II. FINDINGS OF FACT AND CONCLUSIONS
The Hearmg Examiner has reviewed the conditional use permit apphcation and the evidence
of record and adopts the following findings of fact and conclusions
A. GENERAL INFORMATION:

Location: The property is located adjacent to the Spokane Valley Elks Club at 2607 North
Robie Road The locaron of the tower will be south of and adjacent to Robie Road, south of
Marietta. Avenue and west of Pines Road in the NE 1/4 of Section 9, Township 25 North, Range
44 EWM in Spokane County, Washington
Zoning: Urban Residential-22 (L7R-22)
Comprehensive Plan Category: The property is designated in the Urban category of the
Spokane County Generalized Comprehensive Pian The subject property is inside the Intenm
Urban Growth Area (IUGA) boundary, inside the Public Transportation Benefit Area (PTBA),
and also the Prionty Sewer Service Area (PSSA)

Environmental Review: A Determmation of Nonsignificance was issued by the Division of
Building and Planning of Spokane County on November 2,1998
Site Description: The site is irregular in shape with rock outcroppings and several changes in
elevation There are multiple uses on site, including an Elks Club facility with an adjacent green
spaceJpicnic area and parking, and there is a water tower located on the property also Portions
of the property are still in the'v natural state and there are dnveway areas passing throughout the
site to serve various uses

the zoning is a combination of UR-3 S and UR-22 To the east and north, the zoning is of the
same combination and the property is developed mostly with multifamily residerrtial housing
Project Description: The applicant seeks to construct an unmanned wireless
telecommunications facility consisting of a three-sector antenna array mounted on top of a 125-
foot lattice tower There also will be radio equipment mounted on a concrete slab next to the
tower The tower and equipment will be located on approximately 2,825 square feet of land
approximately SO feet northwest of an existing water tank The tower and equipment will be
surrounded by a six-foot cham-link fence and wffl comply with other requirements as set forth in
the County Code

C. CONDTITUNAL USE PERMTT ANALYSIS
1 Review cnteria
In order to be approved, this canditional use permit must comply vvith Spokane Caunty
Code Sectian 14 404 100 as well as Section 14 622 240 The H+earing Exanuner has reviewed the
facts and appfication and those sections of the County Cvde and makes the fallowing Findings and
Conclusions
County Zoiung Code Section 14 404 104 establishes the requirement5 far a conditivnal use
permit Section 14 444 101 states that in order to grant a conditional use pernut, the hea.rmg
body must find that the fallowing facts and conditinns exist

The Zonmg +Code also allows the Hearing Exanuner tv impose additional conditions and
requuements in order to uphold the spirit and intent of the zoning cvde and the comprehensive
plan as well as to mitigate any adverse impacts upon the adjacent propemes
The standards for wireless communication support towers in the UR-22 Zone are found in
the Zoning Code Section 14 622 240(6). The critena set farth in that Sectivn are relatively new
and are designed to mitigate adverse impacts on the public and on surrounding properties The
Hearing Exatniner finds that those reguIations are the most important in determining whether or
not this conditional use pennit should be grar►ted

As stated in the StaffReport, the proposed tower is 125 feet high, which is greater than the
distance to three of the four property Iines on the site on which it is tv be located That means
that m a catastraphic event, the tower could faU on ad1oining properties The appLcant has
submitted a letter Src,m Rohn Industnes which has been desigrung and manufactunng
telecvmmurucation strucfiures for many years That letter states thai the structure can be designed
m such a way as to fall upon itself in a catastrophic event rather than to fall m a hnear fasluon on
to adjouiing properties The Hearing Examiner will impose that as a conditian of this approval
and, thereby, finds that the first requirement of the ordmance can be met.
Spokane County Code Sechon 14 622 240(6)(U) states

