wrecking and salvage yard, known as "Spalding Auto Parts," by adding approximately 11 '
acres of an adjacent parcel of land to the existing facility. Section 14.629.020 of the Zonin(, ;
Code of Spokane County allows such a use upon issuance of a Conditional Use Pernut
pursuant to § 14.632.240.1 of the Zoning Code. Authority to consider such a request exists
pursuant to section 14.404.100 of the Zoning Code of Spokane County and Spokane County
Board of County Commissioners resolution No. 89 0708, as may be amended.
PROJECT LOCATION: Generally located in the Spokane Valley, surrounded by Felts
Road, Knox Avenue, University Road, I-90, Raymond Road and Shannon Avenue in Section
8, Township 25N, Range 44EWM; 2210 N. University Road. Parcel Number(s):
45084.0112, 45084.0108 and 45084.0113.
OPPONENTS OF RECORD: NONE
PUBLIC HEARING AND DECISION: After consideration of all available information
on file, one or more site visits, exhibits submitted and testimony received during the course of
the public_hearing held on June 28, 1995, the Zoning Adjustor rendered a written decision on
August 1995 to APPROVE the application.
FINDINGS OF FACT AND CONCLUSIONS
1. Testimony was taken under oath.
2. The proposal is described above and detailed in documents contained in the file.
The site plan, accompanying documents and other documentation is contained in the
companion file CUE-8-95. The applicant seeks relief from the sight-obscuring fencing on
Knox Avenue (on the north) along the undeveloped right-of-way of Shannon Avenue to the
south, along the Raymond Road right-of-way connecting the east end of Shannon Avenue and
I-90 to the south, on the south boundary along I-90, and along the east boundary (University
Avenue alignment). The applicant would develop the property easterly of the existing
residence located on the southeast corner of Knox Avenue and Felts Road, with the parking
area, dismantling area and office building north of Shannon Avenue right-of-way, with the
balance of the property to the east used for the storage of wreck vehicles and hulks.
The property is presently about 90% screened from I-90 on the south side of the property
by 30-40 foot tall, existing Australian Pine trees. Farther to the east, along the north boundary
of I-90 is a row of poplar trees which provide some screening of the subject property from
westbound traffic on Interstate 90. Southwesterly of the property (south of Shannon Avenue

nght-of-way and west of Raymond right-of-way) is a hill which provides screerung of
property from both east and west bound traff'ic East bound traffic will be very httle aware of
the add.itional space devoted to wreclung yard due to the hill and the Australian Puie trees
Knox Avenue is a uruque situation insofar as it was developed at pubhc expense as
compensation for loss of wreckuig yard property when I-90 was bwlt The only access to the
wreckmg yard was south on Umversity Road from Ntssion Avenue Knox Avenue, although
a paved pubhc nght-of-way road, leads no where east of Felts Road except to property of the
wreckmg yard; in tlus sense, functioiung as a pnvate road Additionally, a dedicated nght-of-
way for Indiana Avenue swmgs southeasterly off of Knox Avenue, pnor to its intersection
with Umversity Road nght-of-way, and moves southerly and thence easterly through the
Spalduig property, eventually connectuig to Montgomery Avenue some distance to the east
Umversity Avenue right-of-way exists on ttie east side of the subject property, but, m fact
nerther connects south across the freeway nor north across the former Burluigton Northern
Railroad property At some unspecified point in the future, both Umversity Road, including a
cross-freeway connection to the south and an interchange with I-90 may develop, along with
the development of Indzana Avenue as a connection between Knox Avenue, through the
Spalding property and thence easterly to a connection with Montgomery Avenue However,
none of these projects have any slated time schedule with them

