building location, building materials, land-
scape plans, and general allowable uses of the permitted zone. All variations
must conform to regulations set forth in the Spokane County Zoning Ordinance.
The original intent of the development plans shall be maintained.
c) A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to building
permit issuance.
d) That the provisions of SEPA's Notice of Action pursuant to 43.21c.080 R. C.W .
and the Board of County Commissioners' Resolution #77-1392 be accomplished
by the applicant within thirty (30) days of formal action by the Board, as instruc-
ted by the Planning Department Staff.
e) Interior driveways and parking areas shall be paved.
f) That, if after one year from the date of the Planning Commission's action, the
applicant has not received final adoption of the zone change, the application
is void.
