STAFF REPORT ON VARIANCE APPLICATION
FILE NO. VE-11-96
1. SUMMARY OF REQUEST AND RECONTMENDATION: Variance request
to allow a 20'-0" front yard setback, whereas Section 14.618.325 (1) of the
Spokane County Zoning Code requires a 25'-0" setback from the lot front line.
The variance is being requested in order to receive building permit approval for an
existing manufactured home as it is currently located on the subject site.
NOTE: The subject site was created upon approval of Barker Road Mobile
Homes First Addition subdivision (file no PE-709A-69) and Zone
Reclassification (file no. ZE-47A-69) from Agricultural (A) to the Residential Manufactured Home (RNIH) zone in 1969. The subdivision was approved for the
development and sale of individual lots for single family/manufactured home
development and is not considered a manufactured home park. Therefore, special
setbacks applicable to manufactured home park developments do not apply to the
site.
Recommendation: Staff recommends that the variance request be approved.
II. GENERAL INFORMATION:

C. Location: The subject site is generally located south of and adjacent to
Marlin Drive, approximately 150 feet west of McMillan Road in the NW 1/4
of Section 8, Township 25 North, Range 45, EWNi, Spokane County,
Washington.
D. Existing Zoning: Urban Residential-7 (UR-7).
E. Land Use Plan Designation: The subject property is located within the
Urban category of the Spokane County Generalized Comprehensive Plan.
F. Environmeatal Review: The proposal is exempt from environmental
. review pursuant to WAC 197-11-800 2 b and Spokane Environmental
Ordinance 11.10.070.
G. Enabling Zoning: Chapter 14.404.080 (Variance) of the Spokane County
Zoning Code.

III. FINDINGS OF FACT
A. Site Description: The subject site consists of a relatively flat, rectangular
shaped lot approximately 9,750 square feet in size. The site is developed as
a single family residential lot with all necessary services in place. The site
is partially fenced and is currently occupied by a manufactured home and
storage shed.
B. Project Description: If approved, the variance would allow the existing
manufactured home to remain on site in its current location with a front yard
setback of 20'-0", whereas Section 14.618.325 (1) of the Spokane County Zoning Code requires a 25'-0" setback from the lot front line.
C. Adjacent Zoaing: Urban Residential-7 (LJR-7).
D. Adjacent Land Uses: Land use within the vicinity is dominated by single family residential/manufactured home development.
E. Adjacent Road System: The subject site is located south of and adjacent to
Marlin Drive. Marlin Drive is identified by the Spokane County Arterial
Road Plan as a local access street.
F. Applicable Zoning Code Regulations: Chapter 14.618, Section
14.618.325 (1); Urban Residential-7 (UR-7) Minimum Front Yard Setback
development standard.
G. Applica6le Variance Criteria: Chapter 14.404.080 of the Spokane County
Zoning Code.
IV. DEPARTMENT REVIEW/REPORTS
Notice of this variance request was sent to various county departments and outside
agencies of jurisdiction. Copies of reports/responses from agencies who
responded to the notice are attached to and made part of this report by reference.
V. VARIANCE ANALYSIS
In order to be approved, a variance must comply with the conditions and
requirements specified by Section 14.404.082 of the Spokane County Zoning
Code. The follovuing description identifies how the proposed variance complies
with the above-cited conditions and requirements.

Response 1 a. The applicant has demonstrated that special circumstances
applicable to the subject property may warrant the granting of the variance
request. The applicant, unaware of the lack of valid building permit approval for
the existing manufactured home, purchased the subject site fully developed
including the existing manufactured home, septic system, provisions for public
water, fencing, landscaping, parking areas and decks.
Strict application of the Urban Residential-7 (UR-7) zone front yard setback
requirements would require the relocation of the manufactured home on the
subject site. Extensive site renovation/improvements would be required including
relocation of plumbing, existing fencing, water and electrical lines, etc. in order to
bring the proposal into compliance with the Spokane County Zoning Code.
Response 1 b. The granting of the variance will not be materially detrimental to
the public welfare nor injurious to the property or improvements within the
vicinity or zone in which the subject site is located.
Response Z a. Strict application of the Zoning Code, specifically Section
14.618.325(1) does create an unreasonable burden on the applicant. The applicant's
answer to question "C" on the Burden of Proof form/application indicates the
property owner, Cindy Rudolf, purchased the property with the existing
manufactured home in its' current location. Moving the home would be extremely
costly to the owner. Cost of site and structure renovations/improvements needed to
relocate the home on the subject site has been estimated to be between $7,000.00
and $10,000.00.
Also, the applicant's answer to question "F" on the Burden of Proof
form/application notes relocation of the home may be difficult due to the existing
location of the septic system on the subject site. The applicant continues to note
the home could be moved if the variance request is denied. However, denial of
the variance would not preclude reasonable use of the site as evidenced by
previous building permit approval for the placement a single-wide manufactured
home on the site in 1970. Also, many existing homes located within the vicinity
of the subject site do comply with the front yard setback required in the Urban
Residential-7 (UR-7) zone.
Response 2 b. Relaxation of the Urban Residential-7 (UR-7) front yard setback
standard does not contribute to a more environmentally sensitive, energy
conserving design or result in the adaptive reuse of an historic property;
Response 2 c. The broader public interest will not be served by granting the
variance. The applicant has not met this criteria.
Response 3 a. The applicant's response to question "E" on the Burden of Proof
form/application specifically states, "There are other mobile homes in the mobile
home park that are closer to the road than 25 feet". However, staff review of
variance requests for properties located within the vicinity of the subject site has
found that no property owners have requested or received approval to deviated
from the Urban Residential-7 (UR-7) front yard setback requirements. Approval
of a variance should not consider or be based upon precedence established by non-
confornung or illegal uses.

