Mr. Richard Nacarrato, on the west side of Argonne Road, just north of Sprague Avenue. Mr. Posdewait has expanded his restaurant onto a deck stcucture immediately adjacent to the ' east side of the Nacamdto building, in which he leases restaurant space. The purpose of this deck is obviously to expand the seating area of the restaurant, thus setving additional customers. We are concerned, of course, that there be adequate off-street parking taken i n1u account for any use which is an expansion of an original space. I assume that your office gives attention to this detaiL The area of primary concern to our office is the fact that a deck has been built into the front . yard area, the purpose of which to provide for a restaurant business expansion. While the deck itself is less than 30 inches in height and may exist in a front yard, as soon as it is committed to a use, that use then violates the zoning ordinance setbacks. You ask how we made a distinction between this situation and a residential porch in the front yard clearly used for residential purposes. We would make a distinction insofar as the primary purpose of the restaurant is to seat people for eating. When we expand the restaurant to the outside on a deck, we have expanded the absolute primary use of the interior space of the . building. On the contrary, when we use a porch as a portion of a residence, it is clearly incidental to the intenor usage of the dwelling unit and dces not generate the need for additional parldng. I see no comparison and do not have d.iff'iculty in clarifying for anyone that the outdoor restaurant use oa the deck in the front yard is a violation of the Zoning C►rdinance. I also point out that the deck was constructed in the storm water drainage d.isposal area, thus violating one of the underlying zoning cond.itions of approval. Our position is that the deck should be removed and the two-way drainage area should be restored to its original state. Section 4.10.080 d. 1. of the Spokane County Zoning Ordinance requires a minimum thirty-five (35) foot setback from the front property line. The applicant requests a waiver of violation to allow the violating roof structure to remain. Authority to consider such a request exists pursuant to Sections 4.25.010 and 4.25.030 f. of the Spokane County Zoning Ordinance. PROJECT LOCATION: The property is generally located in the Spokane Valley, north of Sprague Avenue and wesi ot and adjacent to Argonne Road in the SE l4 of Section 18, Township 25N, Range 44EWM. The Assessor's parcel numbers are 18544-2044 and -9150. The property is addressed as N. 101 Argonne Road. DECISION SUMMARY OF THE ZONING ADJUSTOR: Based upon the evidence presented and circumstances associated with the project proposal, the Zoning Adjustor DENIES the Waiver of Violation. The applicant acknowledged in the public hearing that even the dedc, over which the sun-shade roof was built, was not cleared with the County Depanment of Building and Safety, is more-than-likely in violation of the Certificate of Occupancy issued for the restaurant and is likely contrary to the underlying Zone Change ZE-99-84. OPPONENTS OF RECORD: None. PUBLIC HEARING: After examining all available informatlon on ffle with the application and visiting the subject property and surrounding area, the Zoning AdJustor conducted a public hearing on Oecember 28, 1988, rendered a verbal decision on December 28, 1988 and rendered a written decisfon on January 23, 1989. FINDINGS OF FACT 1. The project location is as set foAh above under PROJECT LOCATION. 2. The proposal consists of a sun-shade roof constructed in the front yard of Geoffrey's Restaurant business bcation on Argonne Road. The roof was constructed during the spring of 1988 as a covering over a deck which was constructed in the spring of 1987. The declc itself is not directly a part of the consideration of this application. The deck, however is an indirect, intimate part of this project. The deck was constructed in the front yard and over top of a portion of the 208 stormwater drainage swale required by ZE-99-84 to be functional as a stoRnwater drainage disposal area for the parking lot. The deck is adjacent to, and is an overflow seating area for, Geoffrey's Restaurant, a major tenant in the small building complex. The deck was constructed at a level less than thirty (30) inches in height. It was neither subject to a building permit nor subject to a zoning interpretation since no building permit initiated clearing the project with the Planning Department. However, the deck was used as an expansion of the restaurant and was not part of the Certificate of Occupancy initially issued to the restaurant. Additionally, as overflow seating area for the restaurant, • CASE NO. WVE-23-88; POSTLEWAIT SPOKANE COUNTY ZONING ADJUSTOR PAGE 2 there was never a reconciliation as to whether or not there was sufficient extra parking provided in the common parlcing lot. Also, since no building permit was issued and no Planning Department evaluation was made, it never came to light that the restaurant expansion into the front yard is clearly an illegal use, regardless of whether or not the actual deck was subject to a building permit. (The Zoning Administrator for the County Planning Department has advised the Zoning Adjustor that, if the deck were placed there without any restaurant use for it, it would not be a violation of the Zoning Ordinance, even though it may be a violation of the approved site plan for the underlying zone change. Part of the required 208 drainage swale was obliterated by the construction of the deck because the contractor laid black plastic beneath the deck to prohibit the growth of vegetation, thereby eliminating the purpose for which the 208 drainage swale is constructed.) Since the roof construction is subject to a building permit, the matter of whelher this is an allowed use in the front yard has oome to light. The thirty-five (35) foot setback from