BEFORE THE SPOKANE COUNTY PLANNING DEPARTMENT
IN THE MATTER OF ) FINDINGS OF FACT,
TEMPORARY USE PERMIT ) CONCLUSIONS AND
TUE-4-91 ) DECISION
THIS MATTER, an application for a temporary use pernut, from Acme Materials and Construction Company has been received and decided upon, pursuant to the Spokane Counry
Zoning Code regulations, on the 2nd day of August, 1991.
FINDINGS OF FACT AND CONCLUSIONS
" 1. The individual signing below has further been properly delegated the responsibility for
rendering the decision by the Spokane County Director of Planning.
2. The proposal is to operate a temporary asphalt batch plant and perform rock crushing at a
Washington State Departinent of Transportarion designated surface mine. The proposed
use is in conjunction with a Washington State Deparnnent of Transporta.tion resurfacing
project for Interstate 90.
3. The proposal is generally located north of and adjacent to Spokane River east of Flora
Road in the NE 1/4 of Section 7, Township 25 North, Range 45 EWM, Spokane
County, Washington. .
4. The current zoning of the property is Light Industrial(I-2). The proposed use is of a
temporary nature and does not appear to create significant long term impacts to the
surrounding area. 5. While the current proposal is a short term project with minimal impacts to the
surrounding area, it is apparent from application documents that use of the site for si.milar
activities in the future is probable. A zone reclassification to Heavy Industrial (I-3) or
Mining Zone (MZ) may be appropriate for continued activity on this site.
6. The site is located over the Spokane-Rathdrum Aquifer. On site fuel storage will be in a
plastic lined., bermed containment area to prevent accidental spills. The risk of other
potential contarnination will be minimai and must comply with Aquifer Sensitive Overlay
Zone Standards. .
7. Portions of the site are located in designated flood zones. All on site activity is outside of
those designated areas.
8. The Spokane County Comprehensive Plan designates this area as Industrial. The
development and uses proposed are in accord with this category.
9. Surrounding uses include:
West: Existing surface mining and gravel storage.
Spokane County Anunal Control Shelter. -
North: Active railroad right of way.
Industrial.
Undeveloped industrial property.
East: Undeveloped industrial property.
South: Spokane River.
Spokane River Centennial Trail.
Developed and undeveloged residential property.
10. The site is undeveloped and covered with narive grasses and scattered tree cover.
11. The southern bound.ary of the property is adjacent to the Spokane River and is designated
as Pastoral on the Spokane Counry Shoreline Program. The proposed uses are outside
the designated 200 foot shoreline area.
12. Access to the site will be by a private gravel road to Flora Road. F1ora Road is
designated as a Principal Arterial on the Spokane County Arterial Road Plan.
13. The required public notice was provided for this proposal and agencies having a potential
interest in the project were notified and recommendations solicited.

14. Recognizing the recommended conditions and Spokane County temporary use standards,
the proposed use makes appropriate provisions for the public health, safety and general
welfare.
15. The project is'not exenapt from environmental review under the State Envi.ronmental
Policy Act pursuant to WAC 197-11-800. The Spokane County Air Pollution Control
Authority has required an environmental checklist and has issued a DNS for the project.
The Planning Department adopts the DNS for this application.
DECISION
Based upon the above noted Find.ings of Fact and Conclusions, Temporary Use
Application TUE-4-91 is hereby APPROVED. This decision is final unless appealed in
writing, consistent with adopted appeal procedures.
These Conditions of Approval apply to applicant(s), owner(s) of the
property, heirs, assigns or any successors-in-interest to property.
PLANNING DEPARTMENT CONDITIONS
1. The temporary use permit is for the properry legally described in the application for this
proposal.
2. The temporary use permit shall expire on November 2, 1991, and is not renewable.
3. Prior to commencing operations, the applicant shall verify that proper arrangements
have been made for spill containment and fire protection.
4. The applicant shall notify the Planning Department if the temporary use is terminated
prior to the expiration date of this permit.
5. The applicant shall comply with the conditions of their Spokane County Air Pollution
Control Authoriry permit.
6. All outdoor lighting on the site shall be directed away from adjoining properry.
7. Operations shall comply with the noise standards identified in WAC 173-60 and the
Spokane County Noise Disturbance Ordinance..
8. A zone reclassification application to Heavy Industrial (I-3) or Mining Zone (MZ) is
required for any future asphalt plant or rock crushing activity.
9. Compliance with the Aquifer Sensitive Area (ASA) Overlay Zone (Chapter 14.706) is
required. Facilities shall be designed so any spilled or leaked critical materials are
contained in an approved double containment system.
COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
2. An approach permit shall be obtained from the Counry Engineering Department prior to
the construction of any new driveway approaches. This shall be done prior to the
release of a building permit, change of use pernut or certificate of occupancy. 3. The regulations of the National Flood Insurance Program shall be observed, since the
subject property is affected by a flood hazard zone. A development permit shall be
obtained from the County Engineer before construction or development begins within
any area of special flood hazard (reference Spokane County Ordinance 88-0251).
. 4. The applicant shall contact Fire District No. 1 to assure that fire district access standards
and the provisions of the Fire Code are being met.

