She has received preliminary short plat approval for a two (2) lot short plat and now needs the approval of a variance from the minimum frontage standard. Section 4.04.040 of the Spokane County Zoning Ordinance requires 100 feet of continuous public road frontage. Authority to consider and grant such a request exists pursuant to Sections 4.03.020 64. and 4.25.030 b. of the Spokane County Zcning Ordinan,_e. PROJECT LOCATION: The project is generally located in the Spokane Valley, north of Boone Avenue and west of Marguerite Road in the NE Y4 of Section 18, Township 25N, Range 44EWM. The property would be addressed as E. 8811 Boone Avenue. The Assessor's parcel number is a portion of 1 8541 -031 6. DECISION SUMMARY OF THE ZONING ADJUSTOR: Based upon the evidence presented and circumstances associated with the project proposal, the Zoning Adjustor APPROVES the application, conditioned and stipulated as set forth below. PUBLIC HEARING: After examining all available information on file with the application and visiting the subject property and surrounding area, the Zoning Adjustor conducted a public hearing on June 8, 1988, rendered a verbal decision on June 8, 1988, and rendered a written decision on June 17, 1988. FINDINGS OF FACT 1. The project location is as set forth above under PROJECT LOCATION. 2. The parent piece of property was the subject of SP-88-541 which was approved as a preliminary short plat. The parent parcel of land was an approximately 26,422 sq. ft. with frontage on Boone Avenue. As is the case for many many blocks of the Spokane Valley in ihis general area, the blocks are about 600 feet by 600 feet, with many deep narrow lots fronting on the periphery streets. With most residential development occurring near this street, the center portion of these blocks is frequently undeveloped. As is happening more and more often, owners of these longer deep lots are requesting a two lot short plat in order to create a separate building parcel on the rear of the lot, in the interior of these blocks. Without installing a public road system to service the rear of these lots, or developing a planned unit development of the entire interior portion of the block, these rear half-lots require granting of a variance from the requirement of minimum frontage on a public street. In this case, the applicant would like to divide the parcel into two (2) equal portions with the front portion containing the existing dwelling unit and an easement to the rear portion, upon which would be built a second dwelling unit. In this case, the rear of this lot contains a 1-Yz story garage/barn structure, which will be retained as a garage for the new dwelling unit. The applicant intends to move a dwelling unit from another location to this site for establishment on the rear portion of the parent parcel. 3. The adopted Spokane County Future Land Use Plan designates the area of the proposat as Urban. 4. The existing land uses in the area of the proposal include similarly laid out housing parcels; that is, many parcels have frontage on the road and a long narrow portion into the interior of the block and increasing numbers of lots have obtained permission to create a two (2) lot short plat. 6. The Short Plat Decision for SP-88-541 signed on May 18, 1988 was apparently not appealed and was conditioned upon receiving a frontage variance prior to finalizing. I 7. The Findings of Fact, Conclusions and Decision for SP-88-541 are herein adopted by reference. 8. Subsequent to all the reports being filed with the Short Plat file, Spokane County Fire Protection District #1 submitted comments in a May 31, 1988 memorandum expressing concern that a dead-end fire lane over 150 feet in length requires a turn-around for fire apparatus at the terminus. The District clarified that an approved turn-around is a 100 foot diameter circle or a 90 foot by 30 foot hammerhead cul-de-sac. They pointed out that the distance from the street to the proposed rear property line is 155 feet at the borderline. They also requested that if a variance is to be granted and the short plat ultimately occurs, the applicant be required to instatl an address sign on Boone Avenue indicating access to the secondary lot. (The applicant and the Fire District have discussed the matter and arrived at a solution which satisfies the Fire District's need for access.) 9. The proposal is exempt from the provisions of Chapter 43.21 C RCW pursuant to WAC 197-11-800 (6) (b). 10. The applicant was represented at this hearing by her father, Mr. Robert Dunlap. Permission to represent was not established in writing, however; the Zoning Adjustor accepts the claim for representation as an agent by Mr. Dunlap. 1 1. The applicant has submitted a proposed easement of twenty (20) feet in width serving as access to the parcel. The easement will be rec;orded as a part of the final plat process. 12. The applicant has been made aware of the recommendations of various County/State agencies reviewing this project and has indicated she can comply with those recommendations. 13. Any conclusion hereinafter stated which may be deemed a finding herein is hereby adopted as such. From the Findings, the Zoning Adjustor comes to these: ~ CONCLUSIONS 1. The applicant's proposed private road located on an easement is sufficient substitute for the requirement of 100 feet o` continuous frontage on a public road. 2. The variance wili not authorize a use other-wise prohibited in the zone. 3. With the conditions of approval set forth below, the variance will: a) not constitute a grant of special privileges inconsistent with limitations on other properties in the vicinity and similar zone; b) ensure that the intent and purpose of the Zoning Ordinance is achieved with regard to location, site design, appearance, and landscaping, etc; and c) protect the environment, public interest and general welfare. 