APPLICATION DESCRIPTION: The applicant proposes to replace an existing water
sroY•age tank with a 145 foot tall water tank plus a 15 foot tall radio antenna on top of the water
tank; whereas, secrion 14.616.210.B.2.d.. of the Zoning Code of Spokane County requires a
maximum height of 125 feet. Authority to consider such a request exists pursuant to secrion
14.404.080 of the Zoning Code of Spokane County and Spokane County Board of County
Commissioners resolution No. 89 0708, as may be amended.
PROJECT LOCATION: Central Spokane Valley, approximately 500 feet northeast of the
intersection of Broadway Avenue and Pines Road, in NW 1/4 of Section 15, Township 25N,
Range 44 EWM; 904 N. Pines Road.
OPPONENTS OF RECURL`: NQNE
PUBLIC HEARING AND DECISION: After consideration of all available inforrnation
on file, exhibits subm.itted and testimony received during the caurse of the public hearing held
on J'anuary 13, 1993, the Zoning Adjustor rendered a written decision on February 2, 1993 to
APPROVE the application as set forth in the file documents and as conditioned below.
FINDINGS OF FACT AND CONCLUSIONS
1. Testimony wa.s taken under oath.
2. The proposal is describeci above and detailed i.n documents containecl in the file.
3. In compliance with RCW 36.70.450, the Pla.nning Deparbment deternlined that this
proposal is generally consistent, as conditioned, with the Urban category of the
Comprehensive PIan.
4. The site is zoned CJR-3.5, which allows the proposed use upon approval of this
application.
5. The existing land uses in the area of the proposa.l include.several business
properties fronting on Pines Road and numerous residential properties to the south and east, all
of which are comparible with the proposal.
6. The proposal is exempt from the provisions of the Washington State Environmental
Policy Act, Chapter 43.21C RCW pursuant to WAC 197-11-800 (6) (b); however, the,
proposal would require SEPA review at the buildi..ng pemut stage and the Planning Deparient

assumed the SEPA role for the Building Department. Pursuant to the State Environmental
Policy Act, the environmental checklist and other data have been reviewed and the project has
been found to not have any probable significant adverse impacts to the physical environment.
A Determinarion of Nonsignificance (DNS) was issued on December 10, 1992 and sent to 7
agencies. The agencies reviewing the checklist neither indicated that a more detailed
environmental review should be provided nor commented that the DNS should be
reconsrdered. Comments regarding the environmental matters were not made at the public
hearing. There was not sufficient evidence presented pursuant to WAC 197-11-340(3)(a) to
withdraw the DNS.
7. The reasons for granting the variance, as setforth by the applicant, are as follows:
a. added height allows compatibility with adjacent districts for interties to
provide improved pressure, fire flows and generally better service;
b. added height implements the Spokane County Coordinated Water System
Plan, October, 1989, and the Comprehensive Water Plan for Modern Electric
Water Company; and
c. construction of a 125 foot tall tower would do neither of the above; thus
resulting in continued inferior service.
8. Section 14.404.082 of the Zoning Code addresses the requirements for granris;g a
variance.
" 1. Any variance from the terms of the Zoning Code shall be subject to such conditions
as will (a) ensure that the adjustment shall not constitute a grant of special privilege
inconsistent with the limitations upon other properti.es in th.e vicinity and si.milar
zone classification in which the property is situated, (b) ensure that the intent and
purpose of the Zoning Code is maintained with regard to location, site design,
appearance, landscaping and other feanires of the proposal, and (c) protect the
environment, public i.nterest and general welfare, and that the following
circumstances are found to apply:
a. Because of special circumstances applicable to the property, including size,
shape, topography, locaaon or surroundings, the strict application of the
Zoning Code creates practical difficulties and is found to deprive the property
of rights and privileges enjoyed by other properties in the vicinity and similar
zone classification; and
b. That the granring of the variance will neither be materially detrimental to the
public welfare nor inj urious to the property or improvements in the vicinity
and 7one in which the property is located.
2. The following, while not to be considered as sole substantiation, shall be
considered in the granting of a variance:
a. Strict application of the Zoning Code standard(s) creates an u.nreasonable
burden in light of the purpose to be served by this Code;