The site plan shows a six-foot fence surrounding the proposed tower with a twelve-foot-
wide gate It will be a requirement of this approval that the gate be locked
14 622 240(6)(c) states
The height of the struclure(s) above ground does not exceed one hundred crnd
twenty-five (125) feet.
The applicant has teshfied that the tower is to be 125 feet and that is the height shown on
the site plan
14 622 240(6)(d) states
All support for wireless comrriunication rnrtennas shall have their means of access
located a mrramum of eight (8) feet above the grounci
The site plan is not clear as to how far above the ground the access point will be, but the
apphcant has agreed to amend the site plan to show its access point at least eight feet above the
ground
14 622 240(6)(e) states
Before the issuance of a buil&ng permd, the applicant sharll have demonstrated that
all applicable requrrements of the Federal Commumcahons Commrssion (FCC),
Federal Avratron Admtrastration (FAA) and arry required aviation easemerris hcrve
been satisfied
The applicant has subrrutted a letter from an aviation consultant which demonstrates that
there can be compliance vvith FCC and FAA requirements Fuial approval from these agencies
will be necessary before building permits are issued
14 622 240(6)( fl states
The facility mary be located on the same lot as one or more other structures avzd
uses without violating, or causrng violatron of Section 14.416 of thrs code w)uch
prohibits multtple primary uses on one buildable lot Any land drvision sharll
conform to RCW 5817.
The wireless communications facility is to be on the same piece of property as the Spokane
Valley Elks, which is allowed by the above section of the code The question which has arisen is
compLance by the applicant to the requirements of RCW 58 17 The applicant is leasing a small
portion (less than 3,000 square feet) of this lot for its facility RCW 58 17 020(1) states

Section (6) references short subdivisions which essezrtiaUy the same defimtion but for
divisions of land into four or fewer lots for the same purposes Since the applicant seeks to lease
property, his proposal would seem to require compliance wrth RCW 58 17
There are certain exceptions to compliance with RCW 58 17, and some of those are set
forth in the County's Subdivision Code Spokane County Code Se.ction 12 100 110(6) states
that
The Director may approve government or pubbc purpose segregatrons as defined
urrder Chapter 12.100 of thts ordinance, provided tJW:
a An applicanon is submitted, and
b. The segregahon includes the provrsron tn the instrui»ent of transfer that "The
subject property was created for (list purpose) under Secnon 12.100110 of the
Spokane County Subdivrsron Or&nance' :
In order to qualify under this Section the appLcant would have to demonstrate to the
Division of Building and Planning that their use is a public purpose and, therefore, they should be
allowed segregatton under this SecUon If the applicant shows that he quaLfies, then a Certificate
of Exemption could be issued.
Another possibility for the applicant is what is defined in Section 12 200 104 of the County
Code as a"public purpose segregation " That is defined as

governmerual body, utrlity company or nonprofit communrty orgaruzahon or

sufficrent lot areg drmensiorrs, and meets all oiher cnteria to comply with the
applicable couniy regulations, for ihe intended purpose of segregahorL Public
purpose segregcmons may rnclude deeded pcrths, tratls; uvtd rtghts-of-way for public
access purposes; rf a deeded path, trarl, or nght-of-way traverses a parcel, such
parth sharll be consrdered un excephon to the underly»g porcel and shall not be
consrdered a dr»sron of the underlying parrcel nor subtract from the parrcel srze for
density purposes.
To qualify under this Section, the applicant would have to demonstrate that they are either a
utility company or very similar to a utility company as a wireless communications company If
they can so demonstrate, then they will not be subJect to RCW 58 17

