1. REQUEST FOR RECONSIDERATION
On Apnl 17, 2000, the Heanng Examiner adopted Fmduigs of Fact, Conclusions
of Law and Decision approving the above-referenced condirional use pemut for a home
industry, to allow operanon of a chimney and masonry contracting busuless in the
existing Urban Residential-3 5(tTR-3 5) zone
County Planrung condition #14 of the decision reqwred the apphcant to uistall at
least 10 feet of Type I landscaping along the north boundary of the site, and along the
northerly 75 feet of the east boundary, except to a11ow a reduchon in such landscaping
along the easterly boundary to 5 feet where adjacent to the existing shop building.
Planiung condrtion #7-10 also contauied special reqiurements related to the storage or
parlcuig of company vehicles on srte, the placement and screening of outdoor storage, the
loading and unloacimg of equipment, and UPS dehvenes to the site
On Apn124, 2000, the apphcant submitted a letter with attachments requeshng
some relief from the landscapmg requirements m Planning condihon #14, and indicatuig
that the applicant had removed the matenals stored along the east side of the shop
bulld.ing, and that the apphcant had moved velucles parked along the north property luie
to the west side of the shop This letter was circulated along with a cover letter from the
Exanuner to the owners of property borderuig the site on the north and east, who had
appeared at the pubhc heanng and subirutted letters or documents m opposition to the
proposal Such owners, the Groesbecks and Frances Luden, responded m wnting to the
applicant's request for reconsideration See letter dated 5-12-00 with attachment from
Frances Luden, and letter dated 5-11-00 with attachments from David and Marci
Groesbeck
The applicant subrrutted a response to the Luden and Groesbeck letters on May
17, 2000 In such letter, the applicant agreed to 1) install 5-foot tall arborvitae (36-inch
centers, 42 inches from property line) along the entire north boundary, from the northeast
corner of the slte to the northwest corner, 2) install6-foot tall arborvitae along the east
boundary (36-mch centers, 36 inches firom Luden fence), from the northeast comer of the
site to a point 36 inches south of the northeast comer of the shop building, 3) maintain the
area behind the shop building, west of the Luden fence, as dead space, wnthout any
storage, 4) maintain all outdoor storage at a level less than 5 feet tall or the shrub line

after planting the arborvrtae, and 5) park all velucles either in the shop or west side of the
shop, except for personal vehicles not taller than the arborntae luie, and vehicles or
recreational equ.ipment for personal use (i.e boat, snowmobiles, lawn tractor).
The apphcant's response also mdicated that the apphcant plans to construct a
lean-to shed awning, matclung the existing shop color and style, within the next 6
months
H. ANALYSIS
Secnon 17 of the Heanng Exammer Rules of Procedure, adopted by County
Resolution No 96-0294, authonzes the Heanug Examiner to reconsider or clanfy a final
decision to address excephonal cucumstances The Exammer finds that such
circumstances exist, consideruig the addition of condrtions of approval which the
applicant and others did not have a chance to respond to dunng the public hearulg
process
After reviewing the vanous posirions of the pames, the Examiner generally agrees
with the apphcant's final proposal The Exanuner's maui concerns wlth regard to the
addihonal landscaping imposed by Planrung condihon # 14 is to completely screen any
outdoor storage of matenals used in the business from view by adjacent properties, and to
linut the parking of business velucles, pamcularly any oversized velucles, near adjacent
property lines If the space between the existuig shop building and the Luden fence is left
vacant, and the storage on the north side of the shop is kept below the arborvitae line,
then the applicant's proposal is reasonable
The apphcant's letter is somewhat ambiguous regarduzg the parksng of personal
velucles which may also be used for commercial use At the public hearing, the applicant
indicated that he had one such vehicle, a new Chevrolet pickup Such velucle is counted
in the maximurn number of company velucles (3) allowed under Plaruung condition #7
The Exammer would allow one such vehucle to be parked somewhere beside the west side
of the shop, provided rt is not visible over the penmeter landscapmg or fencing
The Exammer has modified the Planrung condihons of approval to unplement the
applicant's final proposal The Exammer has also extended the appeal penod to
accommodate the request for reconsideration
The apphcant is cautioned that the proposed lean-to must not increase the gross
floor space of the home industry so that it exceeds twice the gtoss floor space of the
footpnnt of the existing residence, although space added stnctly for storage as opposed to
operations is usually not included in the gross floor calculation