5. The applicant which may include but is not limited to State of Washington Department
of.Transportation or Acme Materials shall execute a Haul Road agreement including the
following roads: Euclid Avenue, Flora Road, Barker Road, Sullivan Road or any other
county road utilized for hauling of material from this temporary use.
COUNTY HEALTH DISTRICT CONDITIONS -
1. The drinlQng watez hauled by the water truck be from an approved, potable source; and
that portable chemical toilets be utilized for sewage disposal at the portable asphalt batch
plant site.

Dear Jay:
Thank you for sending me the information I requested abaut pit site PS-G293. The
elevations on the ultimate reclamation plan appear to be on USGS datum, the same datum
used for the 100-year flood elevations. It appears two small sections of DOT property (the
southeast corner and the southwest corner) would be affected by the flood znne. 1'he tlood
elevation for the side drainage at the southwest corner is 1972.
You will need a floodplain development permit from our office for any work (grading,
excavating, filling, paving, berm building, etc.) proposed for the flood zone. Yau will need
to show that the proposed activity will not raise the 100-year flood elevation.
I would like to meet with you to discuss the timing for your tlovdplain development permit
application anci the appropriateness of an updated environmental review.

The Board of Adjustment, hereinafter referred to as the 'Board", having held a public hearing
on November 8, 1991, and having fully considered all testimony, as well as File # TUE-4-91,
does hereby make the following:
PROJECT DESCRIPTION: The applicant requested a Temporary Use Permit to operate a
temporary asphalt batch plant and rock crushing facility at a Washington State Department of
Transportation designated surface mine. Chapter 14.510.000 of the Spokane County Zoning
Code provides for Temporary Uses, which may be granted by the Planning Department in the
form of a temporary and revocable permit, for not more than a 6 month period. Authority to
consider an appeal of an administrative decision provided for by Chapter 14.510.000 exists
pursuant to Chapter 14.412.041 of the Spokane County Zoning Code.
PROJECT LOCATION: Generally located north of and adjacent to the Spokane River,
east of Flora Road, in the NW 1/4 of Section 7, Township 25N, Range 45 EWM, Spokane
County Washington.

FINDINGS OF FACT AND CONCLUSIONS
1. The proposal is as described above, and in detailed information contained in the
2. The adopted Spokane County Comprehensive Plan designates the subject property
as Industrial. The uses proposed are in accord with this category.

3. The current zoning of the property is Light Industrial (I-2), which allows the
proposed use upon approval of a Temporary Use Permit .
4. The existing land uses in the area surrounding the proposal include surface mining
and gravel storage, Spokane County Animal Control Center, railroad right of way,
undeveloped industrial properties, Spokane River, and single family dwellings.
5. The site is undeveloped and covered with mature grasses and scattered tree cover.
6. The southern boundary of the property is adjacent to the Spokane River and is
designated as Pastoral by the Spokane County Shoreline Program. The proposed use is
outside the designated 200 foot shoreline area.
7. Access the property will be provided by a private gravel road to Flora Road. Flora
Road is designated as a Principal Arterial by the adopted Spokane County Arterial Road Plan.
8. Portions of the site are located in designated flood zones. All on site activity is
outside of these designated areas.
9. The project is not exempt from environmental review under the State Environmental
Policy Act pursuant to WAC-197-11-800. The Spokane County Air Pollution Control
Authority required an environmental checklist and issued a determination of non -significance
"DNS" for the project and the Planning Department adopted the "DNS" issued by the Spokane
County Air Pollution Control Authority for this project. Since the Spokane County Air
Pollution Control Authority assumed lead agency status for the environmental review, the
Board makes no finding in regard to the issuance of a "DNS" for the proposal.
10. The proper legal requirements for advertising of the hearing before the Board of
Adjustment of Spokane County have been met.
11. As explained in a letter to the file (TUE-4-91) dated August 14, 1991, the Planning
Department erred in providing notice to adjacent property owners as required by Chapter
14.514 of the Spokane County Zoning Code. Therefore, additional public notice of the
Planning Department's Decision on the Temporary Use Permit was provided pursuant to
Chapter 14.514 of the Spokane County Zoning Code and the 20 day appeal period began on
August 14, 1991.
12. Pursuant to Chapter 14.512 of the Spokane County Zoning Code, Jelmer E. Blum
filed and appeal of the Planning Department approval of the Temporary Use Permit. The
appeal was filed on September 3, 1991.
13. Pursuant to Chapter 14.412.041 of the Spokane County Zoning Code, a public
hearing was scheduled before the Spokane County Board of Adjustment for the appeal of the
Temporary Use Permit (TUE-4-91). The public hearing was scheduled for October 16, 1991,
and due to unusually adverse weather conditions caused by the "Firestorm", the public hearing
was continued to November 8, 1991. The Temporary Use Permit (TUE-4-91) approved by
the Planning Department on August 2, 1991, expired on November 2, 1991, and was non-
renewable. The continued hearing date of November 8, 1991, essentially makes the appeal of