At the hearing on this matter, the apphcant stated that they may try to obtain an easement
from the land owner for this use rather than a lease An easement is also exempt from RCW
58 17 and is defined in the County Subdivision Code as
EASEME1V7:• A grant by a property awrier to specific persons or to the publtc to
use la»d for a specific purpose or purposes-
It could be that through proper wording of instruments the applicant could change its use of the
property from a lease into an easement Easements are interests in land wluch must be conveyed
by deed The applicant would have to show that any easement granted to it from the property
owner was a valid easement under Was}ungton law in order to qualify for that exception
It is important for the applicant to qualify for one of the exceptions to the Subdivision
Statute because it would be diffcult to comply with the statute itself The applicant seeks to use
approximately 3,000 square feet of the landowners property This is a common parcel size for
wireless commwvcation towers and their support equipment Generally, that size lot does not
quaLfy under most zoning regulataons as a legal lot Those lots also usually do not front on a
public street and only have marginal access by road Therefore, if the applicant were forced to
apply for a subdivision in order to receive the conditional use perrnit, it may be difficult to have
such a subdivision approved It may be also that Spokane Coutrty may have to amend its zoning
ordinance to allow wireless communication towers to exist on parcels of land without going
through the subdivision process
14 622 240(6)(g) states
The owner of the factlity for wrreless communtcation shall not ify the Divmon when
the tower is no longer operatrng as part of a wireless communicahon system
authorued arid Ircerrsed by the Federal Communrcanons Commission. Withm six
(6) mo»ths of the date the facrlity ceases to operate a part of an authonzed system,
the facilrty must eiiher be removed from the srte, or a bull&ng permit must be
obtarined to Qllow artother permitted use of the faciltty.
The above Section would only become activated when the use ceases
The Hearing Examiner also finds thai the wireless communication faciLty is not inconsistent
with the County's Comprehensive Plan Wireless communication facihtaes are not mentioned in
the County's Plan, as they are a new development in the use of land Staff, however, has done
some analysis of the project's compliance with the Comprehensive Plan and the Hearing Examiner
adopts that analyss which is in the Division of Building and Plamung Staff Report on page 4
III. DECISION
Based on the above findings of fact and conclusions, the above application for a conditional
use permit for a wireless communications support tower and antenna facility is hereby approved,
subject to the conditions specified below

Failure to comply with the conditions of this approval may result in revocation of this
approval by the Hearing Examiner. This approval does not waive the appLcant's obligation to
comply with all other requirements of other agencies with jwisdiction over land development
SPOKANE COUNTY DIVISION OF BUII.DING AND PLANNING
1 All conditions imposed by the Hearing Exarruner shall be binding on the "Applicant," which term
shall include the owner or owners of the property, heirs, assigns and successors
2 This proposal shall comply with all of the requirements of the Urban Residential-22 (UR-22) Zone
relating to special perntits for wireless communication facilities as set forth in this decision and in
Spokane County Code Section 14 622 240(6) The applicant shall submit an amended site plan
showing compliance with those regulations and shall also submit the appropriate documentation to
the Department showing compliance with all conditions
3 The applicant shall develop the subject property in strict conformance wrth the site plan presented
to the Hearing Examiner on November 18, 1998, as amended by this decision All aspects of the
concept and proposal shall be binding on the development, including the proposed use Variations, to
be approved by the Director of the Division of Building and Planning/designee, shall only be aUowed
to meet regulation standards and conditions of approval Any other modification must be presented
to the Hearing Examiner for review and approval
4 The Division of Building and Planning shall prepare and record with the Spokane County Auditor
a Trtle Notice noting that the property in question is subject to a variety of special conditions imposed
as a result of approval of a land use action This Title Notice shall serve as public notice of the

DescriQtion of the Proaosal:
The proposal is to construct an unmanned telecommunications facility consisting of a three sector antenna
array mounted on top of a 125 foot lattice tower, with radio equipment mounted on a concrete slab next to
the tower. The proposed tower and equipment will be located on approximately 2,825 square feet of a 5.3
acre parcel owned by the East Side Land Corporation and approximately 80 feet northwest of the existing
Irvin Water District water tank located north and west of the intersection of Pines Road and Interstate 90.
The tower and equipment will be surrounded by a six foot chain-link fence. Access to the tower and
equipment is proposed from Robie Street, across East Side Land Corporation property and across Irvin
Water District property.
Backqround:
The application for the proposal was submitted to the Division of Building and Planning on May 19, 1998. A
Technical Review meeting was held on June 11, 1998, and the application was deemed to be "technically