The apphcant is reminded that the purpose of the additlonal landscapmg is to
preserve the residential appearance and character of the property, comply vrnth the storage
screenuig requuements for a home industry, and to buffer adjouung residenfiial properties
from the more commercial aspects of the proposal Wrthout the addihonal conditions
imposed by the Exammer, the Exammer would have denied the apphcation The
neighbor's concerns are perfectly jushfiable, and the applicant is well advised to adopt a
more concihatory attrtude toward such concerns than mdicated by the comments in his
most recent letter
III. ORDER
Based on the above findings and conclusions, it is hereby ORDERED that the
Findings of Fact, Conclusions of Law and Decision dated Apnl 17, 2000 in the above-
entitled matter be revised as follows
A Division of Planrung condition #7 is revised to read "The number of company
vehicles, including any vehicles used for both personal and business use, shall not exceed
three (3) m number, and shall be kept uiside the e-Tzsnng shop burldang as much as is
practical No more than two (2) outside employee velucles may access or park on the site
dunng the day All company and outside employee vehrcles shall be parked in the shop
or along the west side of the shop, provided that one vehicle used by the applrcant for
both personal and bustness use may be parked elsewhere on the site as long as such
vehicle is not taller than the height of the arborvitae hedge required by Planning
condttaon #14 below "
B Division of Planning condition #8 zs revised to read. "All outdoor storage shall be
kept to a minimum, placed outside the required yard setbacks for accessory uses, and
completely screened from view from adjoining properhes All such outdoor storage
shall be placed along the north stde of the exrsting shop buildrng and kept below a height
of S feet or below the height of the arborvitae hedge requrred by Planning conditYOn #14
No buszness achvtty or storage shall take ptace along the east sade of the shop building "

of the stte, with the center of each shrub planted no more than 36 inches apart and at a

Dear Mr Dempsey please accept what we hope will be a final resolution in this
nagging matter over arborvitae placement. We propose the following so we can
move on in our day to day lives. (SEE DR.AWING AND RCUGH SKETCH ATTACHED)
A) Plant 5' tall Arborvitae from west corner to east corner of north boundary
36" apart and 42" from property liLne.
B) Plant 6' tall Arborvitae from North boundary going south to 3ust behind the
existing shop 36" in behind, and leave fence on Luden lot #2 sight obscuring
(Even though this is viewing my personal back yard in our personal yard area).
C) Vehicles( Z Each) will be parked either in the S'nop or at the west side of
,%--he shop unless they are of my personal use or recreational I.E. Boat,
Snowmobiles, lawn tractor or any of my personal vehicies that are not taller
than the Arborvitae line. I will be perfornung vehicle maintenance on weekends
and some loading and unloading of materials as I dc now for brief periods of
time.
D) All materials will be kept at a level less than .55' tall or shrub line after
planting and will not exceed line as they grow. Until they grow taller the
materials will not exceed 5' in height. I also intend to build a enclosed
lean-to shed-awning-that will match existing shop color and style hopefully
with in the next 6 mo.
We will follow the County requirements in doing so.
E) Area behind shop will stay vacar.t and there will be no employees walking
behind shop unless they are doing buildl.ng repair or area clean up. In
addition we will not be and are not currently storir_g any business related
items behind shop. This will be dead space.

Our landscaper has advised us that the time for pianting Arborvitae is comir.g
to and end season wise for a healthy plant start and that selection is also
thinning out as well. He also has advlsed me that the industry standard is
that the Shrubs come in 4' -5` sizes and 5' -6' sizes there is not a perfect 5'
or 6' batch of trees. So some varlatian will need to be accepted in thls
proposal. We would also like to point aut that this type of landscaping is for
commercial lots and Commercial buildings which we are not, and that this
little adventure that we are going on is to purely satisfy the neighbors at a
very larqe expense to us.
Assuming that you have the final say in this matter we would Iike your
approval as soon as possible so we can proceed with our planting and can stop
wasting your time and ours.
Yau are also weleame to visit our site during this process as I Gm sure that
you will find it acceptabl.e for what I propose to do.

