THIS MATTER, an application for a temporary use permit, from Larry Wittkopf has been
rec ived and decided upon, pursuant to the Spokane County Zoning Code regulations, on the
~ day of June, 1993.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to allow storage of topsoil on site for a period not to exceed six months.
3. The proposal is generally located north of and adjacent to Sprague Avenue, approximately
1,000 feet west of Conklin Road in the SW 1/4 of Section 13, Township 25 North, Range
44 EWM, Spokane County, Washington.
4. The current zoning of the property is Regional Business (B-3) (ZE-7-88C). The proposed
use does not create significant impacts to the general area.
5. The Spokane County Comprehensive Plan designates this area as Major Commercial. The
development and uses proposed are in accord with this category.
6. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendarions solicited.
7. A berm, approximately 13 feet high, will be created to stockpile the topsoil and allow orderly
removal of the topsoil from the site.
8. Recognizing the recornmended conditions and Spokane County temporary use standards, the proposed use makes appropriate provisions for the public health, safety and general welfare.
9. The project is not exempt from environmental review under the State Environmental Policy
Act pursuant to WAC 197-11-800. An Environmental Checklist was provided by the
applicant and reviewed by the Planning Departrnent. A Detemunation of Nonsignificance
(DNS) was issued on May 19, 1993 for comment by other agencies. Addirional comments
were received by the Planning Department.

sprinklers or suspension of activity during certain weather conditions. Haul roads shoulci
be treated and emissions from the transfer of earthen material must be controlled as well a,,
emissions from aIl other construction related activities. Also dust emissions from the
storage piles must be controlled by use of water sprays, tarping, etc.
3. Measures must be taken to avoid the deposition of dirt and mud froin unpaved surfaces
onto paved surfaces. If tracking or spills nccur on paved surfaces, measures must he
immediatelv to clean these stirfaces.