complete" on September 25, 1998. A Notice of Application was issued on September 25, 1998 with a 14
day public comment period ending on October 8, 1998.
Staff Analysis:
Comprehensive Plan:
The Comprehensive Plan category for the subject property is Urban. The Urban (U) category is intended to
provide the opportunity for development of a"city-like" environment which inc(udes various land uses. It is
primarily a residential category of single-family, two-family, multifamily, and condominium buildings along
with neighborhood commercial, light industrial and public and recreational faci{ities. The more intensive land
uses such as light industrial and neighborhood commercial will be iocated near the heavily traveled streets,
while the least intensive single-family residential uses will be isolated from the noise and heavy traffic. Cell
phones and associated towers were probably not contemplated when the Comprehensive Plan was drafted
in 1980. Goal 1.3 is to "Encourage conservation and utilization of natural features and vistas within the
county." Whiie the proposed tower and equipment will not alter the natural rock outcropping unique to the
subject property, the proposed tower is approximateiy 25 feet tafler than the existing 100 foot water tank
Iocated nearby and will alter the aesthetic character of the area. Goal 1.5 is to "Encourage a healthful and
pleasing environment in the county's residential areas." The location of the subject property is partially
isolated from the surrounding residential uses. The proposed conditional use permit implements the majority
of the Goals, Objectives and Decision Guidelines of the Urban Category, to the extent that it can.
Zoning:
The subject property is located within the Urban Residential-22 (UR-22) zone. A wireless communication
support tower is an allowed use in the Urban Residential-22 (UR-22) zone, provided the applicant applies for
and receives a Conditional Use Permit based upon compliance with the performance criteria specified by
Section 14.622.240(5)(a-g) of the Spokane County Zoning Code.
Section 14.404.101 of the Zoning Code states that before a Conditional Use Permit is approved, the Hearing
Examiner shall find that 1). Adequate conditions and restrictions are attached to the development of the
property to ensure that the proposed use will be compatible with uses permitted outright in this location; and
2). The special standards as outlined in the Zoning Code for the underlying zone shall be met.
Review of the proposat's compliance with the specific development criteria for a Wireless
Communication Support Tower as identified in Section 14.622.240(5)(a-g) is as follows:
• Section 14.622.240(5)(a): That the wireless communication company shall secure the necessary
property or right-of-way to assure for the proper construction, continued maintenance, and general safety of
the properties adjoining the wireless communication facility.
Response: According to Sheet A-1 of the site plan of record date stamped Received Sept. 22, 1998, the
proposed tower is setback between 136 feet and 23 feet firom adjacent property lines. Since the tower itse{f
is 125 feet (greater than the distance to 3 out of 4 property lines) the applicant should provide evidence that,
in the event of catastrophe, the tower is designed to collapse in such a way that adjacent properties will not
be threatened.
• Section 14.622.240(5)(b): The facility shall be enclosed by a fence not {ess than six (6) feet in height with
a locking gate.
Response: According to Sheet A-1 of the site plan of record date stamped Received Sept. 22, 1998, the
proposed tower is surrounded by a 6 foot high chain-link fence with a 12 foot wide gate. The gate is not
specified as being a locking gate as required.
• Section 14.622.240(5)(c): That the height of the structure(s) above ground does not exceed one hundred
twenty-five (125) feet.
Response: According to Sheet A-2 of the site plan of record date stamped Received Sept. 22, 1998, the
height of the proposed tower is 125 feet above ground.

' Secfion 94.622.240(5)(d): That all support structures for wireless communication antennas shall have
their means of access located a minimum of eight (8) feet above the ground.
Response: The site plan of record date stamped Received Sept 22, 1998, does not illustrate a means of
access for the support tower or that the access is eight feet above the ground.
• Section 14.622.240(5)(e): That before the issuance of a building permit, the applicant shall have
demonstrated that all applicable requirements of the Federal Communications Commission, Federal Aviation
Administration and any required aviation easements have been satisfied.
Response: The applicant has not demonstrated compliance with FCC or FAA requirements.
• Section 14.622.240(5)(0: That the facility may be located on the same lot as one or more other
structures and uses without violating, or causing violation of Section 14.416.000 of this Code which prohibits
multiple primary uses on one buildable lot. Any land division shall conform to RCW 58.17.
Response: The tower and associated equipment are proposed to be located on the same Spokane County
tax parcel as the Spokane Valley Elks facility in compliance with special standard f.
On the Conditional Use Permit Application, in response to the question "What interest does applicant hold in
the property?", the applicant responds "Reserved portion of land for the location of a wireless
communication support structure." Staff does not understand this response but has been told by the
applicant that his intention is to lease just that portion of the subject property from the property owner. A
leasee is considered a division of land which must conform to RCW 58.17.
• Section 14.622.240(5)(g): The owner of the facility for wireless communication shall notify the Division
when the tower is no longer operating as part of a wireless communication system authorized and licensed
by the Federal Communications Commission. Within six (6) months of the date the facility ceases to
operate a part of an authorized system, the facility must either be removed from the site, or a building permit
must be obtained to allow another permitted use of the facility.