Comments received are general in nature and in the form of recommended conditions of approval. Spokane
County Fire District #1 is requesting that access to the rear of the site be kept clear for emergency
purposes. The Spokane County Division of Engineering and Roads is requesting that a strip of property 20
feet in width along the site frontage be set aside as Future Acquisition Area (FAA) for future improvements
to Broadway Avenue.

DescriAtion of the Site: ,
The subject property is approximately 30,000 square feet in size and contains an existing single family
residence, detached garage and detached shop. The site is accessed from Broadway Avenue. The site
plan illustrates the existing residence to be approximately 990 square feet in size and the shop to be
approximately 1300 square feet in size. Building permit records for the subject address show the detached
shop to be approximately 1830 square feet in size. The rear yard is enclosed by a six (6) foot high cyclone
fence with sight obscuring slats. The subject property is nicely landscaped and contains a gravel parking
area for vehicles near the north end of the site. The applicant is currently running a chimney and masonry
business from the detached shop. Surrounding uses include single family residences on similarly sized lots
with an elementary school located to the southeast of the site on Broadway Avenue and Progress Road.
Backqround:
The applicant was notified on October 26, 1999, by the Division of Building and Planning that the existing
business was a zoning violation (file # G-343-99) and advised to apply for a Conditional Use Permit for a
home industry. The application for the proposal was submitted on January 12, 2000, and was determined to
be technically complete on February 16, 2000. The Notice of Application was also circulated on Febnuary
16, 2000. The applicant has stated that the proposed Home Industry consists of a chimney and masonry
business and that most of the related business takes place off of the site. The detached shop is used as a
business office, and as storage for business related materials and three company vehicles. The applicant
has stated that there are frequent deliveries of materials to the site, and that the business also employs a
maximum of two unrelated employees who visit the site.

Site Plan: '
The site plan submitted by the applicant illustrates an existing residence, a detached garage, and a '
detached shop. The applicant has stated that the proposed Home Industry currentty takes place within the
detached shop. Spokane County Assessor's records identify the size of the existing home as approximately
990 square feet. The site plan illustrates the size of the existing shop to be approximately 1300 square feet,
however the building permit file for the subject site contains information stating that the existing shop is
approximately 1830 square feet in size. The rear yard of the subject property is screened from the view of
adjacent properties by an existing six (6) foot high cyclone fence with sight obscuring slats. The site plan
illustrates a gravel parking area located in the rear yard.
Staff Analvsis:
Comprehensive Plan:
The site is Iocated within the Urban category of the Comprehensive Plan. The Urban category is intended to
provide the opportunity for the development of a"citylike' environment which includes various land uses,
intensive residential development, and public facilities and senrices. The Urban category states that the
more intensive uses such as light industrial and neighbofiood commercial should be located near the
heavily travefed streets, with the less intensive uses such as residential isolated from the noise and traffic.
The Urban category indicates that buffering, screening, or other performance standards may be required to
make potentially conflicting land uses compatible. Decision Guideline 1.1.4 states that "a variety of
residential uses should be available to provide a freedom of choice to live in Urban areas with varying
densities, combinations, or mix of uses.° Objective 1.1.i states that " Home occupations may be allowed
provided they are non-disruptive of neighborhood amenities" and is followed by Decision Guidelines 1.1.7
which lists criteria to be considered prior to the approval of a home occupatian. These criteria state that a
proposed home occupation will not disrupt surrounding residential amenities, create traffic which exceeds
the capacity of the surrounding road systems, or negatively affect the intended uses of the Urban category.
The proposed Conditional Use Permit for a Home Industry is consistent with these criteria in that the use
does not affect the surrounding residential uses, does not create a traffic impact and will not affect the
recommended uses of the Urban category. Decision Guidelines 1.5.1 and 1.5.2 require the use of buffering
to mitigate the impacts between proposed and existing uses. The site currently contains landscap+ng in the
form of large trees and shrubs and contains a six (6) foot high cyclone fence with slats surrounding the area
of the property where the existing business is located. Decision Guidefine 1.6.1 states that before land use
proposals are approved they should conform to County plans addressing public water and sewer, and to
traffic plans. The site is currently served by public water and sewer and does not affect existing
transportation plans. The Spokane Cvunty Division of Engineering and Roads is requesting that the a strip
of property 20 feet in width along the frontage of the site be set aside as a Future Acquisition Area (FAA) in
order for the proposal to conform to the Spokane County Arterial Road P{an.
The Urban category does not specifically recognize a Home Industry, however, a Home Industry is similar to
a home occupation and is an allowed use in the Urban Residential-3.5 (UR-3.5) zone provided the applicant
applies for and receives a Conditional Use Permit.
As proposed, the application for a Conditional Use Permit for a Home Industry is consistent with the Goals,
Objectives and Decision Guidelines of the Urban category of the Comprehensive Plan.
Zoning Analysis:
The proposal is located in the Urban Residential-3.5 (UR-3.5) zone and the purpose of the Urban
Residential-3.5 (UR-3.5) zone is to implement the lower density range of the Urban category of the
Comprehensive Plan. The intent of this zone is to promote areas of primarily single-family residential use in
an urbanized neighborhood setting, having a high level of public services. A Home Industry is an allowed
use in the Urban Residential-3.5 (UR-3.5) zone provided the applicant applies for and is granted a
Conditional Use Permit and demonstrates compliance with the Conditional Use Permit criteria of the
Spokane County Zoning Code. Sections 14.404.101 and 14.616.240(4) of the Spokane County Zoning
~ Code identify the criteria governing the approval of a Conditional Use Permit for a Home Industry.

