REGARDING A SIGN IN THE AGRICULTUAL ZONE. ~ FINDINGS, CONCLUSIONS
(YE-15-86); YALLEY ASSEMBLY OF GOD CHURCN ) AND DECISION
SUMMARY OF APPLICATION:
The appiicant requests a deviation from the sign standards of the Agricutural
zone to perniit the installation of a sign considerably in excess of the
maximum requirements in the zone. The sign proposed is 25' in height and
approximately 170 square feet per side, including the logo, for each side of a
2-side sign.
LOCATION:
The 3.6 acre Church's parcel is located approximately 300' east of Sullivan
Road with frontage on and south of Broadway Avenue. The Church ha; an
easernent access westward to Sullivan Road at a location approximately 300'
south of the intersection of Broadway and Sullivan. The Assessors Parcel # is
13543-0419.
DECISION OF THE ZONING ADJUSTOR:
Based upon the evidence presented and circumstances associated with the
project proposal, the Zoning Adjustor DENIES the project as set forth in the
application, and APPROYES A LESSER YARIANCE.
PUBLIC HEARING:
After examining all available information on file with the application and
visiting the subject property and surrounding area numerous times, research-
ing the legality of several church signs in the neighborhood, the Zoning
Adjustor conducted a public hearing on March 12, 1986, which hearing was con-
tinued to March 26, 1986, renered a verbal decision on March 26, 1986, and a
written decision on April 1986.
FINDINGS OF FACT
~
1. The proposal is generally located southeast of the intersection of
Broadway and Sullivan in the Spokane Yalley and is further described as
Assessors Parcel #13543-0419, being more completely described in Zoning
Adjustor File VE-15-86.
2. The applicant Church proposes to place a pre-fabrlcated sign
identifying their Church in a landscaped island at the Broadway entrance to
the parking lot. The sign as proposed is 25' in height, whereas the Zoning
Ordinance in Section 4.17.120 e, i1, limits the height to 6 feet. The sign as
set forth in the application contains approximately 170 square feet of
illuminated infonaational sign and logo (Cross) on each side of a 2-sided
sign, whereas the Zoning Ordinance limits the area to not more than 15 square
feet on each face of a back-to-back sign. The sign is shown on the site plan
as being approximately 20' from the Broadway front property 1ine. The
language in the Zoning Ordinance is unclear; however, it appears to state that
a si gn coul d al l owably be up to 6' from the ri ght-of-way. A si gn el evati on
(sketch) is contained in the Planning Department file.
3. The adopted Spokane County Future Land Use Plan designates the area of
the proposal as SUBURBAN. Nowever, this kind of proposal is not really
addressed by the Comprehensive Plan map or text and the sign can neither be
said to be consistent nor inconsistent with the Plan.
4. The site is zoned Agricultural, which would al]ow the proposed use
upon approval of this application.

5. The existing land uses in the area of the proposal are varied. A
fire station exists on the southeast corner of Broadway and Sullivan Road,
occupying about a 300 foot square site. The northeast corner of Broadway and
Sullivan is a 60 or 70 acre site which has received zoning for a regional
shopping center through the year 1991. If the shopping center is not
substanti al ly underway by 1991, the zoni ng may revert back to the ori gi nal
Agricultural zoning. Any commercial development of that site will be
contingent upon a slte plan review before the Hearing Examiner Committee and
possible and EIS. The northwest corner of Broadway and Sullivan is occupied
by local business and freeway comnercial uses. The southwest portion of the
southwest corner of Broadway and Sullivan is zoned Agricultural and is
occupied by residential uses. Sullivan Road south of Broadway is
predominantly Agricultural zoning with two small portions of Comnercial
zoning. One of these Cortnnercial zones is on the west side of Sullivan
approximately 250' north of Yalley Way; dental offices occupy this commercial
use. On the east side of Sullivan in the vicinity of the subject Church
property a car wash occupies two small pieces of Commercial property. Some
Local Busi ness zoning ri ngs thi s car wash property and is parti al ly ad,jacent
to the Church's interior property. Other than that, the uses south of
Sullivan Road are agricultural and R-2 Zoning uses or the land is vacant.
6. The Church property seems to suffer from a lack of thoughtful site
design. The Church structure is located at the rear most, southeastern corner
of the ownership and has very limited visibility from both Sullivan Road and
Broadwa4Y. The physical design of the structure is not "church-like" and in
that respect works against the identification of the property as a Church.
These circumstances could only have been created by the persons making
decisions regarding the development of the site and the design of the Church.
In other words, the church structure could have been located closer to
Broadway with parking behind it and the Church structure could have had a
design which identified it more as a Church.
7, Broadway Avenue is a secondary arterial and Sullivan Road is a major
arterial.
8. The Church's case for a variance is predicated on low visibility and
poor identity as a Church and the need to compensate for this with a large and
obvious sign. The site itself suggests no lack of privileges when compared to
other church's in the Agricultural zone, but the use of the site was created
by the Church.
9. Statements were,in support of the application,made that the Church
needs to compete with other businesses and signs in'the area. However, the
Washington Trust sign which was identified as being at the northwest cor,ner of
the Church property was found, upon inspection by the Building and Safety
Department, to be illegal and was removed during the time period between the
two hearings.
10. The applicants claim there is a general proliferation of commercial
and business signs in the area with which they feel the need to compete as a
business. The Zoning Adjustor's observation, however, is there are no such
signs on Broadway east of Sullivan Road (once the illegal Washington Trust
sign was removed).
11. The Zoning Ad3ustor field checked the area and found there to be very
few if any signs in the Agricultural zone that exceeded the standards of that
zone. Of particular note was the Cowley Memorial Baptist Church on Sullivan
Road, slightly to the south of the existing Church property, This Church is
in the Agricultural zone and has a detached, unlighted s1gn, which conforms to
the Agricultural zone detached sign standards for a Church.

12, additionally, there are two churchs east of this site on the north
side of Broadway. The Valley Church of Christ has an apparently legal sign at
its location on Broadway. However, this Church has an extremely large and
illegal sign on the north side of its building facing the freeway. This sign
was pointed out by the applicant at the second hearing as one which they felt
that ought to have comparable privileges with.
13. Slightly farther to the east on Broadway is the Hope Lutheran
Church, The Hope Lutheran Church has an apparentiy 1ega1 sign for the Agri-
cu]tural zone on Broadway and it also has an apparently second legal-sized
detached sign on the freeway side of its property, as viewed from the freeway.
14. Another church on Broadway, the East Broadway Weslayan Church, also
located in the Agricultural zone has an apparently legal sign for the Agri-
cultural zone.
15. Leading up to the hearings, the Zoning Adjustor observed 15 to 25
church signs throughout the County in the process of travels associated with
the Job responsi bi 1 i ti es. I t was very rare to f i nd a church si gn, i ncl udi ng a
cross, which exceeded approxfmately 10 feet in height, unless the crosses were
an architectural feature of the building.
16. Upon ful l impl ementati on of the new zoni ng code, the property wi 11
"c ross-overp to Suburban Residential 1/2. The signs standards are quite a bit
the same for a detached sign in this zone under the new code, wlth the
exception that a sign may be up to 10' in height, but no more than 6' in
width. The new code would aiso allow a"bulietin board" sign in addition to
the j ust descri bed si gn.

17. The app]icant may find its sign needs most easily met by attempting
to secure an easement for its hoped-for sign on the Commercial property
fronting on Sullivan near its easement driveway which leads from Sullivan to
the primary church parking lot and building.
18. The proposal is exempt from the provisions of Chapter 43.21C RCW
pursuant to WAC 197-11-800 (6) (b).
19. The proposed site plan indicates that setbacks, parking, height of
the structure(s) will conform to the Spokane County Zoning Ordinance. The
slte plan appears to indicate that the northern most edge of the sign would be
located 20' from the property line. In light of its proposed iocation in an
island between and entrance and an exit, it is reasonable that this sign be
1 ocated thi s far back from the property 1 i ne i n order that i t not i nterfere
with ingress and egress.

21. No one appeared to oppose the proposal nor were any written comments
adverse to the proposal received.
22. The proper legal requirements for advertising of the hearing before
the Zoning Ad3ustor of Spokane County have been met.
23. Any conclusion hereinafter stated which may be deemed a finding
herein is hereby adopted as such.
From the Findings, the Zoning Adjustor comes to these:
CONCLUSIONS
1. The proposal as set forth by the applicant would be detrlmental to
and not compatible with the public health, safety and weifare.
2. To allow the proposed sign with as little or no Justification or
substantiation to achieve the standards set forth for variances would be to
set a most unfortunate precedent in which it would be difficult to say no to
any Church in the Agricultural zone proposing a sign of comparable magnftude.
3. The subject property i s not depri ved of pri vi 1 eges comnonly enjoyed
by other church properti es i n the general vi ci ni ty and i n the Agri cul tural
zone.

