e. Surface soils are clasaed by the U.S. Soi-1 Conservation Service as
Garrison gravelly loam with 0$ to 5$ slope9. They have a septic
tank filter field limitation of slight. There is al.so possible
contamination of qroundwater. This s'oil would be classified as a
Type II I . ° '
f. Geologically, the soile are qlaciofluvial deposits. These
geolocjrical structures generally yield moderate to very large amounts
of watei. Data from wells in the area referenced in -section lf
shows they are from 80' to 250' d"eep and have static water levels varying from 50' to -165' below the surface. The Modern 8lectric
Water Co. has indicated that it can 9upply domeatic use water for
the project upon. completion of agreements with the proponent.
3. Required (mandatory) Conditions If Approved: - '

Utilities, Spokane County.
b. Water service shall be coordinated through the Director of -
Utilities, Spokane County.
c. Water service ehall be by ar► existing public water 'supply when

Health. d. A public sewer system will be made available for the project and
individual aervice will be provided to each lot prior to sale. Use

Recommendations are as circled:
1.) Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use of on-
site sewer disposal systems is hereby authorized. This authorization is conditioned in
compliance with all rules and regulations of the Spoka.ne County Health District and
is further conditioned and subject to specific applfcation approval and issuance of
permits by the Health District.
2.) The Owner(s) or Successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a ULID by petition method pursuant to RCW
36.94 which the petition includes the Owner(s) property and further not to object by
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW 36.94 which includes the Owner(s) property. PROVIDED, thfs
condition shall not prohibit the Owner(s) or Successor(s) from objection to any
assessment(s) on the property as a result of fmprovements called for in conjunction with
the formation of a ULID by either petition or resolution under RCW 36.94.

3.) Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4.) There are no recommendations concerning the method of sewage disposal as the project
is outside of the 201 sewer study area.
5.) Water service as approved by the Spokane County Health District and/or Washington
State Department of Social and Health Services.
6.) Each dwelling unit shall be double plumbed for connection to future axea-wide
collection systems.
7.) A dry sewer connection to the future area-wide Sewerage System is to be constructed.
Plans and specifications for the dry sewer connection are to be reviewed and approved
by the Utilities Department.
8.) Located within the Critical Water Supply Service Area but not within any purveyor's
district. May be serviced by an individual well owned and operated by the lot owner.
9.) Any sewerage service for this project shall be provided in accordance with the
Comprehensive Wastewater Management Plan for Spokane County, as amended.
10) Sewerage facilities are not affected by this proposal therefore no recommendation.
11 Applicant will make connection to Public Sewer System. Sewer Connection Permit is
required. Plans and Specifications are to be reviewed and approved by the Utilities
Department.
12) This project lies within the Sewer Service Area. Applicant us
required to notify them of this proposal.
13) Applicant is required to sign a Developer Connection Agreement.
14) Individual service should be provided to each lot, but if a single stub is to be shared, a
maintenance agreement must be approved by the County.

Dear Ms. Bjordahl:
This letter is in response to your request for comments regarding DNS for ZE-130B-78. The
development will be ]ocated in the Spokane Valley and consists of seventeen (17) apartment
units.
The Board of DiXectors of Central Valley School District has adopted a resolution which directs
the administration to take necessary action to mitigate impacts upon the School District created
by housing developments. The authority for this action is SEPA, RCW 82.02.020 and RCW
58.17.110. Under these statutes, the County, prior to approvi.ng a subdivision, must determine
whether adequate provisions exist for public school service.
The Central Valley School District has determined that added dwellings envisioned by this
change of conditions will adversely impact the District's ability to provide adequate student
housing. We ask that Spokane County not approve this change of conditions unless the
developer and- Central Valley School District agree to voluntary means of mitigating its adverse
impact on the Central Valley School District. The School District seeks a fee or other measure
which would mitigate the impact by partially funding cost of space to adequately house students
residing in the proposed new housing. This determination is based on the following:
1. The District's elementary schools are overcrowded. We are cunently using portable

