PRELIMINARY SUBDIVISION
I. GENERA.L INFORMATION
A. Location
The proposal is located in the Spokane Valley in the Opportunity area on the
east side of Pines between 12th and 13th Avenues.
B. Proposal
- 1.79 acres subdivided into 3 lots for residential office use
- Lot frontage = Approximately 90'
- Lot size = Ranges from 13,136 sq. ft. to 42,429 sq. ft.
C. Relationship to the Comprehensive Plan
The approved map of the Comprehensive Plan indicates residential usage of this
area, as well as all nearby surrounding lands, with no density designation.
D. Land Use Analysis:
1. Existing Land Uses
The project site is currently vacant with a single family dwelling and out
buildings. Land uses within the general area are varied. Generally,
commercial and residential office type uses are found adjacent to Pines Road. '
In addition, multi-family uses (apartments) are found within close proximity
to Pines Road (generally within a block east or west).
More specificallp, land uses adjacent to the proposal are as follows:
North of the proposed site is one single family dwelling with pasture, and
vacant the predominant use. East of the proposal are duplexes and Kofinehl
Subdivision with multi-family structures. 38 units in all. South of the
proposed site is abutted by a church. To the east of the site is a bank and
fuaeral home.
2. Compatibility with Existing Land Uses
The applicant has proposed three lots; one lot to be used for a dental office
and the other two for general office use. In light of past and current
planning decisions along Pines Road, the proposed land use of the site would
appear to be both consistent and compatible with existing surrounding land
uses.

II. SPECIAL INFORMATION
A. Circulation
The County Road Engineer has examined the proposed preliminary plat and has
recommended specific conditions to insure the satisfactory development of this
plat. Generally, recommendatioas are standard county road improvment
requirements.
B. Sewage Disposal
The applicant's engineer has prepared an analysis of alternative sewage dis-
posal means; including on-site septic tank disposal, community septic tank
disposal, and community package treatment plant disposal. For economic
reasons, and to provide the most realistic alternative, the applicant's engi-
neer feels on-site septic tanks should be utilized.
The Spokane County Health District has authorized the use of individual
on-site sewage systems for each lot within the plat. The plat is situated
over the Spokane Valley Aquifer and the Health District in their examination
of the possible impact on groundwater quality from this proposal have the
following comments: ,
Impact Discussion
a. The plat sponsor has proposed 4 commercial office buildings to be served
by a public water system and its individual on-site sewage disposal
system. This raises the question of significance of the impact on the
groundwater in the area and possible alternatives for sewage disposal.
b. In the course of the conduct of the Army Corps study, Dr. Todd considered
typical soils, natural and sewage disposal recharge to the groundwater,
and the effect of continued urban development in the Spokane River Valley
upon the quality of the groundwater. In swnmary, he concluded that:
1. In normal precipitation years subsurface disposal of sewage
treatment effluent does reach and recharge the groundwater.
2. All the dissolved salts in sewage effluent will be carried to
the groundwater. However, bacteria and detergents
(phosphate portion) are mostly removed by the deep soil layer
above the groundwater and "minor dissolved constituents such as
phosphates, which are known to react with soil particles, or
aitrates, which are taken up by the plant roots," will be less
than the total found in septic tank effluents.
3. The calculated results at the downstream end of groundwater
flow line indicate that the maximum range of (dissolved) solids
concentration expected at presnet (1975) is up to 93 mg/1
(milligrams per liter) above the natural groundwater background
of 155 mg/1. The forecast year 2020 maximum iacremental
conceatration is 101 mg/1 above the natural background.

