The existing land uses in the area of the proposal include relaavely small to medium lot development, all of which are compatible with the proposal 5. The proposal is exempt from the provisions of the Washington State Envimnmental Pohcy Act, Chapter 43 21 C RCW pursuant to WAC 197-11-800 (6) (b) 6 The apphcant has been made aware of the recommendations of vanous County agencies reviewuig this project The applicaat found no particular problems vnth any of the agency recornmend recommendations, except those of the County Engineer The County Engineer has recommended that 7 75 feet of land be dedicated on both South Riverway and Center Road The Enguieer's Office is trying to establish the addiaonal pomoa of the half nght-of-way wluch would bnng these respecave mdes of the street to a 25 foot half nght-of- way in an effort to eventually estabhsh a 50 foot nght-of-way stneet standard, as is requued by the Board of County Comnussioner"s adopted regulaaons The apphcant objects to this much land being dedicated from a small parcel, stating that the present streets are enarely adequate for the area and that no addstionai nght-of-way for future expansion is needed. After evaluaang these two opposing points of view, the Zoning Adjustor concludes that the street standards reqtunng a nununum of a 50 foot nght-of-way ar+e consistent wnth adopted County Ordmances, wluch the Enguieer's recommendaaons are attempting to unplemenL Therefore, the dedicaaon of 7 75 feet for both fronnng streets will be imposed as a cond.iaon of approval 7. GENERAL 1 The followuig conditions shall apply to the applicant, owner and successors in interest and shall run wnth the land. 2. Failur+e to comply with any of the condiaons of approval contained in this decision, except as may be reheved by the Zoning Adjustor, shall consatute a violaaon of the Zoning Ordinance and be subject to such enforcement as is appropnate 3 The Zorung Adjustor may administratively make minor adjustments to site plans or the condhtions of approval as may be judged to be withun the context of the ongmal decision II. Pursuant to a telephone conference with you on September 6, 1990, I indicated Mr. Adrian's objections to the conditions put upon his variance request as granted on August 9, 1990, by Thomas Mosher, the zoning adjustor. A brief review of the facts I believe are necessary in order to apprise you of the reasons for writing this letter. Mr. & Mrs. Adrian own a corner lot situated at E. 7708 South Riverway near Felts Field. A home is currently situated on the lot in which the Adrians reside. The home is in violation of current zoning standards concerning set backs, however, the home was constructed before the zoning ordinances were enacted and, therefore, it is grandfathered. The lot itself is not uniform in that each side is a different length. The lot is fronted by South Riverway Street and flanked on the East by Center Road. I The Adrians filed a variance so they could build a new home on the lot, but due to the dimensions of said lot the home would be within 40.25 feet of the right-of-way center line for South Riverway an.~ within 32.25 feet of the center line of Center Road. It should be noted that any new construction on the lot for a home of any siz~ would be in violation of the set back requirements due to th,.:- irregular lot size. While both Center Road and South Riverway are paved, they are non-arterial residential streets. On August 9, 1990, the zoning adjuster granted the Adrian's request for the variance on the set backs to allow construction of a new home on their lot. The Adrians, of course, do not dispute the granting of the variance and agree that all elements necessary for 1 . Mr. Robert BinQer Page 2 October 10, 1990 the granting of the same were present. However, pursuant to recommendations of the engineering and health department the zoning adjustor made findings in a decision which attached conditions to the variance. I have enclosed for your reference a copy of the Findings of Fact, Conclusions, Decision and Amended Decision of the Zoning Adjustor. The Adrians specifically have appealed the conditions contained in Section VI, paragraphs 2, 31 4 and 5 of the original Decision and Section IV, paragraph 4 of the Amended Decision concerning an ULID. My purpose in sending this letter is to raise concerns about the legality of the aforementioned conditions imposed upon the Adrian' s variance. I will address each condition in order as follows: Paragraph 2 of Section VI of the adjustor's Decision requires tre Adrians to sign and record an agreement for petition of the formation of the Road Improvement District (RID) pursuant to RCR 36.88. I have enclosed a copy of the agreement which the Adrians were requested to sign in order to obtain a variance. The Adrians object to Notice No. 6 as it is called because of numerous def iciencies and inaccuracies contained within it. First of all, the Adrians cannot in good conscience truthfully sign a document agreeing that the improvements or construction contemplated within the proposed RID are feasible. RCW 36.88.072 requires that any waiver of protest must specifically indicate the improvements to be f inanced by the district. Since a RID has not been developed, no one knows the improvements that will be made, let alone whether they are feasible. Secondly, paragraphs 2 and 3 of Notice No. 6 provide the improvements made shall be at the sole expense of the undersigned owner without participation by Spokane County. That proviso is in direct violation of RCW 36.88.072 which proscribes that: "It is against public policy and void for an owner, by agreement, as a condition imposed in connection wit: proposed property development, or otherwise, to waive the rights to object to the property owners individua~ assessment (including the determination of specia: benefits allocable to the property),". The aforementioned statute allows the owner to seek monies from Spokane Count-,ri ~.