' Section 14.404.101 of the Zoning Code states that before a Conditional Use Permit is approved, the He2rira
Examiner shall find that 1). Adequate conditions and restrictions are attached to the development of the
property to ensure that the proposed use will be compatible with uses permitted outright in this Icca±icn;
2). The special standards as outlined in the Zoning Code for the underlying zone Shall

identified in Section 14.616.240(4) is as follows:
• Section 14.616.240(4)(a): The property shall retain its residential appearance and character;
Response: The subject property is a large residential lot that is landscaped and maintained. The existing
use occurs in an existing detached shop located in the rear yard, and buffered from adjacent residences
because of its location, existing fencing and landscaping. The applicant appears to have an outside gravel
storage area for vehicles however, the storage area is enclosed by a privacy fence.
• Section 14.616.240(4)(b): The use shall be carried on in a primary residence or may be allowed in
accessory, detached structures which are not, in total, larger than two (2) times the gross floor area of the
primary residence;
Response: The applicant has stated that the Home Industry will be camed out in an existing detached
storage structure that is identified on the site plan as a"shop and office". County records approximate that
the gross floor area of the primary residence is 990 square feet and building permit records indicates that
the existing shop is approximately 1830 square feet in size. The existing detached shop is not larger than
two (2) times the gross floor area of the primary residence.
• Section 14.696.240(4)(c): Only members of the family residing on the premises, and no more than two
(2) employees outside of the family, may be engaged in the Home Industry.
Response: The applicant has stated that only members of the family residing on the premises and no more
than two (2) outside employees will be engaged in the proposed Home Industry.
' Section 14.616.240(4)(d): One (1) sign identifying the Home Industry shall be unlighted and may be
attached or detached and shall be a maximum of four (4) square feet on a~face.
Response: There are no proposed signs illustrated on the site plan or currently existing on the site.
• Section 14.616.240(4)(e): Window or outside displays may be allowed as approved by the Hearing Body.
Response: There are no proposed window or outside displays.
• Section 14.616.240(4)(t): There shall be no stock stored nor commodity kept for sale on the premises
which is not necessary to the occupation, profession, or craft.
Response: The applicant has not proposed any items to be stored on the site for sale which is not
necessary to the proposed Home Industry.
• Section 14.696.240(4)(g): All material or mechanical equipment shall be used in such a manner as to be
in compliance with WAC-173-60 regarding noise.
Response: No physical measurement of sound levels have been taken which indicate noise levels do or do
not exceed the 55 dBA limitation as required by WAC 173-60 for residential properties. The application does
not state that there will be any mechanical equipment used in carrying out the proposed Home Industry.
• Section 14,616.240(4)(h): Parking, traffic, and storage requirements shall be as approved by the Hearing
Body.