2020 when compared with the present impact, both measured in
terms of leachate volume and dissolved solids concentration,
indicate that the present impact on groundwater quality is
already a substantial proportion of the ultimate level.
c. Currently, results of chemical analysis show the total nitrogen content
of the groundwater as in the range of 2.3 to 2.5 ppm. A projected
incremental increase using Dr. Todd's expected 8.6 percent would result
in a range of 2.4 to 2.7 ppm. Current Federal and State drinking water
. standards permit up to 10 ppm.
d. Alternative sewage disposal methods that would not recharge the ground-
water have the following general characteristics:
1. Collector and central treatment systems discharging to surface
waters would require at least tertiary treatment and perhaps more to
obtain a permit for the discharge from the Department of Ecology.
These systems are not currently economically available for this
project.
2. Sealed systems, whether individual or community, depend on
evaporatioa for liquid removal. These systems require more land
area than a conventional subsurface drainfield. Some, such as
lagoons, have safety hazards associated with them and relatively
poor community acceptance. Land, installation and operational cost
are generally more expensive than those for septic tanks and
drainfields.
C. Draina~e
The County Utilities Eagineer reports that the preliminary storm drainage plan
submitted by the applicant indicates that on-site storm drainage provisions
will adequately handle surface water runoff. However, final construction
plans should be reviewed and approved prior to the final plat filing.
D. Water Supply
The proposal is located within the recorded service area of Modern Electric
. Water Company.
The District advises the staff that adequate system capacity, and a desire on
their part to serve, exists for the provision of water for domestic, fire and
irrigation uses.
E. Fire Protection
The proposal is situated within the recorded service area of Spokane County
Fire Protection District #1.
The Fire District staff requests that the Hearing Examiner Committee require
mains and hydrants of sufficient size for fire protection as a conditioa of
final plat approval. The District also requests that they be allowed to
review aad approve final water plans and fire flows.

F. Schools
Proposal lies within the boundaries of Central Valley School District #356.
G. Parks
The report "Planning for Parkst" (revised 1976) indicates that the plat lies
within the McDonald neighborhood and has a 6 acre park requirement that the
park is proposed to be located adjacent to or in the vicinity of McDonald
Elementary School.
H. Unique Environmental Features
None have been indentified.
I. Cultural Resources
None have been indentified.
III. Z4NING ANALYSIS
The project site is currently zoned Residential Office and therefore would require
no zone change. The zone change on this property was approved on November 13,
1978. Certain conditioas were attached with the approval dealing generally with
street improvements, height limitation of 2 stories, light and sigaing approval by
Zoning Administrator, specific landscape plans and provisions for maintenance and
sewage disposal approval for sewerage.
IV. ENVIRONMENTAL REVIEW
An Environmental Checklist was submitted by the sponsor and has been reviewed by
the Planning staff. No significant adverse environmental impacts were judged to
exist.
Slight adverse eavironmental impacts were identified on the checklist in the
following categories: earth; air; water; flora; fauna; noise; light and glare;
land use; population; housing; transportation/circulation; public services;
utilities and energy.
The Planning Director issued a proposed Declaratioa of Non-Significance, and it was
circulated to other agencies of jurisdiction.
V. CONDITIONS:
If approval is granted, the following conditions are recommended.
NOTE: Any amendments to said conditions are stated separately and listed
hereafter.
1. That the plat be designated as indicated on the preliminary plat of record
and/or attached sheets as noted.