16. The proposal does not unpose excessive demands on pubhc utilities.
17. The proposal, as condirioned, is compahble with uses pemutted outnght ul the
zone.
DECISION
From the foregoing Finduigs of Fact and Conclusions, the Zomng Adjustor
APPROVES the proposal, subject to comphance with the following
CONDITIONS OF APPROVAL
I. GENERAL
1. The followuig cond.itions shall apply to the apphcant, owner and successors in
interest and shall run with the land
2. Failure to comply with any of the condztions of approval contamed m tlus decision,
except as may be reheved by the Zomng Adjustor, shall constitute a violation of the Zomng
Code for Spokane Couaty and be subject to such enforcement as is appropnate.
3. The Zoning Adjustor may administratively make minor adjustments to site plans or
the conditions of approval as may be judged by the Zomng Adjustor to be wittun the context of
the onguial decision.
H. DIVISION OF BUILDING & PLANNING
1. The apphcant shall contact the Building Section of the Division of Btulduig and
Planning at the earhest possible stage of design/development in order to be informed of code
requirements administered/enforced as authorized by the State Building Code Act
Design/development concerns include: FIRE APPARATUS ACCESS ROADS; FIRE
HYDRANT/FLOW; APPROVED WATER SYSTEMS; BUII.DING ACCESSIBII.ITY;
CONSTRUCTION TYPE; OCCUPANCY CLASSIFICATION; EXITING; EXTERIOR
WALL PROTEG°TION; AND ENERGY CODE REGULATTONS. Eight foot tall fencmg may
requtre builduig pernuts and adherence to yard setbacks. The Plannuig Section of the Division
of Builduig & Planning shall clanfy tlus issue.
2 No Certificate of Occupancy shall be issued for the buildings and/or the wreclang
yard/storage yazd until the Planiung Section of the Division of Bwlding and Plannuig has
verified compliance with the site plan and other file documents. Because of this hold on the
Cert1f'icate of Occupancy, § 14.632 240. l.f is not needed.
3. Compuuon vanance file VE-9-95 relieves the applicant of the necessity of a sight-
obscunng fence. However, the chain-hnk fence shall comply with all other state and local

regulations for wrecking yards and shall be of a single, uruform matenal and color. It may
need to comply with yard setbacks.
4. The ternis of vanance VE-9-95 apply with respect to re-evaluation aad
administrative assignment of screemng techniques in the event there is change in the through
public road system ui the area. This may re-estabhsh certain reqwrements for sight-obscuring
fencing and landscaping.
5. The proposal shall comply with all apphcable standards of sections 14.632.330
through 14.632.385 of the Zonuig Code of Spokane County unless deviations, variances or
exceptions have been lawfiilly granted The concern and interest here is the extent of paving or
surfacing to be reqLUred pursuant to section 14.632.340 and chapter 14.082 of the Zonuig
Code. This decision takes no position mnth respect to stipulatuig the degree or amount of
pavuig. That shall be decided dunng the builchng pernut process.
6. This permit expues on September 1, 1997 unless renewed under the follovving
tenns•
a. An request for renewal shall be received pnor to the above date, preferably 60
days pnor
b. Pnor to renewal of the pernut or the granting of pernaanent status, venficahon
shall be made of comphance with the vanous conditions of approval, includuig, as
appropnate, any admuustratively added reqturements for screetung or sight obscunug
fencing.
c. After a muumum of one renewal, the Division of Btulduig and Planning may
optionally estabhsh either a contlnuing renewal process or may establish, upon request,
perpetual status for the Condltional Use Pernmt. Perpetual status may be estabhshed
upon a finding that all conditions of approval have been met, includuig any
admuustratively unposed reqwrements for additlonal fencmg or screemng as set forth in
VE-9-95 and a finduig that no substantive violahons are of record
7. If the Division of Build.ing and Planning believes there are extenuating -
cuicumstances associated with the renewal of the pernut, it may cause there to be a pubhc
heazing and neconstderation of the pernut; the notification expense shall be that of the county if
such reconsideration takes place.
8. A specific landscape plan, plantuig schedule and provisions for maurtenance
acceptable to the Planrung Director/designee shall be subnutted with a financial guarantee
performance bond or other financial warranty for the project pnor to release of builduig
permits. Landscaping shall be uistalled and mauitained so that sight dzstance at a,ccess points is
not obscured or unpaired. Although a perfornaance bond is not needed for other site
unprovements to be constructed, the Division of Building and Plannuig shall handle the
financial wairanty for landscaping in a customary manner. Nothing in tlus decision reheves the
apphcant from responsibilrty of complying with landscaping reqwrements reqwred in the I-2
zone.