c. A broader public or community need or interest will be served by granting the
variance as opposed to denying the application.
3. The granting of a variance generally should not:
b. Establish a precedent which wi11 adversely affect the zoning concept for an
area or the county as a whole;
c. Be substantially based upon a lack of reasonable economic return or a claim
that the existing structure is too small;
d. Be inconsistent with the general purpose and intent of Spokane County's
comprehensive Plan;
f. Result in a de facto zone reclassification; or
g. Be substantially for the purpose of circumventing density regulations
designed to protect groundwater.
4. For the purpose of implementation of Section 14.404.082 of this Code, the
fallowing terms and concepts shall have the following meaning.
e. "Pracrical difficulties" are one or more of any number of differences in
privileges characteristic of a property due to a combinarion of special
circumstances and the standards of Zoning Code: Provided, That a practical
difficulty:
ii. may be the gross rectriction or preemption of innovative or state-of the-
art technology. not anticipated by the drafters of this Code. "

9. Whether or not the new, taller and larger water tank/tower be injurious to property
or improvements in the vicinity and zone, is a matter of conjecture and personal preference.
The applicant made personal and written contacts to adjacent and nearby property owners
concerning the proposed tower. None of the contacts resulted i.n negative commentary;
possibly due to the fact that improved water service would zesult with little risk and little
adverse aesthetic impacts.
10. The applicant's property at this location is fully developed with offices for the
electric and power company, maintenance shops, ttle existing water tower (proposed to be
demolished after construction of the new one), electrical substation equipment, etc. The only
use for this property, short of a total relocation of all existing improvements, is to continue as
its present function. The present function is oriented toward providing electric and water
service for customers throughout the service area.
11. One of the major objectives of this proposal is to increase the water pressure
throughout the nauch of the water service area for the applicant company. Construction of the

taller tower presents a greater "head" for water pressure. It also brings the hydraulic level of
water to a level comparable to surrounding water districts; thus, greatly improving the
possibilities and opportunities for exchange of water as may be needed to meet emergency
needs, including low water pressure during certain periods of the year and extra-needed water
volumes and pressures for fu-e fighting purposes.
12. Rohan, in Zonine and Land Use Controls, § 43.02 CS], states that over the years a
number of factors have been considered by courts with respect to granting variances. These
include: (1) whether strict compliance with the terms of the ordinance will preclude a pennitted
use from being pursued; (2) whether the land will yield a reasonable return; (3) the degree to
which the applicant seeks to vary from the ordinanr,e; (4) the degree of harm which will be
imposed on the surrounding area if the variance is granted; (5) whether some other method can
be pursued to avoid the need for the variance; (6) whether the difficulty is self imposed; and (7)
whether the interest of justice and the general welfdre will be served. Rohan continues that no
factor alone controls and all must be considered. It is a balancing act of the competing interest
between the landowner and the community, as expressed through the zoning document.
13. After examining the various criteria cited in number 8 above and using Rohan's
'balancing act,' the Zoning Adjustor concludes the following.
a. Variance request is not a classic one in which the property is deprived of sorne
privileges. However, the need to consider deviating from the regulations
qualifies very well in several otller areas.
b. Considering the unique nature of the applicant, a water district, its request to
maintain proper water pressure and better serve its customers, while at the
same time intertieing efficiently and effectively with neighboring districts is of
paramount importance. It can best be achieved through a deviatioa from tlie
125 foot maximum. c. The public i.nterest and general welfare vvill be best served by granting the
variance. d. Notning suggests dlat granting the variance will be materially detrimental to
public welfare nor injurious to property improvements in the vicinity.
e. Strictly applying the Zoning Code standard creates an unreasonable, possibly
unsafe, burden in light of the purpose to be served by the Zoning Code and
this height standard.
f. A broader public or community need or interest will be serveri by granring the
variance as opposed to denying it.
g. Granting the variance will be consistent with the general purpose and intent of
the County's Comprehensive Plan, the Coordinated Water System Plan and
the District's comprehensive plan.
h. The "practical difficulty" being overcome by the applieant's request for a
variance is in response to a principal of hydraulic design to achieve certain