2. That a statement be placed in the dedication to the effect that no more than
one dwelling structure be placed on any one lot, nor shall any lot be further
subdivided for the purposes of creating additional lots or building sites
without filing a replat.
3. That the plat provide for right of way width for streets as indicated on the
preliminary plat of record.
4. That appropriate provisioa be made that the following described property be
held in trust until the continuation of the streets be dedicated or deeded: A
1' strip at the ends or edges of all streets that terminate or border the plat
boundary. (Temporary cul de sacs are required when streets terminate at the
plat boundaries.)
5. That appropriate street names be indicated.
6. That appropriate utility easements be indicated on copies of the approved
preliminary plat for distribution to the Planning Department and the utility
companies. Written approval of the easements by the utility company must be
received prior to the submittal of the final plat.
7. That the plan for water facilities adequate for fire protection be approved by
the water supplier and fire protection district. Said water plan must also
have been approved by the appropriate health authorities. The health
authorities, water supplier (purveyor), and fire protection district will
certify, prior to the filing of the final plat, on the face of said water plan
that the plan is in conformance with their requirements and will adequately
satisfy their respective needs. Said water plan and certification will be
drafted on a transparency suitable for reproduction.
The purveyor will also certify prior to the filing of the final plat on a copy
of said water plan that appropriate contractual arrangements have been made
with the plat sponsor for constructioa of the water system, in accordance with
the approved plan, and in accordance with a time schedule. The time schedule
will provide, in any case, for completion of the water system aad inspection
by the appropriate health authorities prior to application for building
permits within the plat. The contractual arrangements will include a
provision holding Spokane County aad the purveyor harmless from claims by any
lot purchaser refused a building permit due to the failure of the plat sponsor
to satisfactorily complete the approved water system.
The plat dedication will contain a statement to the effect that the public
water system as approved by County and State Health authorities aad the local
fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot.
8. That a certificate of title be furnished the Planning Department prior to the
filing of the final plat.
9. That the preliminary plat be given conditional approval to July 1, 1980.
10. That a declaration of Non-Significance be issued, in accordance with
Section 11.15.340 of the Spokane County Environmental Ordinance (SCEO) prior
to approval, or any approving action in accordance with SCEO 11.15.340.
NOTE: The official file contains an environmental checklist for the
proposal and a staff review of their checklist as required by
wac 197-10-320.

11. That conditional approval of the plat is given subject to the dedication of
right of way to the public an.d approval of the road system in the plat by the
County Engineer.
12. That plans, profiles, and cross sectioas showing proposed street centerline
and curb grades be submitted to the County Engineer for approval prior to
construction and the filing of a final plat.
13. The drainage plans and design calculations showing the grades and alignment of
drainage facilities be submitted to the County Engineer for approval prior to
construction and the filing of a final plat.
14. Construction within the proposed public streets and easements shall be
performed under the direct supervision of a licensed land surveyor, who shall
be responsible for perpetuating all evidence of the location of survey
monuments which may be distrubed during construction and who shall furnish the
County Engineer with "As Built" plans and a certificate in writing that all
improvements were installed to the lines and grades shown on the approved
construction plans and that all disturbed monuments have been replaced.
15. No construction work is to be performed with the Public Right of Way until a
permit has been issued by the Couaty Engineer. All Work is subject to
inspection and approval bp the County Engineer.
16. All coastruction within the Public Right of Wap is to be completed prior to
filing the final plat or a bond in the amount estimated by the County Engineer
to cover the cost or construction of improvements, construction certification,
"As Built" plans, and monumenting the street centerlines, shall be filed with
the County Engineer.
17. That a name be indicated before the final plat is filed; such name to be
approved by the County Assessor and the Plaaning staff.
18. That each lot be authorized for the use of individual on-site sewage disposal
systems.
19. Prior to filing of the final plat, the sponsor shall present evidence that the
plat lies within the recorded service area of the proposed water.district.
Special Conditions
20. That the provisions of SEPA'S NOTICE OF ACTION pursuant to 43.21C.080 RCW and
the Board of County Commissioner's Resolution No. 77-1392 be accomplished by
the project applicant within thirty (30) days of formal action by the Hearing
Examiner Committee, with regard to the preliminary plat approval; as
instructed by the Planning Department staff.
21. That the project sponsor is responsible for requesting an extension of time to
review any preliminary plat approval. All extensions applied for may subject
the project sponsor to new conditions required by Reviewing Agencies.
22. That the Hearing Examiner Committee sustain the issuance of a proposed
Declaration of Non-Significance and recommends issuance of a final Declaration
of Non-Significance.