4. The granting of the variance as requested would be a grant of special
pri vi 1 eges i nconsi stent wi th pri vi 1 eges enjoyed by other church properti es i n
the vicinity and Agricultural zone.
5. The granting of the variance to the degree proposed would be
materially detrimental to the public welfare.
6. Even though the those persons who are charged with making decisions
for the Church have created the very hardship from which they seek relief by
virtue of the location and the non-church-like appearance of the building, a
self-created hardship is not clearly recognized as denying a zone change in
the Spokane County Zoning Ordinance as it is presently written. The problem
from which the present Church administration seeks relief is one which was one
created by the volunteer Church board of directors or other such group charged
with the administration of the Church. The Zoning Adj ustor recognizes the
lack of clear direction and lack of absolute foresight with which such well-
i ntended bodies may operate. The Zoni ng Adjustor consi ders thi s si tuati on of
pgoverning" and "decision making" to be a special circumstance which warrants
the granting of some relief to the present body of persons and the minister
now trying to solve a problem essentially created by others. Therefore, it is
the Zoning Adjustors intent to grant limited relief, conmensurate with the
amount of relief which could be granted as consistent with the degree of
special circumstances recognized. The intent of the relief to be granted is
to describe a sign which would be generaily consistent with the church si9n
standards of the new zoning code in the Suburban Residential 1/2 zone.
7. Any finding hereinabove stated which may be deemed a conclusion
herein is adopted as such.
DECISION
From the foregoing Findings and Conclusions, the Zoning Adjustor DENIES
the proposal as set forth by the applicant and APPROVES A LIMITED VARIANCE,
designed to somewhat off-set the special circumstances in which the church
governing body finds itself at the present time, while not granting a
deviation in excess of what would be allowed under the new code if it were in
effect at the present time. The following CONDITIONS OF APPROVAL ARE
STIPULATED.
CONDITIONS OF APPROYAL
1. GENERAI. .
1. The following conditions shall apply to the applicant, owner and
successors i n i nterest.
2. The Department of Building and Safety shall route the building permit
application to all of the agencies and offices of county government below
which are indicated as needing to give their authorization prior to the
release of a building permit. Upon reviewing the various plans returned
to the Department of Building and Safety by the other departments, the
department w111 consult with the Planning Department if there are arty
changes resulting from review by the other departments when compared to
the plans as approved by the Planning Department. Such review may
necessari ly resul t i n a revi si on of the si te pl an for use by the
Department of Building and Safety or possibly a with-holding of the
bui 1 di ng permi t unti 1 any confl i cts are resol ved.
3. Prior to application for any building permits associated with a sign at
this location on Broadway and in the center of the curbed island at the
Broadway entrance, a revised plan shall be submitted and approved by the
Zoning Adjustor for substantial conformance with the guidelines set forth
below.
II. PLANNING DEPARTMENT
1. Any sign to be approved for installation on Broadway Avenue shall have a
design generally patterned after the following.

a. Each side of the sign may have a maximum of 45 square feet. The sign
shall not generally exceed 6' in height except that a religious
symbol may extend to a total height of 10' above grade.
b. The sign shall be have a maximum of 20 square feet which would
identify the name of the church and ma4Y have an additional 25 square
feet (totalling 45 square feet per side) qualifying as a bulletin
board sign similar to the definition contained in the new zontng code
i n Secti on 8.04. 060 1, The si gn may al so have 1 ow i ntensl ty 1 i ghti ng
as generally defined and set forth in the new zoning code.
c. The northern edge of the sign may be located up to within 10' of the
right-of-way.
III. DEPARTMENT OF BUILDING & SAFETY
1. All signs require building permits as per Section 3.08 of Title III,
Spokane County Code.
2. Compliance with the following provisions sha11 be demonstrated prior to
issuance of a bui]ding permit.
a. Signs at or near a street intersection shall not obstruct visibility
for purposes of ingress and egress.
b. The sign shall be placed so as to not unreasonably interfer with the
movement of vehicles or pedestrian traffic.
c. The location of all signs shall be subject to approval by the County
Engineers Office,
d. Permit numbers on the sign shall be painted at the lowest corner next
to the road in figures not less than 1" high.

PROJECT DESCRIPTION
The applicant requests deviation from the sign standards in order to install a sign
25' in height and approximately 170 square feet per side, including a logo, for each
side. The Zoning Adjustor denied the proposal presented at the public hearing on
March 12, 1986, but approved a lesser variance permitting a sign no closer tha'n 10 feet
to the right-of-way, 45 square feet on each side, not to exceed 6' in height and a
religious symbol not to exceed 10' in height. The applicant filed an appeal to the
dectsion on April 18, 1486, ten days after the signing of the findings for the follow-
ing reasons.
a) The sign is only 72 sq. ft. and is 8 ft. in height not making it detrimental to
the ordinance intent;
bl By adjoining adjacent property the sign would not be incompatible or detrimental

1. VN-10-86 Scott - The property is accessed via a private road access
which connects to Wild Rose Road. See attached comments which pertain

2. Vtd- LZ-86 Larson - Wildwood Circle has not been established as a County
road for maintenance by the Road Department. Prior to tlie release of a
bu1lding permit the applicant must sign Spokane County Notice to the Public
iao. 4. This document acknowledges that Spokane County is not responsible
for the construction or maintenance of Wildwood Circle until such time as
the road is established by Spokane County. Should the applicant desire
tYiat the road be made a public road; the document provides that the appli-
cant will be willing to participate in a road improvement district created
for the purpose of improving the road.
3. VE-13-86 Ghering.- The County Engineer's road section map for Section
31, Townstiip 25 North, Range 44 E.W.M. depicts the road right of way of
44th Avenue as passing through the applicant's property. Forty-fourth is
a nonmaintai.ned public road right of way. Thetefore, prior to the release
of a building permit, the applicant must sign and record Spokane County
Plotice to the rublic No. 4. Since ttie applicant is proposing access to the
property via an easement which extends Yorthward from 44tli Avenue, we are
also requiring the applicant to sign and record Spokane County Notice to
the Public No. 3. Both Pu>>lic Notice documents acknowledge that Spokane
County is not responsible for the construction or maintenance of the private
road(s) serving the applicant's property.
4. 114-161-86 A-I Jermain - That all roads within the proposed development
shall be destgnated as "Tract X- Future Public Rignt of tday Tracts".
ApFlicant shall submit to the County Engineer road and drainage plans for
review and approval. All roads and drainage structures shall be designed
and constructed in compli-ance with Spokane County Road and Drainage stan-
dards. All easements except the easterly extension shall run to the boundary
of the sub,j ect parent parcel.

5. CLM 4-86 -;].W.P. Co. - Spokane County has no record of road right of
way for Havana south of the 1/4 Section line and East of the West line of
Section 11, Townstiip 25, Range 43, H.W.M. It will become necessary to
improve Havana Street at some future date to accomodate traffic generated by
this proposal and other developments in the vicinity. In order to accomo-
date future roadway improvements, Spokane County is requesting the dedication
of 30 feet of right of way along the alignment of Havana Street from the 1/4
Section corner Southward to Upriver Drive. Other comments and conditions
pertinent to this application.

5. CUE 4-86 - W.W.P. Co. - Spokane County has no record of road right of
way for Havana south of the 1/4 Section line and East of the West line of
Section 11, Township 25, Range 43, B.W.M. It will become necessary to
improve Havana Street at some future date to accomodate traffic generated by
this proposal and other developments in the vicinity. In order to accomo-
date future roadway improvements, Spokane County is requesting the dedication
of 30 feet of right of way along the alignment of Havana Street from the 1/4
Section corner Southward to Upriver Drive. Other comments and conditions
pertinent to this application.
6. VE-15-86 Valley Assembly of God - The proposed sign shall be constructed
in such a manner so as to not interfere with sight distance at the driveway
approach to Broadway Avenue.

We have of this date initiated corrective action on the
, above siqn. The berm that waa cut away to erect the sign ia !
beinq refilled to its original level, and the top of tAe _
sign will then meet the requirement of being no more than 10
feet above grade.
We continue to contend that you have measured the surface of
the siqn incotrectly, neglecting to deduct the area of the
cut off cozners. When measuzed cozrectly, the sign does in :
fact meet the square foot cziteria given us in the variance.
We hope this satisfies your complaint concerning the sign on
our pzoperty.

regarding the non-compliance of the pole sign located at the
above-referenced address.
In our letter dated October 29, 1987 you were given a period of
thirty days in which to bring the sign into compliance with the
conditions of the building permit and the Board of Adjustment's
order. To date, there has been no action to resolve this
problem.
Unless corrective action is initiated within ten (10) days of the
date of this letter, we have no further choice but to refer this
matter to the Prosecuting Attorney's Off ice for appropriate legal
action.

