VE-18-94 ~ V' ZONING ADJUSTOR SPOKANE COUNTY, WASHINGTON IN THE MATTER OF A VARIANCE FROM ) FINDINGS OF FACT, FRONT YARll SETBACK STANDARDS ) CONCLUSIONS, AND DECISION FILE: ~ VE -1$-94 APPLICANT:- PRING CORPORATION COMPANION FILE(S): None APPLICATI4N DESCRIPTION: The applicant requests a front yard setback of 18 feet from the Sprague Avenue property line; whereas section 14.628.325.1 of the Zoning Code of Spokane County requires a 35 foot setback from the front property line. Authority to consider such a request exists pursuant to section 14.404.080 of the Zoning Code of Spokane County and Spokane County Board of County Commissioners resolution No. 89 0708, as may be amended. PROJECT LOCATION: Generally located in the Spokane Valley, south of and adjacent to Sprague Avenue, between Sargent and Sipple Roads and north of and adjacent to First Avenue in the NE 1/4 of Section 19, Township 25N, Range 44EWM; 8500 E. Sprague Avenue. Parcel Number(s): 45191.9113 ()PPONENTS OF RECORD: NONE PUBLIC HEARING AND DECISION: After consideration of all available information on file, one or more site visits, exhibits submitted and testimony received during the course of the public heanng held on July 27, 1994, the Zoning Adjustor rendered a written decision on SeptemberM 1994 to APP120VE the application as set forth in the file documents and as conditioned below. - FINDINGS OF FACT AND CONCLUSIONS 1. Testimony was taken under oath. 2. The proposal is described above and detailed in documents contained in the file. The project would expand the existing showroom to the east, coming approximately to the existing door to the service deparmient. The construction would eliminate 4 parking stalls currently available for service customers. These pa.rking stalls can apparently be absorbed in other locations and still exceed the minimum number of required parking stalls for the dealership. Some existing outdoor display space may be eliminated at the curbside edge. 3. In compliance with RCW 36.70.450, the Planning Department determined that this proposal is generally consistent, as condiaoned, with the Commercial category of the Comprehensive Plan. The Arterial Road Plan, contained within the Comprehensive Plan specifies that this arterial may evenCually reach 130 feet in width. It is presently 100 feet in width. At some point in the future, this may place the edge of the nght-of-way (not the roadway) within approximately 3 feet of the building. VE-18-94 SPOKANE COUNTY ZOIVING ADJUSTOR PAGE 2 has a similar predicament, as does McCollum Ford and Appleway Mitsubishi, both to the west, and Spokane Yamaha to the east. 4. The proposal is exempt from the provisions of the Washington State Environmental Policy Act, Chapter 43.21C RCW pursuant to WAC 197-11-800 (6) (b). 5. Over the years, the right-of-way width for Sprague Avenue has slowly been expanded, thus progressively encroaching on the existing businesses. Right-of-way expansion has thus reduced the size of many of the businesses, including Appleway Chevrolet. The Zoning Code allows, in 14.810.140(2) an administrative establishment of common lines of buildings where a large number of buildings have established fronts less than the required setback. However, in this instance the situation falls just short of qualifying this building for the administrative approval for an adjustment to a common building line on Sprague Avenue. Thus, the applicant has pursued the situation through the variance procedure. 6. The applicant notes that this is not the establishment of a new building line; but, merely the extension of the existing showroom building line in an easterly direction. 7. A representative of the area's water purveyor pointed out that a water main exists in the vacated Bessie Road right-of-way. This water main actually lies beneath the existing Appleway Chevrolet building's east edge. The water purveyor representative expressed concern that this addiaon might adversely affect the location of that water main. After some discussion, it was decided by all present that the construction would not affect the water main; that is, it would not put new construction over the area where the water main exists. It would be neither harder nor easier, as a result of new construction, to repair the water main if it needed to be so repaired. 8. Where the problem complained of is conunon to land in the area or throughout the community, the proper solution is legislarive rezoning, rather than piecemeal administrative exemption. The alleged problem or hardship must relate to the land. Community needs or - personal hardships do not qualify as legitimate grounds for issuing a variance. (Zonine and Land Use Controls, Rohan, § 43.02 [4] [b] [i]). There are enough special circumstances common to this particular site to identify this as a hardship which would likely be common to any owner and one that is not generally common throughout the area, insofar as this construction fills in a void and creates no greater nonconfomung setback than the existing showroom structure. 9. Rohan, in Zoning and Land Use Controls, § 43.02 [5], states that over the years a number of factors have been considered by courts with respect to granring variances. These include: (1) whether strict compliance with the ternis of the ordinance will preclude a pemlitted use from being pursued; (2) whether the land will yield a reasonable return; (3) the degree to which the applicant seeks to vary from the ordinance; (4) the degree of harm which will be imposed on the surrounding area if the variance is granted; (5) whether some other method can be pursued to avoid the need for the vanance; (6) whether the difficulty is self imposed; and (7) whether the interest of jushce and the general welfare will be served. Rohan continues that no factor alone conrrols and all must be considered. It is a balancing act of the competing interest between the landowner and the community, as expressed through the zoning document. IiD/VE-18-94 Pring Corp ~ ~ CA~E NO. All vanations must conform to regulations set forth in the Zoning Code for Spokane County, and the original intent of the development plans shall be maintained. 2. Dunng the building permit process, the applicant shall comply with the standards of the underlying zone as directed by the Planning Department. Of particular concern is the verification that the loss of 4 parking stalls and the addition of 1,800 square feet of showroom space will not result in a net loss of parking spaces. In fact, additional parking spaces must be justified for the new construction as well as those lost to the consrruction. 3. The Spokane County Planning Department shall prepare and record with the County Auditor a Title Notice specifying a future land acquisition area for road right-of-way and utilities. The reserved future acquisition area Title Notice shall be released, in full or in part, by the Planning Department. The nonce should be recordeti within the same nme frame as an appeal and should generally provide the following: a. At least 15 feet of reserved future acquisition area for road right-of-way and ualiaes, in addition to the existing and/or newly dedlcated nght-of-way along Sprague Avenue. b. Future building and other setbacks required by the Spokane County Zoning Code shall be measured from the reserved future acquisitlon area c. No required landscaping, parking, '208' areas, drainfield or allowed signs should be located within the future acquisition area for road nght-of-way and utilities. If wly of the above improvements are made within this area, they shall be relocated at the applicant's expense when roadway improvements are made. d. The future acquisition area, untll acquired, shall be private property and may be used as allawecl in the zone, except that any improvements (such as landscaping, parking, surface drainage, drainfield, signs or others) shall be considered interim uses. III. DIVISION OF BUILDINGS 1. The applicant shall contact the Division of Buildings at the earliest possible stage of design/development in order to be infomied of code requu-ements administered/enforced as authonzed by the State Building Code Act. Design/development concerns include: Fire Apparatus Access Roads; Fire Hydrant/Flow; Approved Water Systems Building Accessibility; Construction Type; Occupancy Classificahon; Exiting; Extenor Wall Protection, and Fnergy Code Regulations. IV. DIVISION OF UTILITIES 1. Any water service for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended.
