The Spokane County Engineering Department has reviewed the above referenced
application. The following "Conditions of Approval" are submitted to the
Spokane County Planning Department for inclusion in the "Findings of Fact,
Conclusions and Order/Decision " should the request be approved.
Prior to release of a building permit or use of property as proposed:
1. Dalton Road is a county gravel road located within the PM-10 suspended
particulate non-attainment area as designated by the Washington State
Department of Ecology. By allowing additional access further
degradation would occur to air quality. Due to the lack of adequate
infrastructure the County Engineer recommends that the request for
industrial access to Dalton Road be denied. Should the applicant
volunteer to construct Dalton Road along the frontage of the property
and extending back to Tschirley Road, the County Engineer would not
restrict access to Dalton Road.

Notice of this vanance request was sent to various county departments and outside
agencies ofjurisdiction The responses from the Spokane County Division of
Engineering and Roads, Spokane County Division of Utilities, Spokane County
Air Pollution Control Authority (SCAPCA) are attached The Spokane County
Division of Engineering and Roads~ ds denial unless the applicant is
willing to pave Dalton Avenue fr ' Flora Roa to Tschirley Road SCAPCA

V VARIANCE ANALYSIS
The situation presented here is not truly a request for variance but is instead a
request for a change of conditions from a variance that was granted in 1978 by the
Board of Adjustment The variance granted in 1978 was done so on appeal of a
decision of the Zoning Adjustor of Spokane County
The Zoning Adjustor heard the proposal on November 14, 1977 to allow an
industrial building to be located 10 feet from the front property line adjacent to
Dalton Avenue The Zoning Ordinance required that the building be set back 35
feet (The variance requested was 25 feet ) The Zoning Adjustor approved the

request in part on November 21, 1977 and agreed to allow the bulldtng to be built
25 feet from the property line adjacent to Dalton Avenue (The variance granted
was for 10 feet ) Reasons 5 and 6 of the Zoning Adjustor's decision explained
why the full 25 feet requested was not granted The Zoning Adjustor's concern
was about impact to residential structures located across Dalton Avenue
The Zoning Adjustor's decision of November 21, 1977 was appealed to the Board
of Adjustment which held a public heanng on December 20, 1977 The Board
modified the Zoning Adjustor's decision and granted the requested vanance wrth
three conditions Condition 1 effectively restncted access to Dalton Avenue
Condition 2 advised the Spokane County Engineers and the Zoning
Administrators to restrict access to Dalton Avenue from the property west of the
subject property in the future and suggested to the applicant that County owned
right of way could be vacated Conditlon 3 stated that the subject property should
be developed in conformance with the "plot plan" in the file
It is the opinion of Staff, that Condition 1, which prohibited access to Dalton
Avuenue, was included to protect the residential properties located on Dalton
Avenue (See Zoning Adjustor decision) The residences are still located across
Dalton Avenue and the concerns of the Zoning Adjustor and the Board of
Adjustment remain valid Two letters from neighboring property owners
objecting to the proposal are part of the file
VI VARIANCE CONCLUSION
The applicant has not presented evidence that the proposed change of conditions
of the previously granted vanancP will not negatively impact the adjacent
residential properties
VII RECOMMENDATION
Staff has reviewed the change of conditions / variance request in accordance with
the Spokane County Zoning Code and finds that the proposal is detnmental to the
health, safety and welfare of t11e general public Therefore, the staff recommends
denlal of the change of conditions / varlance request
VIII CONDITIONS OF APPROVAL
Should this request for vanance be granted, the following are recommended
Conditions of Approval
1 The applicant shall develop subject property generally in accordance within
the concept presented to the Heanng Body Variations, when approved by the
Division Director/designee, may be permitted, including, but not limited to
building location, landscape plans and general allowable uses of the permitted
zone All variations must conform to regulations set farth in the Zoning Code
for Spokane County, and the original intent of the development plans shall be
maintained

areas, access roads) shouid be paved and kept clean to minimize emissions
* Measures must be taken to avoid the deposition of dirt and mud from unpaved surfaces
onto paved surfaces If tracking or spills occur on paved surfaces, measures must be
taken immediately to clean these surfaces
* SCAPCA Regulation i, Article IV may require registration with this agency depending
upon the type of equipment operated at the site This includes solvent tanks or
solvent spray areas, spray painting operations, abrasive blasting operations,
ovens, and furnaces
* SCAPCA Regulation i, Article Vi, and SCAPCA Regulation II, Article IV, address air

SPOKANE COUNTY HEARING EXAMINER
Hearing Procedure
Pursuant to Spokane County Resolution Nos 96-0171, 96-0293 and 96-0294, as may be supplemented
by the Spokane County Code
All interested persons may attend the public hearing Written comments or documents may be submitted
at or prior to the hearing, but if at all possible should be submitted to the Division of Building and
Planning prior to the hearing Timely written materials submitted will be considered by the Hearing
Examiner and made a part of the record Testimony will be allowed on the proposal and related
environmental documents and issues This will be the only open record heanng allowed on the
application Any appeal of the Hearing Examiner's decision will be based on the record established at
this hearing Appeals must be taken to the Board of County Commissioners of Spokane County for
decisions on applications for a rezone, or an application for a combined rezone and preliminary plat
Appeals must be taken to the superior court for all other applications State Environmental Policy Act
appeals shall follow the same procedural route as the underlying actions
The folLowing procedural rules have been established to allow a fair and orderly hearing
1 The Hearing Examiner may limit the time given to speakers for or against a proposal
2 A speaker representing each side of the issue is encouraged
3 Only specifically relevant testimony to the proposal will be accepted
4 Cross-examination may be allowed at the discretion of the Hearing Examiner
S The project file will be adopted by the Hearing Examiner as part of the record
6 The Hearing Examiner will tal:e notice of Spokane County's Generalized Comprehensive Land Use
Plan, Zoning Code, and County Code
Inspection of File, Obtaining Copies of Documents The project file is available for inspection in the

P), Spokane, WA, 99260, between 8 a m and 4 p m, Monday through Friday, except holidays The Staff
Report of the Division will generally be available seven calendar days before the scheduled hearing