As a follow-up Lo our conversation yesterday, I am forvarding to you more
precise information about the sign which the Valley Assembly of God Church has
had erected by the Baldain Sign Company. In fact, the requested variance,
VE-15-86, vas deoied by the Zoning Adjustor and that denial upheld by the
Board of Adjustment.
The sign which they have erected is the sign which the Church had proposed to
be erected and vhich had been purchaeed in advance. The sign vas apparently
found not to comply with the Zoning Ordiaance when they attempted to have it
erected. The Church then attempted to seek a variance for the sign which they
had already purchased. That sign Was described in the submiesion documents of
the Zoning Adjuator file as plus or minue 25 feet tall at the top of the
crosa, plus or minue 12 feet tall at the top of the eignboard, plue or minus
11.3 feet wide at the widest signboard width, and with the sign reading,
"Valley Assembly of God," calculated at 77.7 square feet in size. This sign
variance was denied by both the Zoning Ad,justor and the Board of Adjustment.
In the appeal document submitted by the pastor, he described the sign as bein::_,
72 equare feet.
The outcome of the appeal to the Board of Ad justment was to approve a modif ield
sign which is deacribed below. In substantially upholding the Zoning
Adjustor's decision, vith the minor exception of one height dimension, the
sign which the Church purchased was categorically rejected. In ita place were

Below are the conditions, as performance srandards, established with the
deaial of the proposed sign.
1. Any sign to be approved for installation on Broadway Avenue shall
have its design generally patterned after the following.
a. Each side of the sign portion of the structure may have a
maximum of 45 square feet. The sign portion of the struc[ure
sliall not generally exceed 10 feet above grade. (Reference
Board of Adjustmeat portion of the decision. )
b. The sign shall have a maximum of 20 square feet, which would
identify the name of the church and may (emphasis added) have an
additional 25 square fee( (totaling 45 square feet per side), i
qualifying as a bulletin board sign similar to the definition
contained in the new Zoning Code, Sec[ion 8.04.060 1. The sign
may also have a lov intensi[y lighting as generally defined and
set forth in the oew Zoning Code. (Zoning Ad justor portion of
the decision, left intact by the Board of Adjustment action.)
c. The northern edge of the sign may be located up to aithin 10
feet of the right-of-way. (Zoning Ad justor portion of the
decision, left intact by the Board of Adjustment action.)
What has happened here, in my opinion, is that BaldWin Sign Company, acting on I
behalf of the applicant Church, sought building permit approval of a
reduced-acale version of the sign, described ae: a) "16-foot OAH";
b) a signboard of S' 6" by 8' and "S' 6" A/G," and approved by Martin
Robinson on April 10, 1987. Sose 12 days later, on April 22, 1987, John I
PederBOn (Planning Department) approved a eign (however, ve did not keep a
record of it), conditioning the sign as consistent with the approved site plan
and with reference to conditions of VE-15-86. That meane that our approval of
the sign was for one vhich must be consistent with the decision as set forth
in 1(a), 1(b) and 1(c) above. The location at which the sign was proposed was
consiste nt with that decision in 1(c).
So, Lhe sign whic.h was built is noi in noncornpliance wi[ti t he sign approved b}'
Mr. Robinson of your department; that sign (t he one approved by Mr. Robinson)
is not conaistent with VE-15-86, although he may have no way of knowing that ,
due to the Planning Department's signoff and conditioning wit h reference to
VE-15-86 some 12 days later. Since the Planning Department sends our
decisions to your Uepartmen[, vas this site not "flagged" for compliance with
VE-15-86? The sign Robinson approved roughly calculates to 45 feet, but it
does not comply wic h t he presc ript ion of t he 20 square feet t o ident if y t he
c-hurch and 25 square feet as a reader board. You make reference to "feasible

alternatives" in Tom Davis' letter to the Aasembly of God Church. Please be
advised that there may be alternatives, as long as they are consistent vith
the performance atandards set forth in 1(a). 1(b) and 1(c) above. The eign
which the Church has installed cannot be made acceptable except by substantial
modifications Lo bring it int_o conformance wit.h t he performance standards.
It is obvious [o us that ihe Church and Baldwin Sign proceeded knowingly and
in full violation of the Zoning Ordinance as administered by Lhe Zoning
Adjuetor and the Board of Adjuetment, to install a eign which had been
rejected in the two public hearings end also in the building permit review
process.

In conducting an inspection of the sign constructed on your
property located at the above-referenced address, our district
inspector has reported that the sign is not in compliance with
the approved plans submitted to this office.
Tn review of the building permit application, a condition was
imposed by the Planning Department that the sign complies with
the condition of the variance approval No. VE-15-86. That
decision specified a height limitation of 16 feet and the
nameplate shall not exceed an area of 5 feet, 6 inches, by 8
feet. The sign that was constructed appears to be approximately
25 feet high with a larger nameplate. _
The intent of this letter is to advise you of the permit
requirements and to request that corrective action be taken. we
are of the.opinion that a period of 30 days, beginning with the
date of this letter, should be sufficient time for you,to resolve
this matter.
For clarification of the requirements as specified by the
variance approval, you should contact Mr. Pat Frankovic, County
Planning Department, at 456-2205 for the specific requirements
and any feasible alternatives.

In response to our file #VE-15-86. whic6 is that file containing the Valtey Assembly
of God Church's application for a vanance from the sign requirements of the
Agricultural zone
On Ianuary 25. 1988 the sign was measured in the field by yourself and Tom Mosher
This exercise confirmed the following
1 The documents submitted by the applicant church, and used in good faith by
our respective Departments, unproperly indicate the size of the sign The
drawings submitted were marked with a scale of 1"=3'-0" It is upon the basis of
this scale that vanous area calculations were made throughout the ongmal
case and the appeal case At no Ume did the Planning Department or the
Department of Building and Safety presume oiher than that the scale drawings
submitted by the appitcant wete of a proper scate and therefore indicated the
actual size of the sign The applicant church and it's representatives, through
two heanngs, including statcmenls on their own appeal document, concurred
in the height and width dimensions and area calculations derived from the
drawings which had been submitted We believed them to be accurate and
apparently so did the applicant church
2 As a result of field measurcments, the actuai sign is substantially smaller than
the size of the sign represented by the drawings used throughout the entire
process Based upon calculations of the sign surface shown on drawings (to

purpose of acbieving a reasooabie average grade, for thc applicants to raise

would allow the height of the mulc6 to be brought to a point about 2inches
below the intersectioa of the aagled support member and the verucai suppon
piece The accompanying photographs show approximately where the
acceptable level of fill should come (one for your records and one for the
church)
We do feel that the sign measurement was misrepresented when the permit was
applied for Baldwm clearly indicated to all parties that the total sign 6eight,
including the cross, was approximately 16 feet, that the height of the sign board
above grade was approximately 5'-6° above grade and that t6e sign area could be
represented by rectarigular dimensions of 5'-6" by 8 feet (Your plan checker. in
good faith. approved the sign) Baldwin's rectangular dimensions yield a 44 sq ft
sign, over 2 sq ft smaller than the actual sign An actual rectangular representation
of the sign board approximates 6 9' ande and 6 8' high. or 46 9 sq ft The top of the
sign board is clearly in excess of 10 feet above grade, as opposed to the S'-6" A/G
(above grade?) indicated on their drawing The sign is obviously substantially
higher than the 16 feet OAH (over all height?) indicated on the drawing submitted to
your depariment for approval
In the future, with regard to signs. we are gang to biad the appiicants very closely
to the accuracy of the sign documeats submitted to us for approval We urge that
your Department adopt standards for 6olding an applicant accountable for the
dimensions submitted with their ptans
In conclusion, the following is our department's position. as set forth in my capacity
as the Zoning Administrator
l With a minimum amount of fill or mulch added around the base of the slgn, the
height of the sign above grade at thc base of the sign may be brought to a
point where it is ten (10) feet or less This may be accomplished by adding fill
or mulch to approximately 2 or 3 inches below the intersection of the vertical
support post with the diagonal support post, as shown in the attached
photographs

