entire record, and finding good cause therefore, hereby makes the following findings of fact, conclusions of law and decision I FINDINGS OF FACT 1 The application requests a conditional use permrt for expansion of a nonconfornling warehouse use, in the Mirung (MZ) zone 2 The site is located east of and adjacent to Tschirley Road, approxunately 700 feet north of Euclid Avenue, Ln the SW '/4 of Sectlon 6, Township 25 North, Range 45 EWM, Spokane County, Washington 3 The site ls currently referenced as County Assessor's tax parcel no 5506 0175, and has an address of 3420 N Tschirley Road, Spokane, WA 4 The applicant for the proposal and the site owner is Brown & Hi11 Properties, c/o Ty Brown, 4320 N Tschirley Road, Spokane, WA 99206 5 The Hearing Examiner heard the application pursuant to the County Heanng Examiner Ordinance (County Resolution No 96-0171) and the County Heanng Examiner Rules of Procedure (County Resolution No 96-0294) 6 The Exarmner conducted a site visrt on December 10, 2002, and conducted a public heanng on the proposal on December 11, 2002 The requirements for notice of public hearing were met 7 The following persons testified at the pubhc heanng James Tschirley Spokane, WA 99206 Spokane, WA 99216 HE Findings, Conclusions and Decision CUE-09-02 Page 1 0 A ~ 8 The County Division of Planning issued a Detennination of Nonsignificance for the proposal on November 26, 2002 9 The Heanng Examiner takes notice of the County GMA Comprehensive Plan and Capital Facilities Plan, Phase I Development Regulations, County Resolution Nos 2-0037 and 2-0470, County Zonulg Code, 2001 Standards for Road and Sewer Construction, County Code and other applicable development regulations 10 The record tncludes the documents in the project file at the time of the public heanng, the documents and testirnony submltted at the public heanng, and the items taken notice of by the Hearing Examiner 11 The site is approximately 67 acres in size, irregular in shape and relatively flat in topography An existing wholesale warehouse building is found along the west side of the northerly two-thirds (2/3) of the site, including 3,930 square feet of warehouse space and 450 square feet of office space The office space has four tenants associated with the warehouses uses in the building, but has only two persons in the office A mobile home is located on the site east of the warehouse building, and a second mobile home is found in the northwest corner of the site near Tschirley Road T'he mobile homes are used for caretaker purposes The existing warehouse, wholesaling and office uses, and one of the mobile homes used for caretaker purposes are legal nonconforming uses 12 The conditional use pernlit application and site plan of record were submitted on October 9, 2002 The site plan of record illustrates the existing warehouse building, and a proposed single-story, 16-foot lugh, 3,210-s9uare foot addition to the building along its north side Access to the expanded warehouse would be via a single approach to Tschirley Road Employee parking and truck loading areas are also shown duectly west of the expanded warehouse The warehouse addition would be used to store used medical equipment and supplies, lncluding refngerated storage 13 In 1980, the site was rezoned to Mining (Class IIH) under the now expired County Zoning Ordinance, to allow sand and gravel extraction Effective January 1, 1991, the zorung of the site was reclassified to the Mining (MZ) zone, pursuant to the Program to Implement the Spokane County Zomng Code 14 Effective January 15, 2002, the County Lmplemented a new comprehensive plan ("GMA Comprehensive Plan"), Capital Facilities Plan, County Urban Growth Area (UGA) boundanes, and Phase I Development Regulations, all pursuant to the State Growth Management Act (GMA) The County also repealed the intenm development regulations previously adopted by the County under the State Growth Management Act See County Resolution No 2-0037 Minor revisions were made to the Phase I Development Regulations on May 7, 2002 See County Resolution No 2-0470 15 The Phase I Development Regulations designate the site and the land in the vicinity in the Heavy Industnal category of the GMA Comprehensive Plan, and in the Urban Growth Area The HE Findings, Conclusions and Decision CUE-09-02 Page 2 a , J land surrounding the site is zoned Light Industrial (I-2) or Heavy Industnal (I-3), and consists of inactive sand and gravel excavation sites and industrial uses 16 The location of two (2) mobile homes on the site for caretaker purposes violates the Zoning Code, and one of the mobile homes must be removed from the site The applicant intends to remove the mobile home located in the northwest portion of the site, which interferes with the proposed warehouse building expansion The proposal should be condihoned for removal of one of the mobile homes 17 The site is located outside the County's 6-year Sewer Caprtal Improvement Program area, and public sewer is currently unavailable to the site The Phase I Development Regulations do not require conditional use permit applications for land located in the UGA to comply with sewer and water concurrency requirements if the proposed use will not result in an increased amount of wastewater generated on the site 18 The