FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal requests a Temporary Use Permit, as defi.ned in Chapter 14.510 of the Spokane County Zoning Cod.e, to allow retail sales of inees, shrubs, and produce. The applicant also requests the construction of a small structure on the site. The Temporary Use Perm.it would be valid for a period not to exceed six months and is not renewable. 3. The proposal is generally located at the northeast corner of the intersection Sprague Avenue and McCabe Road in the SE 1/4 of Section 15, Township 25 North, Range 45 EWM, Spokane County, Washington. The location is idenrified by Spokane County Assessor parcel numbers 45154.2526 and 45154.2527. 4. The current zoning of the property is Urban Residential-3.5 (UR-3.5), previously established as Agricultural Suburban (AS) (ZE-465-57) and redesignated to Urban Residential-3.5 (UR-3.5) on January 1, 1991 consistent with the Program to Implement the Spokane Counry Zoning Code. 5. The Spokane County Comprehensive Plan designates this area as Commercial. The development and proposed use is generally in accord with this category. 6. The required public notice is provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. Agencies respond.ing to the application include the County Engineer's Department, the County Health DisCrict, the County Utilities Departrnent, the Spokane Counry Air Polllition Control Authority, and the Spokane Valley Fire Department. 7. An Environmental Checklist was submitted by the sponsor and was reviewed by the County Planning DepartmenL The review considered the specifics of the proposal, other available informarion, County ordinances, other regulations and laws, possible standard Cond.itions of Approval, the Generalized Comprehensive Plan, and other County policies and guidelines. The Planning Department has determineti that "No probable significant adverse impacts" would result fmm the praposal being developed and has issued aDetermination of Nonsignifiqa cg ("DNS"). The "DNS" was circulated to Q other agencies of jurisdiction and other agencies/departments affected by the future development for review and comment The "DNS" comment period ended April 20. 1994. No Comments were received to alter the "DNS". 8. The erection of a structure on the site as proposed i.n the application is not permitted with a Temporary Use Permit. Chapter 14.510.000 of the Spokane County Zoning Code states in part that: "Any owner of any property may submit an application for the temporary use of a structure or premises in any zone classification for a purpose or use that dces not conform to the regulations prescribed elsewhere in this Code for the zone classification in which it is located, provided that such use is of a temporary nature and dces not involve the erection of a substantial structure." 9. The Flanning Departinent inspected the site on April l, 1994 and found that the site has been graded, and landscaping shrubs and materials were on the site. .r ~ r FIIVDINGS AND DECISZON TLTE-4-94 Page 2 10. Recognizing the recommended conditions and Spokane County Temporary Use Standards, the proposed use, as mod.ified by this decision, makes appropriate provisions for the public health, safety and general welfare. DECISION Based upon the above noted Findings of Fact and Conclusions, Temporary Use Application TUE-4-94 is hereby APPROVED. This decision is final unless appealed in writing, consisterit with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONS 1. The temporary use permit is for the property described in the application for this proposal. _ 2. The temporary use pernut shall expire six months from the date of this approval, and is not renewable. A,pproval of the Temporary Use Pernut shall have no bearing on subsequent land use actions concerning the subject property. 3. The erection of permanent structures is prohibited. 4. All development standards of the Zoning Code and other agency permit requirements shall be complied with. COUNTY UTILITIES DEPARTMENT CONDITIONS - 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. 2. Sewe.r service is available to the property. Any permanent use, structures and or facilities will be required to connect to the public sanitary sewer system. SPOKANE COUNTY ALR POLLUTION CONTROL AUTHORITY 1. All air pollution regulations must be met. 2. Air pollution regulations require that dust emissions during demolition, construction and excavation projects be controlled. This may require use of water sprays, tarps, sprin.klers or suspension of activity during certain weather conditions. Haul roads should be treated, and emissions from the transfer of earthen material must be controlled, as well as emissions from all other construction-related activities. 3. SCAPCA strongly recom.mends that all traveled surfaces (ingress, egress, parking areas, access roads) must be paved and kept clean to minimize dust emissions. 4. Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces onto paved surfaces. If tracking or spills occur on paved surfaces, measures must be taken immediately to clean these surfaces. 5. SCA.PCA Regulation I, Arricle V requires that a Norice of Construction and Application for Approval be submitted to and approved by our Agency prior to the consiruction, installarion or establishment of an air pollution source. This includes fuel burning equipment rated at greater than 400,000 BTU/hour input. 6. Debris generated as a result of this project must be disposed of by means other than burning (i.e construction waste, etc.) - ~ . .
