application.
FINDINGS OF FAC7'
l. Testimony was tal:en under oath.
2. The proposal is described above and detailed in docur»ents cantained in ule fllc.
Additionally, referring to the 'approved site plan' containeci in the file, the applicants have
described a'house exercise area' (A) as being proposed to completely enclose an area suitable for
dogs occupying the house to be let outside for exercise and waste elimination purposes. This
fence, associated with the 'house exercise area,' is to be a newly constructeti fence. The applicarits
also described a'puppy pen' exercise area at the approximate location shown. This fence is
approximately 4 feet high and made of wire sufficient to contain the smaller, younger animals. Thc
'puppy pen' area is presently entirely visible from the south and the view fi•nm the puppy pen
presently clearly includes all of the beauty salon property and parking lot to the sauth. The
proposed kennel building itself (B) is an "ancient" small barn, originally used as a"pig pen," ancj
is presently in very dilapidated cond.ition. It is partially converted ta a kennel a-ea at the present
time. Its principal propased features are as follows:

b. 10 indoor-outdoor runs will be created, each a total of 16 feet by 4 feet, with
approximately 8 feet of each run outside of the building, separated by the south wall of
the building. Some of this wall is concrete and some is wood. c. The pens/runs will be accessible from the inside storage area of the kennel building.
d. The kennel building itself will have R-11 insulation installed in the walls and ceiling and
new sheet rock applied to the interior walls and ceilings.
e. Each kennel will have the outdoor and indoor run areas separated by a drop door,
capable of contairung the dogs inside at night.
f. The building will have shuttered windows, capable of being opened to scrzen ventilation
on both the east and west sides of the building.
g. The outside runs will each be 8 feet long and 4 feet wide, with a pea gravel floors.
h. The kennel runs will be separated by a 6 foot tall solid board fence. The solid board
fence will also enclose the entire outdoor kennel area, including a small outside gate for
each kennel. .
i. A portion of the outside kennels will be sheltered with a roof structure, probably
translucent acrylic plastic or similar, for the purpose of shade and shelter.
3. The adopted Spokane County Comprehensive Plan designates the area of the proposal
as Major Commercial for about the east 150 feet and Urban for the west 214 feet. The Major
Commercial category encourages commercial activities, some of which could easily rival or exceed
the impact of a kennel, regardless of the size/number of dogs. The Urban category generally
embraces limited business or other activities subordinate to and respecting residential occupancy of
the land.
4. The site is zoned Urban Residential - 3.5 (LTR - 3.5) and Community Business (B-2).
The actual proposed kennel building is on the UR - 3.5 land and is a.llowed upon approval of a
conditional use permit.
5. The existing land uses in the area of the proposal include approximately 1/2 to 3/4 acre
residential lots in the block bounded by Margarite, Alki and Argonne (including the site of the
proposed kennel). Immediately to the south of the proposal exists a beauty salon which has
occupied this former residence for approximately 4 years. Immediately to the north is an existing
house, the residents of which allegedly have two "chow" dogs which allegedly routinely violate
standards of courtesy and are a nuisance with respect to waste eli.mination, bar.king and running
unsupervised in the area. Across Argonne to the east are numexous businesses, including a
wedding chapel business, off'ices, and a day care center. The center of the large block in which
this parcel exists is devoted in many cases to vacant and overgrown pastures; although, some of
the parcels are developed and maintained as larger residential lots. The applicant has one horse on
the westerly part of the property. Typically, uses listed as a condirional use are assumed as
permitted in the underlying zone, subject to the listed standards and any other conditions needed to
assure compatibilxty in the given instance. But, pursuant to 14. 404.101, the requested conditional
use permit may be denied if the Hearing Body cwlnot find that the requested use will be compatible

