PROPOSAL: Applicant requests pernussion to construct an attached 24' x 24' garage onto the
east end of the existing residence at a distance of 39 feet from the centerline of Wilbur Road right-
of-way; whereas, Section 14.616.325.B.3 of the Zoning Code of Spokane County requires a
setback of 55 feet from the centerline of the right-of-way.

file, one or more srte visrts, exlubits subnutted and testunony received dunrig the course of the
pubhc hearing held on November 8, 1995, the Zorung Adjustor rendered a wntten declsion on
January 22, 1996 to APPROVE the apphcatton
FINDINGS OF FACT AND CONCLUSIONS
1 Testimony was taken under oath
2 The proposal is descnbed above and deWed m documents contained in the file
3 The site is zoned Urban Residential-3 5(UR 3 5), which allows the proposed use
upon approval of ttus apphcation
4 The proposal is exempt from the provisions of the Washington State Envuonmental
Pohcy Act, Chapter 43 21C RCW pursuant to WAC 197-11-800(6)(b)
5 The following cucumstances were observed in the neighborhood, after consultation
with vanous official maps of the area, mcludzng the official County Division of Enguieeruig and
Roads nght-of-way maps and the official file documents for the subdivision planned unmediately
south of the property and accessed by Wflbur Street
a Most homes in the neighborhood have a two-car garage, in some instances a one-
car garage, and m rare uistances no garage (as is the present situahon at the apphcant's
property)

~ b The pmperty immediately a,cross the street to the north is an exact duphcate of the
srtuation proposed by the apphcant Even the dwelling uiut is the exact design and has a
garage identical to the one proposed by the apphcant added to it It also has an approxnnately
14-foot setback from the property luie, the same as proposed by the apphcant The property
to the immechate east has a nearly sunilar setback to the one proposed by the apphcant
Several other properties north on Wilbur Street have sunilar setbacks
c The apphcant's house has a sephc tank and dramfield in the back yard which
somewhat comphcates adchlaonal improvements in the rear yard area. The apphcant's house
(wluch he did not construct) could have been Iocated shghtly farther to the west, which
would have allowed a httle more room for an attached garage
d Imposition of a full 55-foot setback from the centerline of the Wilbur Street nght-
of-way would be restrictive enough to not allow the construcrion of even a single-car attached
garage
e The addition of an attached garage, as opposed to a detached garage with access
from Wilbur Street, utilizes the existuig dnveway configuration and would therefore mamtatn
the exishng neighborhood traffic pattern A detached garage structure in the rear yard would
necessitate access from Wdbur Street, wluch would present ingress and egress wluch would
intervene with traffic headwg south on Wdbur Street to the newly approved subdzvision
existuig to the south of tlus and other properhes This situation should be avoided if
possible
f The apphcant pmposes an integrated design nearly idenhcal to the one across the
street to the north and usmg T-111 siding and compatible tnm and shuigles
6 The facts in support of grantuig the variance are as follows
a Apphcation of the requued 55-foot setback from the centerluie of the road nght-
of-way creat,es a practical difficulty insofar as adcling a two-car garage is not unreasonable
but complying with the setback would force the apphcant to a detached garage in the r+ear
yard. This would possibly be comphcated by the dram field locanon and would also create
another curb cut with an ingress-egress pomt on a road leaduig to an approved subchvision to
the south
b The use of a double-car attached garage is not a prohibited use or activrty
c Havuig a two-car attached garage does not constitute a grant of special pnvilege
Other properties in the area, although approved under different zorung regulations, have a
similar setback in many instances The placement of the two-car garage as proposed will
neither interfere with sight dsstances nor comphcate any existsng or futcue ttaff'ic situation In
fact, the same dnveway access point will be used wluch has also been used since the
construction of the dwelluig wut
d The relatively narrow width of the lot, combined with the relatively large setback
on the flankng street (not anticipated when the subd.ivision was actually laid out), the
placement of the dwelling urut farther from the west property luie thaa the muumum

number of factors bave been considered by courts with respect to grantzng vanances These
include (1) vvhether stnct camphance with the terms of the ordanance wnll preclude a pernutted use
from bevag pursued, (2) whether the land will yield a reasonable return, (3) the degree to whxch the
applicant seeks tv vary► fram the orduiance, (4) the degree of harm wluch will be unpased on the
surroundmg area if the vanance is granted, (5) whether some other method can be pursued to avoid
the need for the vanance, (6) whether the chfficulty is self unposed, and (7) whether the internest of
3ushc:e and the general welfare will be served Rohan contlnues that no factor alone eontrdls and all
must be considered It is a balancmg act af the competing usterest between the landowner and the
eommuruty, as expressed thraugh the zorung document
After consideratton of all the facts, testimony, relevamt ease law and instruciive

REGARDING VE-12-95
I, Thomas G. Mosher, AICP, am the Zoning Adjustor for Spokane Cotinty.
On November 8, 1995 I conducted a public hearing regarding VE-12-95, an application for a
flanking street variance to allow an attached garage at 11710 East Buckeye Avenue to be
constructed 14 feet from the Wilbur Road property line (about 22 feet from the curb).
After considering the evidence in support of the variance, including a review of the existing
proposed subdivision to the south and its intended access by this stretch of Wilbur Road, I
granted the variance.
Because Ralph and Shirlee Polson, 11610 East Grace Avenue, stated written objection to the
variance, they have standing to appeal ($215 fee) the yet-to-be-issued written decision within 10
days of the signing of the future written decision. The applicant for the garage cannot start
construction until the appeal period lapses, and the Polsons have not appealed.
If the Polsons withdraw their objection as stated in their October 22, 1995 letter, I can authorize a
building permit, based upon my verbal decision in an advertised public hearing to approve the
variance.
In my capacity as an appointed Spokane County off~' c~f I attest the above to be true and factual.~

Zonine, Code of Spokane County.

. Conditional Use Permits
applicant is responsible for meeting all standards of the Caie with respect to both the
conditional use section and the underlying zone. Any uncertainty should be clarified at

F. Notification Requirements
The applicant is to provide notification as follows. More detailed instrucrions are provided
when notification packet is picked up at the Department. You will be notified when to pick up
the packet.
Step 1: All property owners and taxpayers within four hundred (400) feet of the property,
including all additional contiguous ownership or optional land by the owner or agent for the
owner and any easement lands provid.ing access shall be norified by the proponent. Utilizing a
list of such property owners and taxpayers obtained from a title company and copies of the
Agenda Notification prepared by the Department, the applicant shall accom.p,'r~1, mailing the agenda notification as directed by the Department personnel.
Step 2: The applicant shall provide the original of the title company-prepareci
mailing list, Affidavit of Mailing, all returned mailings (addressee unknown, etc.), and
certain other infornzation to the Department at least two (2) days prior to the public hearin g, t or
inclusion in the file. Failure to do so may jeopardize the hearing process.
NOTE: The address list obtained from the ritle company must be dated no more than 30 days
before the hearing date. When you plan to pick up your mailing packet from this department,
please allow 1 week for the title company to prepare the address list and time for you to do the
mailing by the deadline d atc.
G. Public Hearing
The applicant or representative must be present at the public hearing. It the
owner is not at the meeting, the "representarive" must have written authorization from all