record indicates that the existing on-site sewage disposal system is adequate to serve the existing uses on the site and the proposed warehouse expansion, subject to removal of one of the mobile homes on the site The proposal is, accordingly, exempt from sewer and water concurrency requirements Public water currently serves the subject property and is avallable for the expansion 19 The proposal is exeinpt from transportation concurrency requirements based on the determination by County Engineenng that the proposal will have an insigruficant transportation impact, and will not change the traffic volumes and flow patterns in the PM peak hour travel penod 20 The site is not designated as Mineral Land Due to the site size and the lack of any evidence that the site has long-term commercial significance as mineral land, the subject property generally does nofi meet the cnteria in the Comprehensive Plan for deslgnation as Mineral Land The highest and best use for the site appears to be industnal, rather than mining 21 Warehousing and wholesaling uses, and associated office and caretaker uses, are not permitted in the MZ zone, but such uses are permitted in the Heavy Industrial (I-3) zone Mirung is permitted in both the I-3 zone and the MZ zone The I-3 zone is the only zone intended to implement the Heavy Industnal category, the category in wluch the site is designated 22 No opposition was expressed with regard to the proposal The Health District requested that one of the mobile homes on the site be removed and that barriers be placed around the existing sewage drainfield to protect vehicular traffic on the sewage dtsposal system 23 As conditioned, the proposal will not have more than a moderate effect on the quality of the environment and will be reasonably compatible with neighbonng land uses HE Findings, Conclusions and Decision CUE-09-02 Page 3 0 , < 24 The proposal complies with the development standards of the MZ zone, except with regard to use The Zoning Code discourages the expansion or extension of a nonconforming use, but authonzes an expansion through the conditional use permit process Based on the above Findings of Fact, the Heanng Exanuner enters the following II. CONCLUSIONS OF LAW 1 The proposed conditional use permit to allow expansion of a nonconforming wholesale warehouse use, in the Mining (MZ) zone, as condltioned, conforms to the GMA Comprehensive Plan 2 The proposal is consistent with the general purpose of the County Zoning Code, set forth in Section 14 100 104 of the Zoning Code, the development standards of the MZ zone, other than use restrictions, and other applicable development regulations 3 The proposal, as conditioned, is reasonably compatible with other uses permitted in the MZ zone or located in the vicinity of the proposed use 4 The proposal, as conditioned, reasonably mitigates any adverse impacts on adjacent properties by reason of use, extension, construction or alteration allowed with respect to the conditional use 5 The proposal, as conditloned, will not have a sigruficant, probable, adverse impact on the environment The requirements of the State Environmental Policy Act and the County's Local Environmental Ordinance have been met 6 The proposal, as conditioned, satisfies the requirements for issuance of a conditional use pennit under Chapter 14 404 of the County Zoning Code, and for expansion of a nonconforming use under Sectlon 14 508 040 of the County Zonulg Code 7 Approval of the land use application, as conditioned, is appropriate under section 11 of the County Heanng Examiner Ordinance, as adopted by County Resolution No 96-0171 III. DECISI4N Based on the above Findings of Fact and Conclusions of Law, the application for a conditional use permit to allow the expansion of a nonconforming wholesale warehousing use, in the Nhning (MZ) zone, as hereby approved, subject to the conditions of approval specified below Any public agency conditions that have been sigruficantly altered or added to are italacized Failure to comply with the conditions of this approval may result in revocation or suspension of this approval by the Hearing Examiner Thls approval does not waive the applicant's obligation to comply wrth all other requirements of other agencies with j unsdiction over land development HE Findings, Conclusions and Decision CUE-09-02 Page 4 SPOKANE COUNTX DIVISION OF PLANNING 1 All conditions imposed by the Heanng Examiner shall be binding on the "Applicant," which term shall include the owner and developer of the property, and their heirs, assigns and successors 2 The Conditional Use Permit applies to the parcel legally descnbed as "That portion of Tract 72 of PLAT NO 3 WEST FARMS rRRIGATED TRACTS descnbed as follows COMMENCING at the Southwest corner of said Tract 72, thence along the Easterly nght of way of Tschirley Road North 01 °OS'33" West 150 feet, thence North 89°47' East 225 feet, thence South 67°OS' 15" East 112 55 feet to a point on the Southerly line of Tract 72342 93 feet to the point of begulning, EXCEPT the West 10 feet of Tschirley Road, in the SW 1/4 of Section 6, Township 25 North, Range 45 EWM, in Spokane County, Waslungton " 3 The applicant shall develop the subject property in conformance with the site plan of record submitted on October 9, 2002, subJect