Argonne Road has two implications: 1) a structural setback; and 2) a setback in which a use may also not take place. There is realty a two-fold violatfon here. The Waiver ot Violation portion of the Zoning Ordinance can only deal with the unauthorized structure; not the unauthorized use. 3. The site is zoned Commercial with a thirty-five (35) foot setback; which does prohibit the use for which the applicant has established the deGc. 4. During discussions in the hearing, the Zoning Adjustor and the applicant discussed the following items: a. The applicant leases space hom Cedar Tree Builders, represented or owned by Richard Naccarato. The applicant planned and opened a restaurant, receiving the proper permits to do so, including a Certificate of Occupancy from the Department of Building and Safety upon the completion of the work. A Certificate of Occupancy takes into account (1) oonstruction and development in accordance with the underlying zone change and its associated conditions and (2) the assignment of the number of parking stalls in order to see that ihere are enough parking stalls. Any change in the size of the space or the oonstruction of the space for which a Cenificate of Occupancy has been issued, is supposed to be reevaluated by the Department of Building and Safety. b. The applicant, owner of Geoffrey's Restaurant, undertook the construction without notifying the landlord/owner of the property, Richard Naccarato. The • applicant stated that when Mr. Naccarato learned of the construction, he made a comment something to the effect that there will probably be some problems over this. c. The applicant hired a contractor, which he admitted he did not know whether was licensed or bonded, to build the declc. He assumed if any building permits were necessary, that the contractor would have acquired the building permits. d. The expansion of the restaurant, including the outdoor deck with a seating capacity of approximately thirty (30), was done so without the immediate knowledge of the owner of the property (Cedar Tree Builders) and without having approved the expansion through the Planning Department of the Department of Building and Safery. e. The applicant also testified in the hearing that as a lessee, he did not have his lease modified with the owner of the property and there was no additional rent charged for the four hundred (400) to five hundred (500) square feet of additional space onto which he expanded his restaurant needing seating area. 5. The Zoning Adjustor in the past has taken the position that lgnorance of the zoning and building laws is not atone sufficient justification or substantiation that one has erected the project in good faith and with every intent to comply with the provisions of the Zoning Ordinance. Additionally, in this instance, the applicant did not clear his project with the owner of the property, certainly a basic step of simple courtesy which one should go through, not to mention the proper legal thing to do. The owner of the property is a contractor and developer and would more-than-likely have questioned the construction, at least to the standpoint of being assured that building permits had been issued. The owner of the property, upon notification by the applicant that a deck had been constructed, (or otherwise having become aware of it) took no immediate action to require the applicant to seek proper permits or to remove the consiruction in the event ihat it was uliimately judged to be unauthorized (this is with specific reference to the deck as well as the sun-shade . CASE NO. WVE-23-88; POSTLEWAIT SPOKANE COUNTY ZONING ADJUSTOR PAGE 3 roof.) NOTE: An observation can be made that the Building and Safety Department might consider only accepting application for property owners of record or a designated agent. 6. In the past, the Zoning Adjustor has been advised by legal counsel that it is ultimately the owner of the property that bears the responsibility for what happens on his/her property, in this case unauthorized canstruction and an unauthorized expansion of the restaurant. This becomes most obvious when one asks the question "If we had a zoning enforcement problem, who would we begin investigating?" Answer: We investigate the owner of the property as being responsible for any alleged violations. 7. The required setbaGc is thirty-five (35) feet and the construction was placed approximately twenty (20) feet from the front property line. 8. The undertying zone change required there to be a certain square footage of 208 stormwater drainage swale. By constructing as the applicant did, including both the deck and the sun-shade roof, a ponion between four hundred (400) and five hundred (500) square feet was removed from practical, functional use as a stormwater disposal area. Hence, the conditions of the zone change have not been followed and the entire property is in violation oi the Conditions of Approval of the underlying zone change (ZE-99-84). 9. The Waiver of Violation is sought pursuant to the following language of Section 4.25.030 f. of the Spokane County Zoning Ordinance. "Walver ot Violation" Recognizing that a building structure...may be erected in good faith wirh every intent to corriply with the provisions oj the Zoning Ordinance in respect to the location of the building, structure...upon the lot and the size and location of required yards, and that it may later be determined that such building or structure...does not comply in every detail with the requirements, although nor violacing the spiric or inrercr oj the Zoning Ordinance, the Board of Adjustment, (the Zoning Adjustor in this case) may issue a Waiver of Violation subject to such conditions as will safeguard the public health, safety, convenience and general welfare (emphasis added.) The Zoning Adjustor reduces this language to two standards: a. The Zoning Adjustor or Board of Adjustment must find that the project was erected in good faith and with every intent to comply with the provisions of the Zoning Ordinance; and b. The Zoning Adjustor or Board of Adjustment must find that while not complying with every detail of the provisions or standards of the Ordinance, the project does not violate the spirit or the intent of the Ordinance. 