The development will be ]ocated in the Spokane Valley and consists of seventeen (17) apartment units. The Board of DiXectors of Central Valley School District has adopted a resolution which directs the administration to take necessary action to mitigate impacts upon the School District created by housing developments. The authority for this action is SEPA, RCW 82.02.020 and RCW 58.17.110. Under these statutes, the County, prior to approvi.ng a subdivision, must determine whether adequate provisions exist for public school service. The Central Valley School District has determined that added dwellings envisioned by this change of conditions will adversely impact the District's ability to provide adequate student housing. We ask that Spokane County not approve this change of conditions unless the developer and- Central Valley School District agree to voluntary means of mitigating its adverse impact on the Central Valley School District. The School District seeks a fee or other measure which would mitigate the impact by partially funding cost of space to adequately house students residing in the proposed new housing. This determination is based on the following: 1. The District's elementary schools are overcrowded. We are cunently using portable facilities. We have need for additional classroom space. 2. Enrollment projections indicate that the capacity of our schools to house students will continue to be exceeded. Enrollment pxojections are based on a cohort survival model which predicts future enrollment based on the past three years' enrollment growth by grade level. 3. A number of housing developments have been submitted for preliminary plat approval within the Central Valley School District during the past three years. Many of these approved developments have not been completed. The development will be located in the Spokane Valley and consists of seventeen (17) new apartment units. The Board of Directors of Central Valley School District has adopted a resolution which directs the administration to take necessary action to mitigate impacts upon the School District created by housing developments. The authority for this action is SEPA, RCW 82.02.020 and RCW 58.17.110. Under these statutes, the County, prior to approving a subdivision, must determine whether adequate provisions exist for public school service. The Central Valley School District has determined that added dwellings envisioned by this zone reclassitication will adversely impact the District's ability to provide adequate student housing. We ask that Spokane County not approve this zone reclassification unless the developer and Central Valley School District agree to voluntary means of mirigating its adverse impact on the Central Valley School District. The School District seeks a fee or other measure which would mitigate the impact by partially funding cost of space to adequately house students residing in the proposed new housing. This determination is based on the following: 1. The District's elementary schools are overcrowded. We are currentlv using portable iacitities. We have need for additional classroom space. 2. Enrollment projections indicate that the capacity of our schools to house students will continue to be exceeded. Enrollment projections are based on a cohort survival model which predicts future enrollment based on the past three years' enrollment growth by grade level. 3. A number of housing developments have been submitted for preliminary plat approval within the Central Valley School District during the past three years. Many of these approved developments have not been completed. Proposed Buffering/Landscaping Techniques: The proposed landscaping meets the requirements of the Zoning Code with a twenty (20) foot wide strip of Type III landscaping along Third Avenue and five (5) feet of Type III landscaping along the east, west and south property lines. The site plan also illustrates a six (6) foot high sight obscuring fence along that portion of the south property line which abuts the parking area. Other Site Plan Considerations: The site plan submitted generally conforms to the development standards of the existing Urban Residenrial-22 (UR-22) zone. The site plan submitted for review by the Hearing Examiner Committee is general in nature. Detailed review to determine compliance with all Code regulations and conditions of approval is recommended to be administrative and to occur at the Building Permit stage. I. Density: The proposed density is approacimately 26 units per acre. The Urban Residential-22 (UR-22) zone allows 22 units per acre which may be increased through bonus densities as pennitted under Chapter 14.820 of the Spokane County Zoning Code. The maximum density pemutted for this proposal is 17 units. A public sewer will be made available to the project and the Va11ey Transit Center and University City Mall are within 1/4 mile walking distance as required by Chapter 14.820: Bonus Density for Sewer Hookup. Summagy; Under the existing Urban Residential-22 (UR-22) density guidelines, the site could be developed with 14 units per acre. The proposed 17 units per acre is consistent with the bonus density provisions of Chapter 14.820. J. Drainage: A drainage plan is required. This plan must be reviewed and approved by the County Engineer's Department prior to development. K. Power Transmission Lines/Other Known Easements: The site plan submitted does not illustrate any easements. Any required or recorded easements will be disclosed during the building permits process. L. Water Supply: The proposal is within the Modern Electric Water District. N. School: The proposal is in the Central Valley School District No. 346. The Central Valley School I?istrict has responded to the proposal and is requesting that the applicant enter into a voluntary agreement to mitigate the impact of the proposal on the school distiict. This request is included as a condirion of approval. 0. Fire Protection: The proposal is within Fire District No. 1. The Fire District and the Division of Buildings Deparament (Fire Marshall) are required to approve fire protection provisions prior to the issuance of building permits. P. Wetlands: Spokane County Wedand Inventory Maps do not indicate the presence of wedands on the site. Q. Cultural Resources: None have been identified. R. Transit: The proposal is located within the Public Transit Benefit Area (PTBA) boundary. The Valley Transit Center is located west of the site at University Road and Fourth Avenue. III. ENVIRONMENTAL REVIEW: An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning Department. The review considered the specifics of the proposal, other available information, County ordinances, other regulations and laws, possible standard Conditions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Planning Department has deternuned that "No probable significant adverse impacts" would result from the proposal being developed and has issued a Detemunarion of Nonsienificance ("DNS"). The "DNS" was circulated to 12 other agencies of jurisdiction and other agencies/ departments affected by the future development for review and comment. The "DNS" comment period ends October 19, 1993 and was advertised 15 calendar days before said date in the newspaper, by letter to adjacent property owners within 400 feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing Examiner may consider additional environmental related testimony at the public hearing. I V. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION The proposed Change of Conditions is consistent with the development standards of the Urban Residential-22 (UR-22) zone and the Goals, Objectives, and Decision Guidelines of the Urban category of the Comprehensive Plan. Public services available to the proposal support the increase in density pursuant to Chapter 14.820; Bonus Density for Sewer Hookup. The proposed density could be considered compatible with developments in the area and provide "fill-in" development. A specific landscape plan, planting schedule and provisions for maintenance acceptable to the Planning Director/designee shall be submitted with a performance bond for the project prior to release of building permits. Landscaping shall be installed and maintained so that sight distance at access points is not obscured or impaired. 5. Direct light from any exterior area lighting fixture shall not extend over the property boundary. 6. The Planning Department shall prepare and record with the Spokane County Aud.itor a Title Notice noting that the properry in question is subject to a variety of special condirions imposed as a result of approval of a land use action. The design, location and arrangement of parking stalls shall be in accordance with standard traffic engineering practices. Paving or surfacing as approved by the County Engineer, will be required for any portion of the project which is to be occupied or traveled by vehicles. 4. The construction of the road improvements stated herein shall be accomplished as approved by the Spokane County Engineer. 5. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. Debris generated as a result of this project must be disposed of by means other than burning (construction waste, etc.) 6. All solid fuel burning devices (wood stoves, pellet stoves, etc..) must comply with local, state, and federal rules.