Response: The above noted condition shall be addressed at the time the operation of the facility ceases. If the
applicant does not comply with this condition, a zoning violation will arise and the property shall be subject to
enforcement proceedings. '
Staff Recommendation:
The proposed Conditional Use Permit for a wireless communication support tower can implement the Goals,
Objectives, and Decision Guidelines of the Urban category of the Comprehensive Plan. The application, site
plan and other support information submitted by the applicant demanstrates general compliance with the
development standards of the Urban Residential-22 (UR-22) zone, most specifically Section 14.608.240(13)
of the Zoning Code. Those development standards not addressed by the applicant must be met prior to the
issuance of any building permit. The Division of Building and Planning recommends approval of the
proposed Conditional Use Permit, as conditioned.

GTE Wireless of the Pacific proposes to construct, operate, and maintain a Personal Communications Sernces (PCS)
wireless communications facdity oa the subject parcel. The proposed facffity will occupy a rectangular project area
measuring forty feet (40') by forty feet (40') located on the eastern portion of the property. It would include
construction of a one hundred twenty-five foot (125') steel lattice tower mouated with up to twelve 51-0 panel antennas.
The proposed facility would also include one 8' by 2 5' by 6' Motorola equipment cabinet, one utility mounhng board,
and associated co-axial conduit The facility would be surronnded by a siac foot (61) chain Lnk fence to restrict access

The one hundred hventy-fve foot (125') steel lathce tower will be constructed in a manner to facditate future co-
location with other wireless providers It will include at the top up to tweive (12) total panel antennas, each measuring
five (5) feet in height The initial budd-out wiU reqnire only sia (6) panel antennas, tivith the remaining six (6) spaces
reserved should additional capacity be needed to meet customer demand.
The PCS cabmet, transition vault, and utility service mounhng board will be located on a poured concrete pad
measuring nine and % feet (9.51) by fourteen feet (141) (total impervious surface area =133 square feet). The
remaining project area will be composed of a permeable all-weather surface. The proposed base stabon will be
accessed from Robie Road via the existing Elk's Lodge parkutg Iot and via access easement across property oNned by
Irvin Water District #6 Routine maintenance of the facility after construction will occur only once a month, with the
access easement serving as a temporary parking area

proposed GTE Wireless Tower Site #WA0288 to be located at 2607 Robie Road, Spokane
County, Washington.
The attached report presents the results of our research, field evaluation, and engineering
anatyses. Conclusions and recommendations with respect to the soil and geologic conditions are
included in the report to assist pro}ect planning and design. Based on the results of this
evaluation, it is our opinion that the site is suitable for the proposed 125 foot tall tri-leg tower.

INTRO D UCTION
Strata, Tne., has complctcd the authorized geotechnical engineering evaluation for the
proposcd 125 foot tri-leg GTE Wireless-Millwood 4WA0288 communications tower to be
located at 2607 Robie Road in Spokane, Washinbton (Plate 1). The purpose of the evaluation
was to assess the soil and geologic conditions within the proposed tower construction area and to
provide geotechnical engineering recommendations witli respect to design and consEruction_
~ EVALUATION PROCEDURES
One exploralory boring was drilled in the proposed construction area. Due to access
. restraints, the boring was situated as close to the tower location as was practical_ The location of
the boring is shown on P1ate 2, Site Schematic. The field work was performed by an engincering
geologist from our office on Apri{ 29, 1998.
The boring was drilled by a Bortec hollow stem auger driil rig with coring capabilities.
The rock encauntered was visually classified and the subsurface profile was logged_ Gs'anit+c
Gneiss bedrock was encountei•ed near the surface and therefore, the boring was completed via
coring techniques from the surface to the termination depth. Rock Qual;ty Designation (RQll)
values were recorded for each core "r-un" drilled. ~

