APPLICATION DESCRIPTION: The applicant proposes to construct and locate a low
intensity, internally illuminated combination school identification and bulletin board sign: (a)
with an area of 56 square feet per side; and (b) not exceeding 18 feet in height. Section
14,804.060.1. of the Zoning Code for Spokane County allows this type of sign to have a
maximum area of 32 square feet per side and not exceed 14 feet in height. (Note: The Zonxng
Code was amended July 9, 1991 to allow a 32-square foot sign up to 14 feet tall.) Authority to
consider such a request exists pursuant to section 14.404.080 of the Zoning Code for Spokane
County and Spokane County Board of County Commissioners resolution No. 89 0708, as
may be amended. PROJECT LOCATION: Located in east central Spokane County, east of and adjacent to
Park Road and approximately 300 feet north of Broadway Avemle in the NW 1/4 of Secaon
18, Township 25 N, Range 44 EW1VI; 915 N. Ella Road. (Sign is proposed in the southeast
portion of the school property).

PUBLIC HEARING AND DECYSION: After considerarion of ait available information
on file, exhibits submitted and testimony received during the course of the public hearing held
on ~pS~mber 11, 1991, the Zoning Adjustor renders a written decision on , 1991 to APPROVE the application as cond.itioned below. ~
. FINDINGS OF FACT AND CONCLUSIONS
1. Initially comments need to be made with xespect to the approach of the school, the
school district, the sign company (that made the sign) and the cirizens group. All of these
entities showed a measure of general irresponsibility and disrespect for the land use regulations
established by the County. The sign company is a long established fum with many years of
experience with sign construcrion and sign regulation in Spokane Counry. The staff and
management of the company know full well that signs are regulated throughout Spokane
County. There is no excuse for their having not checked to see if the sign they were being
asked to make was in fact legal. Minimally, they could simply have advised the school or
citizens group to check. That having been done, a proper, lawful procedtire could have been
followed, greatly expediring the process.
Equally so, the school district, the school officials of Centennial Middle School and
the citizens group have not acted responsibly by not checking with the Division of Buildings or
the Planning Department to determine if the sign they wished to build was a legal sign. Had

they done so, the process could have been handled with much less red tape and in a more
compressed time frame. Additionally, the process was extended considerably when the
applicant failecl to meet the public notice hearing mailing deadline established by the
Washington State legislature, thus postponing the hearing for more than a month.
The part that bothers the Zoning Adjustor the most is that the children of the school
are being set up to believe that land use regulations have no purpose and that the most effective
way to deal with these laws is to proceed with a project, without respect to whether or not it is
a Iawful project, and then to attempt to use media pressure and intimidation to gain approval
after the fact. Fortunately, for the very good purposes which this sign will serve, there exists
the bare essentials which enable a variance to be approved; although, the reasons were not
established outright by the applicant. The Zoning Adjustor's careful structuring of several key
questions in the hearing and the resiilting answers managed to establish a wealc case for
approval.
If one other benefit is gained from the approval of tlis sign,besides the existence of
the sign itself, the Zoning Adjustor hopes that somebod.y will pick up on the theme that
everybody in the community, businesses, schools and individuals,has a responsibility to
investigate land use regulations prior to undertaking any project which would change the
physical appearance of the landscape. After all, land use regulations exist only to protect the
majority of citizen against the actions of a small mznority.
2. The proposal is described above and detailed in documents contained in the file.
Acrual proposed location of the sign is not clear; but, is clarified'in the conditions of approval.
3. The adopted Spokane County Comprehensive .Plan designates the area of the
proposal as Urban. The proposal is generally consistent widl this category and complies with
RCW 36.70.450.
4. The site is zoned Urban Residential-3.5 (UR-3.5), which allows the proposed use
upon approval of this application.
5. The existing land uses in the area of the proposal include rental apartznents to the
east and vacant land (owned by the school clistrict) to the south, all of which are compatible
with the proposal.
6. The proposal is exempt from the provisions of the Washington State Environmental
Policy Act, Chapter 43.21C RCW pursuant to WAC 197-11-800 (6) (b).
7. No adverse testimony or written comments were received regarding the proposal.
8. The Zoning Adjustor may require such conditions of approval as necessary and
appropriate to make the project most compatible with the public interest and general welfare.
9. Various performance standards and criteria are additionally needed to make the use
comparible with other permitted activities in the same vicinity and zone and to ensure against
imposing excessive demands upon public utilities, and these shall be addressed as conditions
of approval.