Response 3 b. Granting the variance request could establish a precedent in the
area when considering the temporary nature of manufactured homes and the
frequency of relocating homes on lots located within Barker Road Mobile Homes
First Addition subdivision.
The applicant's answer to question "F" does indicate the home could be moved if
the variance is not approved, although it would be costly. The site is large enough
to accommodate a manufactured home the size of the existing residence while
meeting all setback requirements of the Urban Residential-7 (UR-7) zone.
If the variance is approved, staff recommends the Hearing Examiner note in his
Findings and Decision that the variance request is granted for the existing
manufactured home currently existing on site, only. All other structures and/or
homes located on the subject site in the future must comply with the front yard
setback requirement as noted in Section 14.618.325(1) along with all applicable
development standards identified of the Spokane County Zoning Code and other ,
applicable ordinances.
Response 3 c. The applicant does not indicate that a lack of economic return is a
consideration for the request of this variance.
Response 3 d. The proposal is consistent with the Goals, Objectives and Decision
Guidelines of the Urban category of the Spokane County Comprehensive Plan.
Response 3 e. The applicant identifies in the response to question "B" on the
Burden of Proof form/application that the home existing on site was in its current
location upon the applicant purchasing the subject site. The applicant was not
aware of the lack of building permit approval for the placement of the home on
the subject site. Only after the applicant applied for refinancing on the home did
she become aware of this problem. When Ms. Rudolf applied for a building
permit for the existing manufactured home, the permit was denied because the
location of the home clearly did not comply with the front yard setback
requirement of the Urban Residential-7 (UR-7) zone, thus the reason for this
variance request. Denial of the variance should not be based on the fact that the
practical difficulty giving rise to this variance request existed at the time of
acquisition of the subject site.
Response 3 f, g. The proposal would not result in a defacto zone change as the
existing uses are permitted within the Urban Residential-7 (UR-7) zone. Density
of development in the surrounding area will not be impacted if the variance
request is approved.
VI. VARIAiNCE CONCLUSION
The majority of the criteria analyzed for determining approval of a variance as
specified by Section 14.404.082 of the Spokane County Zoning Code do support
the proposed request.

VII. RECOMMENDATION
Staff has reviewed the variance request in accordance with the criteria specified
by the Spokane County Zoning Code and finds that the proposal does satisfy a
majority of these criteria. Therefore, the staff recommends approval of the
variance request.
VIII. CONDITIONS OF APPROVAL
1. The applicant shall develop subject property in strict conformance with the site
plan presented to the Hearing Examiner on October 23, 1996. All aspects of the
concept and proposal shall be binding on the development, including proposed
use. Variations, to be approved by the Division Director/designee, shall only be
allowed to meet regulation standards and conditions of approval. Any other
modification must be presented to the Hearing Examiner for review and approval.
2. The Division of Building and Planning shall prepare and record with the Spokane
County Auditor a Title Notice noting that the property in question is subject to a
variety of special conditions imposed as a result of approval of a land use action.
This Title Notice shall serve as public notice of the conditions of approval
affecting the property in question. The Title Notice should be recorded within the
same time frame as allowed for an appeal and shall only be released, in full or in
part, by the Division of Building and Planning. The Title Notice shall generally
provide as follows:

land use action by a Spokane County Hearing Body or Administrative
Official on [ imposing a variety of special development

C. Scheduling an Application for Public Hearing

Department personnel will contact the applicant approximately 28 calend.ar days prior to the
public hearing, and provide the information needed to fulfill the notificaxion requuements
outlined in "E" below. Occasionally, excessive and unpredictable workloads in the Department
may cause scheduling at a later date.

including all additional contiguous ownership or optionaflandby the owner or agent for the
owner and any easement lands providing access shall be notified by the proponent. Utilizing a
list of such property owners and taxpayers obtained from a title company and copies of the
Agenda Notification prepared by the Department, the applicant shall accomplish notification by
mailing the agenda notification as directed by the Department personnel.
Step 2: The applicant shall provide the original of the title company-prepared
mailing list, Affidavit of Mailing, all returned mailings (addressee unknown, etc.), and
certain other inforniation to the Department at least two (2) days priar to the public hearing for
inclusion in the file. Failure to do so may jeopardize the hearing process.
NOTE: The address list obtained from the title company must be dated no more than 30 days
before the hearing date. When you plan to pick up your rnailing packet from this department,
please allow 1 week for the tide company to prepare the address list and time for you to do the
1 mailing by the deadline date.
G. Public Hearing The applicant or representative must be present at the public hearing. If the
owner is not at the meeting, the "representative" must have written authorization from all
property owner(s) to act on their behalf