site sewer disposal systems is hereby authorized. This authorization is conditioned in
compliance with all rules and regulations of the Spokane County Health District and
is further conditioned and subject to specific application approval a.nd issuance of
permits by the Health District.
2.) The Owner(s) or Successor(s) in interest agree to authorize the County to place their
name(s) on a petition for the formation of a ULID by petition method pursuant to RCW
36.94 which the petitfon includes the Owner(s) property and further not to object by
signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW 36.94 whfch includes the Owner(s) property. PROVIDED, this
condition shall not prohibit the Owner(s) or Successor(s) from objection to any
assessment(s) on the property as a result of improvements called for in corjunction with
the formation of a ULID by either petition or resolution under RCW 36.94.
3.) Any water service for this project shall be provided in accordance with the Coordinated
Water System Plan for Spokane County, as amended.
4.) There axe no recommendations concerning the method of sewage disposal as the project
is outside of the 201 sewer study axea.
5.) Water service as approved by the Spokane County Health District and/or Washington
State Department of Social and Health Services.
6.) Each dwelling unit shall be double plumbed for connection to future area-wfde
collection systems.
7.) A dry sewer connection to the future area-wide Sewerage System is to be constructed.
Plans and specifications for the dry sewer connection are to be reviewed and approved
by the Utilities Department.
8.) Located within the Critical Water Supply Service Area but not within any purveyor's
district. May be serviced by an individual well owned and operated by the lot owner.
9.) Any sewerage service for this project shall be provided in accordance with the
Comprehensive Wastewater Management Plan for Spokane County, as amended.
10) Sewerage facilities are not affected by this proposal therefore no recommendation.
DO Applicant will make connection to Public Sewer System. Sewer Connection Permit is
required. Plans and Specifications axe to be reviewed and approved by the Utilities

This letter is in response to your request for comments regarding ZE-130B-93. The
development will be located in the Spokane Valley and consists of seventeen (17) new apartment
units.
The Board of Directors of Central Valley School District has adopted a resolution which directs
the administration to take necessary action to mitigate impacts upon the School District created
by housing developments. The authority for this action is SEPA, RCW 82.02.020 and RCW
58.17.110. Under these statutes, the County, prior to approving a subdivision, must determine
whether adequate provisions exist for public school service.
The Central Valley School District has determined that added dwellings envisioned by this zone
reclassitication will adversely impact the District's ability to provide adequate student housing.
We ask that Spokane County not approve this zone reclassification unless the developer and
Central Valley School District agree to voluntary means of mirigating its adverse impact on the
Central Valley School District. The School District seeks a fee or other measure which would
mitigate the impact by partially funding cost of space to adequately house students residing in
the proposed new housing. This determination is based on the following:
1. The District's elementary schools are overcrowded. We are currentlv using portable
iacitities. We have need for additional classroom space.

classification of the subject property. Although the area south of the proposal is zoned
UR-22, single family residences are located adjacent to the south. Based on the
adjacent land use to the south, the Planning Department will recommend development
restirictions to mitigate potenrial impacts to the existing single family residences. This
will include the installation of landscaping and limitarion of maximum building height.
2. CQiVIPREHENSIVE PLAN:
The proposal is located within the Urban category of the Comprehensive Plan which
supports intensive residential development as proposed.
3. DENS ITY B ONUS :
The proposal has a public sewer system available, is wi[hin 1/4 mile walking distance
of public transit ; and has off-site shopping facilities within 1/2 mile walldng distance.
The Planning Department will recommend approval of the density bonus far an
additional three (3) units.
4. SZTE PLAN DESIGN/ZONING CODE:
The site plan is generally in confonnance with the development standards of the Urban
Residential-22 (UR-22) zone. The structure shall be located a miniznum of 25 feet from
Third Avenue and a minimum 15 feet from the rear property line. The number of
parking stalls illustrated exceeds the minimum required by the Zoning Code. The
applicant may wish to consider eliminating some of the stalls along the south property
boundary so as to lessen the impact of traffic circulation on the adjoining single farnily
residences The Planning Department w711 also recommend to the Hearing Examiner
Committee that landscaping along the southern property line be increased to Type I and
also increased in width.