9 The apphcant shall develop subject property generally in accordance withui the
concept presented to the Hearuig Body Vanations, when approved by the Buildsng &
Plannuig Director/designee, may be pemutted, including, but not limrted to builduig location,
landscape plans and general allowable uses of the permitted zone. All vanations must conform
to regulations set forth in the Zorung Code for Spokane County, and the onginal intent of the
development plans shall be maintained. The site development plan marked "approved plan tgm
8/3/95" is to provide a substantial guidance for review of the site through all phases of design
development and construcaon.
10. The Division of Btulchng and Planrung shall prepare and record with the Spokane
County Audztor a Title Notice notuig that the property in question is subject to a vanety of
special condstions unposed as a result of approval of a land use acuon This Trtle Notrce shall
serve as pubhc noace of the condiuons of approval affecting the property in question The
Title Notice should be recorded withun the same time frame as allowed for an appeal and shall
only be released, m full or in part, by the Division of Btulduig & Planiung The Title Notice
shall generally provide as follows.

III. DIVISION OF UTILITIES

IV. SPOKANE COUNTY HEALTH DISTRICT
1 Sewage disposal method shall be as authonzed by the Duector of Utilities, Spokane
County
2 Water sernce shall be coorduiated through the Director of Utilities, Spokane
County.
3 Water service shall be by an existuig public water supply when approved by the
Regional Enguieer (Spokane), State Department of Health.
4. Subject to specific apphcation approval and issuance of perrruts by the health
officer, the use of (an) individual on-site sewage d.isposal system(s) may be authonzed
5. Use of pnvate wells and water systems is prohibited.
6 Disposal of sewage effluent beneath paved surfaces is currently prolubited

V. DIVISION OF ENGINEERING AND ROADS
1. The apphcant shall subrYUt for approval by the Spokane County Engineer road, drainage
and access plans
2 The apphcant shall subnut for approval by the Spokane County Engineer and the
Spokane County Health Distnct a detailed combmed on-site sewage system plan and
surface water disposal plan for the entire project, or portion thereof, if the development
is to be phased.
3 A pazking plan and traff'ic cuculation plan shall be subrrutted and approved by the
Spokane County Enguieer The design, location and arrangement of pazkuig stalls
shall be in accordance wrth standard traffic enguieeruig practices Pavulg or surfacuig
as approved by the County Enguieer, will be reqtured for any portion of the project
wluch is to be occupied or traveled by vehicles.
4. Roadway standards, typical roadway sections and drainage plan reqLUrements are found
m Spokane Boazd of County Comnussioners Resolution No 80-1592 as amended and
are apphcable to this proposal
5. An approach pernut shall be obtained from the County Engineering Department pnor to
the construction of any new dnveway approaches. This shall be done pnor to the
release of a builduig permit, change of use permit or certificate of occupancy.
6. The apphcant shall enter into a"Hold Hanmless" agreement with Spokane County to
allow storage of salvage automobdes in the Indiana Avenue nght-of-way.
VI. WA STATE DEPARTMENT OF TRANSPORTATION
1 The apphcant is advised that the proposed wreclcing yard expansion, as well as
portions of the existuig wrecking yard are witlun the footprint of the I-901Uruversrty Road
mterchange Tlus proposed expansion is dzscussed in the "Four Lakes to Idaho State Line
Environmental Impact Statement." 1'he apphcant is advised of the probable unpact and
consequences of expansion of the proposed wrecking yard into ttus area
VII. SPOKANE COUNTY AIR POLLUTION CONTROL AUTHORITY
The recommended condltions of approval from the Air Pollution Control Authonty
are presented below for convenience; but, are not enforceable through this decision