the Temporary Use Permit moot. To afford the appellant all procedural due process, the public
hearing was held on November 8, 1991.
14. Adverse public testimony and written comments were received from area residents
regarding the proposal. Neighborhood opposition to the Temporary Use Permit (TUE-4-91)
and subsequent uses focused on the environmental hazards generated by the proposal such as
excessive noise, dust emissions, emissions from asphalt batch plant, impact on flood plain and
the Spokane-Rathdrum aquifer. The opponents also cited instances of non-compliance with
noise and emission regulations.
CONCLUSIONS
1. Temporary uses are provided for by Chapter 14.510 of the Spokane County
Zoning Code, for not more than a 6 month period.
2. The appeal of the planning Department approval of the Temporary Use Permit
(TUE-4-91), was filed within the specified 20 day appeal period, and the issue of mootness
arose due to no fault of the applicant or appellant.
3. Objections from area property owners to the Temporary Use Permit (TUE-4-91)
and subsequent activities are valid concerns and the "Board" recognizes the need to protect area
amenities and the public interest. However, these concerns do not invalidate issuance of the
Temporary Use Permit (TUE-4-91). Non-compliance with conditions of approval for the
Temporary Use Permit or other environmental regulations are not at issue before the "Board"
and are a separate issue to be processed thru applicable enforcement procedures.
DECISION
From the foregoing Findings and Conclusions, the Board of Adjustment DENIES
the appeal of the Temporary Use Permit for an asphalt batch plant and rock crushing operation,
and in doing so, adopts the following:
CONDITIONS OF APPROVAL
I. PLANNING DEPARTMENT
1. The temporary use permit is for the property legally described in the application for this
proposal.
2. The temporary use permit shall expire on November 2, 1991, and is not renewable.
3. Prior to commencing operations, the applicant shall verify that proper arrangements
have been made for spill containment and fire protection.

4. The applicant shall notify the Planning Department if the temporary use is terminated
prior to the expiration date of this permit.
5. The applicant shall comply with the conditions of their Spokane County Air Pollution
Control Authority permit.
6. All outdoor lighting on the site shall be directed away from adjoining property.
7. Operations shall comply with the noise standards identified in WAC 173-60 and the
Spokane County Noise Disturbance Ordinance..
8. A zone reclassification application to Heavy Industrial (I-3) or Mining Zone (MZ) is
required for any future asphalt plant or rock crushing activity.
9. Compliance with the Aquifer Sensitive Area (ASA) Overlay Zone (Chapter 14.706) is
required. Facilities shall be designed so any spilled or leaked critical materials are
contained in an approved double containment system.
II. COUNTY ENGINEER'S DEPARTMENT CONDITIONS
1. The word "applicant" shall include the owner or owners of the property, his heirs,
assigns and successors.
2. An approach permit shall be obtained from the County Engineering Department prior to
the construction of any new driveway approaches. This shall be done prior to the
release of a building permit, change of use permit or certificate of occupancy.
3. The regulations of the National Flood Insurance Program shall be observed, since the
subject property is affected by a flood hazard zone. A development permit shall be
obtained from the County Engineer before construction or development begins within
any area of special flood hazard (reference Spokane County Ordinance 88-0251).
4. The applicant shall contact Fire District No. to assure that fire district access standards
and the provisions of the Fire Code are being met.
5. The applicant which may include but is not limited to State of Washington Department
of Transportation or Acme Materials shall execute a Haul Road agreement including the
following roads: Euclid Avenue, Flora Road, Barker Road, Sullivan Road or any other
county road utilized for hauling of material from this temporary use.
III. COUNTY HEALTH DISTRICT CONDITIONS
1. The drinking water hauled by the water truck be from an approved, potable source; and
that portable chemical toilets be utilized for sewage disposal at the portable asphalt batch
plant site.