This matter has come before the Hearing Exami.ner Committee on October 21, 1993.
The members of the Committee present are Phil Harris, Chairperson, Verona

PROPOSAL
The sponsor, George Paras, requests approval of a Change of Condinons to allow
bonus density, File No. ZE-130B-78, to exisring Urban Residential-22 (UR-22) zone
and within the Aquifer Sensltive Area (ASA) Overlay Zone.
FINDINGS OF FACT AND CONCLUSIONS
1. The property is generally located south of and adjacent to Third Avenue,
approximately 600 feet east of University Road in the NW 1/4 of Section 21,
Township 25 North, Range 44 EWM, Spokane County, Washington.
2. The committee adopts the Planning Department Report ds a part of this record.
3. The existing land uses in the area include single family residences, apartments, Valley
Transit Center and commercial uses.
4. The proposed use is compatible with existing uses in the area.
5. The Comprehensive Plan designates this site as Urban. The Urban category is
intended to provide the opportunity for developmeilt of a"city-like" environment
which includes various land uses and intensive residential development.
6. The existing zoning does implement and conform to the Comprehenslve Plan

surfacing as approved by the County Engineer, will be requu-ed for any portion of
the project which is to be occupied or traveled by vehicles.
4. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
5. All required improvements shall conform to the current State of Washington
Standard Specif-ications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise

SPOKANE COUNT'Y AIR POLLUTION CONTROL AUTHORITY
l. All air pollution regulations must be met.
2. Air polluaon regularions requue that dust emissions during demolinon, consrruction
and excavation projects be controlled. This may require use of water sprays, tarps,
sprinklers or suspension of activlty during certaxn weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen matenal must be
controlled, as well as errussions from all other construcaon-related activities.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved

public services including water, sewer, transit and other services available.
2. Arterial Road Ptan: The site is adjacent to Third Avenue which is
identified as a Local Access Street by the Spokane County Arterial Road
Plan. The County Engineer is not requesting dedication or Future
Acquisirion Area (FAA) for this proposal. The nearest arterials are Fourth
Avenue and University Road which are designated as a Collector Arterial
and Principal Arterial respecrively.
3. County Parks Plan: The Spokane County Parks and Recrearion Plan
idenrifies Castle Park and Balfour Park as the nearest park facilities. Castle
Park is located approximately 2 miles south of the site at University and
33 rd Avenue. Balfour Park is located northwest of the proposal at Balfour
and Main.
C. Site Characteristics: The site is undeveloped and covered with deciduous
trees, weeds and brush.
D. Neighborhood Characteristics: The sunounding area consists of multi-
family, single family, and commercial uses. The Valley Transit Center is also
located west of the proposal at the University Road and Fourth Avenue
intersection. University City Mall is located northwest of the site along Sprague
Avenue and University Road.
E. Zoning Analysis: This site and the surrounding area comprising

developed. The average densiry of existing muld-family uses in the area is
approximately 22 units per acre which is lower than the proposed density of 26
units per acre. Although the project proposes a higher density than those
established in the area, multi-family uses at various densiries may be found
- compatible.
T'he area west of the proposal along University Road is zoned for commercial
uses and the areas to the north, east and south are generally zoned for residential
uses including single family, duplexes and multi-family.

F . Land Use Analysis:
The existing land uses in the area are residential, nonresidential and commercial.
Residenrial uses are primarily apartments and condominiums. Single family
residences are also located south of the proposal along Fourth Avenue. The
Valley Transit Center is located west of the site and commercial uses including the
University City Mall are located northwest of the site. Nonresidential uses in the
area include professional offices and a retirement home.