REGARDING A SIGN IN THE AGRICULTUAL ZONE. ) FINDINGS, CONCLUSIONS
(VE-15-86), YALLEY ASSEMBLY OF GOD CHURCH ~ AND DECISION
SUMMARY OF APPLICATION:
The applicant requests a deviation from the sign standards of the Agricutural
zone to permit the installation of a slgn conslderably in excess of the
maximum requirements in the zone. 7he sign proposed is 25' in height and
approximatety 170 square feet per side, including the logo, for each side of a
2-s1 de si gn.
LOCATION:
The 3.6 acre Church's parcel 1s located approxlmately 300' east of Sullivan
Road with fronta9e on and south of Broadway Avenue. The Church has an
easement access westward to Sullivan Road at a location approximately 300'
south of the intersection of Broadway and Sullivan. The Assessors Parcel # is
13543-0419.
DECISION OF THE ZONING AOJUSTOR:
gased upon the evidence presented and circumstances associated with the
project proposal, the Zoning Adjustor DENIES the project as set forth in the
application, and APPROVES A LESSER VARIANCE.
PUBLIC HEARING:
After examining all avallable information on f11e with the application and
visiting the subject property and surrounding area numerous times, research-
ing the legalitry of several church signs in the neighborhood, the Zoning
AdJustor conducted a public hearing on March 12, 1986, which hearing was con-
tinued to March 26, 1986, renered a verbal decision on March 26, 1986, and a
written decision on April 1986.
FINOINGS OF FACT
1. The proposal is generally located southeast of the intersection of
Broadway and Sullivan in the Spokane Yalley and is further described as
Assessors Parcel #13543-0419, being more completely described in Zoning
Adjustor File VE-15-86.
2. The applicant Church proposes to place a pre-fabricated sign
identifying their Church in a landscaped island at the Broadway entrance to
the parking lot. The sign as proposed is 25' in height, whereas the Zoning
Ordinance in Section 4.17,120 e, ii, limits the height to 6 feet. The sign as
set forth in the application contains approximately 170 square feet of
illuminated informational sign and logo (Cross) on each side of a 2-sided
sign, whereas the Zoning Ordinance limits the area to not more than 15 square
feet on each face of a back-to-back s1gn, ?he sign is shown on the site plan
as being approximately 20' from the Broadway front property line. The
language tn the Zoning Ordinance is unclear; however, it appears to state that
a sign coutd allowably be up to 6' from the right-of-way. A sign elevation
(sketch) is contained in the Planning Department file.
3. The adopted Spokane County Future Land Use Plan designates the area of
the proposal as SUBURBAN. However, this kind of proposal is not really
addressed by the Comprehensive Plan map or text and the sign can neither be
satd to be consistent nor inconsistent with the Plan.
4. The site is zoned Agricultural, which would a11ow the proposed use
upon approval of this application.

5. The extsting land uses in the area of the proposal are varied. A
fire station exists on the southeast corner of Broadway and Sullivan Road,
occupying about a 300 foot square site. The northeast corner of Broadway and
Sullivan is a 60 or 70 acre site which has received zoning for a reglonal
shoppi n9 center through the year 1991. If the shoppi ng center i s not
substantial ly underway by 1991, the zoni ng may revert back to the ori gi nal
Agricultural zoning. Any commercial development of that site wtll be
contingent upon a site plan review before the Neartng Examiner Committee and
possible and EIS. The northwest corner of Broadway and Sullivan is occupied
by local business and freeway commercial uses. The southwest portion of the
southwest corner of Broadway and Sullivan is zoned Agricultural and is
occupied by residential uses. Sullivan Road south of Broadway is
predominantly Agricultural zoning with two small portions of Comnercial
zoning. One of these Commercial zones is on the west side of Suliivan
approximately 250' north of Valley Way; dental offices occupy this commerciat
use. On the east side of Suliivan in the vicinity of the subject Church
property a car wash occupies two small pieces of Commercial property. Some
Local Business zoning rings this car wash property and is partially adjacent
to the Church's interior property. Other than that, the uses south of
Sullivan Road are agricultural and R-2 Zoning uses or the land is vacant.
6. The Church property seems to suffer from a lack of thoughtful site
design. The Church structure is located at the rear most, southeastern corner
of the ownership and has very limited visibility from both Sullivan Road and
Broadway. The physical design of the structure is not "church-like" and in
that respect works against the identification of the property as a Church.
These circumstances could only have been created by the persons making
decisions regarding the development of the site and the design of the Church.
In other words, the church structure could have been located closer to
Broadway with parkin9 behind it and the Church structure could have had a
design which identified it more as a Church.
7. groadway Avenue is a secondary arterial and Sullivan Road is a major
arterial.
8. The Church' s case for a vari ance is predicated on 1 ow vi si bi 1 i ty and
poor identity as a Church and the need to compensate for this with a large and
obvious sign. The site itself suggests no lack of privileges when compared to
other church's in the Agricultural zone, but the use of the site was created
by the Church.
9. Statements were,in support of the application,made that the Church
needs to compete with other businesses and slgns in the area. Nowever, the
Washington Trust sign which was identified as being at the northwest corner of
the Church property was found, upon inspection by the 8uilding and Safety
Department, to be illegal and was removed during the time period between the
two hearings.
10. The applicants claim there is a general proliferation of commercial
and business signs in the area with which they feel the need to compete as a
business. The Zoni ng AdJustor' s observati on, however, i s there are no such
signs on Broadway east of Sullivan Road (once the illegal Washington Trust
sign was removed).
11. The Zoning Adjustor ffeld checked the area and found there to be very
few if any signs in the Agricultural zone that exceeded the standards of that
zone. Of particular note was the Cowley Memorial Baptist Church on Sullivan
Road, slightly to the south of the existing Church property. This Church is
in the Agricultural =one and has a detached, unlighted sign, which conforms to
the Agricultural zone detached sign standards for a Church.

12. Additionally, there are two churchs east of this site on the north
si de of Broadvday. The Yal l ey Church of Chri st has an apparently 1 egal si gn at
its location on Broadwayo Hoa►eder, this Church has an extremely large and
i11 egal sign on the north si de of i ts bui 1 di ng faci ng the freea+ay. Thi s sign
was pointed out by the applicant at the second hearing as one which they felt
that ought to hmve comparable prlvileges w1th,
13. Slightly farther to the east on Broadway is the Hope Lutheran
Church. The Hope Lutheran Church hms an apparently 1ega1 sign for the Agri-
cultural zone on Broadway and it also has an apparently second legal-sized
detached sign on the freearay side of its property, as viewed from the freeway.
14. Another church on Broadwayo the East Broadway Weslayan Church, also
located in the Agricultural aone has Sn apparently tegal sign for the Agri-
cultural aone.
15. Leading uP to the hearings, the Zoning Adjustor observed 15 to 25
church signs throughout the County in the process of travels associated with
the Job responsibi 1 i ti es. I t was very rare to f i nd a church sign, i ncl udi ng a
cross, which exceeded approximately 10 feet in height, unless the crosses were
an archi tectural feature of the bui 1 di ng.
16. Upon ful l imp1 ementation of the new aoni ng code, the property wi 11
"cross-oderp to Suburban Residential 1/2o The signs standards are quite a bit
the same for a detached sign in this zone under the new code, with the
exception that a sign may be up to 10' in height, but no more than 6' in
width. The nea code would also allow a"bulletin board" sign in addition to
the 3 ust descri bed s1 gn.
17. The applic8nt may find its sign needs most easily met by attempting
to secure an easement for its hoped-for sign on the Comnercial property
fronting on Sullivan near its easement driveway which leads from Sullidan to
the primary church parki ng 1 ot and bui l di ng e
18. ?he proposal is exempt from the provisions of Chapter 43.21C RCW
pursuant to WAC 197-11-800 (6) (b).
19. The proposed site plan indicates that setbacks, parking, height of
the structure(s) will conform to the Spokane County Zoning Ordinance. The
site plan appears to indicate that the northern most edge of the sign would be
located 20' from the property lineo In 11ght of its proposed location in an
island between and entrance and an exit, 1t is reasonable that this sign be
located this faw back from the property line in order that it not interfere
with ingress and egress.
21. No one appeared to oppose the proposal nor were any written comments
adverse to the proposal receivede
22. The proper legal requiwements for advertising of the hearing before
the Zoning Adjustor of Spokane County hade been met.
23. Any conclusion herelnafter stated vahich may be deemed a finding
herein is hereby adopted as such.
From the Findingso the Zoning Adjustor comes to these:
COtdCLUSIONS
1. The proposal as set forth by the appllcant would be detrimental to
and not compatible with the public health, safety and welfare.
2. To al l oar the proposed si gn wi th as 1 i ttl e or no Justi f i cati on or
substantiation to achieve the standards set forth for variances would be to
set a most unfortunate precedent in which it would be difficult to say no to
any Church in the Agricultural zone proposing a sign of comparable magnitude
3. The subject Property i s not depri ded of privi 1 eges comnonly en3oyed
by other church properti es i n the ~general di ci ni ty and i n the Agricul tural
zone.

