'I'he propvsal is described above and detailed in documents contained in the file. 2. The adopted Spokane County Comprehensive Plan designates the area of the proposal as [Jrban. 'ne proposed use is generally consistent with this category. 3_ 'I'he site is zvned [3rban Residential 22 (ijR-22), whieh allows the praposed use upon approval of this applicafion. 4. T'he existing land uses in the area of the Rroposal include vacant lands, zoned Agricultural5uburban, rv fhe svuth and west, all of whrch are compatiale with the proposal. The applicant testi£ied that the owners of adjacent lands to the south and the west have been ' contacted. 'I'he applicant stated that they had little cancern, except with storm water runoff. ' 7'he storm water runoff design collects roof draLinnge and dtverts it to the park.ing lot and hence ~ , CASE NO. Presently, there are existing trees and tall shrubs on the property immediately to the west of the proposed building. As long as these exist, they will provide some screening in the area where the setback is being requested to be reduced from 15 feet to 5 feet (west bound.ary). The applicant has additionally shown by a landscaping plan that . a tree will be planted in the landscaped area immediately to the south of the small build.ing; hence, providing some visual screening for the building. Although, on this south boundary, the building could exist to within 5 feet of the property line, as it is considered a side yard in which the required setback is only 5 feet, instead of the 15 feet proposed by the applicanL 5. It is important to note that this build.ing is in a lawful location. The only request of the applicant is that the side and rear yards be switched at this corner locarion in order to provide a 15 foot setback to the south and a 5 foot setback to the west; whereas, the required yards establish a 5 foot setback to the south and a 15 foot setback to the west. The proposed juscificaaon for this is that this location, with respect to the existing parking lot layout, takes out fewer parking spaces than an orientation as per the setbacks of the zone. 6. The only problem that is foreseen with the proposal is that it cuts the travelway at the northeast corner of the building down to about 16 feet from the nearest two car parldng spaces. The applicant has agreed to eliminate some parking stalls in order to widen this travelway to an acceptable width. The Zoning Ordinance suggests a width of 24 feet for such a travelway, although that is not an ironclad rule. The County Engineer's Office reports to the Zoning Adjustor that a actual required travelway is set forth in the uniform fire code and will be enforced through the building permit process. The County Engineer's Office requested of the - Zoning Adjustor that the design of the travelway at the northeast corner of the building be handled through the approval of a parking and circulation plan to be approved by the County Engineei's Office at the time of building permit review. 7. The proposal is exempt from the provisions of the Washington State Environmental Protection Act, Chapter 43.21C RCW pursuant to WAC 1997-11-800 (6) (b). 8. The applicant has been made aware of the recommendations of various County agencies reviewing this project, 9. The proper legal requirements for advertising of the hearing tzefore the Zoning Adjustor of Spokane County have been met. 10. No adverse testimony or written comments were received regarding the proposal. . 11. Granting the variance will be neither materially detrimental to the public welfare nor injurious to property or improvements in the vicinity and zone. 12. Strict application of the zoning standards dces creaie an unreasonable burden in light of the purpose to be served by the standards. 13. With the conditions of approval set forth below, the variance will: 1) not constitute a grant of special privileges inconsistent with limitadons on other properties in the vicinity and similar zone; b) ensure that the intent and purpose of the Zoning Ordinance is achieved with regard to location, site design, appearance, and landscaping, etc; and c) protect the environment, public interest and general welfare. r CASE NO. DECISION From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES the proposal, subject to compliance with the following CONDITIONS OF APPROVAL 1. GENERAL 1. The following conditions shall apply to the applicant, owner and successors in interest and shall run with the land. 2. Failure to comply with any of the conditions of approval contained in this decision, except as may be relieved by the Zoning Adjustor, shall constitute a violation of the Zoning Code for Spokane County and be subject to such enforcement as is appropriate. 3. The Zoning Adjustor may administratively make minor adjustments to site plans or • the conditions of approval as may be judged by the Zoning Adjustor to be within the context of the original decision. II. PLANNING DEPARTMENT 1. Construction and location of the building and adjacent landscaping shall be as shown on the approved site plan, dated December 19, 1990. The deta.ils of the travelway and parking shall be handled by the County Engineees Office. 2. Design and layout of the parking lot east of the northeast corner of the building shall vest with the Spokane County Engineer's Office through approval of a traffic and circulation plan. III. DEPARTMENT OF BUILDING & SAFETY 1. The applicant shall contact the Department of Building and Safety at the earliest possible stage of design/development in onder to be informed of Code requirements administered/enforced by the department, e.g., State Building Code Act regulations such as requirements for fire hydrant/flow, fire apparatus access roads, street address assignment, barrier-free regulations, energy code regulations, and general coordination with other aspects of project implementaeon. 2.