10. The school is a recently renamed school and lacks somewhat a name familiarity for
the nearby communiry and school service area. The school presently has no readily visible
sign identifying the school as "Centennial Middle School." The only sign is one which is
fastened on the side of the school near the entrance; but, this wall-mounted sign is, for all
practical purposes, hidden by the wing on the south side of the school which projects east
towaxd Ella Road. The proposed sign is actually a combination of an allowed school
identification sign (15 square feet) and a bulletin board sign presently allowed at 32 square feet.
This concept of combining the signs into one would create a sign of 47 square feet ; whereas,
the proposed sign is 56 square feet.
11. The school is not at a busy intersection and suffers somewhat from a highly visible
and prominent Iocation on an arterial. Anyone presendy looking north on Ella Road from
Broadway, would not be able to clearly identify that the school site, 'partially due to the lack of
a sign. The proposed sign would place an illuminated sign in a location where it might be seen
and identified from Broadway, thus helping the school with both it's name change and it's
location. The school is used for various community events and meetings, some at night, thus
militating in favor of a lighted sign.
12. The sign is proposed and be erected in a location which may be obscured by a
young deciduous tree to its inlmediate south-southwest location. The most preferred location
for the sign appears to be farther to the north and as close to the Ella Road property line as
possible, without overhanging the actua.l public road right of way. An alternative and more
visible location (from the Broadway approach) is south of the tree and on school property.
13. The community in general would benefit from this slightly larger sign, located more
prominently visible from the intersection of Broadway and Ella Road. Almost all of the traff c
approaching the school, does so from Broadway, as Ella is not a through street due to the
location of Interstate 90 to the north.
14. The proper legal requirements for advertising of the hearing before the Zoning
Adjustor of Spokane County have been met.
15. With the conditions of approval set forth below, the variance will: a) not constitute
a grant of special privileges inconsistent with limitations on other properties in the vicinity and
similar zone; (b) ensure that the intent and purpose of the Zoning Code is achieved with regard
to location, site design, appearance, landscaping, etc.; and c) protect the environment, public
interest and general welfare.
16. It is necessary to stipulate that this sign is a combination school identificarion sign
(14.804.080.3.b.) and a bulletin board sign (14.804.060.1.e.) and that no additional school
identification sign is allowed as long as the subject sign is in existence.
DECISZON
From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES
the proposal, subject to compliance with the following

CONDITIONS OF APPROVAL
x. GENERAL
1. The following conditions shall apply to the applicant, owner and successors in
interest and shall run with the land.
2. Failure to comply with any of the conditions of approval contained in this decision,
except as may be relieved by the Zoning Adjustor, shall constitute a violation of the Zoning
Code for Spokane County and be subject to such enforcement as is appropriate. .
3. The Zoning Adjustor may administratively make minor adjustments to site plans or
the conditions of approval as may be judged by the Zoning Adjustor to be within the context of
the original decision.
H. PLANNING DEPARTMENT
1. The sign pole shall be located approximately 8 feet from the curb and approximately
centered on the exit doors fonn the southern most wing of the school facing Ella Road (see the
"Centennial Middle School Recreational Master Plan" with approval by "tgm" on September
17, 1991. 1'he Zoning Adjustor may approve some deviations from this locarion upon written
request. An alternarive location south of the tree and the same distance from the curb is
acceptable and actually may be more visible.
2. The sign shall be located on a single pole approximately 10 feet tall with the top of
the sign not exceeding 18 feet above grade.
3. The sign shall be substantially as showri on the sign drawing and attached
photograph.
4. The illumination of the sign shall be low intensity and may be equally visible from
both sides.
5. The sign shall be operated on a timer so as to not be visible later than 10 p.m.
Daylight Savings or Standard Time.
6. This sign takes the place of any otherwise allowed free standing school
identification sign which might otherwise be allowed under 14.804.080.3.b. No other free
sta.ndicag signs will be allowed on Ella Road as long as this sign is in existence.
III. DIVISION OF BUILDINGS
1. - The issuance of a building pernut by the Division of Buildings is required.