SURFACE CONDITIONS
The surface of the property is relatively flat with a gentle slope down from all sides. The
site in general lies atop a hill consisting of gneiss bedrock outcrop. The site was previously used
as a water storage tank. A new water tank was constructed in the 1970's, and the tank on the site
was demolished. Slopes on the knoll ranged between 15 degrees and 45 degrees from horizontal.
Vegetation surrounding the site consisted of sparse pine trees and bushes. Site access is from
Robie Road to the east, through the Valley Elks facility.
SUBSURFACE CONDITIONS
A thin, very poorly developed topsoil horizon was encountered at the ground surface.

Fractured and weathered granitic gneiss bedrock was encountered immediately below the surface
at 1.5 feet, and continued to the termination depth of the boring. RQD values were typically SS%
with the highest RQD value of 94% at approximatety 10 feet.
Ground water was not encountered at the time of the field evaluation. The ground water
table is reportedly at depths in excess of 100 feet in the area. However, perched water tables can
be encountered within the fractured gneiss. The elevation of a perched water table will vary with
seasonal changes in precipitation, infiltration, irrigation and other factors.
Detailed descriptions of the subsurface conditions encountered in the boring are presented
on Plate 3. The Unified Soil Classification System, Plate 4, can be used to interpret the terms
used on our exploration log and throughout this report. Subsurface conditions may vary across
the construction site. These changes in condiiions would not be apparent until construction. If

the subsurface conditions change from those observed in the boring, the construction timing, plans
and costs may change.
CONCLUSIONS AND RECOMMENDATIONS
It is our opinion that the site is suitable for the proposed communications tower
construction with respect to the explored subsurface conditions. Based on our subsurface
exploration and site reconnaissance, it appears that the tower foundation can be supported on or
within native gneissic bedrock.
The following rock parameter recommendations are presented to assist in the planning and
design of the proposed communications tower. Our recommendations are based on our
experience with similar rock and geologic conditions and our understanding of the proposed

construction.
Communications Tower Foundations
We have selected the following foundation design criteria based on our knowledge of the
proposed construction and the engineering properties of the subsurface that were encountered in
our exploratory boring. The following parameters should be incorporated in the design of the
tower. It should be noted, however, that with the exception of allowable bearing capacity, the
presented values do not include factors of safety. Allowable bearing capacity includes a factor of
safety of 3.0.

Drilled S6aft Foundation
To minimize total foundation movement to one inch or less in the vertical direction,
allowable bearing capacities of 10,000 pounds per square foot (psf) in rock between five and ten
feet depth, and 15,000 psf below ten feet depth are recommended for design. The recommended
pressure may be increased by 1/3 for non-sustained loads (i.e. wind and seismic). Allowable side
friction may be calculated by using the appropriate lateral earth pressure value (at-rest) multiplied
by the friction coefficient. Lateral earth pressures (passive) should not exceed a tota] of 10,000
psf acting against foundation shafts.
The bottom of foundations should be cleaned of loose cuttings. The concrete should be
placed on the bottom of the shaft (via "tremie") to avoid soil inclusions and segregation of the

concrete during the concreting and casing removal. The top of the fluid concrete should be
maintained above the bottom of the casing during casing removal.
Monolithic Slab/Footing Foundations
After the foundation excavation is complete for slab type foundations, we recommend a
leveling course of six inches of granular structural fill be placed, moisture conditioned and
compacted to at least 95% of the maximum dry density as determined by ASTM D-1557,
Modified Proctor. The purpose of the leve]ing course is to provide an even working surface for
forming and concrete placement. Bearing and friction factors for design can be obtained from the
Design Parameters table above. All foundation bearing surfaces should be free of loose soil, fill,

or debris prior to forming and pouring concrete. Backfill against foundations should be
compacted as structural fill.
We recommend that an anchor type tensile support system be utilized if additional capacity
is required to resist uplift forces or moments on the foundation. Rock anchors should be installed
a minimum of fifteen feet into undisturbed native gneiss and have a minimum grouted length of six
feet. For a six foot pressure grouted anchor length, we estimate the allowable soil anchor
capacity at 20 kips. If additional tensite capacity of the anchors are desired, we recommend a
design value of four kips per linear foot of pressure grouted rock anchor be utilized for design.
Pressure grouted anchors should be load testing at 125% of the tota] design stress at the time of
construction. The test load should be applied for at least ane-half hour and deflection monitored
to assess the efficiency of the anchor. AlI rock anchors should be designed and installed in
accordance w-ith the manufacturers recommendations.