taken unmechately to clean these surfaces

Uruversity Avenue nght-of-way exists on the east side of the sub~ect property, but, in fact
nerther connects south across the freeway nor north across the former Burlington Northern
Railroad property. At some unspecif'ied point m the future, both Uruversrty Road, inclucung a
cross-freeway connection to the south and an interchange wrth I-90 may develop, along with the
development of Ind.iana Avenue as a connection between Knox Avenue, through the Spalding
property and thence easterly to a connection with Montgomery Avenue However, none of these
projects have any slated time schedule with them
3 A substantive argument made by the apphcant in favor of grantmg rehef from the
requirement of sight-obscunng fencing is that sight-obscunng fencing will not really obscure any
of the yard contents. Addltionally, the apphcant opined that the pnmary view shed for the
proposed wreckmg yard addition is from I-90 and from the housing located to the south and
southeast, on the south side of the Interstate tughway From these standpoints, the applicant
further opines that the existuig pine trees planted on the north side of the Interstate nght-of-way
provide a reasonable and effective screenuig mechamsm Addstionally, the apphcant makes the
case that travehng on Knox Avenue is traffic only interested in going to the wreckmg yard, and is
therefore not offended by dnving between fenced or unfenced wreclung yards on the north
(existing) and on the south (proposed)
4 The pnmary observatron locations of the contents of tlus proposed wreckmg yard are
the west bound travel ianes of I-90, the roadway of Knox Avenue and the property south of side of
I-90, particularly where the housing is on an elevated bluff or terrace in the 1Vlission Ridge First
subdivision Because of the raised level of I-90, installing a sight-obscuruig fence along the south
boundary of the proposed wreckmg yard not obscure the contents of the proposed wreckmg yard
The existing vegetation along the north edge of I-90 provides far more effective screerung than any
sight-obscunng fencmg
This is likewise the srtuation from the elevated locauon of 1Vfission Ridge Fust, located on the
south side of I-90 As these residents look to the northwest, toward the proposed wreckmg yard
area, the only remotely effective screenuig is the 30-40 tall trees in the I-90 nght-of-way Even
these trees fail to obscure the entire future contents of the yard The hill or bluff located
southwesterly of the mtersection of undeveloped Shannon Avenue and Raymond Road, provides
effective screerung for much of the proposal as viewed from Interstate 90 and housing areas to the
south of I-90
The only present-day traffic to be found on Knox Avenue, east of Felts Road, where the
contents of the future wreckmg yard would be viewed, are customers going to the Spalding
wreclung yard and arguably would not be offended by its contents In this respect, Knox Avenue
acts as a pnvate road or dnveway into the center of the existuig and proposed wreckuig yard area

The residents/owners of the houses on the west side of Felts Road have offered no objection
to the expansion of the wreckuig yard From theu elevated location, a 6 foot or an 8 foot sight-
obscunng fence would not screen any contents of the wreckuig yard
5 For all practical purposes, sight-obscuring fencing around the proposed wreclung yard
would serve absolutely no purpose with respect to screenuig the contents of the yard Zonuig
Code § 14 632 240.1.a, wlule requinug a sight-obscunng fence, also states that landscaping may
be requued to break up the exposure of the storage area when it is not feasible to obscure the view
of the storage area from the pubhc street due to local rehef condhtions In fact, the existuig
landscaping is the only possible way to screen the contents of the wreclcing yard
6 These arguments and opuuons of the apphcant and the concurrent conclusion of the
Zoiung Adjustor for that seem valid for the present condztions and cucumstances, the record shows
that Knox Avenuemay eventually become Indiana Avenue and be tied into Montgomery Avenue at
a point farther to the east, thereby ehnunatzng the argument that Knox Avenue would only used by
people gomg to the wreckuig yard It's also lilcely that Uruversity Road will be extended from the
south, across the freeway to a connection farther to the north as part of the inter-belt or highway
bypass system. Then University Avenue, and east of the site, would become a through pubhc
road wlth pubhc traffic capable of viewing the contents of the proposed wreckuig yard It's also
likely that an mterchange would be built at Uruversity Road and I-90, takuig quite a bit of land with
the footpnnt of the interchange A future interchange would wipe out the existuzg pine trees wluch
provide the screeiung, besides reducing the acreage of the proposed wreckuig yard if any of these
pubhc road unprovements occur (the extension of Knox Avenue into Indiana Avenue, the
estabhshment of University Road as a pubhc through street and the uistallation of an interchange
footprint at University Road and I-90), it would then be appropnate to impose the screening now
being waived This would likely include a reqwrement for the installation of sight-obscunng
fencuig if it would, in fact, produce a benefit to the pubhc of screerung and/or the addition of fairly
mature landscaping to as quickly as possible screen the contents of any remaining wrecking yard
from the adjacent pubhc nghts-of-way
7 The proposal is exempt from the provisions of the Washmgton State Envuonmental
Pohcy Act, Chapter 43 21C RCW pursuant to WAC 197-11-800 (6) (b)
8 Where the problem complauied of is common to land in the area or throughout the