4. 7he granting of the variance as requested would be a grant of special
pri vi 1 eges t nconsi stent w1 th priv11 eges enjoyed by other church properti es i n
the vicinity and Agricultural zone.
5. 7he granting of the variance to the degree proposed would be
materially detrimental to the public welfare.
6. Even though the those persons who are charged with making decisions
for the Church have created the very hardship from which they seek relief by
virtue of the location and the non-church-like appearance of the building, a
self-created hardship is not clearly recognized as denying a zone change in
the Spokane County Zoning Ordinance as it is presently written. The problem
from which the present Church administration seeks relief is one which was one
created by the volunteer Church board of directors or other such group charged
wi th the admi ni strati on of the Church. The Zoni ng Adjustor recogni zes the
lack of clear direction and lack of absolute foreslght with which such we11-
i ntended bodies may operate. The Zoni ng Adjustor consi ders thi s si tuati on of
"governing" and "decision making" to be a special circumstance which warrants
the granting of some relief to the present body of persons and the minister
now trying to solve a problem essentially created by others. Therefore, it is
the Zoning Adjustors i ntent to grant 1 imi ted rel i ef, commensurate wi th the
amount of relief which could be granted as consistent with the degree of
special circumstances recognized. The intent of the relief to be granted is
to describe a sign which would be generally consistent with the church sign
standards of the new zoning code in the Suburban Residential 1/2 zone.
7. Any fi ndi ng herei nabove stated wh1 ch may be deemed a concl usi on
herein is adopted as such.
DECISION
From the foregoing Findings and Conclusions, the Zoning Adjustor DENIES
the proposal as set forth by the applicant and APPROVES A LIMITED YARIANCE,
designed to somewhat off-set the special circumstances in which the church
governing body finds itself at the present time, wh11e not granting a
deviation in excess of what would be allowed under the new code if it were in
effect at the present time. The following CONDITIONS OF APPROVAL ARE
STIPUI.ATED.
CONDITIONS OF APPROYAL
1. GENERAL
1. The following conditions shall apply to the applicant, owner and
successors in interest.
2. The Department of 6uilding and Safety shall route the building permit
applicatlon to alt of the agencies and offices of county government below
which are indicated as needing to give their authorization prior to the
release of a buitdin9 permit. Upon reviewing the various plans returned
to the Department of Bullding and Safety by the other departments, the
department w111 consult with the Planning Oepartrnent if there are any
changes resulting from review by the other departments when compared to
the plans as approved by the Planning Department. Such review may
necessari 1y resui t i n a revi st on of the site pl an for use by the
Oepartment of Building and Safety or possibly a with-holding of the
building permit until any conflicts are resolved.
3. Prior to applicatlon for any bulldtng permits associated with a sign at
this location on Broadway and in the center of the curbed fsland at the
Broadway entrance, a revised plan shall be submitted and approved by the
Zoning Adjustor for substantial conformance with the guidelines set forth
below.
II. PLANNING DEPARTMENT
1. Any sign to be approved for installation on Broadway Avenue shall have a
desi gn general ly patterned after the fol l owi ng.

a. Each side of the slgn may have a maximum of 45 square feet. The sign
shall not generally exceed 6` in height except that a religious
symbol may extend to a total height of 10' above grade.
b. The sign shall be hade a maximum of 20 square feet which would
1 denti fy the name of the church and ma4Y have an additi onal 25 square
feet (totalling 45 square feet per side) qualifying as a bulletin
board sign similar to the definitlon contained in the new zoning code
i n Secti on 8, 04.060 1. The si gn may al so have 1 ow i ntensi ty 1 i ghti ng
as generally defined and set forth in the new goning code.
c. The northern edge of the sign may be located up to within 10' of the
right-ofowaye
IIIe OEPARTMENT OF 6UILDING & SAFETY
10 All signs require building permits as per Section 3.08 of ?itle III,
Spokane County Code,
2. Compliance with the following provisions shall be demonstrated prior to
i ssuance of a bui1 di ng permi t.
a. Signs at or near a street intersection shall not obstruct visibility
for purposes of ingress and egress.
b. The sign shall be placed so as to not unreasonably interfer with the

We have of this date initiated corrective action on the
above sign. The berm that was cut away to ezect the sign is
being refilled to its original level, and the top of the .
sign will then meet the requirement of being no more than 10
feet above grade.
We continue to contend that you have measured the surface of
the sign incorrectly, neglecting to deduct the area of the
cut off corners. When measuted correctly, the sign does in ~
fact meet the squate foot criteria given us in the variance.
We hope this satisfies your complaint concerning the siqn on
our property.

regarding the non-compliance of the pole sign located at the
above-referenced address.
In our letter dated October 29, 1987 you were given a period of
thirty days in which to brinq the sign into compliance with the
conditions of the building permit and the Board of Adjustment's
order. To date, there has been no action to resolve this
problem.
Unless corrective action is initiated within ten (10) days of the
date of this letter, we have no further choice but to refer this
matter to the Prosecuting Attorney's Office for appropriate legal
action.

As a follow-up to our conversation yesterday, I am forwardirlg to you :nore
precise information about the sign which the Valley Assembly of God Chur.:i: h:is
had erected by the Baldwia Sign Company. In fact, the requested varianc<l,
VE-15-86, was denied by the Zoning Adjustor and that denial upheld by th~,
Board of Adjustment.
The sign which they have erected is the sign which the Church had proposed to
be erected and which had been purchased in advance. The aign was apparently
found not to comply with the Zoning Ordinance when they attempted to have it
erected. The Church then attempted to seek a variance for the sign which they
had already purchased. That sign was described in the submiasion documents of
the Zoniag Adjuator file as plus or minus 25 feet tall at the top of the
cross, plus or minus 12 feet tall at the top of the eignboard, plus or minus
11.3 f eet wide at the widest signboard width, and with the sign reading,
"Valley Assembly of God," calculated at 77.7 square feet in size. This sign
variance was denied by both the Zoning Adjustor and the Board of Adjustment.
In the appeal document submitted by the pastor, he described the sign as being
72 square feet.
The outcome of the appeal to the Board of Adjustmen[ was to approve a modifiPd
sign which is described below. In substantially upholding the Zoning ~
Adjustor's decision, with the minor exception of one height dimension, t:
sign which the Church purc.hased was categorically rejected. In its place were
established performance criteria for a sign which would be acceptable. The
sign which has been erected is not acceptable.
Documenis which describe a sign resembling the one presently illegally erected
at the site are marked in File VE-15-86 as "not approved," and signed by the
Zoning Ad justor on March 31, 1986.

denial of the proposed sign. 1. Any sign to be approved for installation on Broadway Avenue shall
have its design generally patterned after the following.
a. Each side of the sign portion of the structure may have a
maximum of 45 square feet. The sign portion of the structure
shall not generally exceed 10 feet above grade. (Reference
Board of Adjustment portion of the decision. )
b. The sign shall have a maximum of 20 square feet, which would
identify the name of the church and may (emphasis added) have an
additional 25 square feet (totaling 45 aquare feet per side),
qualif ying as a bulletin board sign similar to the definition
contained in the new Zoning Code, Section 8.04.060 1. The sign
may also have a low intensity lighting as generally defined and
set forth in the new Zoning Code. (Zoning Adjustor portion of
the decision, left intact by the Board of Adjustment action.)
c. The northern edge of the sign may be located up to within 10
feet of the rightrof-way. (Zoning Adjustor portion of the
decision, left intac.t by the Board of Adjustment action. )
What has happened here, in my opinion, is that Baldwin Sign Company, acting on
behalf of the applicant Church, eought building permit approval of a
reduced-scale version of the sign, described ae: a) "16-foot OAH";
b) a aignboard of S' 6" by 8' and "S' 6" A/G," and approved by M.artin
Robinson on April 10, 1987. Sooe 12 days later, on April 22, 1987, John
Pederson (Planning Department) approved a sign (however, we did not keep a
record of it), conditioning the sign as consistent with the 8pproved site plan
and with reference to conditions of VE-15-86. That means that our approval of
the sign was for one which must be consistent with the decision as set forth
in 1(a), 1(b) and 1(c) above. The location at which the sign was proposed was
consistent with that decision in 1(c).
So, the sign which was built is not in noncompliance with the sign approved by
Mr. Robinson of your department; that sign (the one approved by Mr. Robinson)
is not consistent with VE-15-86, although he may have no way of knowing that,
due to the Planning Department's signoff and conditioning with reference to
VE-15-86 some 12 days later. Since the Planning Department sends our
decisions to your Uepartment, was this site not "flagged" for compliance with
VE-15-86? The sign Robinson approved roughly calculates to 45 feet, but it
does not. comply with the prescription of the 20 square feet to identify the
church and 25 square feet as a reader board. You make reference to "feasible

advised that there may be alternatives, as long as they are consistent with
the performance standards set forth in 1(a), 1(b) and 1(c) above. The sign
which the Church has installed cannot be made acceptable except by substantial
modifica[ions to bring it into conformance with the performance standards.
It is obvious to us that the Church and Baldwin Sign proceeded knowingly and
in full violation of the Zoning Ordinance as administered by the Zoning
Adjustor and the Board of Adjustment, to install a sign which had been
rejected in the two public hearings and al8o in the building permit review
process.

While on tour it was noted that the sign advertising of the Valley
Assembly of God Church near Broadway and Sullivan appeared to be
rather large.
This particular sign went through two hearing processes and was
limited in size Prom the original request of 25 feet. The sign
company ir.volved seems to have ignored the original order stated in
file VE-15-86 and constructed the sign in violation.
Could you have this matter investigated and let me know the results.

