address rtself to a"home industry" use The Urban category does allows for "home occupations", wluch are similar to the "home profession" use which may be approved administratively by the County Ihvision of Planning in the vanous zones recognized by the County Zoning Code The Urban category recommends that before home occupations are X approved in an existing residential area, it should be See County Resolution No 97-0874 The project file does not reflect contact vnth the City of Spokane or the Town of Millwood regardzng the project However, the mte is located outside such junsdictions' sewer and water service area. The site is located across from an active set of railroad tracks and has conveiuent access to nearby artenals via Utah Avenue Such road is classified as a Loca1 Acces.s road, but functions as somewhat of a collector road in the area due to the lack of crossing intersections ~ T1re automotive detailing, cleaning and mmor repair business conducted by the apphcant is X performed in the detached shop, wluch shop has much less than tvvice the gross floor area of the residence on the site T'his easily illustrates comphance wrth Zoning Code 14 616 240 (b) The ExaBUner has added a condihon restncting busmess achvihes to the deta,ched shop This includes the waslung of velucles The record ind.icates that 2 persons are currently employed in the business, both of which are family members At least one of the family members, and perhaps both, reside on the site This easdy illustrates comphance vnth Zorung Code 14 616 240 (c), which allows an unlunrted number of faznily members resldzng on srte, and up to 2 outside employees to be vavolved in the busmess Zonuig Code 14 616 240 (4)(c) authonzes a home industry an unlighted sign anth a maaumum aarea of 4 square fee# on a face The apphcant does not currently display a siga for the business and has not proposed a sign The apphcant has not proposed any wuidow or outside displays, and there is no evidence of any stock being stored or commodzty kept for sale on the site that ls unnecessary to the home industry Wiule several owners of property residuig wrthin a 400 foot radzus of the site objected to the home industry, the only property owner who observed noise conung from the existing business was the owner of properiy located directly south of the southeast porhon of the site Such person indicated that the business was noisy at times, but did not descnbe noise as a major problem See letter subnutted on 8-11-00 from Ivo McKittnck, and testimony of Ivo McKtttnck. The Examiner agrees with Planning staff and the apphcant that noise unpacts will be minimal provided the busmess is operated only wrthui the detached shop The apphcant is requn-ed to comply vnth the maJnmum noise levels for residential property estabhshed in chapter 173-60 WAC There ls no evidence that such levels will be exceeded by the project The apphcant indicated that a11 waste chenucals generated by the busmess are disposed of at the Valley tra~nsfer station located on Sullivan Road The Examiner has added a condzhon to ensure tlus A fan is used to ventilate the detached shop from one end to the other Cowaty Fire Distnct 1 conchtions require the apphcant to meet the reqwrements of the Uniform Fu e Code, for any pauiting done on site The Examiner has added a condition requuzng the apphcant to comply wrth apphcable axr polluhon control reqwrements adopted by the Spokane County Air Pollution Control HE Fmdings, Conclusions and Decision CUE-15-99 Page 7 Some property owners expressed concern over the traffc generated by the project along Utah Avenue, which has a somewhat natrow paved width See testmmony of Ivo McKittnck However, the record in&cates that the business typically handles only 3-4 vehicles per day, although as many as 12 customer velucles have been left on srte at one time The business acrivrty during the wurter ls low to non-existent See testimony of Mchael Howell The Planning file (No F-352-99) estabhshed for a zoning complauit fileci by a neighboruig property owner in 1999 indicated that the business was causing a taraffic hazazd by customer vehicles backing out onto Utah Avenue County Engineeruig dzd not express any concern over the traffiic impacts from the home mdustry, but has reqwred that the apphcant subnut a parking and ftffic circulation plan for the d home industry for review and approval by County Engmeermg The apphcant is also requzred to approve a road unprovement distnct (RID) wauver, wluch includes the apphcant's property in any future RID formed by the County for the unprovement of Utah Avenue The Exammer has added a condirion of approval restricting access to the site to the existing approaches for the residence and the detached shop, and prolubihng the apphcant from creating a traff'ic hazard along Utah Avenue The pnmary issue regarding approval of the home industry is malntenance of the residenhal appearance and character of the site, considermg the number of customer velucles comuig to and leav;ng the site, and the number of vehicles stored or pazked on site, or along neighboruig streets near the site The Zonuig Code gives the Heanng Exammer broad discrehon over parktng, traffic and storage requirements for the home industry The Exammer is of the opunon that to retain the residential appearance and character of the site, no more than 4 customer velucles should be pazked on or near the site at any one tune, and no more than 2 such vehicles should be visible outside the shop or sight-obscuring fence on the srte There is room in the shop dnveway for 2 customer velucles, room in the residence dnveway for a customer velucle, and room for 1 or 2 velucles ulside the detached shop The west side yard of the shop, which is 20 feet vvide, is