Zonuig Code causes a practical d.ifficulty dueto there bemg no benefit to the pubhc resulting from a
substantial expenditure of money Conditionuig the proposal to re-examine screerung and
landscaping at such point in time for screerung as there is an alteration of the public road system in
the area effectively deals with the future protection of the pubhc Reserving the nght to re-exarrune
the situation in the future is consistent with the requuement of 14 404 082.1 wluch states that the
grantmg of a vanance shall be subject to such conditions as will ensure that the adjustment does not
constitute a grant of a special pnvilege and further ensunng that the intended purpose of the Zorung
Code is mauitained wrth regard to appearaace, landscaping and other features of the proposal, as
well as protecting the pubhc interest and general welfare

10 Stnct apphcahon of the Zoning Code screenuig standard creates an unreasonable
burden in light of the purpose to be served by the Code and the benefit to be gained m the pubhc
mterest
11 Rohan, in Zorung and Land Use Controls, § 43 02 [5], states that over the years a
number of factors have been considered by courts wrth respect to grantmg variances These
include• (1) whether stnct compliance anth the terms of the ordinance will preclude a pernutted use
from being pursued, (2) whether the land will yield a reasonable return, (3) the degree to wluch the
apphcant seeks to vary from the ordulance, (4) the degree of harm wluch will be unposed on the
surnouncluig area if the vanance is granted; (5) whether some other method can be pursued to avoid
the need for the variance, (6) whether the difficulty is self imposed, and (7) whether the mterest of
justice and the general welfare will be served. Rohan contuiues that no factor alone controls and all
must be considered. It is a balancing act of the competuig mterest between the landowner and the
commumty, as expressed through the zomng document
After consideration of all the facts, testunony, relevant case law and mstructive usefulness of
Rohan's Zotung and Land Use Controls, it is concluded that the balancing test of competuig
interest lies with approvuig the vanance
12 Adverse testunony or written comments were received regazding the proposal The
adverse comment came from an owner of property in Mission Ridge Fust subdivision, whose
residential structure looks northwesterly across I-90 toward the proposed area However, rt has
been demonstrated that sight-obscuring fencing is gomg to have absolutely no screenuig effect on
the contents of the yard, due to the height from which the residential structure is with respect to the
elevahon the car hulks will be stored
13 The apphcant has been made aware of the recommendations of vanous County agencies
reviewing tlus project
14 Vanous performance standards and cntena are additionally needed to make the use
compatible with other pernutted activities m the same vicinity and zone and to ensure agauist
imposuig excessive demands upon pubhc utilities, and these shall be addressed as cond.itions of
approval
15 The proper legal requirements for advertising of the hearuig before the Zomng Adjustor
of Spokane County have been met.
DECISION
From the foregouig Findings and Conclusions, the Zoning Adjustor APPROVES the
proposal as generally set forth in the file documents, subject to compliance wrth the following
CONDITIONS OF APPROVAL
I. GENERAL
1 The follow2ng condltions shall apply to the apphcant, owner and successors in mterest
and shall run with the land as long as the Condihonal Use Pernut CUE-8-95 remains valid; except
as noted below in the event the bordenng pubhc roads are altered