Building Foundations
Footings for any pre-manufactured buildings should bear on the native gneiss at a
minimum depth of 36 inches below final, outside, finish grade to protect against frost. Footing
widths should be consistent with the Uniform Building Code (UBC). We recommend an
allowable bearing pressure of 4,000 psf and a sliding resistance of 0.50 for strip footings bearing
on the native fractured gneiss. .Any loose material should be removed from the base of the footing
excavations prior to forming and pouring the footings. If loose or unstable areas are observed at
the base of the footing excavations, the loose material should be removed and replaced with
compacted structural fill.
Site Preparation
We recommend that vegetation and the existing asphalt and soil layer be excavated and
removed from the proposed tower location and any building areas. The on-site fractured rock
may typically be excavated with conventional excavation equipment. Deeper excavations for
caisson-type foundations may require equipment with coring or augering capabilities. If
excavations are greater than 4 feet deep, such as in the case of excavations for utility trenches, we
recommend that the temporary excavations be sloped at 1.5:1 (horizontal to vertical in
conjunction with OSHA regulations and local codes if workers are to enter the excavations.
Structural Fill
We separate fill into two categories; stn.ictural fill and non-structura] fill. Structural fill is
defined as fill which underlies, or is within 5 feet of foundation, building or roadway areas. Non-

structural fill is fiil which is at least 5 feet outside of building and pavement areas. Structural fill
should consist of GW, GP, GM, SW, SP, or SM soil as designated by the Unified Soil
Classification System, Plate 4.
Structural fill should be placed in eight-inch-thick, loose lifts at near-optimum moisture
content and compacted to a minimum 92% of the maximum dry density as determined by ASTM
D-1557 (Modified Proctor). Non-structural fill should be placed in twelve-inch-thick, loose lifts
and compacted to at least SS% of the maximum dry density as determined by ASTM D-1557
(Modified Proctor). The fractured gneiss near the surface is not considered suitable for structural
fill. It may be necessary to moisture condition the fill soils before placing and compacting them as .
structural fill. We recommend a large smooth drum vibratary roller or vibratory plate attachment
be used for compaction.
Storm Water Drainage and Ground Water
Development of this site will not significantly alter the run-off and infiltration
characteristics of the site. However, we recommend that run-off from the proposed structure be
directed away from the foundation. Site grading should allow for positive drainage of surface
water away from the proposed stnacture foundations.
Ground water was not encountered in the boring at the time of the evaluation. Although
perched water tables may be encountered in the gneiss, we do not anticipate ground water during
the anticipated construction (1998).

Seismicity/L,iq uefaction
The proposed development site is located within Zone 2B in the 1994 edition of the
Uniform Building Code. Zone 2B corresponds to an earthquake of intensity VII on the Modified
Mercalli scale or approximately 5.5 on the Richter scale. A soil "S" factor of 1.0 corresponding
to an S, type soil coefficient (per 1994 UBC, Table 16-n should be used for design.
Liquefaction is a process, typically during earthquakes, where fine grained silty sands
"liquefy" or act as a liquid rather than a solid. For ]iquefaction to occur, three conditions must be
met: loose soils must be present, ground water must be present, and the soil must be in a
confined condition. Due to the lack of soils and ground water on the site, liquefaction is not
considered a concern at the property. No active faults are known to be present within 20 miles of
the site.
Resistivity Test
Resistivity data will follow under separate cover.
Construction Monitoring
We recommend that Strata, Inc., be retained to provide construction monitoring and
special inspection services to verify the report recommendations have been followed. The costs
for these services are not included in the scope of work for this evaluation. If we are not retained
to provide the recommended construction monitoring services, we cannot be responsible for soil
engineering related construction errors or omissions.
