TUE-007-94 . ~ / BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT IN THE MATTER OF A ZONING ) FINDINGS OF FACT, CERTIFICATE FOR A TEMPORARY ) CONCLUSIONS AND USE PERMIT TUE-7-94 ) DECISION THIS MATTER, an application for a temporary use permit, from Modern Electric Water Company has been received and decided upon, pursuant to the Spokane County Zoning Code regulations, on the ~q- day of January, 1995. FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has further been properly delegated the responsibility for rendering the decision by the Spokane County Director of Planning. 2. The proposal is to install a lighted electric display sign in the Urban Residential-3.5 (UR- 3.5) zone. The applicant has applied for a zone change from UR-3.5 to Regional Business (B-3) (file # ZE-1-95), which has been scheduled for a Hearing Examiner Committee public hearing on February 23, 1995. If the proposed zone change is approved, the applicant has indicated that an application requesting to make the sign permanent will be submitted. 3. The subject property of this proposal is identified by Spokane County tax parcel number 45152.1515, and is located east of and adjacent to Pines Road, and north of and adjacent to Broadway Avenue in the NW 1/4 of Section 15, Township 25 North, Range 44 E.W.M., Spokane County, Washington. 4. The existing zoning of the property described in the applicarion is Urban Residential-3.5 (UR-3.5), previously established as Agricultural (A) (file # 99-55) zoning in 1955 and rerlesignated to UR-3.5 on January 1, 1991, pursuant to the Program to Implement the Spokane County Zoning Code. The proposed temporary use is not prescribed nor does it conform to the requirements of the existing UR-3.5 zone. 5. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 6. No written comments were received from any adjoining property owners. 7. Recognizing the recommended conditions of approval and Spokane County temporary use standards, this proposal dces involve the erection of a substantial structure, which will need to be removed by the applicant after 6 months if the proposed zone change (ZE-1-95) is not approved. 8. The proposed temporary use dces not create any significant impacts to the general area and makes appropriate provisions for the public health, safety and general welfare. 9. The project is exempt from environmental review under the State Environmental Policy Act pursuant to WAC 197-11-800. DECISION Based upon the above noted Findings of Fact and Conclusions, Temporary Use Application TUE-7-94 is hereby APPROVED for only-6 months. This decision is final unless appealed in writing, consistent with adopted appeal procedures. CONDITIONS OF APPROVAL The following conditions of approval apply to applicant(s), owner(s) of the property, heirs, . assigns or any successors-in-interest to property: SPOKANE COUNTY PLANNING DEPARTMENT 1. The temporary use perrnit is for the property legally described in the application for this proposal. 2. The temporary use permit shall expire on July 19, 1995, and is not renewable. 3. The proposed d.isplay sign shall comply with Chapter 14.628 (Regional Business (B-3) Zone) of the proposed B-3 zone and Chapter 14.804 (Signage Standards) of the Spokane . County Zoning Code. 4. A specific and detailed site and design plan drawn to scale and showing the proposed locadon of the sign, its size, construction, landscaping, clear-view and setbacks from existing buildings and roadways shall be submitted to the Planning Department for review and approval prior to issuing a sign permit. If you desire to file an appeal, you must submit the appropriate Appeal Application together with the required Fee, payable to the Spokane County Planning Department, within twenty (20) calendar days from the date this decision is signed.