3. The Zomng Adjustor may adnunistratively make nunor adjustments to site plans or the
conditions of approval as may be judged by the Zorung Adjustor to be withui the context of the
onguial decision
II. DIVISION OF BUILDING & PLANNING
1. The apphcant is reheved of the conditioa for sight-obscuring fencing around the parcel
intended for the wreckmg yard Tlus vanance, to be relieved of the sight-obscunng responsibilrty,
shall be adnurustratively re-evaluated at such time as any of the existing screenuig fohage is
removed, destroyed or otherwise becomes ineffective as a screening device Re-evaluauon shall
also occur if the pubhc road nght-of-way changes in the area Re-evaluation shall also take place if
pubhc roads are constructed in the existing right-of-way with respect to Knox Avenue extendmg
easterly as Indiana Aveaue, Uruversity Road connecting either to the north or the south (across I-
90), or a freeway interchange being installed for the intersection of Uruversity Road and I-90
The intent of re-evaluation would be to adnunistratively deternune, subject to appeal by the
applicant, whether or not a combination of sight-obscunrig fencmg and/or relatively mature
vegetation screening needs to be installed in order to screen or partially screen the contents of the
wreckuig yazd of the proposed wreckmg yard (CUE-8-95) from view from a public nght-of-way,
as was surely intended by the Zoning Code The intent for future re-evaluation would be to use
sight-obscunng fencing where it would be effective, to not use it where it would be ineffective, and
to use relatively quick-growmg, moderately mature, irngated vegetation in order to develop a total
or partial screen with respect to viewing the conte of the wreclang yard from any public nghts-

above referenced developrnent:
The propased expansion tQ Spalding Auto Wrecking Yard falls within the fvotprint of
the praposed University interchange, as depicted in the Four Lakes to Idaha State Line
EnWironmental Impact Statement (please see attached). WSDQT is working in
cooperatipn with Spakane County Engrneers toward the eventual expansian of
LJniwersity itoad and this new interchange with I-90. At the present time this project is
unfunded, but we have identificd this as a needed project in the future. VVe feel it
important that the applicant be made aware that the EIS documentation exists, and that
it nat only affects this expansion but the existing auto wrecking yard. Item A8 ofthe
checklist sliould be modifed accardingly.

D. CONDITIONS OR CONTINGENCIES APPLIED TO THIS APPROVAL
a) COUNTY PLANNING DEPARTMENT
1. A specific landscape plan, planting schedule and provisions for main-
tenance acceptable to the Spokane County Zoning Administrator shall
be submitted for the project prior to release of building permits.
2. The applicant shall develop subject property generally in accordance
within the concept presented to the Hearing Examiner Committee.
Variations when approved by the Zoning Administrator will be per-
mitted, inciuding, but not limited to the following changes: Building
location, landscape plans, and generai aliowable uses of the permitted
ione. All variations must • conform to regulations set forth in the
Spokane County Zoning Ordinance. The originai intent of the develop-
ment plans shal I be maintained.
3. Applicant shall comply with 1208' recommendations concerning storm-
water runoff and provide necessary landscaping for runoff.

4. That the provisions of SEPA's NOTICE OF ACTION pursuant to
Chapter 43.21C.080 RCW and the Board of Spokane County Commis-
sioners Resolution #77-1392 be initiated by the project applicant within
thirty (30) days of final disposition of this application, and prior to
any on-site improvements.
5. Pursuant to the provisions of Chapter 43.21C RCW, the SEPA Guide-
tines (WAC 197-10) and the Spokane County Environmental Ordinance
(SCEO), a proposed declaration of non-significance has been issued at
least fifteen (15) days prior to this date; the official file, written
comments and/or public testimony contain information regarding assess-
ment of the proposal's adverse impacts to the physical environment; a
finding is hereby made that no potentially significant adverse impacts
upon the physical environment are anticipated as a result of the
project; and a final declaration of non-significance is hereby to be
i ssued .
b) COUNTY ENGINEERING DEPARTMENT
1. Applicant shall construct cement concrete curb and pave to the exist-
ing pavement adjacent to the property on Knox Avenue.
2. Applicant shall submit for approval by the Spokane County Engineer
road, drainage, and access plans prior to the issuance of a building
permit on the property.
3. The appl icant shall submit for approval by the Spokane County
Engineer and the Spokane County Health Oistrict a detailed combined
on-site sewage system plan and surface water disposaf plan for the
entire project prior to the issuance of any building permit on the
property.

