IN THE MATTER OF VARIANCES FROM ) FRONT AND SIDE YARD SETBACKS ) FINDINGS OF FACT, [VE-56-90] LYNN PIERCE ) CONCLUSIONS, COMPANION FILES: FINAL PLAT #315 } AND DECISION (Sky View Acres) ADDRESS: E. 12103 - 26th Ave PARCEL NUMBER: 28544-0919 APPLICATION DESCRIPTION: 1) The applicant proposes to locate an attached garage addition to an existing single family dwelling 43 feet from the oenterline of the roadway right of way (18 feet from the front property line); whereas, section 4.05.110 a. 1. of the Spokane County Zoning Ordinance requires a 55 foot setback (30 feet from the front property line) from the centerline of the roadway right-of-way; and 2) to locate the attached garage 3 feet from the side property line; whereas, section 4.05.110 a. 2. of the Ondinance requires a 5 foot side yard set back. , Authority to consider such a request exists pursuant to Section 4.25.030b. of the Spokane . County Zoning Ordinance. ; PROJECT LOCATION: Generally located on the northwest corner of Whipple Road and . 26th Avenue in the SE 1/4 of Section 28, Township 25N, Range 44 EWM, Spokane County, Washington. The property is addressed as East 12103 26th. OPPONENTS OF RECORD: NONE PUBLIC HEARING AND DECISION: After considerarion of all available information on file, exhibits submitted and testirnony received during the course of the public hearing held on August 27, 1990, and the Zoning Adjustor rendered a written decision on September 620a-1 , 1990 to APPROVE the aPPlication. FINDINGS OF FACT AND CONCLUSIONS 1. The proposal is generally described above. 2. The adopted Spokane County Comprehensive Plan designates the area of the proposal as Urban. The proposed uses are generally consistent with this category. 3. The site is zoned Agricultural Suburban, which allows the proposed use upon . approval of this application. 4. The existing land uses in the area of the proposal include similar residential development, all of which are compatible with the proposal. Most houses in the area have double car garages; whereas, the applicant's house has only a single car garage. 5. The applicant's house was small, constructed originally (within three years of the subdivision's finalization) to the 40 foot front yard, 12 foot side yard and 20 foot flanking smeet yard requirements of the final plat dedication. These setbacks substantially exceed the ! • CASE NO.VE-56-90 SPOKANE COUNTY ZONING ADJUSTOR PAGE 2 Zoning Ordinance requirements, both in 1956 and now. The 1956 file contains no hint as to why these setbacks were specified. With a drainfield at the rear of the dwelling and a previously constnicted dwelling addition on the east side of the corner lot, no room exists for expansion. In order to have interior space comparable to other dwellings, front/side yard expansion is the only space left to consider. 6. Although only one variance is of reconi in the subd.ivision, numerous garages and portions of dwelling units are in the front yards of 26th Avenue. Most houses of the last 15-20 years also violate the dedication setbacks described in #5 above. 7. Granting these variances from provisions of the Zoning Oniinance does not grant relief from the setbacks set forth in the dedicadon of the plat. But, obviously few if any parties have been concerned about plat dedicarion language. . 8. The proposal is exempt from the provisions of the Washington State Environmental - Policy Act, Chapter 43.21C RCW pursuant to WAC 197-11-800 (6) (b). . 9. The applicant has been made aware of the recommendations of various County agencies reviewing this project and has indicated those recommendations ane acceptable. 10. The proper legal requirements for advertising of the hearing before the Zoning Adjustor of Spokane County have been met. 11. No adverse tesrimony or written comments were received regarding the proposal. 12. With the conditions of approval set forth below, the variance will: a) not constitute a grant of special privileges inconsistent with limitadons on other properties in the vicinity and similar zone; b) ensure that the intent and purpose of the Zoning Ondinance is achieved with regard to location, site design, appearance, and landscaping, etc; and c) protect the environment, public interest and general welfare. CONCLUSIONS DECISION From the foregoing Findings and Conclusions, the Zoning Adjustor APPROVES the proposal, subject to compliance with the following CONDITIONS OF APPROVAL I. GENERAL 1. Failure to comply with any of the conditions of approval contained in this decision, except as may be relieved by the Zoning Adjustor, shall constitute a violarion of the Zoning Ordinance and be subject to such enforcement as are appropriate. 3. The Zoning Adjustor may administratively make minor adjustments to site plans or the conditions of approval as may be judged to be within the context of the original decision. II. PLANNING DEPARTMENT 1. The garage shall be of similar design and appearance as the euisring dwelling structure. . . 2. The front yard set back pursuant to the Zoning Qrdinance, is relieved from the 55 ~ foot standani to 43 feet (resvlts in a 30 foot setback). . 3. The (west) side yani setback, pursuant to the Zoning Ordinance is relieved from the 5 foot standard to 3 feet. ; III. DEPARTMENT OF BUILDING & SAFETY 1. The issuance of a building pemut by the Department of Build.ing and Safety is . required. . IV. UTILITIES DEPARTMENT 1. Pursuant to the Board of County Commissioners Resolution No. 80-0418, the use . of on-site sewer disposal sysLems is hereby authorized. This authorization is conditioned on ; compliance with all rules and regulations of the Spokane County Health District and is further conditioned and subject to specific application approval and issuance of pennits by the Health ~ District. - 2. Any water seivice for this project shall be provided in accordance with the Coordinated Water System Plan for Spokane County, as amended. V. HEALTH DISTRICT No Comment VI. Eventually I would like to bring the utilites upstairs into the existini garage for added convenience and resale value. This is a vz~-y well built house (built in 106U ) with hardwood (oak) floors and wooden Pel1a wir,dows. I hope to put vinyl siding on the new garage and eventually the entire house.