to compliance with conditions of approval and regulation standards Vanations, when approved by the County Division of Planiung Director or designee, shall only be allowed to meet conditions of approval and regulation standards Any other revision must be submitted through a change of condition application, and approved after a public heanng by the Hearing Examiner 4 The proposal shall comply with the Mining Zone (MZ), the Aqulfer Sensrtive Overlay zone, and other applicable provisions of the Spokane County Zoning Code, as amended 5 No further expansion of the nonconforming warehouse use or conversion to other industrial uses shall be permitted until the property is reclassified to an appropnate industnal zone desig.nation Abandon.ment of the current use for 12 or more consecutive months shall tenninate the nonconformmg use nghts authonzed under the Condrtional Use Permit 6 One of the mobale homes located on the sate shall be removed prior to assuance of a bualding permit for the warehouse axpansion, or such earlier tame as requared by County Planning or the Spokane Regzonal Health Dastract 7 The Division of Planning shall prepare and record with the Spokane County Auditor a Title Notice, which notes that the property in question is subject to a vanety of special condrtions imposed as a result of approval of a land use action The Title Notice shall serve as public notice of the condrtaons of approval affecting the property in question The Title Notice should be recorded witlun the same time frame as allowed for an appeal and shall only be released, in full or in part, by the Division of Planning The Title Notice shall generally provide as follows "That portlon of feet to the point of beginning, EXCEPT the West 10 feet of Tschirley Road, in Spokane County, Waslungton" is the subject of a land use action approved by the Spokane County Heanng Examiner on January 23, 2003, approving a conditional use permit for a nonconforming use and imposing a variety of special de-velopment conditions File No CUE-09-02, which relates to such action, is available for inspection and copying in the Spokane County Division of Planrung " SPOKANE COUNTY DIVISION OF BUTLDING AND CODE ENFORCEMENT 1 The applicant shall contact the Division of Building and Code Enforcement at the earliest possible stage in order to be informed of code requirements administered/enforced as authonzed by the State Building Code Act Design/development concerns include addressing, fire apparatus access roads, fire hydrant flow, approved water systems, building acccssibility, construction types, occupancy classification, existing extenor wall protection and energy code requirements SPOKANE COUNTY DIVISION OF ENGINEERING AND ROADS Prior to release of a building permit or use of the property as proposed: 1 A parlang plan and traffic circulation plan shall be submitted and must be accepted by the Spokane Counfiy Engineer The design, location and arrangement of parking stalls shall be in accordance with standard englneenng practices Note The existing head-in parking stalls along Tschirley Road are considered legally non- conforming parking stalls If the current use of thls facility changes from the existing warehouse use, then the non-conforming parking stalls will need to be relocated somewheze else on the site to meet current parking standards Current parking standards will not allow any expansion of the existing head-in parking in the future 2 Roadway standards, typical roadway sections and drai-nage plan requirements are found in Spokane County Resolution No 1-0298 as amended and are appllcable to this proposal 3 No construction work is to be performed wlthin the exishng or proposed public nght-if-way until a permlt has been lssued by the County Engineer All work is sub3ect to inspection and approval by the County Engineer 4 Approach permits must be obtained from the County Division of Engineenng and Roads prior to any access to the Spokane County Road System 5 The applicant is advised tllat utilities may exist erther underground or overhead that affect the applicant's property or the adjacent county nght of way The County assumes no financial obligation for adjustrnents or relocation regarding these uhlities The applicant should contact the applicable utility purveyors regarding the responsibilrty for adjustment or relocatlon costs and HE Findings, Conclusions and Decision CUE-09-02 Page 6 0 ~ to make arrangements for any work A permit is required from the County Englneer for any work performed in the County nght of way 6 The County Engineer has reviewed the project for transportation concurrency and determined that it is exempt under Section IV (B)(2)(c) of the Phase I Development Regulations adopted by the County SPOKANE COUNTY STORMWATER UTILITY 1 Spokane County does not own or operate a regional stonnwater conveyance system As a result, the applicant is responsible for providing on-site control of stormwater runoff from newly constructed impervious surfaces 2 Dralnage shall not be diverted and/or released to a downstream property at points not receiving drainage pnor to the proposed development 3 The srte is located wrthin the Aquifer Sensitive Area (ASA) Overlay zone In order to mitigate the potential for groundwater degradation, all stormwater runoff