currently used to store 2 personal vehicles whrch the apphcant plans to detail at some point There may be room for another velucle in such location The parlang of customer vehicles in the front yazd of the site, west of the detached shop, dettacts from the residential appearance and character of the subject property and should not be allowed The Exammer has added conditions of approval in these regards The apphcant is reqlured to obtain a builduig permrt for the attached shop The Exammer has required that such builduig pernart be apphed for withui 30 days of this decision The reqturements of the State Environmental Pohcy Act and the County's Local Environmental Ordinance have been met The Heanng Exammer concurs Rnth the Deternunation of Nonsigmficance issued by the Division of Planning With unposition of the above conditions on the home industry, the subject property will be able to retaui its residenhal appearance and character, wnll be reasonably compahble vnth adjoining land uses and other land uses m the UR 3 5 zone surrounding the srte, generally conforms vnth the Urban category and other relevant pohcies of Fact and Conclusions of Law, the above apphcation for a condihonal use permait for a home industry in the exishng UR 3 5 zone, for an automobde cleamng/detailing/aunor repair busmess, is hereby The site plan illustrates that the existing shop and parking area is accessed from Utah Avenue. Staff Anaivsis: I Comprehensive Plan: The site is located within the Urban category of the Comprehensive Plan. The Urban category is intended to provide the opportunity for the development of a°citylike" environment which includes various land uses, intensive residential development, and public facilities and services. The Urban category states that the more intensive uses such as light industrial and neighborhood commercial should be located near the heavily traveled streets, with the less intensive uses such as residential isolated from the noise and traffic. The Urban category indicates that buffering, screening, or other performance standards may be required to make potentially conflicting land uses compatible. Objective 1.1.i states that " Home occupations may be allowed provided they are non-disruptive of neighborhood amenities" and is followed by Decision Guideline 1.1.7 which lists criteria to be considered prior to the approval of a home occupation. These criteria state that prior to the approval of a home occupation, it should be determined that it will not result in the disruption of residential amenities concerning sight, sound or smell, create traffic hazards or negatively affect intended uses within the Urban category. The proposed Home Industry can be generally consistent with these criteria if the proposed auto detailing business is performed within the detached shop in order to minimize noise impacts to the adjacent properties and if the number of customers visiting the site is kept to a minimum. Decision Guidelines 1.5.1 and 1.5.2 require the use of buffering to mitigate the impacts between proposed and existing uses. The proposed Home Industry is limited to the west end of the subject property in the area of the detached shop. If the proposed business can be confined within the detached shop, then additional buffering for the home to the west of site may not be necessary. The Urban category does not specifically recognize a Home Industry, however, a Home Industry is similar to a home occupation and is an allowed use in the Urban Residential-3.5 (UR-3.5) zone provided the applicant applies for and receives a Conditional Use Permit. The site is also located within the Spokane City Fringe Area designated by the Comprehensive Plan, which is the unincorporated areas of the County that lies within one (1) mile of the Spokane City limits. The intent of the Spokane City Fringe Area section is to provide guidelines for development in the "Fringe Area" and the purpose is to provide a means to determine whether or not a proposal should be approved, conditioned or denied. Objective 30.1.a is to provide residents of the Spokane Fringe Area a quality of life by using the Comprehensive Plan as a primary tool for guiding development. As stated above, the proposed Conditional Use Permit for a Home Industry is consistent with the Goals, Objectives and Decision Guidelines of the Urban category. As proposed, the application for a Conditional Use Permit for a Home Industry is consistent with the Goals, Objectives and Decision Guidelines of the Comprehensive Plan. Zoning Analysis: The proposal is located in the Urban Residential-3.5 (UR-3.5) zone and the purpose of the Urban Residential-3.5 (UR-3.5) zone is to implement the lower density range of the Urban category of the Comprehensive Plan. The intent of this zone is to promote areas of primarily single-family residential use in an urbanized neighborhood setting, having a high level of public services. A Home Industry is an allowed use in the Urban Residential-3.5 (UR-3.5) zone provided the applicant applies for and is granted a Conditional Use Permit and demonstrates compliance with the Conditional Use Permit criteria of the Spokane County Zoning Code. Sections 14.404.101 and 14.616.240(4) of the Spokane County Zoning Code identify the criteria governing the approval of a Conditional Use Permit for a Home Industry. Section 14.404.101 of the Zoning Code states that before a Conditional Use Permit is approved, the Hearing Examiner shall find that 1). Adequate conditions and restrictions are attached to the development of the property to ensure that the proposed use will be compatible with uses permitted outright in this location; and 2). The special standards as outlined in the Zoning Code for the underlying zone shall be met.