4. There are special circumstances applicable to the property which when combined with the standards of the Zoning Ordinance, create practical difficulties for the use of the property and/or deprive the property of rights and privileges common to other properties in the vicinity and similar zone classifications. The 600 sq. ft. blocks with undeveloped middle portions of the lots constitute special circumstances. 5. Granting the variance will be neither materially detrimental to the public welfare nor injurious to property or improvements in the vicinity and zone. The decision to approve the short plat indicates that consideration has been given to whether or not the proposal would be materially detrimental to the public welfare or injurious to property or improvements in the vicinity and zone. The short plat was not appealed. J , CASE NO. VE-21-88; DUNLAP SPOKANE COUNTY ZONING ADJUSTOR PAGE 3 6. Strict application of the zoning standards does create an unreasonable burden in light of the purpose to be served by the standards. The short plat decision indicated that this kind of development amounts to fill-in development encouraged by the Comprehensive Plan. 7. The case for the variance was not supported by substantial reference to or reliance upon illegal or non-conforming precedent(s). 8. Granting the variance will not adversely affect the overall zoning design, plan or concept for either the immediate area or the entire County. 9. The case for a variance was not based substantially upon a lack of reasonable economic return nor a claim that the existing structure is too small. 10. Granting the variance will not be inconsistent with the general purpose and ~ intent of the Comprehensive Plan. 1 1. The granting of the variance will not result in defacto zone reclassification. 12. The requested variance is not substantially for the purpose of circumventing density regulations designed to protect the Spokane Valley-Rathdrum Prairie Aquifer. 13. Various performance standards and criteria are additionally needed to make the use compatible with other permitted activities in the same vicinity and zone and to ensure against imposing excessive demands upon public utilities and these shall be addressed as conditions of approval. 14. The proposal will neither be detrimental to the Comprehensive Plan nor the surrounding properties. 15. The Zoning Adjustor may require such conditions of approval as necessary and appropriate to make the project most compatible with the public interest and general welfare. 16. The requirement for Fire District verification of driveway access is a relatively new condition request. The Zoning Adjustor feels that this verification is not fully institutionalized into the permitting process and chooses to defer most of the accountability for such performance on the part of the applicant to the Fire District, in cooperation with other agencies/departments. (NOTE: The applicant and the Fire District have (reported by Paul Chase) arrived at an understanding acceptable to the Fire District regarding access.) 17. Any finding hereinbefore stated which may be deemed a conclusion herein is adopted as such. DECISION From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES the proposal, including acting on behalf of the Subdivision Administrator to approve the I associated Certificate of Exemption(s). If the proposed Insured has or acquires actual knowledge of any defect, lien, encumbrance, adverse claim or other matter affecting the estate or interest or mortgage thereon covered by this Commitment other than those shown in Schedule B hereof, and shall fail to disclose such knowledge to the Company in writing, the Company shall be relieved from liability for any loss or damage resulting from any act of reliance hereon to the extent the Company is prejudiced by failure to so disclose such knowledge. If the proposed Insured shall disctose such knowledge to the Company, or if the Company otherwise acquires actual knowledge of any such defect, lien, encumbrance, adverse claim or other matter, the Company at its option may amend Schedule B of this Commitment accordingly, but such amendment shall not relieve the Company from liability previously incurred pursuant to paragraph 3 of these Conditions and Stipulations. 3. Liability of the Companv under this Commitmeni shall be only to the named proposed Insured and such parties included under the definition of Insured in the form of policy or policies committed for and only for actual loss incurred in reliance hereon in undertaking in good faith (a) to comply with the requirements hereof, or (b) to eliminate exceptions shown in Schedule B, or (c) to acquire or create the estate of interest or mortgage thereon covered by this Commitment. Step 1,: All property owners and taxpayers within three hundred (300) feet of the property, including all additional contiguous ownership and any easement(s) providing access across other properties shall be notified by the proponent. Utilizing a list of property owners and taxpayers obtained from the Department or a title company and copies of the Agenda Notification prepared by the Department, the applicant shall accomplish notification by mailing the agenda notification by First Class Mail as directed by the Department personnel.