from land developed within the such zone shall be treated pnor to discharge to a drywell or other approved disposal point The preferred method of treatment is through a bio-filtration swale (formerly referred to as a"208" swale or a grassed percolation area) SPOKANE COUNTY DIVTSION OF UTILITIES 1 All wastewater facilities for this project shall be provlded in accordance with the Comprehensive Wastewater Management Plan for Spokane County and the Spokane County Zorung Code Phase One Development Regulations as amended 2 The proposal lles outside of the current Spokane County Six-Year Sewer Capital improvement Plan Conditional Use Permits that generate an increase in sewage flow are required to connect to the Sanltary Sewer System Conditional Use Pernuts that do not generate an increase in sewage flow may use an exishng on-srte sewage disposal system with the approval of the Health Distnct SPOKANE REGIONAL HEALTH DISTRICT 1 A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and Spokane Regional Health Distnct prior to the issuance of any on- site sewage disposal permit or building permit for this project 2 The sewage disposal method shall be authonzed by the Director of Utilities, Spokane County 3 Water servlce shall be coordinated through the Duector of individual on-site sewage disposal system may be authorized 7 One of the two caretaker's mobile home shall be removed from the szte, prior to tssuance of a bualdang permit for the proposed expansion The mobale home left on the sate shall not be located on the draanfield system oY its replacement area A barrier shall be placed around the exastang draznfielcl to prevent velzicular traffic on the INDUSTRIAL CATEGORIES Categories for industrial use include the following. HEAVY INDUSTRY - Heavy industry is characterized by intense industrial activities that may have significant impacts to surrounding areas, including, but not limited to noise, odor or aesthetic impacts. LIGHT INDUSTRY - The Light Industry category is intended for industrial areas that have a special emphasis and attention given to aesthetics, landscaping and internal and community compatibility. Light Industrial areas are comprised of predominantly industrial uses but may incorporate office and commercial uses that support and complement the industrial area. INDUSTRIAL LAND USE Providing for industrial land is important for the economic health of Spokane County. Industrial businesses help drive the local economy and create an economic multiplier effect throughout the region. Providing an adequate supply of usable land with minimal environmental constraints and infrastructure in place helps ensure that Spokane County will be an attraetive place for industrial CUE-09-02 Staff Report - December 11, 2002 Public Hearing 3 businesses to locate and prosper. (See Chapter 8, Economic Development, for additional policies that encourage recruitment and retention of industrial business.) Goal UL.14a Provide for the development of well-planned industrial areas that create higher- income jobs, provide economic growth and improve the overall tax base of Spokane County. UL.14b Ensure the long term holding of appropriate land in parcel sizes adequate to allow for future development as industrial uses. Policies UL.14.1 Identify and designate industrial land areas for heavy industry and light industry. UL.14.2 Industrial land designations within the UGA shall be based on criteria established by the Growth Management Steering Committee of Elected Officials (March 15, 1996). UL.14.3 Encourage intensification and revitalization of existing industrial areas. UL.14.4 Consider capital facility expenditures to facilitate the development of lands designated for indust(al uses. UL.14.5 Encourage industries with low energy consumption and industries that recycle resources to locate in Spokane County. UL.14.6 Encourage low-polluting industries to locate in Spokane County. UL.14.7 Encourage shared-use parking, pedestrian access and transit incentive programs in industrial development projects. Response: The existing warehouse use and proposed expansion are generally consistent with the general Policies of the Heavy Industrial (HI) category of the Comprehensive Plan. STANDARDS AND REGULATIONS FOR ALL INDUSTRIAL AREAS Goal UL.17 Establish and maintain land use regulations for industrial areas that protect their use into the future and prevent land use conflicts. Policies UL.17.1 Industrial developments within the Urban Growth Area shall provide the following improvements: a) Paved streets b) Adequate parking for employees and business users (parking may be shared or communal) c) Adequate stormwater control, including curbs, gutters and stormwater management facilities d) Public sewer and water supply e) Controlled traffic access to arterials and intersections CUE-09-02 Staff Report - December 11, 2002 Public Hearing 4 . y ResQonse: The existing warehouse use and proposed expansion would be served with all of the utilities (a - e above) except for sanitary sewers. The project site is within the 6-year sewer service area, however, the warehouse use would generate a nominal amount of wastewater which can be accommodated by the existing on-site sewage disposal system. UL.17.2 Access points should be combined and limited in number to