G. Circulation: Third Avenue will provide direct access to the site. Two
ingress/egress approaches from T'hird Avenue are illustrated on the proposed site
plan. All intemal travel ways and parking areas will be paved.
H. Design: The site plan illustrates two (2) structures of approximately 2,000
square feet each. The proposed structure height is 2 1/2 stories. The structures
will be located in the interior of the lot and carports and parking areas will be
located along the east and west property lines. Landscaping will be installed
along all property lines and a benn will also be planted around the perimeter of the

Note: The applicant applied for and received an Administrative Exception (See
AEE-62-93) to permit the 23 foot front yard setback as illustrated.
Proposed Buffering/Landscaping Techniques:
The proposed landscaping meets the requirements of the Zoning Code with a
twenty (20) foot wide strip of Type III landscaping along Third Avenue and five
(5) feet of Type III landscaping along the east, west and south property lines.
The site plan also illustrates a six (6) foot high sight obscuring fence along that
portion of the south property line which abuts the parking area.
Other Site Plan Considerations:
The site plan submitted generally conforms to the development standards of the
existing Urban Residenrial-22 (UR-22) zone.
The site plan submitted for review by the Hearing Examiner Committee is general
in nature. Detailed review to determine compliance with all Code regulations and
conditions of approval is recommended to be administrative and to occur at the
Building Permit stage.
I. Density: The proposed density is approacimately 26 units per acre. The Urban
Residential-22 (UR-22) zone allows 22 units per acre which may be increased
through bonus densities as pennitted under Chapter 14.820 of the Spokane
County Zoning Code. Pursuant to Chapter 14.820, additional units per acre may
be pernutted for:
1) direct hookup to a sanitary sewer ( 3.5 units/acre)
2) availability of public transit within 1/4 mile walking distance (.5 units/acre) ;
3) shopping facilities within walking distance (.5 units/ acre).
The maximum density pemutted for this proposal is 17 units.
A public sewer will be made available to the project and the Va11ey Transit Center
and University City Mall are within 1/4 mile walking distance as required by
Chapter 14.820: Bonus Density for Sewer Hookup.
Summagy;
Under the existing Urban Residential-22 (UR-22) density guidelines, the site
could be developed with 14 units per acre. The proposed 17 units per acre is
consistent with the bonus density provisions of Chapter 14.820.
J. Drainage: A drainage plan is required. This plan must be reviewed and
approved by the County Engineer's Department prior to development.
K. Power Transmission Lines/Other Known Easements: The site plan
submitted does not illustrate any easements. Any required or recorded easements
will be disclosed during the building permits process.
L. Water Supply: The proposal is within the Modern Electric Water District.
Appropriate provisions for connection to a public water system will be required
prior to the issuance of building pernuts.

M. Sewage Disposal: The project will be served by a public sewer system. Plans
and specifications shall be approved by the Spokane County Utiliries Department
prior to the issuance of building permits.
N. School: The proposal is in the Central Valley School District No. 346. The
Central Valley School I?istrict has responded to the proposal and is requesting that
the applicant enter into a voluntary agreement to mitigate the impact of the
proposal on the school distiict. This request is included as a condirion of
approval.
0. Fire Protection: The proposal is within Fire District No. 1. The Fire District
and the Division of Buildings Deparament (Fire Marshall) are required to approve
fire protection provisions prior to the issuance of building permits.
P. Wetlands: Spokane County Wedand Inventory Maps do not indicate the
presence of wedands on the site.
Q. Cultural Resources: None have been identified.
R. Transit: The proposal is located within the Public Transit Benefit Area (PTBA)
boundary. The Valley Transit Center is located west of the site at University
Road and Fourth Avenue.
III. ENVIRONMENTAL REVIEW:
An Environmental Checklist was submitted by the sponsor and was reviewed by the
County Planning Department. The review considered the specifics of the proposal,
other available information, County ordinances, other regulations and laws, possible
standard Conditions of Approval, the Generalized Comprehensive Plan, and other
County policies and guidelines. The Planning Department has deternuned that "No
probable significant adverse impacts" would result from the proposal being developed
and has issued a Detemunarion of Nonsienificance ("DNS").
The "DNS" was circulated to 12 other agencies of jurisdiction and other agencies/
departments affected by the future development for review and comment. The
"DNS" comment period ends October 19, 1993 and was advertised 15 calendar days
before said date in the newspaper, by letter to adjacent property owners within 400
feet of the proposal, and by notice on a sign posted on the proposal site. The Hearing
Examiner may consider additional environmental related testimony at the public
hearing.
I V. PLANNING DEPARTMENT SUMMARY AND RECOMMENDATION
The proposed Change of Conditions is consistent with the development standards of
the Urban Residential-22 (UR-22) zone and the Goals, Objectives, and Decision
Guidelines of the Urban category of the Comprehensive Plan. Public services available
to the proposal support the increase in density pursuant to Chapter 14.820; Bonus
Density for Sewer Hookup. The proposed density could be considered compatible
with developments in the area and provide "fill-in" development. The Planning
Department recommends approval as conditioned.

