FINDINGS OF FACT~AND CONCLUSION
1. The proposal is descn'bod above.
2. The adopted Spokane Gbunty Futurc Land Use Plan designat,es the area of the
proposal as Urban. The proposal ascs arc generally consistent with this caugory.
3. The site is zoncd Agrioultural Suburban, which places a three (3) foot height
limitation on residential fences widun the front yard.
4. Prnpcr public notivc has boen given to all parties requircd by state statute and local
ordinance.
5. A numbcr of pooplc appcarod to opposc the grandng of the application. A major
concern was that a fenoc vanance would be the beginning of future commercial acdvities on the
site. The Zoning Adjustor finds the fence not to be a comrmrcial activity and that no request
for commercial use was considered during the course of the public hearing.
6. The applicant indicated the fence was installed by a fencing contrwtor who never
ind.icated a problem or permit was requirod with the establishment of the fence.

horses are maintaincd in a mainncr consistent with the rCquirrments of the Agricultural

has added to the propcrty valucs in the anea and hc supports the rcqucsted Waiver of Violation.
9. The Zoning Adjustar finds that the fencc has bocn professionally crectod and is not
an obstruction to tr-affic in the arca.
10. The various County Dc~partments reviewing the proposal have not expressed any
concerns with the fence as cunrndy encted.
