THIS NTATTER, a request for an Administrative Interpretation, has been received from Bruttles
Northwest, Inc., Clyde Hasse and decided upon, pursuant to the Spokane County Zoning Cod c
regulations, on the 2nd day of December, 1994
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
renderng the decision by the Spokane County Director of Planning.
2. The applicant has applied for an Administrative Interpretation pursuant to Chapter 14.504,
Section 14.504.000 Interpretation of the Zoning Text of the Zoning Code of Spokane
County, Washington.
3. The proposal is to allow conversion of an existing building into a deli with take-out and
indoor seating not to exceed 50 people.
4. The proposal is generally located in the south Spokane Industrial Park, on Pioneer Lane,
Section 12, Township 25 N, Range 44 E.W.M., Spokane County, Washington.
5. The area north of I-90 to Trent Avenue has been reserved exclusively for Industrial uses.
6. The use is ancillary to the primary uses existing in the Spokane Industrial Park. Merriam
Webster's Collegiate Dictionary, tenth edition, defines "ancillary" as, l: subordinate,
subsidiary (the main factory and its - plants).
7. The current zoning of the property described in the application is Heavy Industrial (I-3)
zone.
8. The Spokane County Comprehensive Plan designates this area as Industrial. The
"Industrial Category" is intended to provide the opportunity for industrial development
and attendant uses and reserve land for industrial purposes. The "Industrial Category" of
the Spokane County Comprehensive Plan, provides a Detailed Definition of characteristic
features which includes the following: "Small-scale activities related to industrial uses
such as cafes, service stations and parts and service stores will be characteristic of the
'Industrial Category.
9. Agencies having a potential interest in the property were notified and recommendations
solicited, and the required public notice is provided for this decision.
10. The applicant proposal is situated on the plan and within the zoning designation in such a
manner as to preclude consideration as a transition use or area.
11. The proposed use appears to promote the public interest safety and welfare in that:
a. It will "reduce midday traffic on Sullivan Road."
b. "Reduce the automobile accident risk to the public and the SIP (Spokane Industrial
Park) work force;" and
c. "Less traffic will also have a positive impact on the public's air quality by reducing
automobile exhaust emissions."
12. The current work force at the Spokane Industrial Park is estimated to be 5,000 people.
13. A public need appears to exist for on-site facilities of this nature in the south industrial
park, much the same as provided for in the north industrial park.

14. The orientation of the facility is towards Pioneer Lane and should not be accessed from
Sullivan Road. The building is located within the industrial complex and is ancillai-ti, to
the Spokane Bu;iness cand I~yd~ist~i~~l Park
DECISI()N
Based upon the above noted Findings of Fact and Conclusions, Admiilistrative Interpretatioti
AIE-36-94 in hereby APPROVED subject to the following conditions. This decision is final
unless appealed in writing, consistent with adopted appeal procedures.
CONDITIONS OF APPROVAL
1. No direct access off Sullivan Road will be provided for the deli and Any existins'i_gns on
Sullivan Road shall be removed.
2. That no free standing signs identifying the proposed deli will be permitted.
3. One sign wall mounted in such a manner as not to be visible form Sullivan Road shall be
permitted pursuar.t to Sip-naqe Standards Section 14.630 34q of the ?on±n(,, C'ade o.r'

4. The proposed cieli will only occupy no more than 2,000 square tee~.
5. That seating will be limited to no more than 50 people.
6. That all seating will be inside with no outdoor accommodations.
7. That exterior alternations to the structure will be limited to handicap access.
8. The hours of operation will be limited, being 6 a.m. to 6 p.m. Monday through Friday, to
coincide with the Spokane Industrial Park hours of operation.

subsequent zone reclassification is approved for the subject site, allowing the proposal as a
permitted use.

APPEAL RIGHTS: This is an administrative interpretation of the Zoning Code for Spokane
County, pursuant to Section 14.504.000. As such, it is required to be sent to the applicant, as
well as adjacent property owners/taxpayers, and is appealable under the provisions of Section
14.412.041. As stated therein, "Such request shall contain reference to the specific decision or
interpretation contested and shall be delivered to the Hearing Body at the Planning Department
office not later than twenty (20) calendar days from the date of the written decision of the
Department." The fee for such appeal is $210.00.