10. The spirit and the intent of the Ordinance with regard to the thirty-five (35) foot setback in the Commercial zone is, among other things, to allow for the expansion of right-of-way and roadway related construction and improvements, while still having a reasonable setbadc in the future hom such improvements. This space is to be provided uniformly along our highways and byways in an effort to create safe view of trafiic entering our roadways from the adjacent propertles. Also, the space fn the front yards can be used for emergencies, fire fighting and related lssues i( the space is kept relatively unobstructed. Additionally, as in this instance, the purpose is also intended to sometimes provide room for the 208 siormwater drainage swales. 1 1. The proposal is exempt from the provisions of Chapter 43.21 C RCW pursuant to WAC 197-11-800 (6) (b). A Waiver o( Violation is technically the consideration of a variance after-the-fact. 12. No one appeared to oppose the proposal nor were any written camments adverse to the proposal received. 13. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. 14. Any conclusion hereinaher stated which may be deemed a finding herein is hereby adopted as such. From the Findings, the Zoning Adjustor comes to these: . . ~ CASE NO. WVE-23-88; POSTLEWAfT SPOKANE COUNTY ZONING ADJUSTOR PAGE 4 CONCLUSIONS 1. The applicant failed to exercise good judgement and normai tenanUlandlord procedures by not consulting with the owner of the land before consiructing either the deck or the sun-shade roof. In turn, the owner of the land, upon later finding out about the construction failed to also exercise flood judgement with regard to investigating whether the lessee had in fact exceeded any laws which woutd reflect on him, the owner of ihe land. 2. The applicant (lessee) or the owner of the land cannot defer responsibility for getting proper permits to a contractor. Although, it is common for the contractor to see to those matters, it is usually done so upon agreement between the owner and the oontractor that the contractor will assume those responsibilities, which are technically those of the property owner. 3. The applicant (and by implication of the owner of the land) failed to operate ln good faith and with every intent to oomply with the provisions of the Zoning Ordinance when the restaurant was: (a) expanded onto the newiy constructed deck; and (b) the sun-shade roof was built over the expanded restaurant space. 4. The project violates the spirit and intent of the Zoning Ordinance. The construction encroaches to a distance of approximately twenty (20) feet from the front property line, whereas lhe standard is thirty-five (35) feet. This is a substantial deviation and one, which if carried out throughout the area on our other arterials, would destroy the purpose and intent of the Zoning Ordinance with regards to setbacks. 5. The appJicant should remove or cause to be removed the sun-deck construction and to worlc with the Building and Safery Department and the Planning Department to determine if there are any other violations invoNing the related oonstruction of the deck and its use as a restaurant space. 6. Any finding hereinbefore stated which may be deemed a conclusion' herein is adopted as such. DECISION From the foregoing Findings and Conclusions, the Zoning Adjustor DENIES the Waiver of Violation and orders the removal of the sun shade roof. CONDITIONS OF APPROVAL 1. GENERAL 1. The following oonditions shall apply to the applicant, owner and successors in interest and shall run with the land. 2. The applicant and/or the property owner shall cause the removal of the sun- shade roof by on or betore April 15, 1989. 3. The applicant and/or owner is/are directed to work with the Building and Safety Department, Thomas L. Davfs, Code Comptiance Coordinator, to init+ate action to either authorize the deck as an expansion of restaurant space, coordinating with a Cerii(icate of Occupancy process and assuring the required number of parking spaces available in the parking lot and the construction of additional 208 stormwater drainage space, or remove the dedc and restore the 208 stormwater drainage area; whichever is decided upon through interaction with the Department of Building and Safety. 4. Failure to comply with any of the oonditions of approval contafned in this decision shall constitute a violation of the Zoning Ordinance and be subject to such enforcement actions as are appropriate. . 5. The Zoning Adjustor may administratively make minor adjustments to site plans or the oonditions of approval as may be judged to be within the context of the original decision. , • • CASE NO. I subsequently had a conversation with Tom Davis of the County Department of Building and Safety. He had talked with Mark Holman, the Assistant Director of that Department and they had . decided that they had responsibility to resolve the issue of the unauthorized expansion of the restaurant space. It was construction which expanded the restaurant after tbey had issued their Certificate of Occupancy. They will deal with any neaded additional parking spaces, Certificate of Occupancy and whether or not . the use is even allowed in the front lawn area. C o n s e q u e n t 1 y. I strongly suggest you consult with Tom Davis, of the Department of Building and Safety (456-3675) sometime within the first two weeks of January. Assuming, (you and Mr. Naccarato, by implication) chooso to remove the construction, Mr. Davis will guide you through the process that is necessary. He will also be able to deal with restoring ihe 208 stormwater management drainage grasses to their required level of effectiveness.
