HomeMy WebLinkAboutVE-7-89 ZOMNG ADJUSTOR SPOKANE COUNTY, WASHINGTON IN THE MATTER OF A VARIANCE FROM ) SETBACK REQUIREMENTS FOR A ) FINDINGS OF FACT, DETACHED SIGN AND ILLUMINATION ) CONCLUSIONS, STANDARDS [VE•07-89] ) DECISION AND ORDER OPPORTUNITY PROFESSIONAL BUILDING ) PARCEL: 15543-3904 ADDRESS: E. 12805 SPRAGUE APPLICATION DESCRIPTION: Applicanc wishes to allow a free standing sign to be located adjacent to Sprague Avenue and have 800 milliamperes lighting. Section 4.09.125 of the Spokane County Zoning Ordinance requires signs over 40 square feet to be attached to the structure and not extend more than two feet into the front yard. Authority to consider such a rcquest exists pursuant to Chapter 4.25 of the Spokane County Zoning Ondinance. A specific sign design has been submitted to the file which has been accepted as the specific height and size of the sign requested. The sign will not exceed 15 feet in heighG PROJECT LOCATION: Generally located in the Spokane Valley, north of and adjacent to Sprague Avenue and approximately 0.2 miles west of McDonald Road in the SW 1/4 of Secdon 15, Township 25N, Range 44EWM. The property is addressed as East 12805 Sprague Avenue. OPPONENTS OF RECORD: None PUBLIC HEARING: After examining all available information on file with the applicadon the Zoning Adjustor conducted a public hearing on May 2, 1989 and rendered a written decision on May 23, 1989. ' FINDINGS OF FACT AND CONCLUSIONS 1. The proposal is described above. 2. The adopted Spokane Counry Future Land Use Plan designates the area of the pmposal . as Major Commercial. The proposO uses are generally consistent with this category. 3. The site is currendy zoned Local Business. The zoning is proposed to crossover co B-1 in 1991 with the full unplementadon of the Spokane County Zoning Code. The applicant's proposed sign is generally consistent with the B-1 Zone (14.804.100), but not with the cwrent Local Business Zoning. 4. The existing land uses in the area of the proposal are predominantly commercial and professional offices. On each side of the proposal signs have been established consistent with the current proposal. 5. The need for the variance arises due to the exisang signs along Sprague which serve as a basic identifier of businesses. The Zoning Adjustor concludes after a review of the pictures subcnitted by che applicant and an on•site visit that the instant property is diffcult to fnd because itl has no firont yard signage. Addiaocially, the limited signage causes increased accident potential as cars abrupdy stop or slow to turn upoa recognizing the structure. The requested variunce should reduce these unexpected vehicular movements as customers are able to more easily locate the structure seeing the detached sign. 6. The requested variadon would comply with the 1991 Zoning standards for this site, and it would not interfere with the view to adjacent properties. 7. The proposal is exempt from,the provisions of Chapter 43.21C RCW pursuant to WAC 197-11-800 6 (b). 8. The applicant has been made aware of the recomrnendadons of various County/State agencies reviewing this project and has ind.icated he can comply with those recommendarions. ~ r CASE NO. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been meL 11. . Granang the variance will be neither materiaUy detrimental to the public welfare nor injurious to properry or improvements in the viciniry and zone. Strict application of the zoning standards dces create an unreasonable burden in light of the purpose to be served by the standards and present development pauerns in that area. 12. ne grandng of the variance is not the granting of a spocial privilege inconsistent with requirements imposed on other properties, in consideration that in 1991 the ciurent pmposal would be pennitted outright-without nced for any variance. DECISION & ORDER From the foregoing Findings and Conclusions, the Zoning Adjustnr APPROVES the praposal presenced, subject to compliance with the following: CONDITIONS OF APPROVAL 1. GENERAL The following coadiaons shall apply to the applicant, owner and successors in interest and shall run with the land. II. PLANNING DEPARTMENT 1. The sign shall conform to the size and general design as that reviewed and subsequently approved by the Zoning Adjustor at the public hearing. III. DEPARTMENT OF BUILDING & SAFETY 1. A building pennit for a sign structure is requiied. VI. ENGINEERING DEPARTMENT 1. We have reviewed the above referenc:ed applicaaon. The applicant should be advised that the proposed sign must be located and shall not extend into the Counry Road Right-of-way. NOTICE: PENDING COMPLET'ION OF ALL CONDITTONS OF APPROVAL WHICH NEED TO BE COMPLETID PRIOR TO PERMIT ISSUANCE. PERNllTS CAN BE RELEASED PRIOR TO THE LAPSE OF THE TEN (10) DAY APPEAL PERIOD.