THIS MATTER, an application for street frontage Administrative Exception, has been
received and decided upon, pursuant to the Zoning Code of Spokane County, Sections
14.506.020 7. and 14.506.040, on the ~ day of September, 1991.
FINDINGS OF FACT AND CONCLUSIONS 1. The individual signing below has been delegated the responsibility for
rendering this decision by the Spokane County Director of Planning.
2. The Spokane County Planning Department has received an application from
James F. and Jo Anne Garst for access to a 9.75 acre lot for residential use. The subject
parcel has 0 feet of frontage on a public road; whereas, section 14.640.315 of the Zoning
Code for Spokane County requires 330 feet of frontage. The parcel would be served by
a private driveway located on a 60 foot driveway from Jensen 12oad across intervening
property. The easement is already, or will be soon, established between private parties.
The County is NOT establishi.ng the easement.
3. This property is generally located east of the City of Spokane, east of Jensen
Road and south of Bigelow Gulch Road in the SE 1/4 of Secrion 30, Township 26 N,
Range 44 EWM; approximately 6514 N. Jensen Road.
4. The current zoning of the property is General Agricultural; which zone has a
minimum lot size of 10 acres. The 9.75 acre lot qualifies in so far as its legal description
is a 1/4, 1/4, 1/4 section. .
5. In compliance with RCW 36.70.450, the Planning Department has
determined that this proposal is generally consistent, as conditioned, with the Rural .
category.
6. The applicant has demonstrated that a suitable easement can be recorded in
the Auditor's 4ffice, which easement will provide adequate locarion for a private road
capable of ineeting both County and fire district standards for access.
7. 'Ihe applicant has demonstrated that an adequate maintenance ag-reement can
be recorded in the Auditor's Office sufficient to assure access for personal and emergency
vehicle use.
8. The project is exempt from the State Environmental Policy Act, purstlant to
WAC 197-11-800(6)(b).

9. The Planning Department failed to require a ULID agreement/covenant to be
signed and submitted. This must be done prior to issuance of a building penmit.
DECISION
BASED UPON THE ABOVE Findings of Fact and Conclusions, Administrative
Exception application is hereby APPROVED, as shown on the approved site plan and
other file documents for access to a landlocked lot. This decision is final unless appealed in
writing, consistent with appeal procedures.
CONDITIONS OF APPROVAL -
1. GENERA]L
1. The following condirions shall apply to the applicant, owner and successors
in interest and shall run with the land.
2. Failure to comply with any of the conditions of approval contained in this
decision, except as may be relieved by the Planning Department, shall constitute a
violation of the Zoning Code of Spokane County and be subject to such enforcement as is
appropriate.
3. The Planning Department may administratively make minor adjustments to
site plans or the conditions of approval as may be judged to be within the context of this
approval.
IY. PLANNING DEPARTMENT
1. When Iocating a house in a wooded homesite area, the applicant is advised to
consult with the local fire distr-ict regarding various steps one can take to mi.nimize the
danger to the stx-ucture from a wildf'i.re running through the area. Such measures would
include vegetarion clearance around the dwelling unit, roofing materials that are least likely
to ignite from nearby heat, the planting of deciduous trees and shrubs in closer proximity to
the house (as opposed to evergreen shrubs and trees), etc.
2. This parcel shall not be further subdivided unless consistent with RCW
58.17, the county subdivision regulations; the Zoning Code and the Comprehensive Pian.
3. Prior to the issuance of any building permits, the applicant shall file with the
Planning Department a copy of the segregation application necessary to recognize the
subject property as an ind.ividual tax parcel, except that this condition shall not apply if the
parcel is presently established with a parcel number.
4. Prior to the release of building pernuts, the applicant, heirs or assigns shall
subnut to the Spokane County Planning Department documentation for each parcel,

recorded in the Spokane County Auditor's office, indicating a maintenance agreement has .

5. Prior to the release of building permits, the applicant, heirs or assigns shall
submit to the Spokane County Planning Department documenta.tion for each parcel,
recorded in the Spokane County Auditor's office, indicating a.ll necessary easements exist
to provide access to the Spokane County right-of-way. Subject easements shall be site
specific and not of a general nature indacating only passage across various parcels of land.
6. Prior to issuance of a building permit, a ULID agreement/covenant sha11 be
signed and submitted to the Department. The Department shall file this ULID document in
" the appropriate manner.
M. DIVISION OF BUII,DINGS
1. Requirements of Fire District No. 9 need to be satisfied during the building
permit process. These are listed below in VTI for convenience.
2. The applicant is advised that the private road shall be named and signed in
accordance with the provisions of Spokane County Road Standards. This condition may
be waived in the event that the Division of Buildings determines addressing on
Jensen Road is acceptable. However, at such time as the Division of Buildings feels the
need for the road to become a private, named road, this applicant shall participate and
cooperate in this process.
IV. DIVISION OF UTILITIES
1. Pursuant to the Board of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. This authorization is
conditioned on compliance with a.ll rules and regulations of the Spokane County Health
District and is further conditioned and subject to specific application approval and issuance
of permits by the Health District.
2. Owner(s) or Successor(s) in interest agree to authorize the County to place
their name(s) on a petition for the formarion of a ULID by petitian method pursuant to
RCW 36.94 which ttie petition includes the Owner(s) property and further not to object by
the signing of a protest petition against the formation of a ULID by resolution method
pursuant to RCW Chapter 36.94 which includes the Owner(s) property. PROVIDED,
this condition shall not prohibit the Owner(s) or Successor(s) from objection to any
assessment(s) on the property as a result of improvements called for in conjunction with
the formation of a ULZD by either petition or resolution method under kCW Chapter
36.94.
3. Any water service for this project shall be provided in accordance with the
Coordinated Water System Plan for Spokane County, as amended.