allow smooth traffic flow on arterials. Access through residential areas should be avoided. UL.17.3 Standards for setbacks, landscaping and noise barriers shall be developed to mitigate impacts between industrial developments and adjacent land uses. Response: The existing warehouse use and proposed expansion would not impact any residential neighborhoods with either traffic or noise impacts. HEAVY INDUSTRY Heavy industry is characterized by intense industrial activities which may have significant impacts to surrounding areas, including, but not lirnited to, noise, odor, or aesthetic impacts. Commercial, residential and, recreational uses should not be allowed in areas designated for heavy industry, except for small-scale ancillary uses serving the industrial area. The conversion of designated industrial lands to other uses should be strictly limited. Limiting incompatible uses ensures a competitive advantage in business recruitment by providing adequate industrial land supply, reducing land use conflicts and preventing inflation of land prices. Goal UL.15 A variety of strategically located heavy industrial areas should be designated and protected from conflicting land uses. Policies UL.15.1 Identify and designate land areas for heavy industry. UL.15.2 Areas designated for heavy industry may include a variety of industrial, mining and transportation uses. UL.15.3 Commercial, residential and recreational uses shall not be allowed in areas designated for heaYy industry, except for small-scale ancillary commercial and recreational uses which serve the industrial area. UL.15.4 Conversion of designated industrial lands to other uses shall be strictly limited in order to ensure adequate land supply and prevent inflation of land prices. UL.15.5 Interim uses of heavy industrial property such as agriculture, animal raising and training, recreation including off road vehicle parks and miniature golf/driving ranges should be allowed to occupy undeveloped property pending more intensive utilization. UL.15.6 Carefully consider the designation of comprehensive plan categories adjacent to heavy industrial areas to ensure compatibility between uses and limit land use conflicts. Response: The existing warehouse use and proposed expansion are generally consistent with the general Policies of the Heavy Industrial (HI) category of the Comprehensive Plan. CUE-09-02 Staff Report - December 11, 2002 Public Hearing 5 . MINERAL LANDS Mineral land areas are primarily devoted to sand, gravel, rock, or clay production. Related products such as concrete, asphalt and brick are also produced. Agriculture and forestry may be conducted on mineral resource lands but residences are generally limited to caretaker residences associated with mining or related industry. MINERAL LAND DESIGNATION CRITERIA NR.1.7 Mineral Resource Lands of long-term commercial significance should be designated on official maps and adopted by the Board of County Commissioners through a comprehensive planning process. Mining shall be allowed on lands not meeting natural resource designation criteria if environmental protection and compatibility with adjacent land uses is assured. NR.1.8 Mineral Resource Lands of long-term commercial significance should be designated pursuant to the following criteria: a) In Spokane County, the commercially important minerals are sand, gravel, rock or clay. Mineral resource land designations should be made where these minerals are known to exist. The Spokane County Mineral Resource Map should be used as a tool to help identify additional sites to help meet future demand. b) Mineral resource land designations should be located in areas with compatible land uses, such as mining, industry, agriculture, forestry, vacant or large-lot residential (less than 1 dwelling unit per 5 acres). Mitigation of adverse impacts from mining on adjacent property shall be a prime designation criterion. c) Mineral resource land designations should be 20 acres or more in size. d) Mineral land designations should have a minimum deposit size of approximately 500,000 cubic yards for sand, gravel and rock, and approximately 200,000 cubic yards for blend sand. e) Mineral resource land designations shall not occur on lands with wetlands, riparian areas, geological hazard or threatened or endangered species unless impacts can be adequately mitigated. fl Mineral resource land designations shall have adequate access for trucks. Access shall not be through a residential neighborhood. Response: The immediate vicinity of the project site includes a miAure of historical sand and gravel extraction sites as well as long established industrial Uses. This project site would not generally be consistent with the criteria for designation as mineral resource lands. COMPREHENSIVE PLAN SUMMARY: The existing watehouse use and proposed expansion are generally consistent with the general Policies of the Heavy Industrial (HI) category of the Comprehensive Plan and somewhat inconsistent with the criteria for designation as mineral resource lands. CONCURRENCY REVIEW: The proposal is exempted from water and sewer concurrency review under the Phase I-Development Regulations-Section IV (F). The Spokane County Engineer has reviewed this project for transportation concurrency and determined