GENERAL PROVISIONS
1 In iLcepting this permit the Grantee its successors and assigns agrees to protect tlic State of Washington and save it
harmless from A1 ctaims actions or damages of every kind and description which may accrue to or be suffered by any
persan or persons corporation ar property by reason of the pertormance of any sucli work character of materials used
or manner of installation maintenance and operation or by the improper occupancy of rights of way or public place or
public structure and in case any suit or action is brought agaiiist said State of Washington for damages aristng out of or by
reason of any of the above causes the petitioner its successors or assigns will upon notice to it or them of commencement
of such action defend the same at its or their own sole cost and expense and wiil satisfy any Judgment after the said suit
or action shall have finally been determined if adverse to the State of Washingtun
2 During the progress of the work such barners shall be erected and maintained as may be necessary or as may be directed
for the protection of the traveltng public the barners shall be properly lighted at night
3 Except as herein authorized no excavation shall be made or obstacle placed within the ltmits of the state highway in such
a manner as to interfere with the travel over said road „
4 IF the work done under this permit interferes in any way with the drainage of the state highway ihe Grantee shall wholly
and at its own expense make such provision as the Department oF Highways may direct to tdke care of said dratnage
5 On completion of said work herein contemplated all rubbtsh and debris shall be immediately removed and the roadway
and roadside shall be left neat and presentdble and satisfactory tn the Department of Hig}iways

ways and the entire expense of said supervision shall be borne by the party or parties to whom ttus permit is issued

rights by the State upon roads streets public places or structures in question

10 The Commission may revoke amend or cancel this permit or any of the provisions thereof at any time by giving wntten
notice to the Grantee The Grantee shall immediately remove all facilities from the nght of way Any facilities remaintng
upon the right of way 30 days after written notice of cancellation shall be removed by the State at the expense of dle

11 The party or parties to whom this permit is issued shall maintatn at its or their sole expense the structure or object for
which this permit is granted in a condition satisfactory to the Department of Highways
12 If the Grantee enters into a contract or agreement with a contractor to perform the work provided herein to be rerformed
by the Grantee the Grantee for itself its assigns and its successors in interest agrees that it will not discriminate on the
basis of race color sex or national ongin in its choice of -ontractors and will include all of the non discrimination
°provisions set forth in AppencLx A from Title VI of the C►vil Rlghts Act of 1964 and Section 162(a) of the Federal Aid
Ac.t of 1973 (23 U S C 324) and as said Regulations may be amended Breach of any of the above non discrirrunation

SPECIAL PROVISIONS
The proposed road approach shall be paved with asphaltic concrete 3-inch compacted
depth
Culvert pipe will not be required under the proposed approach
Asphaltic material placed on the roadside shall be machine spread and rolled wherever
possible Careful attention shall be paid to the drainage pattern Inlet gratings,
valve box covers, etc , shall be adjusted to grade Sufficient pregrading shall be
done to insure a uniform depth of surfacing with the specified sloping Flared con-
nections shall be made to the highway pavement
Highway traffic shall be protected by flagmen whenever any portion of the traveled
surface is obstructed by equipment working on this project
It is unlawful to erect a structure or establishment or maintain a business, the
nature of which requires the use by patrons of property adjoining the structure or
establishment, unless the structure or establishment is so located at a distance from
the right of way of a state 1►ighway that none of the right of way is requlred for the
use of the patrons
All advertising signs shall be placed on private property so that the entire sign shall
be outside the limits of the existing state right of way
All building restrictions established by the Spokane Planning Commission shall be
complied with

Introduction: The State Environmental Policy Act of 1971, Chapter 43.21C, RCW,
requires all state and local governmental agencies to consider environmental valU
both for their own actions and when licensing private proposals, The Act also requires
that an Environmental Impact Statement be prepared for all major actions significantly
(and "adversely", a s per WAC 19 7-10) affecting the quality of the environment. The
purpose of this checklist is to help the agencies involved determine whether or not a
proposal is such a major action.
Please answer the following questions as completely as you can with the information
presently available to you. Please an*swer questions as "yes" or "maybe" if, in your
opinion, even only slight impacts will result. The reviewers of the checklist will be
aware of and concern themselves with the deQree of impact, asking you for more informa-
tion, if necessary. Where explana tions of your answers are required, or where you
believe an explanation would be helpful to government decision-makers, include your
explanation in the space provided, or use additional pacLes, if necessary. You should
include references to any reports or studies of which you are aware and which are
relevant to the answers you provide. Complete answers to these questions now will
help all agencies involved with your proposal to undertake the required environmental
review without unnecessary delay.
The following questions apply to your total proposal, not just to the license for which
you are currently applying or the proposal for which approval is sought. Your answers

A Individual subsurface disposal sewage systems have been proposed for treatment and
disposal of sewage generated within the project This raises the question of significance
of the impact on the groundwater in the area and possible alternaCives for sewage disposal
B In the course of the conduct of the Army Corps study*, Dr Todd considered typical soils,
natural and sewage disposal recharge to the groundwater, and the effect of continued
urban development in the Spokane River Valley upon the quality of the groundwater In
summary, he concluded that
(1) In normal precipitation years subsurface disposal of sewage treatment effluent does
reach and recharge the groundwater
(2) All the dissolved salts in sewage eff luent will be carried to the groundwater
However, bacteria and detergents (phosphate portion) are mostly removed by the deep
soil layer above the groundwater and "minor dissolved constituents such as phosphates,
which are known to react with soil particles, or nitrates, which are taken up by
plant roots" will be less than the total found in septic tank effluents
(3) "The calculated results at the downstream end of a groundwater flow line indicate
that the maximum range of (dissolved) solids consentration expected at present (1975)
is up to 93mg/1 (milligrams per liter) above the natural groundwater background of
155mg/1 The forecast year 2020 maximum incremental concentration is 101mg/1
above the natural background " "The analytical results of the forecast impact
at year 2020 when compared with the present impact, both measured in terms of leach-
ate volume and dissolved solids concentration, indicate that the present impact on
groundwater quality is already a substantial proportion of the ultimate level "

D Alternative sewage disposal methods that would not recharge the groundcaater have the
following general characteristics
(1) Collector and central treatment systems discharging to surface waters would require
at least tertiary treatment and perhaps more to obtain a permit for the discharge
from the Department of Ecology These systems are not currently economically
available for th is project
(2) Sealed systems, whether individual or community, depend on evaporation for liquid
removal of sludges These systems require more land area than a conventional sub-
surface drainfield Some such as lagoons, have safety hazards associated with them
and relatively poor community acceptance Land, installation and operational costs
are generally more expensive than those for septic tanks and drainfields

(3) Special disposal systems using various methods of irrigation or using evapotrans-
piration have had insufficient use in this area to validate design criteria
Irrigation requires effluent disinfection in most cases These systems also require
relatively large areas for year around operation Land and some operational costs
are more than those for septic tanks and drainfields Again, without a specific
additional treatment to remove dissolved solids or completely sealing the disposal
area from percolation, some dissolved salts will be carried with effluent recharge
to the groundwater
E Historically, urban density development has resulted in polluted groundwater beneath the
development and increased values of land to the extent space for individual sewage dis-
posal drainfields is too expensive for that use
F Conclusion
(1) The use of subsurface sewage disposal systems for this project will have a negligible
impact on the water quality
(2) The development of this project in conjunction with other surrounding urbanizing
project can be expected ultimately to have at least a moderate impact on the water
quality
