Sullivan Road. PROPOSAL: The applicant requests two variances with respect to the construction of a branch bank. (A) The location of an automatic telleT machine (A1'M) 40 feet from the centerline of the Valley Way right-of-way; whereas, the Spokane County Zonuig Code considers an ATM machine to be a structure subject to setback reguladons of § 14.625.325.3 of the Zoning Code of Spokane County which require such a facility to be located a minimum of 65 feet from the centerliae of the Valley Way right-of-way. Broadway Ave. Spokane, WA 99260 RE: Request for Variance, Washington Trust Bank 407 N. Sullivan Rd. A. BURDEN OF PROOF The zoning of the site is B-2, and allows drive-through banking facilities. The right-of way for the flanking Street (Valleyway) is 40'. In a B-1 Zone the required flanking street setback for a building is 35' from the property line or 65' from the center of the right-of-way, whichever is greater. At the Pre-Development Conference the Planning Departinent determined the set back for a bank drive-through canopy is as stated in paragraph 3, of Section 14.810.160, which allows a canopy to encroach into the flanking street yazd by no more than 10'. Therefore, for this particular site, the required setback for a canopy along Valleyway is 35'. The B-2 Zone also allows for service stations. The required setback for a service station canopy in the B-2 zone per pazagraph 1, of Section 14.810.160, is a minimum of 5' to any property line. On this site, a service station canopy could be 5' from the Valleyway property line, but a bank canopy can be no closer than 35'. We are requesting a variance to allow our bank canopy the same flanking street setback that would exist for a service station on the same site. The general purpose of the Code to promote public health, safety, and general welfare is better served by approving this variance: . • . • 1. Protection of public health is enhanced. The required setback could restrict the number drive-through islands. During snow and ice conditions, this would expose more customers to the risk of injury as they walk from their car to the bank building. More drive-up islands allows more customers to bank without leaving their car, reducing a public health hazard. If the number of drive-up islaads remained, then the arrangement of public parking would change, moving them further away from the building entry. This would also increase the opportunity for public injury. 2. Protection of public safety is enhanced. One of the major benefits of a canopy is security. We have all read of thefts and muggings at automatic teller machines. A major factor to increased security is an abundance of light. The required setback could restrict the number of drive-through islands which aze covered by a canopy. This would limit the effectiveness of lighting those areas. The excellent security lighting provided under a canopy is diffl'cult to achieve with normal pazking lot lighting, and when parking lot lighting is designed to provide adequate security, the potential for unacceptable off-site glare is increased. 3. The general welfare of the public is served. Allowing the variance will allow the bank to do more with less. They will be able to serve more customers using less land area. To adequately serve their customers' needs, they require the facility as it is designed. Without the variance, they would require more land to meet that need. This wonld require more consumption of a limited resource - land. This in turn woald contribute to the overall requirement for more land to be developed, thereby indirectly reducing to the amount of land available for public pazks, playgrounds, and other necessary public uses. We believe the public's general welfare may be enhanced or harmed by the buildings which are developed. Well designed, quality buildings enhance our built environment, and generally speaking bank buildings enhance the built environment to a greater degree than do service stations. R E C I T A L S A. Pursuant to the provisions of the Revised Code of washington, RCW 3 6. 32 .120 (6) and RCW 36.75.040, the Board of County Commissioners of Spokane County has the care of County property and the management of County funds and business, including the improvement of County roads. Pursuant to RCW 35.72.010, a county may contract with owners of real estate for the improvement of county roads which the owners are obligated under county regulations to install as a condition of development. Developer is developing a commercial enterprise on the following parcel of land (hereinafter referred to as the "Property") designated as Spokane County Parcel Number 45144.1143, and more particularly described as: The South 180 feet of the East half of Tract 56, VERA, according to plat recorded in Volume "O" of Plats, Page 30, in Spokane County, Washington; EXCEPT the West 78 feet thereof; and EXCEPT the East iQ feet for Sullivan Road. D. As a condition of a building permit to be issued by SpokanE :ounty in connection with construction on the Property, Developer will be required to improve Valley Way by installing curb, sidewalk, paving and drainage control in the vicinity of the development (hereinafter referred to as the "Washington Trust Project" Construction of the Washington Trust Project will enhance access to Developer's property. E. Spokane County intends in the near future to make certain roadway improvements to Sullivan Road between Sprague and Broadway Avenues (hereinafter referred to as the "Sullivan Road Proiect") . F. Spokane County shall perform the following responsibilities: a. Prepare plans, specifications and an estimate of cost for the combined Sullivan Road/Washington Trust Bank Project, allow Developer a reasonable opportunity for review and comment on the plans for the Washington Trust Bank Project, and call for bids for a combined Washington Trust Bank Project and Sullivan Road Project. . b. Enter into a contract with the contractor subinitting the lowest responsible bid for the combined Sullivan Road/Washington Trust Bank Projects, as determined by Spokane County. c. Pay the contractor the amounts due under the combined contract, as the work is accomplished and accepted by Spokane County. d. Bill Developer f or the amount due the contractor f or the Washington Trust Bank Project under the contract referenced in paragraph lb above. PAGE - 2 ; . SECTION 2: Oblictations of Develooer. Developer shall perform the following responsibilities: a. No modification or amendment to this agreement shall be valid until the same is reduced to writing and executed with the same formalities attendant to this agreement. SECTION 4 : DisDutes. Any litigation regarding this agreement or arising out of the performance thereof shall be commenced and maintained only in competent courts of 3urisdiction within Spokane County, Washington.