THIS MATTER, Being the consideration by the Board of Adjustment for
Spokane County, is an appeal of an administration action by the Spokane County
Zoning Adjustor denying the Variance VE-15-86, for the purpose of erecting a
sign deviating considerably from the sign standards of the Agricultural zone,
hereinafter referred to as the "Proposal", and the Board of Adjustment of
Spokane County having held a public hearing on May 28, 1986, and having fully
considered all testimony presented thereat, and having rendered a decision on
the 28th day of May, 1986, denying said proposal as presented but approving a
variance of a sign considerably less than presented, does hereby make the
following
FINDINGS OF FACT
1. That the proposal is generally located southeast of the intersection
of Broadway and Sullivan in the Spokane Valley and is further describd as
Assessors Parcel #13543-0419, being more completely described in Zoning
Adjustor File VE-15-86.
2 The applicant Church proposes to place a pre-fabricated sign
identifying their Church in a landscaped island at the Broadway entrance to
the parking lot. The sign as proposed is 25' in height, whereas the Zoning
Ordinance in Section 4.17.120 e. ii. limits the height to 6 feet. The sign as
set forth in the application contains approximately 170 square feet of
illumited informational sign and logo (Cross) on each side of a two-sided
sign, whereas the Zoning Ordinance limits the area to not more than 15 square
feet on each face of a back-to-back sign. The sign is shown on the site plan
as being approximately 20' from the Broadway property line. The language in
the Zoning Ordinance is unclear, however, it appears to state that a sign
could allowably be up to 6' from the right-of-way. A sign elevation (sketch)
is contained in the Planning Department file.
3 That the Generalized Comprehensive Land Use Plan for Spokane County
indicates SUBURBAN designation for the area encompassed by the proposal.
However, the sign can be considered neither consistent nor inconsistent with
the Plan since such proposal is not addressed within the Plan.
4. That the proposal is exempt from the provisions of Chapter 43.21C RCW
pursuant to WAC 197-11-800 (6) (b).
5. That the Spokane County Zoning Adjustor held a public hearing on
March 26, 1986, concerning the proposal, and that on April 8, 1986, the
Spokane County Zoning Adjustor, by Conclusions of Law and Findings of Fact did
render a decision to deny the proposal as presented but approved a variance to
the sign standards of the Agricultural aone consistent with the new Zoning
Code.
6. That on April 17, 1986, an appeal from the decision of the Zoning
Adjustor of Spokane County was filed by C. Allen Hulten, Pastor, Valley
Assembly of God Church.

7. That the existing land uses in the area of proposal are varied. A
fire station exists on the southeast corner of Broadway and Sullivan Road,
occupying about a 300 foot square site. The northeast corner of Broadway and
Sullivan is a 60 or 70 acre site which has received zoning for a regional
shopping center through the year 1991. If the shopping center is not sub-
stantially underwway by 1991, the zoning may revert back to the original
Agri cul tural zom ng. Any conAnerci al devel opment of that si te wi 11 be con-
tingent upon a site plan review before the Hearing Examiner Committee and
possibly an EIS. The northwest corner of Broadway and Sullivan is occupied by

local business and freeway commercial uses. The southwest portion of the
southwest corner of Broadway and Sullivan is zoned Agricultural and is
occupied by residential uses Sullivan Road south of Broadway is pre-
dominantly Agricultural zoning with two small portions of Comnercial zoning.
One of these Commercial zones is on the west side of Sullivan approximately
250' north of Valley Way, dental offices occupy this commercial use. On the
east si de of Sul l i van i n the vi ci ni ty of the subject Church property a car
wash occupies two small pieces of Comnercial property Some Local Business
zoning rings this car wash property and is partially adjacent to the Church's
interior property. Other than that, the uses south of Sullivan Road are
Agricultural and R-2 zoning uses or the land is vacant.
8 That the Board agrees with and adopts as their own the Zoning
Adjustor's Findings and Conclusions in this matter. However, the Board finds
no height restriction in the new Zoning Code nor the existing Zoning Ordinance.
9 That the proper legal requirements for advertising of the hearing
before the Board of Adjustment of Spokane County have been met.
DECISIOP!
From the foregoing Findings, a review of the Zoning Adjustor's Report and
the staff presentation of File No VE-15-86, the Board of Adjustment of
Spokane County hereby in denies the proposal as submitted but approves a
limited variance with those conditions of the Spokane County Zoning Adjustor
with the exception of Condition II.I.a, which will be changed to read
a. Each side of the sign portion of the structure may have a maximum of
45 square feet. The sign portion of the structure shall not
generally exceed 10' above grade.

PROJECT DESCRIPTION
The applicant requests deviation from the sign standards in order to install a sign
25' in height and approximately 170 square feet per side, including a logo, for each
side The Zoning Adjustor denied the proposal presented at the public hearing on
March 12, 1986, but approved a lesser variance permitting a sign no closer than 10 feet
to the right-of-way, 45 square feet on each side, not to exceed 6' in height and a

SUBJ Report to the Board regarding the appeal of VE-15-86
I have read the appeal submitted by Pastor C A11an Iiulten, the
appellant I have to admit, on behalf of the Department that we
erred in the initial analyis and advertising of the fiie The
appellant points out in the last sentence of subparagraph "c " of
Definition 42 (Outdoor Advertising Display or "Slqn"), the languaQe
does indeed exempt the cross, as a religious emblem or symbol, from
the requlations Carrying this to the extreme, this wi11 apparently
mean that a cross of unlimited height and width would not be requlated,
as long as it was not accompanled by a sign greater than that which is
set forth by the regulations
In essence this is what tfie present case consists of That is, the
cross and the structural support for it (the outslde framework) is
twenty-five (25) feet tall, from the top of the cross to qround level
The unequal hexagonal sign contained within the structural support for
the cross is the only portion which can be examined under the sign
ordlnance
We must measure the sign from its top-most part to ground level, which
shows on the attached drawinq as approximately 12 0 feet The same sign
scales out to approximately 11 3 feet wide The siqnboard therefore
measures approximately 77 7 square feet per side These fiqures are in
conflict with those identified in the appeal form by Pastor Hulten He
identified the sign height as 8 feet and 72 square feet per side The
sign is intended to be illumiated, althouqh it is unclear whether this
is from inside or from ground floodlights
You will recall that the ordinance standards from which the appellant
sought relief are the following (4 17 120 e ii ) fifteen (15) square
feet for each side of a back-to-back sign, a maximum of six (6) feet in
height, and no closer than six (6) feet to a public right-of-way The
ordinance would a11ow low-intensity liqhtinq since Broadway Avenue is
a secondary arterial

Although not requested by the appellant, I reviewed this situation in
light of a possibility of my voluntarily reconsiderina the decision
My judgement is that the variance which I did grant is the 1imit to
which I feel I can go and that 1imit still falls short of the
appellant's proposed sign
I take note of the fact that the Church has already purchased this
sign, I imagine at the cost of several thousand dollars, and is
additionally in possession of this sign Althouqh, this is of course
unfortunate, I feel there is no way that this fact can be taken into
account under the Zoning Ordinance criteria related to variances
Obviously, they have created their own practical difficulty by havinq
purchased the sign before adequately doing their homework with regard
to local land use regulations
I believe my decision adequately addr6ssess the issues which the
appellant has chosen to state in his appeal as reasons in support of
the variance.
The facts simply do not support the contention that the Church's property
is under-privlleged by its location adjoining Commercial property The
zoning map for the area shows a very sma11 piece of Commercial property
on Sullivan Road, along with some LocaT Business property However,
the Cfiurch is not applying for the sign on Sullivan Road, but rather on
Broadway On Broadway, there are no signs which would compete with a
1ega1 Church sign The property immediately across the street on the
north side of Broadway is indeed zoned Commercial However, as pointed
out, this property is zoned for the special circumstances of a regional
shopping center and the ioning expires in 1941, revertinq to Agricultural
zoning (the same as the Church property) My feelina is that it is
highly speculative to assume that there will be any competing Commercial
signs at tfiis location in the foreseeable future At such time as
commercial signs may appear it is then questionable whether even that
fact would substantiate a sign variance, since the Zoninq Ordinance
requirements require that the seeking of common privileges must be
associated with situations in the same vicinity and zone
Additionally, as far as similar situations I took note of the nearby
Carey Memorial Baptist Church, on Sullivan Road It is across an
arterial from Local Business and Commerical zoning and exists with a
non-lighted legal sign in the Agricultural zone
As you are probably aware, my findinq that allowing the siqn would be
detrimental to the public health, safety and general welfare is from
the standpoint of setting a precedent This would literally establish
a carte blanche permission to grant every varaince for a Church which
wishes to deviate from the sign standards in the Aqricultural zone,
thus undermining if not destroying the integrity of the Zoning Ordinance
with regard to regulating signs Additionally, what the appellant is
not polnting out, is a presence of four (4) churches, all identified
in my findings, in the vicinity and on an Agriculturally zoned land,
which have conforming signs