SPOKANE COUNTY PLANNING DEPARTMENT
1. The proposal shall comply with the Urban Residential-22 (UR-22) zone and
Aquifer Sensitive Area (ASA) Overlay zones as amended.
2. The proposal shall comply with ZE-130-78 and ZE-130-78A conditions of
approval, as herein modified.
3. T'he applicant shall develop subject property generally in accordance within the
concept presented to the Hearing Body. Variations, when approved by the
Planning Director/designee, may be perinitted, including, but not limited to building
location, landscape plans and general allowable uses of the permitted zone. All
variations must conform to regulations set forth in the Spokane County Zoning
Code, and the original intent of the development plans shall be maintained.
4. A specific landscape plan, planting schedule and provisions for maintenance
acceptable to the Planning Director/designee shall be submitted with a performance
bond for the project prior to release of building permits. Landscaping shall be
installed and maintained so that sight distance at access points is not obscured or
impaired.
5. Direct light from any exterior area lighting fixture shall not extend over the property
boundary.
6. The Planning Department shall prepare and record with the Spokane County
Aud.itor a Title Notice noting that the properry in question is subject to a variety of
special condirions imposed as a result of approval of a land use action. This Title

Notice shall serve as public notice of the conditions of approval affecting the
property in question. The Title Notice should be recorded within the same time
frame as allowed for an appeal and shall only be released, in full or in part, by the
Planning Department. The Tit1e Notice shall generally provide as follows:
The parcel of property legally described as [ ] is the
subject of a land use action by a Spokane County Hearing Body or
Administrative Official on Qctober 21, 1993, imposing a variety of
special development conditions. File No. ZE-130B-78 is available
for inspection and copying in the Spokane County Planning
Department.
7. The Owner shall negotiate with the Central Valley School District and submit a
recorded copy of the agreement making appropriate provisions for public schools
prior to the issuance of building permits. The agreement shall provide a written
descriprion of the subject property to which the agreement applies and also state the
dollar amount and any other agreed to mitigating measures.
The Owner shall also notify any potential purchasers who have made an agreement
to purchase said property that pursuant to the Revised Code of Washington
(58.17.205), adequate provisions for school facilities must be made cond.itioned on
a future agreement between the applicant and school district.
Voluntary agreements between the Owner and the School District shall conform to the
requirements of the Revised Code of Washington Chapter
SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS
Prior To Issuance Of A BuildinLy Permit Or Use Of The Pronertv As Pronosed:
1. Access permits for approaches to the county road system shall be obtained from the
Spokane County Engineer.
2. The applicant shall submit for approval by the Spokane County Engineer drainage
and access plans.
3. A parking plan and traffic circulation plan shall be submitted and approved by the
Spokane County Engineer. The design, location and arrangement of parking stalls
shall be in accordance with standard traffic engineering practices. Paving or
surfacing as approved by the County Engineer, will be required for any portion of
the project which is to be occupied or traveled by vehicles.
4. The construction of the road improvements stated herein shall be accomplished as
approved by the Spokane County Engineer.
5. All required improvements shall conform to the current State of Washington
Standard Specifications for Road and Bridge Construction and other applicable
County standards and/or adopted resolutions pertaining to Road Standards and
Stormwater Management in effect at the date of construction, unless otherwise
approved by the County Engineer.

