Secaon 14.622 240 4 of the Zoning Code of Spokane County allows this use upon issuance of a cond.ltional use permit Autharity to consider such a request exists pursuant to section 14 404100 of the Zonuig Code of Spokane County and Spokane County Board of County Commissioners resolution No 89 0708, as may be amended PROJECT LOCATION: Located east of and adjacent to Pines Road and approximately 1/3 mile south of Euclid Avenue in the NW 1/4 of Secaon 10, Township 25, Range 44EVVM 2500 N Pines Road OPPONENTS OF RECORD: NONE PUBLIC HEARING AND DECISION: After consideration of all available information on file, exhibits subnutted and testimony received dunng the course of the pubhc heanri held on November 10, 1992, the Zomng Adjustor rendered a wntten decision on November , 1992 to APPROVE the apphcanon FINDINGS OF FACT AND CONCLUSIONS 1 Tesnmony was taken under oath 2 The proposal is descnbed above and detailed in documents contained in the file 3 The adopted Spokane County Comprehensive Plan designates the area of the proposal as Urban. The proposal is generally consistent with Urban category of the Comprehensive Plan and complies with RCW 36 70 450 4 The site is zoned UR-22, which allows the proposed use upon approval of this application 5 The existing land uses in the area of the proposal include apartments, professional offices and businesses Typically, uses hsted as a conditional use are assumed as permitted in the underl}nng zone, subject to the hsted conditions and any other condiaons need to assure compatlbihty in the given instance But, pursuant to 14 404 101, the requested conditional use pemut may be denied if the Hearuig Body cannot find that the requested use wdl be compatible wnth other pennitted uses Section 14 622 240 4 lists certain standards to achieve compaabihty, some of w}uch the Heanng Body may exercise nominal discreaon over to achieve the overall intent of compatibility with surrounding properties. Clearly, 14 404 102 allows the Heanng Body to impose any and all manner of additional conditions and requuements in an effort to achieve maximum compaability In the instant situation the , . The parldng lot for dropoff and pickup is safe ulsofar as the non-daycare parlang and traffic will be nunimal. 6. Pursuant to the State Environmental Policy AcL the environmental checkhst and other data have been reviewed and the project has been found to not have any probable sigruficant adverse unpacts to the physical environment. A Determinaaon of Nonsigruficance (DNS) was issued on October 15, 1992 and sent to 8 agencies of jurisdiction The agencies reviewnng the checklist neither indicated that more detailed envuonmental review should be provided nor commented that the DNS should be reconsidered. Comments regard.ing the envuonmental matters were not made at the public heanng There was not sufficient evidence presented pursuant to WAC 197-11-340(3)(a) to withdraw the DNS 7 The applicant has been made aware of the recommendanons of vanous County agencies reviewuig this project and has indicated those recommendations are acceptable S The proper legal requu-ements for advemsing of the heanng before the Zoning Adjustor of Spokane County have been met 9. SP-707-91 ) CONCLUSIONS AND DECISION THIS MATTER, an applicadon for subdivision of land, from Roy Wyatt has been received and decided upon, pursuant to Spokane County Subdivision regulations, on the day of September, 1991. FINDINGS OF FACT AND CONCLUSIONS , 1 The indsvidual signing below has further been properly delegaxed the responsibility for rendering the decision by the Spokane County Duector of Plannmg. 2. The proposal is to divide approximately 12 acres into 41ots for the development of multiple family dwelli.ngs and professional offices. 3. The proposal is located east of and adjacent to Pines Road, approximately 500 feet north of Mansfield Avenue in the NW 1/4 of Section 10, Township 25 North, Range 44 EWM, Spokane County, Washi.ngton. 4. The cuirent zoning of the property is Urban Residential-22 (UR-22). (See file Nos. ZE-32-69 and ZE-31A 84). The pnyposed Tracts meet the minimum lot szze and frontage requirements of this zone. Futune development shall comply with all applicable provisions of the Spokane County Zoning Code and the specific conditions of file Nos. ZE-32-69 and ZE-31A-84. 5. The Spokane County Comprehensive Plan designates this azea as Urban. The development and uses proposed are generally in accord with this category. b. The required public notice was provided for this proposal and agencies having a potential interest in the project were notified and recommendations solicited. 7. No adjacent property owners in the area commented on the proposed short plat. 8 Recognmng the recommended conditions and Spokane County development standards, the proposed subdivision ma.kes appropriate provisions for the public health, safety and general welfare and that the pubhc use and interest wlll be served by platting the subdivision. 9. The project is exempt from environmental review under the State Environmental Pohcy Act pursuant to WAC 197-11-800 (6) (a). DECISION B ased upon the above noted F'indings of Fact and Conclusions, Short Plat Application SP-707-91 is hereby APPROVED until October 1, 1994, subject to conditions noted below. Most of the conditions of approval shall be accomplished by the apphcant and/or sponsor prior to finalization of the short subdivision. This decision is final unless appealed m writing, consistent with adopted appeal procedures. These Conditions of Approval apply to applicant(s), owner(s) of the property, heirs, assigns or any successors-in-interest to property. PLANNING DEPARTMENT CONDITIONS 1. The preliminazy plat of record approval is for the property legally described in the application for this proposal. 2. The final plat shall be designed substantially in conformance with the preliminary plat of record No increase of density or number of lots shall occur without a change of condition application submittal and approval. 4. The Planning Director/designee shall review any proposed final plat to ensure compliance with these Findings and Conditions of Approval. 5. Appropriate road name(s) shall be indicated. 