The appellant has stated that there is no objection raised by anyone
who is notified That is absolutely correct, there were no objectors
of record However, that is not a criteria set forth in the Zoning
Ordinance as one which a decision maker may use This is frequently
the reason behind Law Professor Richard Settles observation that
" T he promiscuous, unprincipaled granting of variances is assiqned
much of the blame for the often dismal performance of traditional
zoning "(Washington Land Use and Envlronmental Law and Practices,
Professor Richard L Settle, 1983, p 49)
The appellant further states that the Church is quite large and enter-
tains a large visitation on Sundary mornings However, this aqain is
not a criteria to be found within our ordinance
The appellant makes a point that if a Church is allowed in the Agri-
cultural zone it should be entttled to have signs consisten with the
Church's use of that property In fact, that is what preclsely the
Zoning Ordinance provides in Section 4 17 030 e It provides for
larger signs for Churchs that would otherwise be allowed in the Agri-
cultural zone The appellant is trying to make the case that the signs
provided for in the Zoning Ordinance are not large enough If by
change the appellant's claim is valid, then the solution Zs not to
grant a variance The solution is to amend the Zoning Ordinance, an
authority the Zoning Adjusto r does not have
The appellant's property is not certainly deprived of any particular
privileges By stretching the definition of "special circumstances",
I allowed that the shape and the location of the property, when com-
bined with the poor judgement used to design both the "non-church"
appearance of the building and the poor site development plan (placing
the parking at the front of the lot rather than the church structure),
have combined to make a self-created practical difficulty at the site
And that is the sole basis upon which I felt a slight deviation could
be granted in the sign standard As you can see I approved a sign
area three (3) times that provided by the standard of the Code, althouyh
I did keep the height at the same level I also required it to be ten
(10) feet back from the right-of-way due to the fact that inqress and
egress areas were on both sides of the sign and it would be almost
impossible for the sign not to provide some measure of interference
with sight distance unTess it were 6ack at least ten (10) feet, If I
had approved the variance requested, it would be granting a special
privilege and an exception to the ordinance, thereby exceedtnq the
authority assigned to me under the law

SPOKANE COUNTY, WASHINGTON
IN THE MATTER OF A VARIANCE FROM THE STANDARDS)
REGARDING A SIGN IN THE AGRICULTUAL ZONE. ) FINDINGS, CONCLUSIONS
(VE-15-86), VALLEY ASSEMBLY OF GOD CHURCH ) AND DECISION
SUMMARY OF APPLICATION.
The applicant requests a deviation from the sign standards of the Agricutural
zone to permit the installation of a sign considerably in excess of the
maximum requirements in the zone. The sign proposed is 25' in height and
approximately 170 square feet per side, including the logo, for each side of a
2-side sign.
LOCATION.
The 3.6 acre Church's parcel is located approximately 300' east of Sullivan
Road with frontage on and south of Broadway Avenue. The Church has an
easement access westward to Sullivan Road at a location approximately 300'
south of the intersection of Broadway and Sullivan. The Assessors Parcel #is
13543-0419.
DECISION OF THE ZONING ADJ USTOR'
Based upon the evidence presented and circumstances associated with the
project proposal, the Zoning Adjustor DENIES the project as set forth in the
application, and APPROVES A LESSER VARIANCE.
PUBLIC HEARING.
After examining all available information on file with the application and
visiting the subject property and surrounding area numerous times, research-
ing the legality of several church signs in the neighborhood, the Zoning
Adjustor conducted a public hearing on March 12, 1986, which hearing was con-
tinued to March 26, 1986, renered a verbal decision on March 26, 1986, and a
written decision on April 1986.
FINDINGS OF FACT
1. The proposal is generally located southeast of the intersection of
Broadway and Sullivan in the Spokane Valley and is further described as
Assessors Parcel #13543-0419, being more completely described in Zoning
Adjustor Fi 1 e VE-15-86.
2. The applicant Church proposes to place a pre-fabricated sign
identifying their Church in a landscaped island at the Broadway entrance to
the parking lot. The sign as proposed is 25' in height, whereas the Zoning
Ordinance in Section 4.17.120 e. ii, limits the height to 6 feet. The sign as
set forth in the application contains approximately 170 square feet of
illuminated informational sign and logo (Cross) on each side of a 2-sided
sign, whereas the Zoning Ordinance limits the area to not more than 15 square
feet on each face of a back-to-back sign. The sign is shown on the site plan
as being approximately 20' from the Broadway front property line. The
language in the Zoning Ordinance is unclear; however, it appears to state that
a sign could allowably be up to 6' from the right-of-way. A sign elevation
(sketch) is contained in the Planning Department file.
3. The adopted Spokane County Future Land Use Plan designates the area of
the proposal as SUBURBAN. However, this kind of proposal is not really
addressed by the Comprehensive Plan map or text and the sign can neither be
said to be consistent nor inconsistent with the Plan.
4. The site is zoned Agricultural, which would allow the proposed use
upon approval of this application.

5. The existing land uses in the area of the proposal are varied. A
fire station exists on the southeast corner of Broadway and Sullivan Road,
occupying about a 300 foot square site. The northeast corner of Broadway and
Sullivan is a 60 or 70 acre site which has received zoning for a regional
shopping center through the year 1991. If the shopping center is not
substantially underway by 1991, the zoning may revert back to the original
Agricultural zoning. Any commercial development of that site will be
contingent upon a site plan review before the Hearing Examiner Corrnnnittee and
possible and EIS. The northwest corner of Broadway and Sullivan is occupied
by local business and freeway comercial uses. The southwest portion of the
southwest corner of Broadway and Sullivan is zoned Agricultural and is
occupied by residential uses. Sullivan Road south of Broadway is
predominantly Agricultural zoning with two small portions of Corromercial
zoning. One of these Commercial zones is on the west side of Sullivan
approximately 250' north of Valley Way, dental offices occupy this commercial
use. On the east side of Sullivan in the vicinity of the subject Church
property a car wash occupies two small pieces of Commercial property. Some
Local Business zoning rings this car wash property and is partially adjacent
to the Church's interior property. Other than that, the uses south of
Sullivan Road are agricultural and R-2 Zoning uses or the land is vacant.
6. The Church property seems to suffer from a lack of thoughtful site
design. The Church structure is located at the rear most, southeastern corner
of the ownership and has very limited visibility from both Sullivan Road and
Broadway. The physical design of the structure is not "church-like" and in
that respect works against the identification of the property as a Church.
These circumstances could only have been created by the persons making
decisions regarding the development of the site and the design of the Church.
In other words, the church structure could have been located closer to
Broadway with parking behind it and the Church structure could have had a
design which identified it more as a Church.
7, Broadway Avenue is a secondary arterial and Sullivan Road is a major
arterial.
8. The Church's case for a variance is predicated on low visibility and
poor identity as a Church and the need to compensate for this with a large and
obvious sign. The site itself suggests no lack of privileges when compared to
other church's in the Agricultural zone, but the use of the site was created
by the Church.
9. Statements were,in support of the application,made that the Church
needs to compete with other businesses and signs in the area. However, the
Washington Trust sign which was identified as being at the northwest corner of
the Church property was found, upon inspection by the Building and Safety
Department, to be illegal and was removed during the time period between the
two hearings.
10. The applicants claim there is a general proliferation of commercial
and business signs in the area with which they feel the need to compete as a
business. The Zoning Adjustor's observation, however, is there are no such
signs on Broadway east of Sullivan Road (once the illegal Washington Trust
sign was removed).
11. The Zoning Adjustor field checked the area and found there to be very
few if any signs in the Agricultural zone that exceeded the standards of that
zone. Of particular note was the Cowley Memorial Baptist Church on Sullivan
Road, slightly to the south of the existing Church property. This Church is
in the Agricultural zone and has a detached, unlighted sign, which conforms to
the Agricultural zone detached sign standards for a Church.