b) COUNTY ENGINEERING DEPARTMENT (continued)
4. A parking plan and traffic circu{ation plan shall be submitted and
approved by the Spokane County Engineer prior to the issuance of a
building permit on the property. The design, location, and arrange-
ment of parking stalis shall be in accordance with standard traffic
engineering practices. Paving or surfacing as approved by the
County Engineer, wiil be required for any portion of the project which
is to be occupied or traveled by vehicles.
5. The word "applicant" shall include the owner or owners of the
property, his heirs, assigns, and successors.
6. The construction of the road improvements stated herein shall be
accomplished as approved by the Spokane County Engineer.
7. AI{ required improvements shall conform t4 the current State of
Washington Standard Specifications for Road and Bridge
Construction, and other appiicable county standards and/or
adopted resolutions pertaining to Road Standards and Storm-
'tivater Management in effect at the date of construction, unless
otherwise approved by the County Engineer.
8. At the time that Felts Road is improved the applicant shall
dedicate 5 feet on Felts Road and a 20 foot radius on Felts Road
and Knox Avenue for right-of-way. The applicant shall aiso be
a witling participant in the formation of a Road improvement
District (R I D)for the construction of Felts Road. At the time of
construction of Felts Road the applicant shall relocate his drive-
way that is shown on the east edge of his property.
c) COUNTY UTI LIT! ES DEPARTMENT
1. Pursuant to 6oard of County Commissioners Resolution No. 80-0418,
the use of on-site sewer disposal systems is hereby authorized. This
authorization is conditioned on comptiance with all rules and regulations
of the Spokane County Health District and is further conditioned and
subject to specific application approval and issuance of permits by the
Health District.
2. The owner, his heirs or successors shall join and participate in any
petition or resolution which purpose is the formation of a utility tocal
improvement district (ULID) pursuant to RCW, Chapter 36.94, as
amended. The owner, his heirs and successors shall further agree not
to oppose or protest any {egal assessments for any utility local im-
provement district (UL1D) established pursuant to RCW Chapter 36.94,
as amended.
3. Any water service for this project shall be provided in accordance with
the Coordinated Water System Plan for Spokane County.

4. Each building shall be double plumbed for connection to future
areawide collection system.

d) COUNTY HEALTH DISTRICT
1. Sewage disposal method shall be as authorized by the Director of
Utitities, Spokane County. -
2. Subject to specific application approval and issuance of permits by the
Health C3fficer, the use of an individual on-site sewage system may be
authorized.
3. Water service must be coordinated through the Director of Utjlities,
Spokane County.
4. Water service shali be by an' existing public water supply when
approved by the Regional Engineer (Spokane), State Department
of Social and Health Services.
5. Use of private wells and water systems is prohibited.

e) COUNTY BUILDING AND SAFETY QEPARTMENT
1. The site is located in Fire District #1.
2. Recommend approvai with condition that prior to development of this
property that an engineered water distribution system pian shaif be
submitted to the Spokane County Department of Building and Safety.
This distribution ptan shall include water main size, fiows, iocations,
fire hydrant type and {ocations, water storage tanks size, and location
and design criteria.
f) WATER PURVEYOR
1. The site Es located within the boundaries of the Modern Electric Water
Company. Satisfactory arrangements for water delivery have not yet
been made.
g) SPOKANE VALLEY FI RE DEPARTMENT
1. That mains and hydrants are needed in the area. Access plans
for firefighting equipment around the buitding shatl be appraved
prior to building permit issuance.

DETERMINATION OF NONSIGNIFICANCE

DESCRIPTION OF PROPOSAL: The applicant proposes to expand an additional Auto
Wrecking and Salvage Yard, lrnown as "Spalding Auto Parts," by adding approximately 11 acres
of an adjacent parcel of land to the existing facility. Section 14.629.020 of the Zoning Code of
Spokane County allows such a use upon issuance of a Conditional Use Penmit putsuant to
§ 14.632.240.1 of the Zoning Code. The applicant also seeks a variance to not use sight-obscuring
fencing as required by § 14.632.240. l.a.
PUBLIC HEARING SCHEDULED FOR: June 28, 1995 at 9:00 a.m. in the
Commissioner's Hearing Room, Lower Level, 1026 W. Broadway, Spokane, WA.
PROPONENT: Max Spalding, 2210 N. University Rd., Spokane, WA 99206
LOCATION OF PROPOSAL, INCLUDING STREET ADDRESS, IF ANY: Generally
located in the Spokane Valley, surrounded by Felts Road, Knox Avenue, Shannon Avenue and

The lead agency for this proposal has determined that it dces not have a probable significant