-~,,`r ,,-•.,n.-,_-_, _ a~~_ .~a•,~o~~ C.- improvements. Paragraph 3 of Document No. 6 likewise is void for the same reasons. It is unconscionable to require an owner to make a "required improvement" at his own expense after the expiration of ~ i ) Mr. Robert Binger Page 3 October 10, 1990 the waiver of protest. By its own terms, the document is only effective for ten years and, therefore, the county cannot put conditions in the agreement which will affect the property owner after the expiration of ten years. The final argument as pertains to the Document No. 6 is that the waiver of protest has no relationship to the variance requested and therefore, should : ct be a condition attached to the granting of the variance. The Adrian's objections to paragraphs 3, 4 and 5 of Section VI of the adjustor's decision all involve dedication of property of the Adrians to the city for purposes of right-of-way. My understandinc is that Spokane County Ordinances require that all residentia- streets have a minimum 50 f oot, and a maximum 60 f oot right-of -way. The engineers office has recommended that the Adrians dedicate 7 3/4 feet on the flanking and front sides of their lot in order t:-, conform to a 50 foot right-of-way required by the Ordinance. The first contention raised by the Adrians is the County's taking o~ that 7.75 feet on two sides of their lot constitutes unlawful taking without just compensation. There has been no consideration given to the Adrians for the taking of that property. Secondly, the County's reqeust for dedication of additional property f or a roadway right-of -way while at the same time relaxing the set backs for the Adrians variance to build their home is inconsistent. Essentially the adjustor's decision is stating thar the Adrians can build their house closer to the street only if the County is allowed to obtain land so they can have the street closer to the house. By granting the variance on the set backs, there is no practical way that the County could use the additional 7.75 feet requested for the right-of-way. If they did use the full amount requested for the right-of-way, the sidewalk and/or curb would be on Mr. Adrian's doorstep. My conversations with the engineer's office have indicated that there is at this time no proposal to improve or widen Center Road or South Riverway. I think you will agree that at no time wili there ever be a need for widening of those streets. Clearly, the county is exacting the 7.75 feet of riqht-of-way so that at some undefined future time they may widen the same. This fact combined with the reality that the streets cannot be widened due to the variance granted to the Adrians makes the County's request for dedication of the right-of-way invalid. Unless the County has some definite plans for development of that area which would require in this specif ic instance 50 f oot right-of -ways ; the dedication of the land by the Adrians is an unconstitutional taking. See Unlimited v. KitsaD Countv, 50 Wn. App. 723, 750 P.2d 651 (1988). I - Mr. Robert Binger Page 4 October 10, 1990 The Adrians final objection concerns paragraph 4 of Section IV of the Amended Decision, which indicates the Adrians must agree to waive opposition to any petition for the formation of a ULID purs uant to RCW 36.94. Upon my review o f RCW 3 6. 9 4, I f ind no authority which would allow the County or any other public agency to require property owners to waive any protest concerning a petition for the formation of a ULID. Unlike the RID statute, there is no waiver of protest authorization contained in the ULID statutes pursuant to RCW 36.94. It also came to my attention that Spokane County does not use the petition method for purposes of forming ULIDs. Therefore, there is no need to have such an agreement and/or covenant executed. Most, if not all, ULIDs in Spoknae County are formed by the resolution method. There is no authority in RCW 36.94 which allow,- the County to require the Adrians to waive their protest rights f cf a ULID as a condition for granting a variance. It is my understanding that the proper procedure would be to allow the Adrians a design deviation due to the unique circumstances of their case. The design deviation would eliminate the conditions required by the health department and engineering department which are attached to the Adrians variance. I believe that if all parties concerned will review the specifics of the Adrians case, they will note that not only are the conditions to be imposed by I the engineering office and health department invalid, they are impractical. These issues will come before the Board of Adjustment on the Adrian's appeal October 17, 1990. It is my hope that this situation can be resolved prior to that hearing to the satisfaction of all parties concerned.