12, Additionally, there are two churchs east of this stte on the north
side of Broadway. The Valley Church of Christ has an apparently legal sign at
its iocation on Broadway. However, this Church has an extremely large and
iilegai sign on the north side of its building facing the freeway. This sign
was pointed out by the applicant at the second hearing as one which they felt
that ought to have comparable privileges wtth.
13. Slightly farther to the east on Broadway is the Hope Lutheran
Church. The Hope Lutheran Ghurch has an apparently legal sign for the Agr1-
cultural zone on Broadway and it also has an apparently second legal-sized
detached sign on the freeway side of its property, as viewed from the freewaye
14. Another church on Broadway, the East Broadway Weslayan Church, also
located in the Agricultural zone has an apparently legal sign for the Agri-
cultural zone.
15. Leading up to the hearings, the Zoning Adjustor observed 15 to 25
church signs throughout the County in the process of travels associated with
the job responsibilities. It was very rare to find a church sign9 inc]uding a
cross, which exceeded approximately 10 feet in height, unless the crosses were
an architectural feature of the buildinge
16. Upon full implementation of the new zoning code, the property will
"cross-over" to Suburban Residential 1/2. The signs standards are quite a b1t
the same for a detached sign in this zone under the new code, with the
exception that a sign may be up to 10' in height, but no more than 6' in
width. The new code would also allow a ubulletin board" sign 3n addition to
the just described sign.
17. The applicant may find its sign needs most easily met by attempting
to secure an easement for its hoped-for sign on the Commercial property
fronting on Sullivan near its easement driveway which ieads from Sullivan to
the primary church parking lot and building.
18. The proposal is exempt from the provisions of Chapter 43.21C RCW
pursuant to WAC 197-11-800 (6) (b).
19. The proposed site plan indicates that setbacks, parking, height of
the structure(s) will conform to the Spokane County Zoning Ordinance. The
site plan appears to indicate that the northern most edge of the sign wouid be
located ZO' from the property line. In light of its proposed location in an
island between and entrance and an exit, it is reasonable that this sign be
located this far back from the property line in order that it not interfere
with ingress and egress.
21. No one appeared to oppose the proposal nor were any written comments
adverse to the proposai received.
22o The proper legal requirements for advertising of the hearing before
the Zoning Adjustor of Spokane County have been mete
23. Any conclusion hereinafter stated which may be deemed a finding
herein is hereby adopted as such.
From the Findings, the Zoning Adjustor comes to these:
CONCLUSIONS
1. The proposal as set forth by the applicant would be detrimental to
and not compatible with the publTC health, safety and welfare.
2e To allow the proposed sign with as little or no justification or
substantiation to achieve the standards set forth for variances wouid be to
set a most unfortunate precedent in which it would be difficult to say no to
any Church in the Agricultural zone proposing a sign of comparable magnitude.
3. The subject property is not depri ved of pr1 vi1 eges commonly enjoyed
by other church properties in the general vicinity and in the Agrlcultural
zone.

4, The granting of the variance as requested would be a grant of special
privileges inconsistent with privileges enjoyed by other church properties in
the vicinity and Agricultural zone.
5. The granting of the variance to the degree proposed would be
materially detrimental to the public welfare.
6. Even though the those persons who are charged with making decisions
for the Church have created the very hardship from which they seek relief by
virtue of the location and the non-church-like appearance of the building, a
self-created hardship is not clearly recognized as denying a zone change in
the Spokane County Zoning Ordinance as it is presently written. The problem
from which the present Church administration seeks relief is one which was one
created by the volunteer Church board of directors or other such group charged
with the administration of the Church. The Zoning Adjustor recognizes the
lack of clear direction and lack of absolute foresight with which such well-
intended bodies may operate. The Zoning Adjustor considers this situation of
"governing" and "decision making" to be a special circumstance which warrants
the granting of some relief to the present body of persons and the minister
now trying to solve a problem essentially created by others. Therefore, it is
the Zoning Adjustors intent to grant limited relief, commensurate with the
amount of relief which could be granted as consistent with the degree of
special circumstances recognized. The intent of the relief to be granted is
to describe a sign which would be generally consistent with the church sign
standards of the new zoning code in the Suburban Residential 1/2 zone.
7. Any finding hereinabove stated which may be deemed a conclusion
herein is adopted as such.
DECISION
From the foregoing Findings and Conclusions, the Zoning Adjustor DENIES
the proposal as set forth by the applicant and APPROVES A LIMITED VARIANCE,
designed to somewhat off-set the special circumstances in which the church
governing body finds itself at the present time, while not granting a
deviation in excess of what would be allowed under the new code if it were in
effect at the present time. The following CONDITIONS OF APPROVAL ARE
STIPULATED.
CONDITIONS OF APPROVAL
.
I. GENERAL
1. The following conditions shall apply to the applicant, owner and
successors in interest.
2. The Department of Building and Safety shall route the building permit
application to all of the agencies and offices of county government below
which are indicated as needing to give their authorization prior to the
release of a building permit. Upon reviewing the various plans returned
to the Department of Building and Safety by the other departments, the
department will consult with the Planning Department if there are any
changes resulting from review by the other departments when compared to
the plans as approved by the Planning Department. Such review may
necessarily result in a revision of the site plan for use by the
Department of Building and Safety or possibly a with-holding of the
building permit until any conflicts are resolved.
3. Prior to application for any building permits associated with a sign at
this location on Broadway and in the center of the curbed island at the
Broadway entrance, a revised plan shall be submitted and approved by the
Zoning Adjustor for substantial conformance with the guidelines set forth
below.
II. PLANNING DEPARTMENT
1. Any sign to be approved for installation on Broadway Avenue sha11 have a
design generally patterned after the following.

ae Each side of the sign may have a maximum of 45 square feet. The sign
sha11 not generally exceed 6' in height except that a religious
symbol may extend to a total height of 10' above gradee
bo The sign shall be have a maximum of 20 square feet which would
identify the name of the church and may have an additional 25 square
feet (totalling 45 square feet per side) qualifying as a bulletin
board sign similar to the definition contained in the new zoning code
in Section 8.04.060 1. The sign may also have louu intensity lighting
as generally defined and set forth in the new zoning code.
c. The northern edge of the sign may be located up to within 10' of the
ri ght-of-way.
III. DEPARTMENT OF BUILDING & SAFETY
1. All signs require building permits as per Section 3.08 of Title III,
Spokane County Codeo
2. Compliance with the following provisions shall be demonstrated prior to
issuance of a building permit.
a. Signs at or near a street intersection shall not obstruct visibili)ty
for purposes of ingress and egress.
b. The sign shall be placed so as to not unreasonably interfer with the
movement of vehicles or pedestrian traffic.
c. The location of all signs sha11 be subject to approval by the County
Engineers Office.
d. Per9nit numbers on the sign shall be painted at the lowest corner next
to the road in figures not less than 1" high.
IV. UTILITIES DEPARTMENT

I am writing this letter as a follow-up to our conversation at the hearing on
M2rc:h 12, 1986, requesting a variance for our sign. There are two points I
would again like to make: (1) Although we are currently zoned agricultural, ~ the county comprehensive plan has us eventually being zoned commercial. /
This sign would just put us a little ahead of our time; (2) Our building sits a
long way south of B roadway, and further is not easily identifiable as a 0

we are on, only 20 blocks straight east. Its dimensions are 16' X 18'. They,
too, are in the agricultural zone and have a sign considerably larger than
what you state is allowed.

b. A sign identifying a kindergarten, nursery school or home occupation is .
perntitted provided that such sign is limited in size to a maximum of two
(2) square feet, unlighted, and placed flat against the buildiag housiag

c. A temporary sign limited to the duratioa of the activity which directs
atteation to the sale, lease or rental of the particular building,
property or premises, or identifies an event (such as garage sale or open
house) upon which it is located is permitted provided that such sign is
unlighted, limited ia size to a maximum of five (5) square feet and in
height to three (3) feet and is situated at least ten (10) feet from any
public right-of-way or private drive. Such sign may not be used to
promote a home occupation.
A temporary sign limited to the duration of the activity which directs
attention to the sale, lease or rental of lots in a plat or of an
unplatted tract of land exceeding five (5) acres in size upon which it is
located is permitted provided that such sign is unlighted, limited in
size to a maximum of thirty-two (32) square feet and in height to six (6)
feet and is situated at least ten (10) feet from any public right-of-way
or private drive.
d. On-premise signs identifying a roadside stand for sale of agricultural
products, commercial greenhouse or nursery, fish hatchery, speciality .
farms including livestock, poultry, vineyards, truck gardeas, orchards,
and dairies, contractor's maintenance, repair and processing operation
are permitted as follows:
i. One sign, unlighted, placed flat against the outside wall of the
main building, having an area of not greater than twenty (20) square
feet; or
ii. One detached sign not having an area of more than twenty (20) square
feet on each face, placed back to back. Such sign shall'not exceed
six (6) feet in height nor six (6) feet in width and shall be
situated at least ten (10) feet from any public right-of-way or
private drive. The sign shall be unlighted.
e. On-premise signs identifying a church, public park, public or parochial
elementary or junior high school, librery, non-profit community hall or
lodge, cemetery, sanitarium, children's home, correctional institution,
and animal cemetery are permitted as follows:
i. One sign, unlighted or low intensity illumination, placed flat
against the outside wall of the main building, having an area of not
greater than twenty (20) square feet, and .
ii. One detached sign having an area of not more than fifteen (15)
square feet on each face, placed back to back. Such sign shall not
exceed six (6) feet in height nor six (6) feet from any public
right-of-way or private drive. The sign shall be unlighted except
when situated on a major or secondary arterials as defined in the
Comprehensive Plan, such sign may incorporate low intensity ~