with other permitted uses. Section 14,616.240.5 1-ists certain standards to achieve compatibility,
some o#' which the Hea.ring Body may exercise nominal discretion over to achieve the overall intent
of compatihility vwith surroundxng properdes. Clearly, 14.404.102 allows the Hearing Bo3y to
impose any and all manner of add'ational conditions and requirement,s in an effart to achieve
ma:ximurn compatibilifiy.
6. The existin~ PuP,Py pen area technic4i11y falls urider the ju-risdictivn of subsection 5,d. of
section 14.616.240. Since this is not the primary exe.rcise area of the adult dogs, it will be
suf-ficient to use this area with screening p.rovided on its south side.
7. The applicant has stated c1early they intend to comply with al1 of the standards setforth
in the ZDning Cade.
8. Numerous camments were mad,e wliich were critical of the pzopasal. Many of the
comments had to da with the unauthorized_ keiiiie1 ope-ration which has existed since apparently
about the beginning of the year (begi-n nxng o#' ,1993); al thOLI gh the appl.ican ts have resided fihere for
a 1onger period of tiziie. Adrrerse coniments incllide: barkrng dogs; olor fr.oIn alleged dog waste;
physical appearance of the property; znd -ciggressive, vicsous acfing dogs, intimidating patrons of
the salon next door. The applicant contested stveral of the camplr~nts, stating that the animals
always were "supervised" when they werc outszde. 7-'he strong, offensive odor is alleged, by the
applicant, to come frorn a la-rge prle of o'ld horse manure wh-ich they removed from the intended
ken.nei and placed undez- the plastic tarp. The owner of the property wa.s a.lJ.eged.ly supp~sed to
remave khat pi'le of horse manure; but, has thus far failed ta da so. (Persans in the audience weTe
urged to contact the Spokane County l~ealth Departranent for odor and unsanitary situations.) The
practice of allawing these dogs, to run reXativety free while chLned up or attached to a pu1ley/wire
apparatus, is ❑ot eonsistent with the requirements of the conditionaL use permi-t section to have
. the rurt or yard area (shall) to be e;lclosed with a szx foot s-ight obscuring fence..." Zoning
Co1e § 14.616.240.5.c. Several persons also spoke about the applica,nt's alleged inability to
affard the necessary improvements at the property; strongly suggesting he vvauld be unable to
fallow through witri promised improvcnients. This was stipported by a represetitative frorn the
Animal Control Qffce, Nancy Sattin, who stated that t.heir licensing requirements were slawed and
impaixed by the applicaiit's lack of ability to a.fforct to tnake irnpravernentS -in a timely fashxan. rI'~e
Zoriing Adjustor vbserved the property and verifies the general claim by liumerous apponents of
recoxd that the propexty apgears ~o be presently in a state of partial neglect and showing inadequate
care compared with sorne of the business and residential _properties xn the area.
9. The blue taurp covere.d manure pile on the pr~-pertY is due to the building being
converted to a kenne1.
10. The proposal is exenipt from the provisions of the Washington State Environmental -
Policy Act, Chapter 43.21C RCW, pursuant to WAC 197-11-800 (1) (iii) and the Spokane
Environmental Drdinance 11.10,070 (1) (c),

the Zoning Adjustor restricts any signs regarding the kennel to camply with sectivns

presently exisfing in the area. Certainly, lesser intensity, s-ize, and prominence 3n size of sigiis is

6. Any approval of rhe dog kennel must be accompanied by a rigid set of standards and
criteria to clarif}r and enumerate the impravennents neede.d. Period.~c time ffirnes for conlpliance

rnaintaiii contro.l of the appearance of the site and effectiveness of the conditions caf approval.

10. The Zaning Adjustor concludes that the proposed kennel ope:rabon, conditioned as
below will not be unduly detrit~ental to su.rroundin.g properties. However, the law does not
require that all adverse impacts be elinv.nated. If it did, no change in land use would ever be
po,ssible, Marantha Mintng, Jnc. v. Pierce Cy., 59 Wn. A.pp. 795, 804, 801, P. 2d, 985 (1990)-

PROPOSAL: The applicant requesis permission for a kennel operation to house no more
than 10 adult dogs. Section 14.616.240.5 of the Zoning Code of Spokane County allows this
use upon issuance of a conditional use permit.