6. Applicant shall construct a paved and delineated approach(s) to meet the existing
pavement on Third Avenue.
6. Roadway standards, typical roadway sections and drainage plan requirements are
found in Spokane Board of County Commissioners Resolution No. 80-1592 as
amended and are applicable to this proposal.
7. No construction work shall be perfonned within the existing or proposed public
right-of-way until a permit has been issued by the County Engineer. All work
within the public road right-of-way is subject to inspe,ction and approval by the
County Engineer.
SPOKANE COUNTY DIVISION OF UTILITIES
1. Applicant will make connecrion to a Public Sewer System. Sewer Corulection Permit is
required. Plans and Specifications are to be reviewed and approved by the Utilities
Department.
SPOKANE COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of Utilities, Spokane
County.
2. Water service shall be coordinated through the Director of Utilities, Spokane County.
3. Water service shall be by an existing public water supply when approved by the
Regional Engineer (Spokane), State Department of Health.
4. A public sewer system will be made available for the project and ind.ividual service will
be provided to each lot. Use of individual on-site sewage disposal systems shall not be
authorized.
5. Use of private wells and water systems is prohibited.
SPOKANE COUNTY DIVISION OF BUILDINGS
1. The applicant shall contact the Department of Buildings at the earliest possible stage
of design/development in order to be informed of code requirements
administeredJenforced by the departinent, e.g., State Building Code Act
regulations, such as requirements for fire hydrant/flow, fire apparatus access roads,
street address assignment, barrier-free regulations, energy code regulations and
general coordination with other aspects of project implementation.
SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
1. All air pollution regulations must be met.
2. Air pollurion regularions require that dust emissions during demolition, construction
and excavation projects be controlled. This may require use of water sprays, tarps,

sprinklers or suspension of activity during certain weather conditions. Haul roads
should be treated, and emissions from the transfer of earthen material must be
controlled, as well as emissions from all other construction-related activities.
3. All traveled surfaces (ingress, egress, parking areas, access roads) must be paved
and kept clean.
4. Measures must be taken to avoid the deposition of dirt and mud from unpaved
surfaces onto paved surfaces. If tracking or spills occur on paved surfaces,
measures must be taken immediately to clean these surfaces.
5. Debris generated as a result of this project must be disposed of by means other than
burning (construction waste, etc.)
6. All solid fuel burning devices (wood stoves, pellet stoves, etc..) must comply with
local, state, and federal rules.

comments to assist the sponsor and aid the processing of public hearing items heard before
the Hearing Examiner Committee. The following informanon does not provide a complete
or binding final review of the proposal. This will occur only after the proposal is accepteci

We respectfully submit this bonus density request, which is a necessity, for
our proposed 17-unit apartment project. The bonus density criteria have been
fulfilled as follows:

Direct hookup to sanitary sewer is available on the proposed lot.

Pence Transit Center is 1/10 mile from proposed lot.
3) Within 1/2 mile of Convenience .5 units
Shopping
Convenience shopping is available within 2/10 mile from proposed lot.

This 17-unit proposal is unique. Where most apar[ments are primarily 2 bedroom
units to optimize rental income, our project consists of mostly 1 bedroom units.
We are trying to meet the demand for lower cost housing. If the purpose of this
project was to optimize rents, it would be designed for 13 - 2 bedroom units and
4- 1 bedroom units containing 30 tenants. This brings light to the fact that we
are asking for a less dense project than normal. Our proposed 11 - 1 bedroom and
6- 2 bedroom project will only house 23 tenants. As you can see there will be
less people as compared to normal circumstances if you figure one occupant for
each bedroom. Even though we are using the bonus density our project is substan-
tially less denae than most apartment projects in the valley.
This project has approval of all adjacent property owners and meets all criteria
set forth by Spokane County. Most notably this proposal "does implement and
conf orm to the comprehensive plan, is compatible with existing uses in the area
and it's use will not be detrimental to the public health, safety, morals or
welfare.
Therefore, in trying to meet the demand for lower income housing, it is absolutely
essential to the feasibility of this project to gain approval of all bonus densities
for three units for a total of 17.
Please find encloaed letters of adjacent and surrounding land owners in favor of
our proposal.
Not only is this project beneficial to the community by providing lower cost units,
we meet all the bonus density requirements for approval.