6. The preliminary plat is given condidonal appmval for three (3) years, specifically to October 1,1994. The applicant may request an extension of time by submitting a written request approximately forty-five (45) days prior to the above expirarion date. 7. Appropriate utility easements shall be ind.icated on copies of the proposed final plat. Written approval of utility easements by appropriate utility compaaies shall be received with the submittal of the final plat. 8. Three (3) current certificates of title shall be furnished to the Planning Deparmaent prior to filing the final plat. 9. The final plat map shall indicate by a clear, dashed luie the required yard setbacks from all pnvate, "Tract X" or public roads. The dedicadon shall contain the following statement: "Side yard and rear yard setba,cks shall be detesmined at the time biulding pernuts are requested unless these setbacks are specifically drafted on this final plat. The setbacks uidicated on this plat may be varied from if proper zoning approvals are obtained." 10. A plan for water facilities adequate for domesdc sernce and fire protection shall be approved by the water purveyor, appropriate fire protection district, County Building & Safety Department and County Health DistricL The agencies will c+ertity on the Water Plan, prior to the filing of a final plat, that the plan rs in conformance with their respective needs and regulations. The Water Plan and certification shall be drafted on a transparency suitable for reproduction and be signed by the plat sponsor. 11. The water purveyor shall ccrufy that appropriate contractual arrangements and schedule of improvements have been made with the plat sponsor for construcdon of the water system in accordance with the approved Water Plan. The time schedule shall provide for completion of the water system and inspection by the appmpriate health authorities prior to application for building permits within the final plat. The amangements or agreements shall include a provision holding Spokane County and the purveyor harmless from claims by any lot purchaser refused a building pennit due to the failure of the subdivision sponsor to satisfactorily complete the approved water system. 12. The final plat dedication shall contain the following statement: "The pubhc water system, pursuant to the Water Plan approved by county and state health authorities, the local fire protection district, County Building & Safety Department and water purveyor, shall be installed within tlus subdivision, and the applicant shall pruvide foar individual domestic water service as well as fire protection to each lot prior to sale of each lot and prior to issuance of a building permit for each 1ot" 13. No bwlduig permit will be issued for any lot wnthin the final plat until certified by a Washington state-licensed engineer that "the water systeni has been installed pursuant to the approved Water Plan for the final plat" including a signed license stamp. The ce,rdfication may be in the fornz of a letter, but is preferned to be certified on a copy of the Water Plan as a schematic map showing the "as-built" water system. 14. The Water Plan and the above four (4) condidons of approval regarding the Water Plan may be waived by the Planning Director/designee upon receipt of letters from the appropriate water purveyor and fire protection district stating that simple connecaons to an existing, appr+oved water system will provide adequate domestic and fue protection water to ensure the public health, safety and general welfare. 15. A survey is required prior to the filing of a final plat 16. Site development shall comply with the specific condhtions of file Nos. The conditional approval of the plat is given by the County Engineer subject to dedhcation of right-of-way and approval of the road system as uidicated in the prehminary plat of record. Plans, profiles, and cross-secdons as designed to County standards showi.ng proposed street centerline and curb grades shall be submitted to the County Engineer for approval prior to construcdon and/or the filing of each final plat; road plans to be prepared under the direction of a licensed Professional Civil Engineer. 3.\ Drainage plans and design calculations showing the ahgnment of drainage facilities shall be subnutted to the County Engineer for approval prior to construction and/or the filuig of the final plat. I?rainage plans to be prepared under the direction of a licensed Professional Civil Engineer. 4. Construction within the proposed public streets and easements shall be perfonned under the direct supervision of a licensed engineer/surveyor, who shall funiish the County Eng~' neer with "as-built" plans and a ceatificate in writing that all improvements were installed to the lines and grades shown on the approved construction plans and that all disturbed monuments have been replaced. 5. No construction work is to be performed within the existing or proposed public right of-way until a pernnit has been issued by the County Engineer. All wark is subject to inspection and approval by the County Engineer. 6. All construction within the existing or proposed pubhc right-of-way is to be completed prior to filing each final plat, or a bond in the amount estimated by the County Engineer to cover the cost of construction of improvements, construction certification, "as-built" plans and monumenting the street centerlines shall be filed with the County Engineer. 7. Appropriate provision shall be made that the following-described pmparty held in trust until the continuation of the smeets be dedicated or deeded: a one(1-foot strip at the ends or edges of all streets that termanate or border the subdivision boundary . (Temporary cul-de-sacs are required when streets terminate at the subd.ivision boundaries.) 8. Individual driveway access pennits are required prior to issuance of a building penmrit for driveway approaches to the county road system. ~ . . . 9. The word "applicant" shall include the owner or owners of the property, his heirs, assigns and successors. 15. The County Engineer has designated Typical Roadway Section Number One, Local Access standard for the improvement of Cheny Street, which is to be constructed within the proposed development. This will require the installation of 40 feet of asphalt. The construction of curbing and sidewalk is also required. 16. The proposed subdivision shall be improved to the standards set forth in Spokane County Board of Commissioners Resolution No. 80-1592, as amended, which resolution establishes regulations for roads, approaches, drainage and fees in new construction. . ^ . . - • . The County Engineer has examined this development proposal and has determined that the impact of this proposal upon the existing county road system warrants the dedication of a,d~ditional right-of-way and the roadway improvements herein specified. 18.