23. That a public water system serviced by Modern Electric Water Company, and
including fire flows, serve each lot prior to the sale of the lot.
24. That final construction plans for on-site storm drainage facilities be
reviewed and approved prior to filing of the final plat by the County
Utilities Engineer and the County Health District.
25. That the plat dedication contain the statement: "Use of private wells and
water systems is prohibited.
26. Existing County roads providing direct access to the plat shall be paved and
curbed to the standards of the County Engineer.
27. That the owner, his grantees and assigns agree to participate in and not
oppose or protest an RID on 12th Avenue.
28. The plat dedication will contain a statement to the effect that: "The public
water system as approved by County and State Health authorities and the local
fire district and purveyor will be installed within this plat, and the
subdivider will provide for individual domestic water service as well as fire
protection to each lot prior to sale of each lot".
29. Appropriate utility easements shall be indicated on copies of the preliminary
plat of record for distribution by the Planning Department to the utility
companies, County Eagineer and Spokane County Health District. Written
approval of the easements by the utility company must be received prior to the
submittal of the final plat. (Note: The first sentence is superfluous if the
easements are shown on the preliminary map as required by Ordinance Chapters 5
and 6.
30. Improvements to Spokane County standards of 12th Avenue and Pines Road along
the project perimeter. Improvements shall include:
Along 12th Avenue: Curbs, sidewalk, drainage control and paving to existing
paving.
Along Piaes Road: Sidewalk.
31. Access permits for the advertised property shall be obtained from the Spokane
County Engineer's Office prior to release of building permits. NOTE: The
Spokane County Engineer has recommended that the applicant vacate 13th Avenue.
32. No strccture on the premise shall exceed two (2) stories in height.
33. Any portion of the project which is to be occupied or traveled by automobiles
shall be maintained in hard surface paving.
34. An on-site storm drainage system shall be approved by the Spokane County
Engineer's Office prior to release of building permits for the project.
35. Approval by the Spokane County Zoning Administrator of a lighting and signing
plan for the advertised property.

The above-entitled matter coming on regularly for hearing before the Board of
County Commissioners of Spokane County, Washington, on this day, and it
appearing to the Board that the Spokane County Planning Commission has given
due notice of the hearing on the matter in the manner and for the time provided by
law; that said Planning Commission has held a public hearing as required; and
that the said Planning Commission concurs in the plan to zone the following
described property as:
RESIDENTIAL OFFICE:
The North 1/2 of that portion of the Wes.t 1/2 of Tract 215 of Opportunity lying south
of the south lfne of 12th Avenue, except from said North 1/2 the East 100 feet of
North 130 feet thereof, and except the East 10 feet of the South 30 feet of the North
160 feet thereof, and except that part, if any, conveyed to State of Washington for

ENVIRONMENTAL CHECKLIST
IntrodUCtion: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW,
requires all state and local governmental agencies to consider enviconmental values
both for their own actions and when licensing private proposals. The Act also requfres
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", as per WAC 197-10) affecting the quality of the environment. ThE
purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a ma jor action.
Please answer the following questions as completely as you can with the information
presently available to you. Please answer questions as "yes" ar "maybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist wili be
aware of and concern themselves with the deQree of impact, asking you for more informa-
tion, if necessary. Where explanations of your answers are required, or where you
believe an explanation would be helpful to goverrment decision-makers, include your
explanation in the space provided, or use additiondl pa ec,s, if necessary. You should
include references to any reports or studies of which you are aware and which are
relevant to the answars you provide. Complete answers to these questions now will
help all agencies involved with your proposal to undertake the required environmental
review without unnecessary delay.
The following questions apply to your total proposal, not iust to the license for which
you are currently applying or the proposal for which approval is sought. Your answers
should include the impacts which will be caused by your proposal when it is completed,
even though completion may not occur until sometime in the future. This will allow all
of the agencies which will be involved to complete their environmental review now,
without duplicating paperwork in the #uture.
No application shall be processed untfl the checklist has been completed and returned
to the appropriate County department. State law reQuires explanations for everv "ves"
and "maybe" answer on the checklist, The person completing the form may be required
to provide explanations for "no" answers, and in some cases, more detailed information
to aid in a threshold determination.
NOTE; This is a standard form being used by all state and local agencies in the State
of Washington for various types of proposals. Many of the questions may not