Response: Section 14.404.102 allows the Hearing Examiner to attach additional restrictions and conditions
to make the proposed Home industry compatible with adjoining land uses. •
• Section 94.616.240(4)(i): All storage areas shall be enclosed or completefy screened from view by a
maximum six foot-high sight obscuring fence meeting accessory use setback requirements.
Response: The applicant has proposed to store business related items either within the existing shop or
behind the existing privacy fence.
Summary
As proposed, the Conditional Use Permit for a Home Industry meets the minimum criteria as listed in Section
14.616.240(4) (a-i) of the Spokane County Zoning Code, is consistent with Urban category of the
Comprehensive Plan and is compatible with adjacent land uses.

1. All conditions imposed by the Hearing Examiner shall be binding on the "Applicant", which
term shall include the owner or owners of the property, heirs, assigns and successors.
2. The proposal shall comply with the Urban Residential-3.5 (UR-3.5) zone, specifically
Section 14.616.240(4) and all other applicable chapters of the Spokane County Zoning
Code, as amended. I
3. The applicant shall develop subject property in strict conformance with the site plan
presented to the Hearing Examiner on April 12, 2000. All aspects of the concept and
proposal shall be binding on the development, including proposed use. Variations, to be
approved by the Director of the Division of Planning/designee, shall only be allowed to I
meet regulation standards and conditions of approval. Any other modification must be
presented to the Hearing Examiner for review and approval.
4. The Division of Planning shall prepare and record with the Spokane County Auditor a Title
Notice noting that the property in question is subject to a variety of special conditions
imposed as a result of approval of a land use action. This Title Notice shall serve as
public notice of the conditions of approval affecting the property in question. The Title
Notice should be recorded within the same time frame as allowed for an appeal and shall
only be released, in full or in part, by the Division of Planning. The Title Notice shall
generally provide as follows:
The parcel of property legally described as is the subject of a land use
action by a Spokane County Hearing Examiner on April 12, 2000, imposing a variety
of special development conditions. File No. CUE-1-00 is available for inspection
and copying in the Spokane County Division of Planning. ~
5. The Spokane County Division of Building and Planning shall prepare and record with the
County Auditor a Title Notice specifying a future land acquisition area for road right-of-way
and utilities. The Title Notice shall state the following:
a. A strip of property 20 feet in width from the existing right-of-way is reserved for future acquisition area for additional road right-of-way width along Broadway Avenue.
b. Future building and other setbacks required by the Spokane County Zoning Code shall
be measured from the reserved future acquisition area.

c. No required landscaping, parking, `208' areas, drainfieid or aliowed signs shouid be .
located within the future acquisition area for road right-of-way and utilities. If any of ,
the above improvements are within the area, they shall be relocated at the applicant's
expense when roadway improvements are made.
d. The future acquisition area, unit acquired, shall be private property and may be used
as allowed in the zone, except that any improvements (such as landscaping, parking,
surface drainage, drainfield, signs or others) shall be considered interim uses.
e. The property owner shall be responsible for relocating such "interim" improvements at
the time Spokane County makes roadway improvements after acquiring said future
acquisition.

Studv. The method of sewage disposal is subject to approval of the Director of Utilities, Spokane
Countv, pursuant to County Resolution 50.0418 adopted March 24, 1980. The topoaraphy and soils in
the area are Qenerally suitable for use of individual on-site sewaQe disposal svstems. The lot is not of

the proper dimensions to permit the'use of both an individual well and sewage system.
d) The project lies in a relatively flat area east of Burns Road and north of Broadway Avenue. Local
drainageways are insignificant.
e) Surface soils are classed by the U.S. Soil Conservation Service as Ganrison gravelly loam with 0% to
5% slopes. They have a septic tank filter field limitation of slight. There is also possible
contamination of groundwater. This soil would be classified as a Type IV.
fl Geologically, the soils are glaciofluvial deposits. These geological structures generally yield moderate
to very large amounts of water. Data from wells in the area referenced in section 1 f shows thev are
from 81' to 240' deep and have static water levels varying from 50' to 158' below the surface. The Vera
Water and Power has indicated that it can supply domestic use water for the project upon completion
of agreements with the proponent.
3. Required (mandatory) Conditions If Approved:
a) Sewage disposal method shall be as authorized by the Director of Utilities, Spokane County.
b) Water service shall be coordinated through the Director af Utilities, Spokane County.
c) Water service shall be by an existing public water supply when approved by the Regional En~ineer
(Spokane), State Department of Health.
d) A public sewer system will be made available for the project.

