RID WAIVER, AGREEMENT AND COVENANTt l'
iCNOW ALL HEN BY THESE PRESENTS, That Barton Investment Company, a Partnership,
being the ownera of the following described lande in consideration of Mutual
Benefite to be hereafter derived do for themselves, their heirs, grantees, assigns
and eucceseor(e) in interest hereby egree to authorize Spokane County to place their
name(e) on a petition for the formation of a Road Improvement Dietrict (RID) by the
petition method pursuant to Chapter 36.88 RCW, which petition includea the owner(s)
property,, and further not to object, by the eigning of a ballot, or not to proteet
to the formation of a RID by the resolution method purauant to Chapter 36.88 RCW,
which reBOlution includee the owner(e) property. If a RID ie formed by either the
petition or reeolution method, as provided for in Chapter 36.88 RCW, the owner(e) or
euccessor(s) further agreet (1) that the improvemente or construction contemplated
within the propoeed RID are feaeible, (2) that the benefita to be derived- from the
formation of the RID by the property included therein, togethez' with the amount of
any County participation, exceede the coat and expense of formation of the RID, and
(3) that the property within the propoeed RID i8 eufficiently developed. Provided,
further, the owner(s) or aucceesor(e) ehall retain the right, ae authorized under
RCw 36.88.090, to object to any aeaeeament(s) on the property ae a renult of the
improvemente called for in conjunetion with the formation of a RID by either the
petition or reaolution method under Chapter 36.88 RCW and to appeal to the Superior
Court the decision of the Board of County Commiseioners affirming the final
aesesament roll.
It is further agreed that at euch time ae ari RID ia created or any Road Improvement
Project ie eanctioned by Spokane County, the improvements required (curb, eidewalk,
drainage control and paving to existing pavement) shall be at the eole expenee of
the undereigned owner, their heire, granteee and aseigne without any monetary
participation by Spokane County.
The RID waiver contained in thie agreement ehall expire after ten (10) years from
the date of execution below. However, at the expfration date the owner(e) or
succeeaor(8) agree to construct the reqvired improvements at their own expense; pay
to Spokane County the then eatfmated coet of the required improvements to enable the
County to complete the eameJ or furnieh a bond or other eecure method euitable to
the County, providing for or securinq to the County the actual conotruction of the
improvemente.
The above conditione and covenant apply to the following described property:
TRACT "A": The North Half of the North Half of Tract 149 of OPPORTUNTTY.
EXCEPT: The West 550.00 feet and the North 25.00 feet thereof.
AND ALSO
TRACT "B": The East 125.00 feet of the West 550.00 feet af the North Half of Tract 149.
EXCEPT: The North 130.00 feet thEreof.
AND ALSO
TRACT "C": The South Half of the North Half of said Tract 149.
EXCEPT: The 6dest 550.00 feet thereaf.
AND ALSO
TRACT "b": The South Half of the East Half of said '1'ract 149.
EXCEPT: The West 69.00 feet and the South 50.00 feet thereof.
All in OPPORTUNITY as per plat thereof recorded in Volucne "K" of Plats, Page 20,
Spokane County, Washington.
Located in SECtion 16, Tawnship 25 North, Range 44 East, W. M.
These requirements are and shall run with the land and shall,be binding,upon
the owners, their heirs, successors, or assigns. ;
