'Authorize Spokane County to place their nAmes on a petition for the fonnation of a Road Improvement District (RID) by the petition method pursuant to Chapter 36.88 RCW, which petition includes the owners property, and further not to object, by the signing of a ballot, or not to protest to the formalion of a RID by the resolution method pursuant to Chapter 36.88 RCW, which resolution includes the owners properly. If a R1D is formed by eithcr the petition or resolution mclhod, as provided for in Cltapter 36.88 RCW, the owners or successor(s) furtiier agree: (1) that the improvements or construclion contemplated wilhin the proposed R1D are feasible, (2) t}iat the benefits to be derived from tlie forniation of the RID by the property included therein, together with the amount of any County participation, eaceeds the cost and expense of formation of the RID, and (3) that the property within the proposed RID is sufficienlly developed. Provided, further, the owners or successor(s) sliAll retain the riglit, as authorized under RCW 36.88.090, to object to any assessiucnt(s) on the property as a result of the improvements called for in conjunction with the fonnation of a RID by cither the petition or resolution method under Chapt6 36.88 RCW,and to appeal to the Superior Court the dccision of the Board of County Commissioners affirming the final assessment roll. Timing of the forcnation of said RID or ollier road improvement project shall be determined by Spokane County consistcnt with RCW 36.88. The street improveuient authorized by the RlD or other improvement projecl sh+all ca1D for the improvcment of Tract "X" and its imuicdiale street syslein to at least the minimum Spokane County Road standards applicable to Tract "X" and the immediate street systecv at ihe time the R1D, or other road improvement project is constructed. If a majority of the property owners round drainAge, etc., that standard shall desire a higher standard of construction, e.g., gutters, (sh4l prevail. Spokane Couaty ha4 no responsibilily to build, improve, maintain or othenvise service the private roada contained within or providing service to the lands herein described. By allowing a building permit to be iasued on property on a private road, Spokane County assuines no oUligations for said private road and the owners hereby acknowledge that the County has no obligation of any kind or nature whatsoever to establish, examine, survey, conslruct, alter, repair, improve, maintain, provide drainage or snow removal on a private road.