minimum water pressures and promote coordinarion between water d,istricts, a
principal not anticipated by the drafters of the Zoning Code when they
imposed the 125 foot height limitation for public utility transmission faciLity.
14. As the Zoning Adjustor considered all the facts, testimony, relevant case law and
instructive usefulness of Rohan's Zoning and Land Use Controls, it is concluded that the
bal.ancing test of competing interest lies with approving the variance.
15. The Planning I7epartment performed the State Environmental Policy Act (SEPA)
responsibilities normally to be performed by the Building Department at the Building Pernut
stage. The Detemlination of Nonsignif~icance was issued by the Planning Department on
December 10, 1992. No information wa.s received sufficient to cause that Determi.nation of
Nonsignificance to be withdrawn. The Department of Ecology, commented about its concern
about any possible erosion during construction. The Departtnent requested that temporary
measures necessary to control erosian and siltaeon to naturai drainage ways be implemented
during the construction phase.
16. The applicant has been made aware of the recommendations of various County
agencies reviewing this project.
17. The proper Iegal requirements for advertising of the hearing before the Zoning
Adjustor of Spokane County have been met.
DECISION
From the foregoing Findings and Conclusions, the Zoning Adjustar A,PPROVES
the proposal as generally set forth in the file documents, subject to compliance with the
following
Ct?NDITIONS OF APFROVAL
1. GENERAL
1. The following condirions shall apply to the applicant, owner and successors in
interest and shall run with the land.
2. Failure to comply with any of the conditions of approval contained in this decision,
except as may be relieved by the Zoning Adjustor, shall constitute a violation of the Zoning
Code for Spokane County and be subject to such enforcement as is appropriate.
3. 'I'he Zoning Adjustor may administratively make minor adjustments to site plans or
the conditions of approval as may be judged by the Zoning Adjustor to be within the context of
the original decision.

II. FLANNING DEPARTMENT
1. The applicant shall develop subject property generally in accordance with the
concept presented to the Hearing Body. Variations, when approved by the Planning
Director/designee, may be pernutted, including, but not limited to structure location, landscape
plans and general allowable uses of the permitted zone. All variations must conform to
regulations set forth in the Zoning Code for Spokane Counry, and the original intent of the
development plans shall be maintained.
, 2. Subsequent to consuuction and demolition, seeding and landscaping suff'icient to
control erosion shall occur.
3. Landscaping plans to the south of the tank site shall be presented to and approved
by the Planning Department prior to issuance of a building perniit. Plans shall generally meet
Type 1 standards of 14.806.040.1.c. of the Zoning Code at the property edge. Suitable
assurance of installation and irrigarion shall also be submitted and approved.
III. DEPARTMENT OF BUILDINGS
1. The issuance of a building permit by the Deparmient of Buildings is required.
2. The applicant shall contact the Department of Building and Safety at ti:e earliest
possible stage of design/development in order to be informed of code requirements
administered/enforced by the department, e.g., State Building Code Act regulations, such as
requirements far fire hydrant/flow, fire apparatus access roads, street address assignment,
batrier-free regulations, energy code regularions and general coordination with other aspects of
project implementation.

The purpose of this letter is to traasmit changes to the contract documents for tlus project related to your
comments.
Your comments were received by phone on February 25, 1993. Your main concern was with the drain
pipe from the floor drain and its routing. This applied to both sites. At the N. Pines site, we bave
rerouted the floor drain to the nearby sanitary sewer for the main offices of Modern Electric Water
Company. At the 1403 S. Houk site, we have rerouted the floor drain into the grassy swale that is also
used for the overflow from the water reservoir. The dry wells at each site that were planned to be used for
the floor drains have been removed from the drawings.
The changes in the contact documents are reflected in the attached drawings. These drawings are being
transmitted to the contractor for quotes and will be incorporated into a change order.
These changes should address your concems. Please notify me or John Larson immediately if this is not
adequate; otherwise we will assume that your signoff will be forthcoming.