that it is exempt under the Phas I-Development Regulations-Section IV (B) (2) (c). ZONING ANALYSIS: The purpose of the MZ zone is to allow for the quarrying, blasting, reduction, processing and mining of minerals or materials in locations that are designated as Industrial, Rural, Semi Rural or Agricultural on the Future Land Use Plan. The intent is to ensure continued CUE-09-02 Staff Report - December 11, 2002 Public Hearing 6 • l . development of natural resources through inclusion of deposits of minerals and materials within this zone reserved for their development and production; to assure that thebest undeveloped mineral and material resources will not be lost forever by developing of the land for other purposes; to allow for the necessary processing to convert such minerals and materials to marketable products; and to assure that mining activities do not detrimentally impact the environment or surrounding land uses. Response: The proposal is generally not consistent with the purpose and intent of the Mining Zone, however, the existing Mining Zone is no longer consistent with the Heavy Industrial (HI) category of the Comprehensive Plan or the historical and planned development of the area for industrial uses. CONDITIONAL USE PERMIT ANALYSIS: The Nonconforming Use provisions of the Spokane County Zoning Code (Section 14.508) require that any expansion of a nonconforming use be approved by the Hearing Examiner through a Conditional Use Permit process. The approval of a Conditional Use Permit is governed by the provisions of Section 14.404.102 of the Spokane County Zoning Code. Response: As conditioned, the proposal generally satisfies the requirements for the approval of a Conditional Use Permit. The location of the project within a developing industrial area results in a minimal number of restrictions which are necessary to insure compatibility with adjoining land uses, existing and planned. SITE PLAN ANALYSIS: The site plan illustrates an existing warehouse with 3,930 square feet of warehouse space and 450 square feet of office space, with an addition of 3,210 square feet of warehouse space proposed. Access is provided via a single approach to Tshirley Road. Employee parking and truck loading areas are also shown. STAFF SUMMARY: As conditioned by the reviewing agencies, the proposal demonstrates general consistency with the applicable Goals and Policies of the Heavy Industrial (HI) category of the Comprehensive Plan. The proposal is not consistent with the purpose and intent of the Mining (MZ) Zone when taking into consideration the location criteria and development standards for mineral resource lands. Although the expansion of nonconforming uses is discouraged, the existing warehouse use and proposed expansion are consistent with both existing development in the area and the future development of other sites which currently retain the Mining (MZ) Zone designation. The method of sewage disposal is subject to approval of the Director of Utilities, Spokane County, pursuant to County Resolution 80.0418 adopted March 24, 1980. The topography and soils in the area are generally suitable for use of individual on-site sewage disposal systems. The lot is not of ! • I . . the proper dimensions to permit the use of both an individual well and sewage system. d) The project lies in a relatively flat area west of Tschirley Road and north of Euclid Avenue. Local drainageways are insignificant. e) Surface soils are classed by the U.S. Soil Conservation Service as Garrison gravelly loam with 0% to 5% slopes. They have a septic tank filter field limitation of slight. There is also possible contamination of groundwater. This soil would be classified as a Type IV. fl Geologically, the soils are glaciofluvial deposits. These geological structures generally yield moderate to very large amounts of water. Data from wells in the area referenced in section 1 f shows they are from 146' to 625' deep and have static water levels varying from 40' to 200' below the surface. Average domestic well production is 42.22 gallons per minute. The Consolidated Irrigation District # 19 has indicated that it can supply domestic use water for the project upon completion of agreements with the proponent. 3. Required (mandatory) Conditions If Approved: a) A combined surface water and sewage disposal detailed plan shall be approved by the Spokane County Engineer and Spokane Regional Health District prior to the issuance of any on-site sewage disposal permit or building permit for this project. b) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County. c) Water service shall be coordinated through the Director of Utilities, Spokane County. d) Water service shall be by an existing public water supply when approved by the Regional Engineer (Spokane), State Department of Health. e) Disposal of effluent beneath paved surfaces is currently prohibited. f) Subject to specific application approval and issuance of permits by the Health Officer, the use of an individual on-site sewage disposal system may be authorized. g) When the caretaker's mobile home is removed, the existing mobile home will be allowed to be placed in that location. A barrier must be placed around the existing drainfield to prevent vehicular traffic on the sewage disposal system. 4.