The Spokane County Engineering Department has reviewed the above referenced application. The
following "Conditions of Approval" are submitted to the Spokane County Planning Department for
inclusion in the "Findings of Fact, Conclusions and Order/Decision" should the request be approved.
Prior to release of a building permit or use of property as proposed:
1. Roadway standards, typical roadway sections and drainage plan requirements are found in
Spokane Board of County Commissioners resolution 95-0498 as amended and are applicable to ~
this proposal.
2. The County Arterial Road plan identifies Broadway Avenue as a 100 foot Principal Arterial. The
existing right of way width of 30 feet is not consistent with that specified in the plan. In order to
implement the Arterial Road Plan it is recommended a strip of property 20 feet in width along thE:~
Broadway Avenue frontage be set aside in reserve. This property may be acquired by Spokan(--
County at the time when Arterial Improvements are made to Broadway Avenue.
3. The applicant should be advised that an approach permit must be obtained from the Spokane
County Engineer Department prior to the construction of any new driveway approaches. This
must be done prior to the release of a building permit.

We are mostly seasonal, Our busy season in Sept-Dec of each year at which time
we employee a couple more people from outside the family.
We Dispose of our own debris once per week in a trailer at the 1occ-3.i _land fi.l.l
on Sullivan road. We do not dispose of any hazardous waste or chemicals of any
kind.
We Now have 3 Co. vehicles on site 2 0` which are parked inside the shop at
night and on weekends- Holidays.
Our Lot is secured and Private due to a 6" Privacy Fence Just installed 2 Mo
ago At a very costly expense.
We employ 2 Family members and 2 outsiae employees who usually carpool
together to minimise traffic to shop area.
we have also improved the appearance of the shop and grounds by ir_vesting
nearly 6000.00 into renovation and beautification to please the neighbours
around us.
We will have Frequent Ups deliveries and some express deliveries to our home
or shop.
We will on occasion have a large delivery delivered to our shop of masonry
supplies ( Nlaybe once per year.} Mostly we go get our stuff ourselves.

THIS MATTER, a request for a Nonconforming Use Determination from Roland
and Virginia Fox, has been received and decided upon pursuant to Section
14.508.040 of the Spokane County Zoning Code, on the 13th day of October,
2000.
FINDINGS OF FACT AND CONCLUSIONS
1. The individual signing below has been properly delegated the responsibility
for rendering this decision by the Director of the Spokane County Division
of Planning.
2. The applicant has requested a Nonconforming Use Determination to
confirm the lawful, nonconforming establishment a 5-unit apartment
complex within the Urban Residential-3.5 (UR-3.5) zone.
3. The subject property is located at 505 North Progress Road, in the
Southeast quarter of Section 14, T 25 N, R 44 EWM.
4. The surrounding land uses are primarily single family and duplex
residences.
5. The site is presently zoned Urban Residential 3.5 (UR-3.5), which does not
permit multiple family dwellings beyond duplexes. The pre-1991 zoning of
the property was Agricultural-Suburban (AS), which also did not allow
multiple family dwellings beyond duplexes.
6. Documentation submitted with the application establishes 1936 as the
earliest date that the property was known to have been used as a multi-
family rental. Since building permits were not required prior to 1950, the
exact date of the conversion from a large residence to a 4-unit apartment
building cannot be determined. The fifth dwelling unit was a detached
garage converted to residential use in 1957 under Permit # C-3581.
7. On September 21, 2000, the completed application for a Nonconforming Use
Determination was filed.
8. The prvposal is exempt from the pravisions of the Washingtan State
Environmenta! P4ticy act, Chapter 43.21 C RCW pursuant to VIIAC 197-1 'i -
800 (1 )(c)(i) and the Spokane Environmental Ordinance 11 .'I Q.07Q (I)(a).
9. The Division of Planning finds that vnly vne conditian of apprvval is
necessary to safeguarci t'he public heafth, safety, and general welfare.