I understand that a requesfi {ias been made, and will be considered at your
meeting on May 20th, Friday, for a change in zoning to permit a grocery
store at 12th and Pines Road. If my information is correct, I will not be
able to attend this meeting as my work schedule at the moment will have
me out of town on Friday--and as you well know, the paycheck pays the

Our home is located just west of the property on the northwest corner of
lOth and Pines, so ( have to figure that as goes 12th and Pines--there
olso goes l Oth and Pines. When we began to purchase our home ove►- 15
years ago, only single family dwellings were evident in the whole area on
Pines from the railroad tracks south to 16th. Grodually since then, severa)
steps have changed the environ of the enfiire area. Firstly, multiple family
units were permitted, secondly, minor business types were ollowed--such as
3 real estate offices, a bank, two churches, a funeral home, and a photogiaph
studio. We assumed that the limited hours of normal operation and type of
business would not be too difficult to live with; and that commercialization wds
not the plan for our immediate area.
lf the present trend conti nues, where do we who purchased property i n good
faith as residential expect to end up? I cannot help but feel that the
determination made on the southeast corner of 12fih ond Pines wi II also apply
to the northwest corner of lOth and Pines in the near fufiure--and, hey, that
is my east property line--so I think I should be concerned. I find it hard to
understand the fairness of the changing of zones to enable a few owners,

promoters, or rea I estate operators to make a f i ncancia l gai n at the expense of
the existi ng tax payi ng home-owners.
In this case the request is for chonge to accommodate another grocery stnre--
please drive Pines north from lbth and look for grocery sfiores. At lbth, we
have Capp's IGA; at Pi nes Square, we have a 7-1 t- at Sprague, we now have
the Scifeway with the new Albertson's to be bui It across the street; near Boone,
we have the derelict of the old R & L or Jamieson's Thrift. Some of these
offer either 24 hour or extended hour service and at present I have no fear of
starving to death if only I can continue to poy the prices--so we need another
grocery st+ore, why?
On this occasion it is only a little request for change for a grocery store,
what wi II the next little change be for? If my area is one on the block to
go commercial because of its location near a state highway, please be good
enough to let me know and I' II see if a change to commercia( for my home
would be fi nancial ly advantngeous to me ond I' II plan to fi nd other quarters
fo r my res i dence.

zoned area and moved to our present location in the 12500 block
on East 15th. We picked an attractive residential area Vrhere every-
one took pride in their homes, hoping that the quality of the
neighborhood would remain unchanged. Now, it seems, this quality
is being threatened. If this area is rezoned to commercial or
business (or multiple dwelling, for that matter) a change is bound
to take place. Hlthough I'm sure the "family type corner nroc,
in itself would not be such a detriment, it is - be(li nni ng of the downgradi ng of the nei,_ Please consider the property owners, mari;
people who have worked many years to obtain a home of whirh
t►iey can be proud, and hopefully where they can retire.

