Zoning Code, on the 21 g` day of January, 2000 FINDINGS OF FAC i ANU CUNGLl1SIONS 1. The individual signing below has been properly delegated the responsibility for rendering this . decision by the director of the Spokane County Division of Building and Planning. 2. The applicant has requested a temporary use permit to set a portable readerboard at 2302 N. Argonne Road #B for an existing barber shop. 3. The subject property is located approximately 400 feet south of Montgomery on the east side of Argonne Road in the Southwest Quarter of Section 08, Township 25 North, Range 44 E.W.M., Spokane County, Washington. 4. The surrounding land uses include commercial businesses in all directions. 5. The subject property is currently zoned Regional Business (B-3). The proposed portable readerboard is not an allowable use within the existing Regional Business (B-3) zone and does not conform to the requirements of the Regional Business (B-3) zone. 6. Chapter 14.510(a) provides that any owner of any property may submit an application for the temporary use of a structure or premises in any zone classification for a purpose or use that does not conform to the regulations prescribed elsewhere in the Zoning Code for the zone classification in which it is located, provided that such use is of a temporary nature and does not involve the erection of a substantial structure. A nonrenewable zoning certificate for such use may be granted by the Division in the form of a temporary and revocable permit, for not more than a six (6)-month period. 7. On November 3r0, 1999, Division of Building and Code Enforcement inspection staff notified the applicant that portable readerboard was not a permitted use/structure in the Regional Business (13- 3) zone and subject to enforcement of the Spokane County Zoning Code. 8. A site inspection on January 215`, 2000 by Code Enforcement identified 2 existing on-premise detached signs located on the property, with a total of 153 square feet. 9. The Division of Current Planning may impose shorter time periods for temporary use permits as provided for under Chapter 14.510(a) wherein a permit may be granted for not more than a six (6)- month period (emphasis added). The Division is not required to issue all temporary use permits for six (6)-months, but rather it has the discretion to issue a permit from one (1) day up to six (6) months. 10. The Division of Current Planning finds that it is reasonable to limit the time period for which this permit is valid to six (6) months. The six (6) month time period provides the applicant ample time to arrange for the removal of the portable readerboard. 11. The proposal is exempt from the provisions of the Washington State Environmental Policy-act, Chapter 43.21 C RCW pursuant to WAC 197-11-800 (2)(b). 12. This decision is final unless appealed in writing, consistent with adopted appeal procedures and fees. This approval is subject to the conditions of approval listed below. CONDITIONS OF APPROVAL 1. The following conditions shall only apply to the applicant(s) and owner(s) and do not run with the land. Failure to comply with any of the conditions of approval contained in thfs decision shall constitute a violation of the Spokane County Zoning Code and be subject to such enforcement and penalties. The permit authorizes the placement of a portable readerboard, for Roberto's Barber Shop, for a period of six (6) months ending on July 21g`, 2000. 2. If a violation of any condition of approval is found, the temporary use permit may be revoked as provided for under Chapter 14.510(a). If the temporary use permit is revoked, the applicant shall remove the portable readerboard immediately upon notification by the Division that the permit has been revoked. 3. Any improvements or alterations to the land to accommodate the proposed temporary use shall be temporary in nature, and must be restored and/or removed at the applicant's expense upon expiration of the temporary use permit. , 4. In order to ensure safe site distance to the traveling public, the sign shall be located 10 feet from the back edge of the sidewalk, or behind the property line, whichever is greater. 5. The sign shall not obstruct the view in any direction of a fire hydrant or any other fire department appliance.