V. SPOKANE COUNTY HEALTH DISTRICT
1. The approval of this ad_min.istrative exception for lack of minimum f.rontage
on a public street does not constitute that a buildable lot exists for development of a
residence. A residential structure is subject to applicarion and approval of pennits for
building(s) and on-site sewage disposal system(s). Parcel size may be a critical factor.
VI. DIVISION OF ENGINEERING AND ROADS 1. The County Division of Engineering and Roads has determined that the
private roadway easement serving the parcel(s) should not be designated as a Tract "X"
Future Public Right-of-Way Tract. Prior to the release of a building permit, the applicant
must sign and record "Spokane County Notice To The Public No. 3." This document
specifies the following:
a) The private road shall be constructed in accorda.nce with Spokane County
standards for private roads.
b) Should Spokane County be requested to create a Road Zmprovement
District for the purpose of improving the private road easement to a public
road standard, the applicant agrees to del.iver to Spokane County the right-
of-way necessary for a public road.
c) The applicant agrees to join in and not oppose the creation of a Road
Improvement District (RID) or County Road Project created for the
purpose of improving the private roadway to a public road standard.
d) Serves notice to future property owners that Spokane County is not
responsible for private roadway construction, maintenance, snow removal
or any other services on the private road.
2. The private road shall be named and signed in accordance with provisions of
Spokane County Road Standards.
3. An approach pernut shall be obtained from the Division of Engineering and
Roads prior to the construction of any new driveway approaches. This shall be done prior
to the release of a building permit, change of use permit or certificate of occupancy.
4. Prior to the release of a building pernut, change of use permit or certificate of
occupancy or issuance of an approach permit, the applicant shall submit road and drainage
plans to the County Division of Engineering and Roads for review and approval. Road and
drainage plans shall be prepared in compliance with Spokane Counry Road and Drainage
Standards. This condition may be waived by the County Division of Engineering and
Roads.
5. The applicant shall contact Fire Disrrict No. 9 to assure that fire district access
standards and the provisions of the Fixe Code are being met.

6. Applicant shall sign and record Spokane County Notice to the Public No. 6
which specifies the following:
The owner(s) or successor(s) in interest agree to authorize the County to place their
name(s) on a petirion for the formation of a Road Improvement District (RxD) by the
petition method pursuant to Chapter 36.88 RCW, which petition includes the owner(s)
property, and further not to object, by the signing of a ballot, the formation of a RID by the
resolution method pursuant to Chapter 36.88 RCW, which resolution includes the
owner(s) property. If an RID is formed by either the petition or resolution method, as
provided for in Chapter 36.88 RCW, the owner(s) or successor(s) further agree:
(a) that the improvement or construction contemplated within the proposed RID is
feasible; =
(b) that the benefits to be derived from the formation of t1e RID by the property
included therein, together with the amount of any County participation,
exceeds the cost and expense of fozmation of the RID; and
(c) that the property within the proposed RID is sufficiently developed.
Provided further that the owner(s) or successor(s) shall retain the right, as authorized under
RCW 36.88.090, to object to any assessment on the property as a result of the
improvements called for in conjunction with the formation of the RID by either petition or
resolution method under Chapter 36.88 RCW.
This requirement applies to Jensen Road, from which the subject parcel takes access.
VII. SPOKANE COUNTY FIRE PROTECTION DISTRICT NO. 9
The following are presented for convenience and are enforceable by the Division
of Buildings and/or District.
1. The access road shall have turnouts and turnarounds as prescribed by the _
District.
2. The access road shall carry a super imposed load of fire fighting apparatus.
3. Address numbering shall be installed to the District's satisfaction.
