but is instead a request for a change of conditions from a variance that was granted in 1978 by the Board of Adjustment The variance granted in 1978 was done so on appeal of a decision of the Zoning Adjustor of Spokane County The Zoning Adjustor heard the proposal on November 14, 1977 to allow an industrial building to be located 10 feet from the front property line adjacent to Dalton Avenue The Zoning Ordinance required that the building be set back 35 feet (The variance requested was 25 feet ) The Zoning Adjustor approved the 1-15-97 HE Staff Report VE-13-96 Bzst Page 7 request in part on November 21, 1977 and agreed to allow the bulldtng to be built 25 feet from the property line adjacent to Dalton Avenue (The variance granted was for 10 feet ) Reasons 5 and 6 of the Zoning Adjustor's decision explained why the full 25 feet requested was not granted The Zoning Adjustor's concern was about impact to residential structures located across Dalton Avenue The Zoning Adjustor's decision of November 21, 1977 was appealed to the Board of Adjustment which held a public heanng on December 20, 1977 The Board modified the Zoning Adjustor's decision and granted the requested vanance wrth three conditions Condition 1 effectively restncted access to Dalton Avenue Condition 2 advised the Spokane County Engineers and the Zoning Administrators to restrict access to Dalton Avenue from the property west of the subject property in the future and suggested to the applicant that County owned right of way could be vacated Conditlon 3 stated that the subject property should be developed in conformance with the "plot plan" in the file It is the opinion of Staff, that Condition 1, which prohibited access to Dalton Avuenue, was included to protect the residential properties located on Dalton Avenue (See Zoning Adjustor decision) The residences are still located across Dalton Avenue and the concerns of the Zoning Adjustor and the Board of Adjustment remain valid Two letters from neighboring property owners objecting to the proposal are part of the file VI VARIANCE CONCLUSION The applicant has not presented evidence that the proposed change of conditions of the previously granted vanancP will not negatively impact the adjacent residential properties VII RECOMMENDATION Staff has reviewed the change of conditions / variance request in accordance with the Spokane County Zoning Code and finds that the proposal is detnmental to the health, safety and welfare of t11e general public Therefore, the staff recommends denlal of the change of conditions / varlance request VIII CONDITIONS OF APPROVAL Should this request for vanance be granted, the following are recommended Conditions of Approval 1 The applicant shall develop subject property generally in accordance within the concept presented to the Heanng Body Variations, when approved by the Division Director/designee, may be permitted, including, but not limited to building location, landscape plans and
