HEARING EXAMINER COMMITTEE
FINDINGS AND ORDER
A. I NTRODUCTION This matter having come before the Examiner Committee on November 27, 1978,
and the members of the Committee present being Eldon Thomas, Chairman, Jane
Myers and Ted McCoury and there being the following persons present who wish
to request approval of a Zone Change; Bob Werner, Pete Rayner, and Mr. Bolem
for a ione change, Agricultural Suburban to Multiple Family Suburban for the
purpose of apartment complexes.
B. FINDINGS OF FACT
1. That the existing land use in the area is East Valley High School and
vacant land. .
2. That the Comprehensive Plan designates this area as appropriate for
residential development.
3. That the existing zoning of the property described in the application is
Agricultural Suburban.
4. That the provisions of RCW 43.21C (The State Environmental Policy Act)
have been complied with.
5. That the proper tegal requirements for advertisement of the Agenda Item
have been fulfilled.
6. That this proposal is not in conflict with the provisions of adopted regula-
tion or intent of adopted policies.
7. That the land in this area is suitable for the proposed use, or uses within
the proposed Zone Classification.

8. That the proposed use is compatible with existing uses in the area.
9. That the owners of adjacent lands expressed disapproval of the proposed
use.
10. The Hearing Examiner Committee finds the proposed use to be in harmony
with the general purpose and will not be otherwise detrimental to the public
health, safety, and welfare.
11. The following are additional findings of fact considered by the Hearing
Examiner Committee:
• a) That an adequate buffer from the residential area is available.
• b) Wellesley and Sullivan are arterials and this proposal will be an
effective buffer from the Local Business Zone on the east side of
Sullivan.
C. ORDER
The Hearing •Examiner Cpmmittee, pursuant to the aforementioned, finds
that the application of Rayner & LeMaster for a ione change, Agriculgural
Suburban to Multiple Family Suburban as described in the application should
be approved.
Special conditions or contingencies applied to motion:
a. Compliance with all requests stated under Reviewing Agency Comments
above.

b. The applicant shall develop subject property generally in accordance within
the concept presented to the Hearing Examiner Committee. Minor variations
when approved by the Zoning Administrator will be permitted, including,
but not limited to the following changes: Building location, building
materials, landscape pfans, and general a!lowable uses of the permitted
Zone. All variations must conform to reguiations set forth in the Spokane
County Zoning Ordinance. The original intent of the development plans
shalf be maintained.
c. A landscape plan showing specific detail and accompanied by a performance
bond shall be approved by the County Zoning Administrator prior to
building permit issuance.
d. That the provisions of SEPA's Notice of Action pursuant to 43.21c.080 RCW
and the Board of County Commissioner's Resolution #77-1392 be accomplished
by the applicant within thirty (30) days of formal action by the Hearing
Examiner Committee as instructed by the Planning Department staff.
e. I nterior driveways and parking areas shall be paved.
f. Direct light from any exterior area lighting fixture shall not extend over
the property boundary.
That, if after one year from the date of the Hearing Examiner Committee's
action, the applicant has not received final adoption of the zone change,

WHEREAS, The Spokane County Zoning Hearing Examiner Committee did,
after public hearing on November 17, 1978, forward to the Board of County
Commissioners a recommendation that the Zoning Map be changed from the existing
Agricultural Suburban classification to the Multiple Family Suburban classification
on property described as follows:
Lots 2, 3, 4, and S, Block 3, Krueger's Third Addition in Section 2,
Township 25 N,, Range 44, E. W. M,, Spokane County, Washington.
and,
WHEREAS, The Board having conducted its own public hearing on
January 8, 1979, at the request of Brenda A. Wells, East 15306 Wellesley, Spokane,
Washington, to present evidence and testimony in favor and opposition to the
application, and
WHEREAS, At said hearing opportunity was afforded those favoring and
those opposing the above-described Zoning Map proposal, and the Board of County
Commfssioners of Spokane County having fully conAdered the testimony given, the
records, and minutes of the Zoning Hearing Examiner Committee and all other
evidence presented and having personally acquainted themselves with the site and
vicinity in question, does hereby find:
1) That the Board of County Commissioners upholds the recommendation
of the Spokane County Zoning Hearing Examiner Committee for
approval, subject to the findings and conditions set forth in the
Zoning Hearing Examiner Committee minutes of November 17, 1978.
2) That an additional condition be required in that no building permits

This being the time set by the Board of County Commissioners of Spokane
County, Washington, to render its decision concerning the request of
Rayner & LeMaster, 611 Peyton Builcling, Spokane, WA 99204 for the above
captioned zone reclassification; and '
The Spokane County Zoning Hearing Examiner Committee having heard the
above application on November 27,1978, did approve said application; and
The Board having conducted its own public hearing on January 8, 1979,
at the request of Brenda A. Wells, East 15306 Wellesley, Spokane, WA
and after visiting the site and revietiving the testimony; and
The Board being fully advised in the premises did determine, based upon
the testimony submitted at the public hearing and other evidence available
to the Board to uphold the action of the Hearing Examiner Committee as
set forth in its Findings and Order of November 27, 1978, subject to
revised rules for wastewater treatment.
The Board instructed the Planning Staff to prepare Findings and Order,
for execution by the Board at a subsequent meeting, setting forth more
definitively the Board's action in this matter.