so that all can understand the exact location of such rezoning

Dear Sir;
My name is Ron Matteson and I live at 1313 S. Reeves Rd. in the
Ualley.
It has been brought to my attention that a proposal for seZOning
of a 1.9 acrre site on the southeast corner of Pines Rd. is up
for consideration May 20th. at a public hearing. The purpose of
the rezoning is to permit a grocery store to be built on this site.
As I only live 4 blocks from this proposed site I feel it Within
my ,jurisdiction to oppose this rezoning With the folloWing reaseons.
1. I don't feil it necessary to have another grocery store Within
the feW blocks of one at 16th. and Pines and the 3 others Within the
12 block radius to the north.
2. Traffic on Pines Rd. has increased at a trmendous rate the last
12 years that I have lived at the above adress creating a someWhat of
a hasadous situation to the residents Who algeady live and travel
that line of travel to and from Work. For example: The intersectmon
at 16th. and Pines has been the scene of numerous accidents in the
past feW years due to the eccesive speed at Which the traffic f1oWs
north and south on Pines @d/ With no traffic lights or traffic
control aouth of Sprague out HiWay 27 until you reach a caution
light at 32nd. St. I put this Question before you as to When a
traffic count as to the number of cars Which travel this hiWay in
a given day has been taken? I can not remember one bein taken in the
last five years yet can seewhA temendous builaiing of homesites in
the area from 6th. street on south has transpired.
If Pines rd. Were to be rezoned Commercial from Trent to 32nd. We
Would be looking at another Oivision St. Within the next 5 to 10
years. Traffic dividers, Limited parking facilities, a complete
evacuation of all residential dWellings on Pines Rd. With the State
Hiway dept. having to maintain this route With the limited funds
from Which they have to Work. It Was stated in our Valkgy Herald
just a short time ago that it Would be at least tWO years before a
teaffic light could be installed at 16th. and Pines Rd. Check
With our own County Sherrifs dept. to see if they do not occasionaly
place radar cars on this route to try to keec, the traffic f1oW to
a legal speed.
I, being unable t: attend this hearing do submit this letter as
my opposition to the rezoning of any more portion of Pines Rd.

I am writing to protest the Aroposed zoning chgnge whi&,
would effect Pines Rd., narticularl,,y the area of 12th and Pir:es
which is currently under consl3.eration for rezoning to allow
a supermarket or shopping complex to be constructed. If such a
mdrket where constYucked it would be bound on the east by residental
2,re*s. This ;ioes not seem compatable with maintaining the
qua'liby, of ='li-f~e,- let alone improvin2 it, in the area. On pines Rd.
betxeen Sprague Ave. and Sixteenth Ave. there are currently three
groclry st,ores with another one scheduled for construction. It seems
that ve ~arer,not lacking shopving facilities. I recognize that
-rice Pines Rd. has become an arterial to the point where it joins
y, 27;4t $ixtee-nth, it is no longer a desirable location for
c<,.-:strU6ing."new single family dwellings. It appears to me that
rezor.qing to allow nrofessional offices such as those wr.ich are ~
located in the area of Pines Ad. and Broadway would be desirable.

I am also concerred about the method of r_otification that
is necessary wren a zone change is to be considered. A small
sign on a local teleDhone post hardly seems adequate. A printed ~
notice in the local newspapers including a map of the erea
to be considered would make more Deople aware of what is hapDening
in areas effecting them and allow them to help make decisions
concerning their neighborhoods.
Since I will be unable to attend the Friday meeting pf
th.e Planning Commisssion, I would apnreciate it if you would make

Gentlemen:
This letter is prompted by the proposed rezoning of land
in the Va11ey around the 1200 block of South Pines Road.
As a homeowner in the area of the proposed rezoning, I
understand that the purposed for the change would be to
enable developers to construct another shopping center.
With Opportunity Shopping area and University City Shopping
Mall a11 within two (2) miles or less radius, I find it
difficult to justify the construction of yet another
facility of this nature. I am opposed to such construction
in a basically residential section of the Valley.
Also as a homeowner in the area of the proposed rezoning,
I would like to be thoroughly knowledgeable and informed
as to the Commission's formal notification and procedure
on this proposal.

This office is in receipt of the agenda of your April 15, 1977 Planning
Commission meeting and would comment on the following item:
ZE-34-77
This off ice would strongly recommend the orientation of any type of
development so that access is onto 12th Avenue and not Sign Route
27. Long range plans developed by the Spokane Regional Planning Con-
ference indicate a significant demand on SR 27 for capacity which
would require as much non-interference to traffic as possible; thus
any direct access onto Pines Road would not be desirable. This office
is contemplating physical curbing so that access will be right turn
only into and out of private access points.
